Data Security Breaches Present Risks, Opportunities for Agents - 0 views

    Data security represents both a new market opportunity to sell insurance coverage and a new risk - especially for independent insurance agencies that may not be compliant with data security laws or have plans in place to protect their own companies from data breaches. While data security is an evolving issue, failing to protect data can have a huge financial impact on a company. The average total per-incident cost of a data security breach was $6.65 million, compared to an average per-incident cost of $6.3 million in 2007, according to the "U.S. Cost of Data Breach Study" conducted by data protection company PGP Corp. and information management research firm The Ponemon Institute. The PGP/Ponemon study indicated that data breach incidents cost U.S. companies $202 per compromised customer record in 2008, meaning that companies incur additional costs with an abnormal churn in lost customers. More than 84 percent of data breach cases in 2008 involved organizations that had more than one data breach. And, more than 88 percent of all cases in the study involved insider negligence. The cost of lost business continued to be the most costly effect of a breach, averaging $4.59 million or $139 per record compromised. Lost business now accounts for 69 percent of data breach costs, up from 65 percent in 2007, compared to 54 percent in the 2006 study. "After four years of conducting this study, one thing remains constant: U.S. businesses continue to pay dearly for having a data breach," said Dr. Larry Ponemon, chairman and founder of The Ponemon Institute. "As costs only continue to rise, companies must remain on guard or face losing valuable customers in this unpredictable economy." Health Care Employers to Add Headcount in 2009 - 0 views

    While the recession injured many industries in 2008, health care was one of the few bright spots in the employment picture, growing by 372,000 jobs last year, according to the U.S. Bureau of Labor Statistics' January 2009 Employment Situation Summary. The large aging population has health care employers in need of qualified workers: stat. Therefore, despite the current economic conditions, health care employers will continue to increase staff in 2009, according to CareerBuilder.com's annual health care hiring forecast, conducted online within the U.S. by Harris Interactive. Close to one-in-five (17 percent) of large health care employers (50 or more employees) plan to increase the number of full-time, permanent employees in 2009, while 67 percent foresee either making no change in the number of employees or are unsure. Sixteen percent plan to decrease the number of employees. "The health care industry continues to boast high demand for qualified workers. Employers are reacting to this need by continuing strong recruiting efforts this year," says Jason Ferrara, vice president of corporate marketing for CareerBuilder.com. "Half of health care employers, the highest among industries we surveyed, have open positions for which they can't find qualified candidates. In response, health care employers will have to adjust their recruitment and retention strategies to find and keep top talent."

    "In a case that could prove to be one of the most important privacy rights battles of the modern era, the 3rd U.S. Circuit Court of Appeals will hear argument this week on the proper legal standard to apply when prosecutors demand cell phone location data. The data, which are recorded about once every seven seconds whenever a cell phone is turned on, effectively track the whereabouts and the comings and goings of every cell phone user. Justice Department lawyers argue that, by statute, they need only show "reasonable grounds" to believe that such records are "relevant and material to an ongoing criminal investigation." But a federal magistrate judge in Pittsburgh strongly disagreed in February 2008, issuing a 52-page opinion that said the prosecutors must meet the "probable cause" standard. "This court believes that citizens continue to hold a reasonable expectation of privacy in the information the government seeks regarding their physical movements/locations -- even now that such information is routinely produced by their cell phones -- and that, therefore, the government's investigatory search of such information continues to be protected by the Fourth Amendment's warrant requirement," U.S. Magistrate Judge Lisa Pupo Lenihan wrote."

    The Heartland data breach is an opportunity for the US government to standardise data breach notification laws. Bill Conner, chairman, president and CEO of Entrust, claimed that following the revelation that more than 100 million credit cards could have been compromised, the government needs to continue to move quickly to standardise data breach notification laws and call for technology, such as encryption and stronger authentication, that truly protects consumer information. Conner said: "Cybercrime continues to grow and is increasingly affecting more and more of this country's citizens. To slow the upward trend of cybercrime in this country, all organisations - enterprise, consumer and even governments - need to carefully review current security approaches and identify key gaps within their infrastructures." He further called for Congress to pass a data breach notification law that better protects consumer identities through stronger data security standards with strong encryption. "This is an opportunity to do something about a security issue that impacts all Americans", said Conner.

