"This paper discusses the implications of this commodification and advocates the full recognition of activities in the gig-economy as "work". It shows how the gig-economy is not a separate silo of the economy and that is part of broader phenomena such as casualization and informalisation of work and the spread of non-standard forms of employment. It then analyses the risks associated to these activities with regard to Fundamental Principles and Rights at Work, as they are defined by the International Labour Organisation (ILO), and addresses the issue of misclassification of the employment status of workers in the gig-economy. Current relevant trends are thus examined, such as the emergence of forms of self-organisation of workers. Finally, some policy proposals are critically analysed, such as the possibility of creating an intermediate category of worker between "employee" and "independent contractor" to classify work in the gig-economy, and other tentative proposals are put forward such extension of fundamental labour rights to all workers irrespective of employment status, and recognition of the role of social partners in this respect."

D'après Sébastien Flais, les organisations syndicales ont un rôle déterminant à jouer pour protéger les travailleurs de la gig economy. Mais pour se faire, ils doivent adopter des stratégies renouvelées, et avoir une approche bottom up.

En Grande-Bretagne, la commission parlementaire sur le travail et les retraites (Work and Pensions Committee) a estimé que les contrats des travailleurs indépendants de la gig economy étaient « incompréhensibles ». Par ailleurs, ils ont estimé que certaines clauses de ces contrats visaient à empêcher les travailleurs de remettre en question leur statut, et d'aller au tribunal pour obtenir des droits qu'ils pourraient peut-être prétendre avoir.

La clé de l'amélioration des conditions de travail des travailleurs de la gig economy pourrait se trouver dans l'observation du travail des femmes...

Dans un rapport sur le monde du travail commandé fin 2016 par la Première Ministre britannique Theresa May, l'ancien conseiller de Tony Blair, Matthew Taylor, plaide pour la clarification du statut des travailleurs de la gig economy rebaptisés « dependents contractors ». Il réclame aussi une hausse du salaire minimum pour les travailleurs aux horaires irréguliers, l'instauration d'un droit au congé maladie obligatoire, ou encore l'obligation de stipuler dès le premier jour de travail au salarié ses droits et ses devoirs. Ces recommandations ont été jugées insuffisantes par les syndicats mais trop contraignantes par le patronat.

D'après l'auteur, la création d'une nouvelle catégorie légale de "travailleur" permettrait de garantir aux travailleurs de la gig economy des conditions de travail, une rémunération et des horaires décents.
