Twitter unmasks anonymous British user in landmark legal battle [30May11] - 0 views

  • Twitter has been forced to hand over the personal details of a British user in a libel battle that could have huge implications for free speech on the web.The social network has passed the name, email address and telephone number of a south Tyneside councillor accused of libelling the local authority via a series of anonymous Twitter accounts. South Tyneside council took the legal fight to the superior court of California, which ordered Twitter, based in San Francisco, to hand over the user's private details.It is believed to be the first time Twitter has bowed to legal pressure to identify anonymous users and comes amid a huge row over privacy and free speech online.Ryan Giggs, the Manchester United footballer named as being the plaintiff in a gagging order preventing reporting of an alleged affair with a reality TV model, is separately attempting to unmask Twitter users accused of revealing details of the privacy injunction.

  • PayPal is testing an NFC mobile payments application at two stores in Sweden while it continues to look for ways to expand access to its payments services. PayPal has been experimenting with NFC for a while and recently incorporated NFC into the latest version of its Android app to enable peer-to-peer payments with two mobile phone users tapping their phones together to transfer money between them. The NFC payments app test is running in conjunction with two Swedish retailers and the Swedish developer Accumulate over a five day period. Obama Tries to Bypass Congress with Deadly Global Internet Treaty ACTA [28Jan12] - 0 views

  • Before the American people were protesting the Stop Online Piracy Act and the Protect Intellectual Property Act, the president managed to sign an international treaty which would permit foreign companies to demand that ISPs (Internet Service Providers) remove web content in the United States without any legal oversight. Entitled the Anti-Counterfeiting Trade Agreement (ACTA), the treaty was signed by Obama on October 1, 2011, but it is currently a subject of discussion because the White House is circulating a petition demanding that senators ratify the treaty.
  • the White House has done some maneuvering — characterizing the treaty as an "executive agreement" — thereby bypassing approval by members of Congress. Concerned by this action of the administration, Sen. Ron Wyden (D-Ore., above left) sent a letter to President Obama in which he declared: It may be possible for the U.S. to implement ACTA or any other trade agreement, once validly entered, without legislation if the agreement requires no change in U.S. law. But regardless of whether the agreement requires changes in U.S. law ... the executive branch lacks constitutional authority to enter a binding international agreement covering issues delegated by the Constitution to Congress' authority, absent congressional approval.

[E]ven if Obama has declared ACTA an executive agreement (while those in Europe insist that it’s a binding treaty), there is a very real Constitutional question here: can it actually be an executive agreement? The law is clear that the only things that can be covered by executive agreements are things that involve items that are solely under the President’s mandate. That is, you can’t sign an executive agreement that impacts the things Congress has control over. But here’s the thing: intellectual property, in Article 1, Section 8 of the Constitution, is an issue given to Congress, not the President. Thus, there’s a pretty strong argument that the President legally cannot sign any intellectual property agreements as an executive agreement and, instead, must submit them to the Senate.