Information security forecast: Security management in 2009 - 0 views

    This year was an interesting year in privacy and information security, and by looking back, we can clearly discern trends that will likely be a major part of the security management landscape in 2009. More and more states passed breach-notification laws and several enhanced or extended existing legislation. Software-as-a-Service (SaaS) and virtualization really took off, and compliance's looming presence grew with PCI DSS version 1.2 and some actual enforcement of HIPAA. Of particular note was Massachusetts' data breach law 201 CMR 17.00: Standards for The Protection of Personal Information of Residents of the Commonwealth. This is to date the most comprehensive law of its kind, setting a new standard for what breach-notification laws should look like; it covers both paper and electronic records, it mandates appropriate security awareness training as well as security and risk assessments and, most importantly, requires companies to make changes to their security programs in accordance with the findings of those risk assessments. Similarly, California enhanced the well-known CA-1386 to include not just traditional financial information, but also health care and health insurance data as well. With new mandates popping up all the time, it's no wonder compliance was one of the biggest focus areas for enterprise information security teams in the past year, and this trend will clearly continue in 2009; there will be more regulation on both the state and federal levels, and stronger enforcement of existing regulations. Fines and other penalties for violations of PCI DSS and HIPAA will continue to rise, along with the inevitable rise in discoveries of malfeasance. As a result, there will be an even larger focus on compliance by upper management, which also means decreased time and budget for necessary security controls that don't clearly fall under a compliance umbrella.

A Leibowitz-Led FTC May Strengthen Spotlight on Digital Ads - ClickZ - 0 views

    Online ad industry will probably continue to be a hot-button if FTC Commissioner Jon Leibowitz is named chairman. The Federal Trade Commission may strengthen its focus on online advertising and privacy if, as is expected, current FTC Commissioner Jon Leibowitz is named chairman of the agency. "He would certainly keep privacy and online advertising as a focus of the FTC, so I think [his potential appointment] does matter," said Mike Zaneis, VP of public policy at the Internet Advertising Bureau. Reports indicate Leibowitz will be named as head of the commission, replacing William Kovacic. Kovacic replaced former Chairman Deborah Platt Majoras in March 2008, when she left to join the private sector as VP and general counsel of Procter & Gamble. "A kind of privacy switch is going to go on at the FTC [once the new chairman is named] and they're going to engage in this issue in a much more serious way," said Center for Digital Democracy Executive Director Jeff Chester. "Under a Leibowitz regime we would get the kind of serious industry analysis that so far has been lacking from the Bush era approach." "Leibowitz has been a leader on privacy issues," said Zaneis, who expects a Leibowitz-run FTC to continue along the agency's current path of pushing for industry self-regulation, rather than creating new regulations for online advertisers. As a commissioner, Leibowitz, a Democrat, has not ruled out FTC regulation of things like behavioral targeting. During a two-day FTC forum held in Washington, D.C. in 2007, Leibowitz noted, "The marketplace alone may not be able to solve all problems inherent in behavioral marketing." He revealed his sense of humor, adding, "If we see problems...the commission won't hesitate to bring cases, or even break thumbs."

Mass. General paperwork for 66 patients lost on Red Line train - The Boston Globe - 0 views

    Paperwork containing the personal medical information of at least 66 patients at Massachusetts General Hospital was lost this month when an employee apparently left it on an MBTA train. The hospital sent out letters last week to patients whose identities were included in the lost paperwork, telling them the information listed their names and dates of birth, and private medical information, including their diagnoses and the name of the provider with whom they met. The material constituted billing records for patients who attended the hospital's Infectious Disease Associates outpatient practice on Fruit Street on March 4. Deborah A. Adair, the hospital's privacy officer and director of health information services, said in a statement released yesterday that while the incident was regrettable, the hospital followed privacy laws by immediately alerting affected patients and authorities, including the state attorney general's office and the Department of Consumer Affairs and Business Regulation. "[Hospital] police and security are thoroughly investigating this matter not only with an eye toward recovering the missing information but also toward making sure that this will not happen again," Adair said. "Our information privacy and security policies and procedures are among the strongest in the healthcare industry, but incidents such as this remind us that we must continue to review and revise them, as well as continue to educate our staff on best practices to avoid incidents such as this." According to hospital security reports, a manager in the infectious disease center's billing unit told supervisors that she left the paperwork on a Red Line train the morning of March 9. The manager said she had brought the paperwork home with her to work over the weekend and left the material sometime between 7:30 and 9 a.m. The Transit Police were notified, but the paperwork was not found.

