Why Muslim-majority countries need secular citizenship and law-making | openDemocracy - 0 views

  • once a political system is based on a religion, it is almost impossible to define the citizens who do not follow that religion as “first class.” In Iran and Iraq, rising legal and political influence of Shiism has led the discrimination against Sunni citizens, and in Pakistan and Egypt the opposite has happened, to a certain extent. Moreover, several Christian and non-Muslim minorities have faced discrimination by various means, including apostasy and blasphemy laws, in Sudan and Malaysia, among other cases.
  • Truly maintaining equal citizenship to all regardless of their religious identities is crucial for Muslim-majority countries to achieve democratization, consolidate the rule of law, and end sectarian and religious tensions.

  • In the twentieth century, secularist rulers adopted secular legal systems in Turkey, Iraq, Tunisia, and several other Muslim-majority cases. These assertive secularist regimes were mostly authoritarian. Therefore, they did not allow the law-making processes to be truly participatory. Secularism appears to be necessary but not sufficient for participatory legislation, too.
  • As my new book Islam, Authoritarianism, and Underdevelopment: A Global and Historical Comparison explains, there existed a certain level of separation between religious and political authorities in the first four centuries of Islamic history.That is why the first systematic book about “Islamic” politics was written as late as the mid-eleventh century. It was Mawardi’s The Ordinances of Government. The book argues that an Islamic government is based on a caliph (an Arab man from the Quraish tribe) to rule all Muslims. The caliph holds the entire political and legal authority and stays in power for life. The caliph delegates his legitimate authority to sultans, governors, and judges.The second book, which systematically defines an Islamic political system, was written in the early fourteenth century. It is Ibn Taymiyya’s Sharia-based Governance in Reforming Both the Ruler and His Flock. Instead of the one-man rule of a caliph, this book emphasizes the alliance between the ulema and the state authorities. Ibn Taymiyya interprets the only phrase in the Quran about authority, “uli’l-amr” (4:59), as referring to the ulema and the rulers (though other scholars have interpreted it differently).

There is Nothing Inevitable About Dictatorships in Muslim States | Opinion - 0 views

  • former Egyptian president Hosni Mubarak, who ruled Egypt as an autocrat for three decades, appeared as a witness against imprisoned former Egyptian president, Mohammed Morsi, who was Egypt’s first freely elected leader. Besides being former Egyptian presidents, they had something else in common: their religious supporters both considered revolting against them to be a forbidden form of "khuruj ‘ala al-hakim" – "withdrawing from the ruler." This wasn’t just an idle sentiment; it was expressed by Ali Gomaa’, the-then Mufti of Egypt whose words I heard when in Cairo during the revolutionary uprising of 2011. “Khuruj ‘ala al-shar’iyya haram, haram, haram” – ‘exiting’ from [political] legitimacy is religiously forbidden, forbidden, forbidden.”