  • Twenty-two EU member states signed the treaty at a ceremony in Tokyo on January 26. Other nations interested in signing the agreement have until May 2013 to do so. According to Wikipedia, the Anti-Counterfeiting Trade Agreement “creates a governing body outside national institutions such as the World Trade Organization (WTO), the World Intellectual Property Organization (WIPO) or the United Nations.” The scope of the agreement includes counterfeit goods, generic medicines, and pirated copyright-protected works.
  • The provisions of ACTA grant copyright holders direct powers to demand that ISPs remove material from the Internet, without the requirement of a court order, and permit foreign influence over ISPs in the United States. Advocates of the treaty seek to give copyright holders the ability to demand that users who do violate intellectual property rights have their Internet connections terminated as a punishment. To enforce such a system would require the creation of an individual Internet ID.
  • The Electronic Frontier Foundation (EFF) reports: The same industry rightsholder groups that support the creation of ACTA have also called for mandatory network-level filtering by Internet Service Providers and for Internet Service Providers to terminate citizens’ Internet connection on repeat allegation of copyright infringement (the “Three Strikes”/Graduated Response) so there is reason to believe that ACTA will seek to increase intermediary liability and require these things of Internet Service Providers.
  • The EFF has been vehement in its opposition to ACTA, particularly regarding the secrecy surrounding the treaty negotiations. Likewise, Michael Geist, in writing for Copyright News, asserted that ACTA was “shrouded in secrecy.” He pointed out that ACTA negotiations did not include civil society groups or developing countries, noting also that “reports suggest that trade negotiators have been required to sign non-disclosure agreements for fear of word of the treaty’s provisions leaking to the public.” The European Commission denied this allegations in 2008, arguing, “It is only natural that intergovernmental negotiations dealing with issues that have an economic impact, do not take place in public and that negotiators are bound by a certain level of discretion.”
  • As noted on Wikipedia, opponents of ACTA also assert that it will impinge upon freedom of expression and communication privacy. A large number of the World Trade Organization’s 157 members have voiced concerns that the treaty would have a negative impact on trade. Others have pointed out that ACTA does not include provisions for legal safeguards protecting ISPs from liability for the actions of their subscribers. Without such provisions, ISPs will be forced to invade the privacy of their subscribers in order to protect themselves. Aaron Shaw, research fellow at the Berkman Center for Internet & Society at Harvard University, stressed that “ACTA would create unduly harsh legal standards that do not reflect contemporary principles of democratic government, free market exchange, or civil liberties.”
  • The technology news and information website ArsTechnica.com argues that ACTA encourages ISPs to collect and provide information about suspects by providing for those ISPs “safe harbor from certain legal threats.” In protest against the treaty, the hacktivist group Anonymous hacked into the Federal Trade Commission’s cybersecurity advice website on January 24, replacing the homepage with the Anonymous logo, a rap song, and a message threatening more attacks if anti-piracy legislation in Congress were to pass. According to The Next Web: The message left temporarily on OnGuardOnline referred to the Stop Online Piracy Act, The Protect Intellectual Property Act and the Anti-Counterfeiting Trade Agreement. If they pass, the message said, "we will wage a relentless war against the corporate Internet, destroying dozens upon dozens of government and company websites."

More retailers turning paper checks into e-transfers - MarketWatch - 0 views

  • SAN FRANCISCO (CBS.MW) -- When an unidentified $30 debit showed up on her bank statement as an electronic funds transfer, Cheryl Hicks was mystified.
  • Each month, three electronic transfers go through her account -- and this wasn't one she recognized. "It just said ACH debit and the amount," said Hicks, a 33-year-old communications manager who lives near Everett, Washington.
  • Hicks soon discovered her phone company transformed the paper check she sent for payment into an e-transfer, and her bank failed to list either the check number or the recipient on her statement.

  • Hicks' inability to readily identify the EFT debit illustrates a mounting bookkeeping problem some checking customers are encountering as banks and retailers seek to minimize the handling of paper checks to cut costs and boost profit.
  • "While the EFTs are helpful to everybody and clearly more efficient, I'm not sure the banking system has adequate safeguards," said Kent Phelps, a vice president of software engineering for WitsEnd Software, which develops programs enabling check scanning.

Gail Hillebrand, senior attorney with Consumers Union, nonprofit publisher of Consumer Reports, said she's received complaints that companies have run checks through twice, once as an electronic transfer and again as a regular check.
  • "There are a lot of merchants who don't really know what the rules are," Hillebrand said. "The merchant thinks 'you owe me money, I have this check here because I didn't send it in last month, I'll send it through now.'
  • "The fact that that is inconsistent with NACHA rules and probably illegal, the merchant doesn't know and hasn't been educated."