    The loss of personally identifiable information, such as an individual's Social Security number, name, and date of birth can result in serious harm, including identity theft. Identity theft is a serious crime that impacts millions of individuals each year. Identity theft occurs when such information is used without authorization to commit fraud or other crimes. While progress has been made protecting personally identifiable information in the public and private sectors, challenges remain. GAO was asked to testify on how the loss of personally identifiable information contributes to identity theft. This testimony summarizes (1) the problem of identity theft; (2) steps taken at the federal, state, and local level to prevent potential identity theft; and (3) vulnerabilities that remain to protecting personally identifiable information, including in federal information systems. For this testimony, GAO relied primarily on information from prior reports and testimonies that address public and private sector use of personally identifiable information, as well as federal, state, and local efforts to protect the security of such information. GAO and agency inspectors general have made numerous recommendations to agencies to resolve prior significant information control deficiencies and information security program shortfalls. The effective implementation of these recommendations will continue to strengthen the security posture at these agencies. Identity theft is a serious problem because, among other things, it can take a long period of time before a victim becomes aware that the crime has taken place and thus can cause substantial harm to the victim's credit rating. Health Insurers Welcome COBRA Subsidy, Leery of Privacy Rules - - insurancenewsnet.com - 0 views

    The federal government would subsidize up to 65% of COBRA health insurance payments for many individuals who have lost their jobs since Sept. 1, 2008, under an $825 billion stimulus package unveiled by House Democrats. COBRA provisions are supported by health insurance groups, including America''s Health Insurance Plans and the National Business Group on Health. However, AHIP said other parts of the plan tying increased investment in health information technology to stricter scrutiny of how health IT records are handled would make it more difficult for plans to coordinate care and streamline administrative costs. Dubbed the American Recovery and Reinvestment Act, the House bill allocates $39 billion to aid individuals attempting to continue paying health insurance premiums through the 23-year-old Consolidated Omnibus Budget Reconciliation Act program. COBRA allows employees who are terminated or leave their jobs voluntarily to remain in their former employer''s group health plan for up to 18 months, which can be extended to 36 months for those with extenuating life circumstances. However, because COBRA enrollees can be charged up to 102% of the full cost of coverage, many find the plans prohibitively expensive and, according to Hewitt Associates Inc., only about 20% enroll. A recent report by the consumer group Families USA found monthly COBRA premiums for family coverage were $1,069, or 83.6% of the average monthly unemployment insurance benefit of $1,278. In nine states, average COBRA payments exceeded unemployment benefits, the group found. Health groups have been largely supportive of the proposal, with AHIP President Karen Ignagni writing in a letter to House Speaker Nancy Pelosi that the group believes the move would "help ensure continuity of coverage and serve as an important lifeline for many workers who do not qualify for Medicaid, but still need help paying their health insurance premiums."

