In Lebanon, the transition out of war in 1990 only perpetuated what had existed during the conflict. The main sponsor of the postwar order was not the Lebanese state, as it had been the state in Italy, but the Syrian regime. This allowed most of the sectarian militia leaders to shape the peacetime republic around their political and financial interests and patronage networks, which the Syrians were more than happy to endorse, as they too extracted tremendous rent from the corruption of Lebanon’s reconstruction period. Rather than resting on an understanding between the state and a criminal element, postwar Lebanon was entirely dominated by a sectarian political leadership that had sustained itself financially during the war years through criminal economic behavior.

In Lebanon, however, we approximate a more perfect criminal republic. Here, the ones committing the crimes are those actually in senior positions of authority. They have infiltrated all state bodies, the security and national defense institutions, the judiciary, educational establishments, even sporting federations. So perfect are their crimes, in fact, that many of their actions are not regarded as criminal by most people in society. The Lebanese will blandly mention the politicians’ “patronage networks,” but under any lawful political system plundering the state to bolster one’s own political fortunes would be considered illegal.

Decades ago, Iranian law required women to take off headscarves in line with modernization plans, with police sometimes forcing women to do so. But hijab wearing became compulsory in 1979 when the country became a theocracy.

Mahsa Alimardani, who researches freedom of expression in Iran at the University of Oxford, has recently heard reports of women in Iran receiving citations in the mail for hijab law violations despite not having had an interaction with a law enforcement officer. Iran’s government has spent years building a digital surveillance apparatus, Alimardani says. The country’s national identity database, built in 2015, includes biometric data like face scans and is used for national ID cards and to identify people considered dissidents by authorities.

Some face recognition in use in Iran today comes from Chinese camera and artificial intelligence company Tiandy. Its dealings in Iran were featured in a December 2021 report from IPVM, a company that tracks the surveillance and security industry.

US Department of Commerce placed sanctions on Tiandy, citing its role in the repression of Uyghur Muslims in China and the provision of technology originating in the US to Iran’s Revolutionary Guard. The company previously used components from Intel, but the US chipmaker told NBC last month that it had ceased working with the Chinese company.

When Steven Feldstein, a former US State Department surveillance expert, surveyed 179 countries between 2012 and 2020, he found that 77 now use some form of AI-driven surveillance. Face recognition is used in 61 countries, more than any other form of digital surveillance technology, he says.

The Middle East and North Africa are becoming a kind of citizenship frontier: a region where certainty, permanence, and protection of citizenship is being uniquely and dangerously corroded. And Western countries are enabling this dynamic.

The creation of a new, opaquely defined but unambiguously lesser form of citizenship is not a symptom of exploitative labor conditions. It’s a symptom of a regional erosion of citizenship.

Most significant of all are the post-1948 populations of Palestinians in Jordan, Syria, and Lebanon, millions of people who were eventually issued identity documents by several governments, such as subvariants of Syrian passports (Syrian travel documents for Palestinian refugees), which looked like and served as passports but faced adamant political insistence from all sides—save Jordan, which eventually largely naturalized Palestinians—that this documentation was not, in fact, citizenship.

The disintegration of Yugoslavia left thousands of Roma people stateless. Issues of statelessness and ambiguous citizenship are universal in any part of the world which experiences crisis and conflict.

Since the 2010s, the Middle East is emerging as a kind of experimental zone where the erosion of citizenship rights can be trialed. While Qatari soccer players are temporary citizens naturalized with an expiration date—even if the details of when their passports expire is not public—Western countries are increasingly comfortable denaturalizing and revoking the citizenship of their own immigrant citizens of Middle Eastern origin when those citizens are accused of terrorist activity in the region.

The West looks the other way as Gulf states chip away at citizenship norms for expediency, and local governments don’t protest too much when Western governments strand their denaturalized ex-citizens in the region. Especially after the emergence of the Islamic State, with its large contingent of Western, immigrant-origin fighters, the revocation of citizenship became an appealing alternative to long and complicated criminal prosecutions.

The erasure of citizenship rights in these cases can be tolerated by international legal regimes because they are considered exceptional. It’s just for some athletes. It’s just for terrorists. But it doesn’t stay that way: The model, once implemented, is attractive for other uses.

2022 was a year for the restitution of Africa’s historical artifacts stolen by colonial powers. The Smithsonian Institution agreed to return its collection of Benin Bronzes and placed legal ownership with Nigerian authorities. In July, Germany handed back two bronzes and put more than 1,000 other items into Nigeria’s ownership while a digital database—known as Digital Benin, which documents Western museums’ existing collection of Benin’s artifacts—was unveiled in November. Despite this progress, there are still unanswered calls for the British Museum, the largest holder of Benin Bronzes, to return its loot. In September, the world marked the 200th anniversary of the deciphering of the Rosetta Stone, a fragment of written decrees issued by Egyptian priests during the reign of Ptolemy V (204 to 180 B.C.). Egyptian scholars and archaeologists renewed their demand for the stone’s return, which has been housed at the British Museum in London since 1802. Their call has garnered more than 135,000 signatures on an online petition.

An online archive to showcase Mali’s cultural history was launched in March, digitizing more than 40,000 of Timbuktu’s ancient manuscripts, some dating to the 12th century and originally written in medieval Arabic but translated to several languages in an online platform. Malian librarians and their assistants secretly transported hundreds of thousands of documents into family homes in a bid to save them from destruction by jihadis. Through those efforts, some 350,000 manuscripts from 45 libraries across the city were kept safe.