  • While the focus of this post is not specifically Apple or the iPad, it’s almost impossible to talk about successful mobile strategies without recognizing that the iPad has created a transitional moment for the Learning & Development world. The reasons why have been the subject of countless blog posts, but I think DreamWorks founder Jeffrey Katzenberg, in this video from TechCrunch, says it best:

Adulterous Site Outsmarts Apple & Google [16May11] - 0 views

  • A few weeks ago, iPhone users were outraged to discover that their iPhones were tracking their every move, storing the information (in an unencrypted file, no less), and sending the data directly to Apple when synced with iTunes. Even more shocking was the news that iPhones do this even when they do not have location-based services enabled. Users concerned about their privacy were left vulnerable, with nothing they could do about it while they waited for Apple to offer a patch.
  • Naturally, Ashley Madison's specialty is guaranteeing privacy and anonymity for its customers (well, that and "an affair to remember!"). Users choose whom they share their photos with. Conversations on the site are password-protected. When users delete their accounts, also deleted is all evidence that they were ever members of the site.   • To battle smartphone location-tracking, Avid Life has released a new privacy application called iWipe. Completely free to download and use, iWipe not only erases an iPhone's entire location history, it also prevents future tracking.

A Windows version has been announced as well (it was due for last week, but has not yet been released as of press time). A New Approach To Reducing Spam: Go After Credit Processors [20May11] - 0 views

  • "A team of computer scientists at two University of California campuses has been looking deeply into the nature of spam, and they think found a 'choke point' [PDF] that could greatly reduce the flow of spam. It turned out that 95 percent of the credit card transactions for the spam-advertised drugs and herbal remedies they bought were handled by just three financial companies — one based in Azerbaijan, one in Denmark and one in Nevis, in the West Indies. If a handful of companies like these refused to authorize online credit card payments to the merchants, 'you'd cut off the money that supports the entire spam enterprise,' said one of the scientists." Content "curation" can create authority [04Mar10] - 0 views

  • Traditionally, the most valued content was original. This emphasis developed within a content model of constrained distribution and expensive production costs. When there are only a handful of distribution points for content — some magazines, books, a handful of TV station and radio stations — the way to build audience was to deliver original and exclusive content experiences.
  • Into this explosion of information comes the concept of Curation. Long-time tech journalist Paul Gillen weighed in on the value of taking a curatorial approach to content in a post about the Chile earthquake. No longer is our problem lack of information; it’s that we’re drowning in information. That’s why curation is so important. Trusted curators who point us to the most valuable sources of information for our interests will become the new power brokers.
  • Gillen points out that the concept of curation shouldn’t be limited to media brands. Marketers should take this trend into account. Creating new content is important, but an equally valuable service is curating content from other sources. This demands a whole different set of skills as well as a new delivery channel. It also means ditching the “not invented here” mindset that prevents content creators from acknowledging other sources.

US Virtual Goods Market To Hit $2.9 Billion In 2012, With Facebook Games Maturing, Mobi... - 0 views

  • The overall market for virtual goods in the US is headed towards $2.9 billion for 2012, according to the Inside Virtual Goods report. That’s up from $2.2 billion this year, and $1.6 billion in 2010.
  • Virtual goods on Facebook are continuing to comprise more than half of that, going from $835 million in 2010 to $1.2 billion this year to $1.6 billion next year. The gains each year are around $400 million, which means growth is going from 50% down to around 35%. While the report doesn’t break out company-specific numbers publicly, Zynga’s pre-IPO filings indicate it made more than $300 million last quarter. Assuming that number stays around the same, look for Zynga to continue to its historical dominance with about 75% of the Facebook virtual goods market.
  • Mobile has also been coming into its own in the last 18 months, report co-author Charles Hudson tells me. The report estimates that mobile virtual goods (for games only, not including other digital media like iTunes songs) made $350 million this year, and will grow to $500 million next year.

