So, you build on a BY-NC work and register your copyright. You license your new work also BY-NC. Someone violates the copyright on your work. You sue. You are entitled to statutory damages right? You collect. Are you now guiilty of violating the NC licneses of the works yours built upon?

"Soweit wir das beurteilen können, handelt es sich vollumfänglich um Werke, deren Urheberrechtsschutz abgelaufen ist und damit gemeinfrei sind. In den Nutzungsbedingungen schreiben sie jedoch, dass sämtliche Werke unter einer Creative Commons "by-nc-sa"-Lizenz stehen. Zusätzlich gibt es einen Widerspruch zwischen der durch die Angabe einer CC Lizenz erlaubten Weiterverbreitung eines Werkes und ihrer Angabe, dass die Werke nicht auf anderen Servern gespeichert werden dürfen. Es ist ihnen selbstverständlich unbenommen, für die Dienstleistung der Erstellung der Scans Gebühren zu erheben. Wenn diese Scans jedoch veröffentlicht werden, sind sie gemeinfrei, denn durch den Vorgang des Scannens entsteht kein urheberrechtlich geschütztes Werk."

"The oldest Koran translation The oldest Koran translation preserved dates from 1143. At the request of Peter the Venerable, abbot of Cluny, it was prepared in Toledo by the polyglot British scholar Robert of Ketton (Robertus Ketenensius, mistakenly referred to as Robertus Retenensis or Robert of Chester). He was assisted by a native Arabic speaker. Several manuscripts reflect the significance of this Latin translation for Western involvement with Islam. Exactly four centuries after the translation originated, it was prepared for publication by the Zurich theologian Theodor Bibliander. In 1543, after fierce debate and mediation on the part of Martin Luther, it was issued by the famous Basle publishing house of Johannes Oporinus. The huge demand for this work led to a second printing seven years later. "

"The March 31, 2010 issue of the Dramatic Growth of Open Access is now available. Highlights: DOAJ is now at 4,863 journals, having added a net total of 864 journals in the past year for a DOAJ growth rate of over 2 titles per day. The Bielefeld Academic Search Engine now searches over 23 million documents; this is an increase of over 1.2 million in the last quarter, or over 13,000 documents per day. There are now more than 200 open access mandate policies listed in ROARMAP, with strong growth in every category. Compliance with the U.S. National Institutes of Health Public Access Policy is 62% - still not 100%, but definitely getting closer. In the past year,120 more journals began contributing all content as open access to PubMedCentral. There are now more than 5,000 journals around the world using Open Journal Systems (OJS). "