    Jan 15, 2009 There may be only a handful of days left in the Bush administration, but the brouhaha over White House e-mail retention policies promises to continue right up to the last day. A federal court yesterday extended a preservation order to ensure that the outgoing administration does everything it can to recover any missing White House e-mails. The White House IT staff now has five days to scour workstations for missing e-mail before administration data records are archived on Jan. 20. The ruling, by U.S. District Judge Henry Kennedy Jr., also orders staff of the Executive Office of the President (EOP) to relinquish any digital media that may contain e-mails from March 2003 and October 2005. The legal action is the latest resulting from a lawsuit filed in September 2007 by the National Security Archive against the EOP, seeking to preserve and restore White House e-mails it alleged were missing. "There is nothing like a deadline to clarify the issues," Tom Blanton, the National Security Archive's director, said in a statement. "The White House will complain about the last-minute challenge, but this is a records crisis of its own making." The Archive, an independent nongovernmental research institute based at George Washington University, is a repository of government records and does not receive U.S. government funding. The Citizens for Responsibility and Ethics in Washington (CREW), a left-wing public advocacy group, also filed suit, but its legal action was subsequently consolidated with the Archive's legal action, which is taking place in the U.S. District Court for the District of Columbia. Last May, the White House's top tech staffer acknowledged that three months of data were missing from backup tapes. Unfortunately, the article tends to point at the misapplication of laws more heavily than offering the reader an account of the abuses that led us to where we are now. Businesses & government, including the medical industry, freely shared details - or spied on Americans with impunity for decades. The article reminds us that work needs to continue to balance our approach. A Federal law, that sets a floor for privacy requirements, could help reduce conflicting requirements caused by almost every state writing seperate laws because there was a lack of leadership from Washington. American privacy regulations are implemented sectorally - at the industry or State level for example. This leads to many different, and conflicting laws. Privacy is a difficult subject with complex considerations touching aspects of life that have not been questioned for years. This article provides more con than balance, but it reminds us that extreme positions rarely serve anyone well.

They are a powerful innovation in advertising, but one that raises compelling privacy issues - issues that should be addressed now, before digital signs that monitor our behavior become the new normal. The most common name for this medium is digital signage. Most digital signs are flat-screen TVs that run commercials on a continuous loop in airports, gas stations, and anywhere else marketers think they can get your attention. However, marketers have had difficulty determining exactly who sees the display units, which makes it harder to measure viewership and target ads at specific audiences. The industry's solution? Hidden facial recognition cameras. The tiny cameras can estimate the age, ethnicity and gender of people passing by and can track how long a given person watches the display. The digital sign can then play an advertisement specifically targeted to whomever happens to be watching. Tens of millions of people have already been picked up by digital signage cameras. While camera-driven systems are the most common, the industry is also utilizing mobile phones and radio frequency identification (RFID) for similar purposes. Some companies, for example, embed RFID chips in shopper loyalty cards. GAO: Fed Security Practices Threaten IT Integrity - 0 views

    The Government Accountability Office issued another scathing report saying that federal agencies still don't do enough to secure government IT assets. "Persistent weaknesses in information security policies and practices continue to threaten the confidentiality, integrity and availability of critical information and information systems used to support the operations, assets and personnel of most federal agencies," Gregory Wilshusen, GAO director of information security issues, wrote in a 66-page report issued Friday. "Recently reported incidents at federal agencies have placed sensitive data at risk, including the theft, loss, or improper disclosure of personally identifiable information of Americans, thereby exposing them to loss of privacy and identity theft." In a written response accompanying the report, federal CIO Vivek Kundra said OMB is committed to the vision of a secure federal government, and are taking steps to make that vision a reality. OMB, he said, has initiated a review of the language in the current reporting instructions to identify and clarify confusion in the annual reporting. OMB also is working with the CIO Council and the Council of Inspectors General on Integrity and Efficiency to improve guidance to agencies. The GAO report also said that nearly all of the 24 major federal agencies last year had weaknesses in information security controls. "An underlying reason for these weaknesses is that agencies have not fully implemented their information security programs," Wilshusen said. "As a result, agencies have limited assurance that controls are in place and operating as intended to protect their information resources, thereby leaving them vulnerable to attack or compromise."

Data security company Cyber-Ark surveyed more than 400 senior IT professionals in the United States and Britain, and found that 35 percent admitted to snooping, while 74 percent said they could access information that was not relevant to their role. In a similar survey 12 months ago, 33 percent of IT professionals admitted to snooping. "Employee snooping on sensitive information continues unabated," Udi Mokady, CEO of Cyber-Ark, said in a statement. Cyber-Ark said the most common areas respondents indicated they access are HR records, followed by customer databases, M&A plans, layoff lists and lastly, marketing information. "While seemingly innocuous, (unmanaged privileged) accounts provide workers with the 'keys to the kingdom,' allowing them to access critically sensitive information," Mokady said. When IT professionals were asked what kind of data they would take with them if fired, the survey found a jump compared with a year ago in the number of respondents who said they would take proprietary data and information that is critical to maintaining competitive advantage and corporate security.
