The Digital economy Act in all its glory. There was a LOT of debate over this Act. It was introduced by Lord Mandelson of the Labour party, tossed back and forth between houses with amendments that were argued to the minutest detail, then finally spat out for the public to revile. All ISPs are now required to monitor their subscibers use of listed sites and warn them when they enter a site that enables pirating. They must then record every such warning, giving every subscriber a number, then make the list available to the government when they get a warrant to look for excessive downloaders. Only the government like this idea, because it makes their job easier. I wandered onto one of the listed sites recently in my quest to find Dr Who episodes before they aired in Australia. Virgin Mobile marketing team clearly not understanding the Spam Act by sending customers email after they have opted out just to 'make sure you're still certain' about option out! Virgin since fined $22K and have committed to providing training for their staff.

Everyone's probably bookmarked this article already! Sentencing senior Google execs on the grounds of profiting from illegal acts is probably also technically correct. Google's defense is the neutrality of the internet, which is questionable as Google do adjust content to suit, for their own profit. Which layer is this issue on? Will increasing controls on content change our internet beyond recognition? Marcuse says that tolerance can not tolerate hateful speech and acts or it is no longer truly tolerant. That's quite a conundrum!

GoDaddy run 'cashparking' offering customers the chance to earn cash when they buy a domain and park the page collecting funds when godaddy's advertising partners receive revenue based on a cost per click model.

Yes, I know you love this - we all do. The regulations have been released! We'll never know if they are a best-seller, as they are free for download by anyone (a little ironic, actually), but the Ofcom, the ACMA of the UK, has released the regulations for the Digital Economies Act. What this does is fills in the details of what the ISPs will be doing exactly, what the processes will be - basically just the fussy details that are too specific for an act. Also, it will have information that may need to be updated regularly (like lists of prohibited sites). The US Federal Trade Commission has release a request for public comment on the  expansion of the Children's Online Privacy Protection Act (COPPA)  The initial review was scheduled for 2015 but is being brought forward.  COOPA's goal is to protect the online safety and privacy of children under the age of 13.  They are considering extending this to children under the age of 17. 

This article discusses who is held resposible for cyberbullying. Three executives from Google have been convicted of privacy violation, and have been accused of not acting swiftly enough to take down an online video of an autistic boy being beating by teen bullies. There are many issues that arise from this topic, for example, how far does accountability stretch, does it stem from the original poster, to the Internet Service Provider, the company hosting the content.It brings to question who do we hold responsible, and under which jurisdiction and set of laws do we use. Should there be a screening process to prevent such videos from being posted online?

Teachers are very much aware and very much worried on how social networking sites, particularly Facebook, are being used by students to "bully" and spread false allegations about them. Not only professional reputations are at stake in acts like these, but hate sites will surely affect the personal lives of teachers as well.  

In the US a coalition consisting of Google, Microsoft, Ebay, AT&T, and Intel is fighting for a change of the Electronics Communications Privacy Act (ECPA) that was enacted in 1986. The coalition stresses the fact that the Internet has changed tremendously since then and the law therefore needs to be adapted. I found this recent pamphlet about "MicroPublicPlaces" from situatedtechnologies.net while hunting down Latour's Dingpolitik. Arendt's theory of acting (as opposed to Heidegger's thinking) in "The Human Condition" foreshadows Habermas's Theory of Communicative Action, in my opinion, and is seen here as operating in parallel with Latour's object-oriented democracry. Beginning with a critique of the current state of the public realm, they follow two trajectories: one through Hannah Arendt's "vita activa" and Bruno Latour's "dingpolitiks", and another through the history of information and computation technologies. Through the former they establish an understanding of the "public" as a space of difference that is held in common, while through the latter they formulate an infrastructure that could support such a contestable space. This leads them argue for a new public realm built on specific architectural programs (water purification plants, zoos, kindergartens, repair shops, chapels) and adaptive learning environments that initiate collaborative relations between people and machines. Their goal is to foster a manifold public through the participatory structures of MicroPublicPlaces.