PayByPhone adds NFC to Mobile Payments for San Francisco'​s 30,800 parking sp... - 0 views

  • PayByPhone, a leading international provider of systems for parking and urban mobility payments, has announced one of the largest deployments of near field communications (NFC) payment solutions in the world. The San Francisco Municipal Transportation Agency (SFMTA), which selected the PayByPhone mobile payment system for parking, is currently adding NFC-enabled stickers to the city's 30,800 parking spaces to give drivers the option to pay for parking with NFC-enabled mobile phones in addition to mobile apps and mobile web for regular phones. All parking meters continue to accept payment with coins.
  • The PayByPhone system, already deployed in the Castro district will be extended citywide as installation of the stickers is completed. The PayByPhone NFC sticker has a passive electronic chip that does not require a battery and stores information such as the parking space number that can be read wirelessly by any NFC-enabled phone.
  • Since each meter in San Francisco will have a PayByPhone sticker, users can simply wave or tap their NFC-enabled phones over the NFC sticker on the meter to automatically launch the parking application. The mobile payment system recognizes the user, identifies the individual parking location, and the driver enters the desired parking time to complete the transaction. The system then sends a text message reminder before the parking period expires, and if needed, allows additional time to be purchased by phone from any location (subject to time limit restrictions). A receipt is automatically sent to the user's email account. Payment is processed against a credit or debit card associated with the mobile phone number.

  • The Dutch consortium of major banks and MNOs which in 2010 signed a letter of intent to jointly introduce mobile payments at the checkout in the Netherlands have taken their initiative one step further.
  • The partnership, which includes financial services providers ABN AMRO, Rabobank and ING as well as KPN and Vodafone, will notify the initiative for approval to the European Commission in Brussels.
  • It is expected that the EC will communicate its vision in the first quarter of 2012. After that, the consortium can start the actual execution of the plans. It is expected that Dutch consumers can experience payments with their mobile early 2013.

  • The consortium was established to develop a user-friendly and secure mobile payment service in the Netherlands. For technical support a central services organization (Trusted Services Manager/TSM) is set to be established by the partners. The creation of a legal entity which will host this TSM is currently in preparation.
  • In 2010 the six original consortium partners signed a letter of intent, followed in mid-2011 by a cooperation agreement. T-Mobile, which was part of the initial group of six, has recently decided not to become a shareholder in the legal entity to be established and therefore not to continue the cooperation. T-Mobile and its parent company Deutsche Telekom strongly believe in the potential of mobile payments, but will decide in a later stage how to bring this service to the market.
  • The other five partners however have fully reconfirmed their commitment to the Sixpack initiative. In view of the competitive aspects of collaboration between the biggest banks and mobile operators, the consortium informed the Dutch Competition Authority (NMa) of the initiative in an early stage.   • “While other vendors are fighting over no monthly fees, but higher processing costs for mobile transactions, we’re still saying ‘no’ to mobile transaction surcharges,” said Hammermaster. “With Sage Mobile Payments, businesses have the option to pay no more than they would to process regular credit or debit card transactions on a standard credit card terminal.”

AmEx Links Up Facebook With Coupon-less Deals, And Lets Merchants Go Social | TechCrunch - 0 views

  • American Express is going all in on the daily deals business, striking a deal with Facebook that is similar to the one it already has with Foursquare. Through a new Facebook app called “Link, Like, Love,” AmEx cardholders can link their cards to their Facebook accounts just like they can already link their cards to their Foursquare accounts. Once they do so they will get a dashboard of deals from brands such as Whole Foods, Dunkin’ Donuts, Virgin America, and Sports Authority. (These offers are different than Facebook Deals, which Facebook sources itself)
  • Unlike Groupon or LivingSocial, these AmEx deals don’t require anyone to pre-purchase anything or present any coupons to merchants. One of the biggest challenges for the daily deals industry is how to measure how many offers are actually redeemed at thousands of different participating businesses. But AmEx has an advantage here in that it is already a payment network that is set up and accepted in businesses large and small around the world. All people have to do is buy the deal item with their AmEx card and they will be credited the deal amount. The Facebook twist is that the deals you see are influenced by what you and your friends “like” on the Web using the Facebook like button.
  • Although many of the deals at launch are with national brands, AmEx is also leveraging its relationships with smaller local merchants. It is a launching a program aimed at them called Go Social which allows merchants to manage deals across both Facebook and Foursquare, with other social networks to be added in the future. Business owners will be able to create their own coupon-less deals in a self-serve manner that are triggered whenever someone with a linked account buys a deal item. Self-serve has been a challenge so far with local merchants, but AmEx can market to them through its existing channels.