What Killed Egyptian Democracy? | Boston Review - 0 views

  • The challenge Egyptians faced throughout the transition was to build an inclusive polity in the face of their deep divisions. They could resolve these divisions either by suppressing disagreements through a forceful exercise of state power or by competing at the ballot box. The former strategy requires massive state violence in the short term and almost always leads to suspension of formal democracy, without any guarantee of a return to democracy in the medium or long term. The latter strategy involves less force, establishes at least the formal elements of democratic rule, and preserves the possibility of additional democratic gains in the future, even if it requires concessions to undemocratic or illiberal political groups in the present and is marked occasionally by episodes of political violence.
  • The 14th century Arab Muslim political thinker Ibn Khaldūn’s tripartite typology of regimes—natural, rational, and Islamic—is consistent, in broad terms, with Rawls’s analysis. Natural states are based on relations of domination between the ruler and the ruled, restrained only by the limitations of the ruler’s actual power. Rational and Islamic states, by contrast, impose moral restraints on the exercise of political power. According to Ibn Khaldūn, rational and Islamic regimes transcend the relations of domination characteristic of natural regimes and establish overlapping conceptions of the common secular good. Ibn Khaldūn’s rational and Islamic regimes both can foster the convergence in political morality that—like Rawls’s overlapping consensus—characterizes a just constitution. Critically, this convergence or consensus must occur organically. Ibn Khaldūn argued that coerced adherence to Islamic law fails to produce virtuous subjects. Likewise, coerced imposition of even a just constitution cannot produce an effective system of justice if large numbers of citizens are incapable of freely adhering to its terms.
  • The real issue, however, was the make-up of the Constituent Assembly and the substance of the constitution it would draft. The parties arrived at a deal, including the semi-presidential structure of the state—with executive power shared by a prime minister and popularly elected president—but the role of religion was a sticking point. Because Parliament had selected the members of the Constituent Assembly, and because Islamists had won Parliament, Islamists dominated the Constituent Assembly. Liberals argued, not unreasonably, that those parliamentary elections exaggerated Islamists’ long-term political strength. Liberals also thought that the draft sacrificed or limited too many personal rights and freedoms in the name of religion, morality, and family values. They argued that the constitution would not be legitimate unless it was a consensual document capable of gaining acceptance by all significant social groups in Egypt.

Under the new constitution, the president would be limited to serving two terms, would face stricter rules on declaring states of emergency, and would no longer be able to dismiss the prime minister. Parliament was newly empowered to withdraw confidence from the government. And the president would be required to select the prime minister from the largest party in Parliament.
  • Unlike constitutions of nearby states, such as Morocco, the 2012 constitution did not entrench any provisions, including those on the role of Islam, as supra-constitutional norms impervious to amendment. Nor did it place any substantive, ideological limitations on the formation of secular political parties, provided that they were not organized on a discriminatory basis. It did not impose religious piety or a theological test as condition for public office. This ensured that the constitution would not privilege the Muslim Brotherhood, other Islamist parties, or even the role of Islam itself above other provisions of the Constitution.

The security forces were largely immune to Morsi’s influence. They refused to protect the offices of the Muslim Brotherhood and its political party, the Freedom and Justice Party. Even businesses affiliated, or thought to be affiliated, with the Muslim Brotherhood could not rely on police or military protection. When the presidential palace was attacked during demonstrations in the wake of Morsi’s constitutional decree, the security services were nowhere to be found. For Morsi’s opponents, however, his failure to reform the security services was taken not as a sign of his weakness but as evidence that he and the Muslim Brotherhood were conspiring with the military and police to destroy the liberal and radical opposition.

How the Muslim World Lost the Freedom to Choose - Foreign Policy - 0 views

  • Beyond skirts and beaches, the 1960s and 1970s were also a time of vigorous intellectual debate about the role of religion in society. Debates between leftists, secularists, capitalists, Marxists, and Islamists raged across the region, from Egypt to Pakistan. Militant Islamists will dismiss those decades of more progressive, diverse thought and culture as decadent Western imports — the lingering after-effects of colonial influence. But if some of it was certainly emulation, much of it was also indigenous.
  • “Purifying the Land of the Pure.” The book, published last year, charts the slow death of minority rights and pluralism in Pakistan, and what it means for the future of democracy. The result is a sweeping but concise chronicle of how things unraveled. A minority herself, as a Shiite, Ispahani was careful to avoid polemic and opinion by delivering a thorough, methodically researched work. She and her husband, former Pakistani Ambassador to the United States Husain Haqqani, have both faced death threats for their work and live in self-imposed exile in Washington. In her book, Ispahani tracks the unraveling to within a few years of the independence of Pakistan. The country’s founder, Muhammad Ali Jinnah — a secular Shiite — envisioned a country where “you are free, you are free to go to your temples, you are free to go to your mosques or to any other place of worship.” But Ispahani writes that “his hopeful declaration of religious pluralism” remains unfulfilled.
  • The trend toward making Islam a central tenet of life in Pakistan started soon after independence in 1947, a result of Muslim feelings of being victimized by both Hindus and British colonialism in India. By 1973, Islam was declared as the state religion of Pakistan. In 1974, under the ostensibly progressive Prime Minister Zulfiqar Bhutto, parliament declared Ahmadis as non-Muslims. "It Started With Conversations - And Then They Started Hitting Each Other" - 0 views

