17 U.S. Code § 107 - Limitations on exclusive rights: Fair use | LII / Legal ... - 2 views

  • Notwithstanding the provisions of sections 106 and 106A, the fair use of a copyrighted work, including such use by reproduction in copies or phonorecords or by any other means specified by that section, for purposes such as criticism, comment, news reporting, teaching (including multiple copies for classroom use), scholarship, or research, is not an infringement of copyright. In determining whether the use made of a work in any particular case is a fair use the factors to be considered shall include— (1) the purpose and character of the use, including whether such use is of a commercial nature or is for nonprofit educational purposes; (2) the nature of the copyrighted work; (3) the amount and substantiality of the portion used in relation to the copyrighted work as a whole; and (4) the effect of the use upon the potential market for or value of the copyrighted work. The fact that a work is unpublished shall not itself bar a finding of fair use if such finding is made upon consideration of all the above factors.

PSA: Don't Let Salami and Google Images Get You In Hot Water -Edublogs - education blog... - 130 views

  • This is a true story.
  • Three years ago, an eleven-year-old blogger here on Edublogs wrote a post about his favorite lunch food – salami.
  • Our Edublogs support team just received a lengthy cease and desist letter from a large law firm that represents the photographer of the salami photo.
  • ...3 more annotations...
  • As part of his post, he used Google Images to find a quick photo of salami that he then uploaded to his blog.
  • What does this mean for teachers and students?
  • Using Google Images or copying a photo from most websites is much like plagiarism. Hopefully, by educating each other, we can avoid mistakes like this one and promote fair use of photos and other media on the web.
  •
Shared this with my students and we decided to create a class Diigo library of public domain images to help reduce everyone's legwork. It takes a little while longer to find pictures, but it's worth it.

CISPA: An Alternate Future Where Your Personal Privacy No Longer Exists - rgesthuizen@g... - 32 views

  •
"(fictional story) Last week the House of Representatives passed the Cyber Intelligence Sharing and Protection Act (CISPA), a follow-up bill to SOPA that wants to erode your personal privacy. The bill, itself, is palatable enough that Facebook and Microsoft gave it their seal of approval, and it's already got a kick start towards passing into law. So what would life be like if CISPA were part of our reality?"

Teenagers, Legal Risks and Social Networking Sites | Lucacept - intercepting the Web - 49 views

  • a significant minority (36.1%) of the teachers who were asked this question indicated that they had used SNS for educational purposes, including communicating with their students about schoolwork.
  • These educational activities should be aimed primarily at equipping children and young people with the skills required to be effective digital citizens, and not focussed on rare or hypothetical fears.
  • the importance of SNS in the lives of students, and the potential significance of social media for future digital citizenship, suggests that room should be found for these issues to be directly addressed.
  • ...1 more annotation...
  • Research findings like these will support our use of new technologies in classrooms. What is evident from their recommendations is that further teacher professional development is required to ensure that we have teachers with the skill set to produce the ‘effective digital citizens’ we need in society today.

EFF Wins New Legal Protections for Video Artists, Cell Phone Jailbreakers, and Unlocker... - 7 views

  • The new rule holds that amateur creators do not violate the DMCA when they use short excerpts from DVDs in order to create new, noncommercial works for purposes of criticism or comment if they believe that circumvention is necessary to fulfill that purpose.
  • "Noncommercial videos are a powerful art form online, and many use short clips from popular movies. Finally the creative people that make those videos won't have to worry that they are breaking the law in the process, even though their works are clearly fair uses. That benefits everyone — from the artists themselves to those of us who enjoy watching the amazing works they create," added McSherry.