  • Go Social will also allow merchants to put their locations on social networks like Facebook and Foursquare, and track their deal campaigns across those networks. Since AmEx has all the payment information, it can track deal redemption fairly easily. Closing the offer to redemption loop is the singel biggest challenge in the daily deals space. Even Groupon Now, Groupon’s mobile app with instant deals, requires participating merchants to have iPhones and train staff on how to redeem the offers. AmEx doesn’t try to change the behavior of the consumer or the merchant, other than give them an incentive to pay with AmEx versus cash or a credit card.
  • While it all sounds good on paper, the proof will be in the quality and density of deals that AmEx can procure. This will be a battle between local sales forces. But it looks like Groupon and LivingSocial finally have some serious competition.

Despite Expanded AmEx Deal, Foursquare Is Still A Revenue-Free Zone | TechCrunch - 0 views

  • Foursquare is expanding its relationship with American Express to provide local deals to people who sync their cards to their Foursquare accounts. AmEx did a trial at SXSW, and that went well enough that it is rolling out the deals more broadly.
  • The discounts, such as $20 off a $50 purchase at Sports Authority, are automatically applied to your AmEx account when you check in via Foursquare to a participating merchant before a purchase. Everyone in local commerce is trying to figure out how to close the loop between deals and payments. Google thinks NFC chips in Android phones will be the answer in the form of a Google Wallet. Whereas Groupon is trying out instant mobile deals with Groupon Now. By tying its specials to a credit card, Foursquare is closing the payment loop with something everyone already carries around in their wallets.
  • Once companies can tie mobile ads or deals to payments, they will be able to measure directly the sales generated by these mobile promotions. And one day that could potentially be a huge new business. But for now, it’s making absolutely zilch for Foursquare, which remains a revenue-free zone.   • Foursquare wants to make sure it gets the product experience right for both merchants and users before turning on revenue, but it can’t wait too long, especially if it wants to justify that billion-dollar valuation in its next round of funding. The race is on to create as many great local deals as possible to present to mobile consumers. And its biggest competitor is Groupon Now.
  • While Groupon is already the largest daily deal company in the world, it wants to move from deals people sign up for in advance through massive email marketing campaigns to instant deals they find on their mobile phones. The company is testing its own mobile app called Groupon Now in a few cities like Chicago and New York. Groupon Now deals are different than regular Groupon deals in that consumers don’t have to wait a day to redeem them. They are available instantly and you can find them on your mobile phone when you are nearby a merchant offering one of these deals.
  • A Groupon Now deal is directly equivalent to a Foursquare special powered by AmEx in that it is instantly redeemable and the payment can be linked to the offer. Closing this loop is the Holy Grail of digital local commerce. But closing that loop is not enough.
  • Foursquare simply doesn’t have the salesforce to craft the same kind of deals that Groupon can. Groupon’s deals tend to be more alluring with deeper discounts. AmEx is helping Foursquare here by sourcing many of these deals itself through its own salesforce and existing relationships with local and national merchants, but it also gets to keep all the revenue. At least for now.
  • Foursquare is bringing the users (and some of the deals), and is betting that eventually that will be worth something. It’s all about who can create a market of users and deals faster. Foursquare’s approach is to build up its users first—now it’s got 10 million—and then hope the deals trickle up organically or through partnerships. Groupon is almost taking the opposite approach, trying to build up an inventory of great mobile deals first and then hoping that the consumers will come. The thing is that it takes both sides to make a market.
