If the answers to these two questions are "yes," a court is likely to find a use fair. Because that is true, such a use is unlikely to be challenged in the first place.

Indeed, the Copyright Act itself makes it clear that educational uses will often be considered fair because they add important pedagogical value to referenced media objects.

  • As part of their own intellectual retooling in the era of the media collage, teachers can begin by experimenting with a wide range of new media to determine how they best serve their own and their students' educational interests. A simple video can demonstrate a science process; a blog can generate an organic, integrated discussion about a piece of literature; new media in the form of games, documentaries, and digital stories can inform the study of complex social issues; and so on. Thus, a corollary to this guideline is simply, "Experiment fearlessly." Although experts may claim to understand the pedagogical implications of media, the reality is that media are evolving so quickly that teachers should trust their instincts as they explore what works. One use not likely to be fair, is the use of a music soundtrack merely as an aesthetic addition to a student video project. Students need to somehow recreate to add value.  Is the music used simply a nice aesthetic addition or does the new use give the piece different meaning? Are students adding value, engaging the music, reflecting, somehow commenting on.the music? Not everything that is rationalized as educationally beneficial is necessarily fair use.  For instance, photocopying a text book because it is not affordable is still not fair use.

A Tech-Happy Professor Reboots After Hearing His Teaching Advice Isn't Working - Techno... - 5 views

  • Not everybody has to teach with technology, but it does need to be deeply embedded throughout the ecosystem we create on campus - and not because "that's what students want" or "that's where the students are."  The surprising-to-most-people-fact is that students would prefer less technology in the classroom (especially *participatory* technologies that ask them to do something other than sit back and memorize material for a regurgitation exercise).  I use wikis, blogs, twitter and other social media in the classroom not because our students use them, but because I am afraid that social media might be using them – that they are using social media blindly, without recognition of the new challenges and opportunities they might create.  I use social media not only as an effective teaching tool that encourages participation, but also as a way to broaden the media literacy of our students.  In this regard, we still have a great deal of work to do.  We need to embed new media literacy more deeply into the curriculum so that it isn't just this "one crazy Anthropology class" (as I have heard my class fondly referred to by students) that showed them how they can effectively use these tools in ways they had not yet imagined, while also allowing them to see a little more clearly how these tools are using them, altering their habits, sensibilities, and values as well as the larger structural contexts in which they live.

(which could be rescanned by another later, possibly.) Librarians and media specialists should understand this... when will people approach schools to scan annuals or student produced works? Maybe that is a while off, but for now, be aware that it is probably inevitable.