  • Inside the prisons of Egypt and other Arab and Muslim countries, a ferocious competition has erupted between radical militants and more established political Islamists over fresh recruits. ISIS is often muscling out more peaceful groups for influence and loyalists among the mostly young men tossed into cramped cells for months or years.
  • Some inmates are subjected to torture and deprivation, despite having committed no or minimal crimes, fueling anger that researchers have long feared breeds extremism in Arab jails.
  • The political dynamics inside Arab detention centers have ramifications far beyond the prison walls. He was transferred to a dank solitary confinement cell, without a towel or blanket. After three days he was released from jail. He said authorities must have calculated he was more trouble inside prison than outside.“When we have a chance to compete we win,” said Abdullah, smoking flavored shisha at a cafe in central Cairo. “The inmates were really excited with what we had to say. But it turns out our government considers secular activists more dangerous than the Muslim Brotherhood, or ISIS.”

Invisibility and Negrophobia in Algeria - Arab Reform Initiative - 0 views

  • In post-independence Algeria, autocratic elites have chosen to characterize the Algerian people as a homogenous block with a single culture (Arab-Islamic), religion (Islam), and language (Arabic) because they consider diversity to be a source of division and a threat to the country’s stability and their hold on power. Identity issues, which the regime insists on controlling, are also used to divide and rule. Aware of this, from the beginning, the Hirak downplayed identity and difference within the movement while focusing on getting rid of le pouvoir (Algeria’s military elite and their civilian allies that rule and exploit the country) as a whole, root and branch.

Power was rebalanced to reflect the growing influence of the Shiite Muslim community in Lebanon, represented politically by the Amal Movement and Hezbollah.

There is much rhetoric about “the nation” and “the people,” but electoral democracies work not in favor of all citizens but rather of special interests represented by the party that wins in the elections.

Winning an election does not mean that you are strong, as the Muslim Brotherhood thought it was. It means you are responsible for failures of the state and economy. And, despite their electoral win, the Muslim Brotherhood and its Freedom and Justice Party are and were always weak. One of the things of which they were often accused was that they wanted totalitarian control of society, that they were on the verge of getting what they wanted, which is absolute nonsense, of course. They did not have such control, they could not acquire such control, and there is no real evidence that they wanted such control. This is one part of their stupidity: To be seen to behave as though they had real control of the state.

  • Iran has a complicated, and at times paranoid, government. Elected parliamentarians give a veneer of democracy but power ultimately resides with the Supreme Leader, Ayatollah Ali Khamenei. The Islamic Revolutionary Guard Corps, the regime’s most powerful security force, answers directly to him. Rival arms of the state, including the security forces, jostle for influence. And the rules are unclear.
  • I had gone to report on the impact of American-imposed sanctions. Some news stories were claiming that Tehran was on the brink of collapse, but I saw few signs of it. There was no panic buying. The mullah’s hesitancy toward the sport was expressed in a pamphlet published a year after the revolution by the government’s propaganda arm that argued that money spent on soccer would be better invested in social and economic development. Saudi Arabia’s religious establishment has similarly struggled with soccer. The official fatwa website of the General Presidency of Scholarly Research and Ifta (Fatwa) has endorsed the game but banned competitions – a ruling the Saudi government has consistently ignored.                 To Saudi Arabia’s Muslim scholars Iran’s Shiites are heretics. Iran denounces Saudi Arabia’s puritan Wahhabi interpretation of Islam as the inspiration of Sunni Muslim jihadism. There seems little that the two countries and their religious establishment can agree on, which makes the meeting of the minds on soccer all the more remarkable.
