Instead of making calls to see who was around, he looked at a digital map on his iPhone that plotted their locations. "One of my friends was also there," said Acton-Maher, 24, who used a service from a startup company called Loopt Inc. "I gave him a call and met him for lunch. It just enhances the communications tools that I already have." Google Inc., encouraged by people's willingness to share their personal lives on sites like Facebook, is betting more people like Acton-Maher will post their whereabouts online. The owner of the most popular search engine started a program this month called Latitude, seeking to compete with mobile networking services such as Loopt, Match2Blue, Whrrl and Limbo. Besides competition, Google's effort to turn mobile phones into tracking devices faces criticism from privacy advocates. Useful for friends and family, location data would also be valuable to the government, said Kevin Bankston, an attorney with the San Francisco-based Electronic Frontier Foundation, a not-for-profit organization focused on civil-liberties. "This is certainly valuable information to investigators and potentially to civil litigants," Bankston said. "This type of location information presents a very new sensitive data flow." Google says its privacy settings address such concerns. People using Google's mobile maps can opt not to use Latitude and choose whom they share their information with. The program also only stores the user's last known location, not a full history of their travels, said Steve Lee, a Google product manager. 'Ephemeral Data' While Google doesn't plan to store the data, the government could still go to court to ask for the company's help in tracking someone during an investigation, Bankston said.

    At first glance, Chicago's latest crime-fighting strategy seems to be plucked from a Hollywood screenplay. Someone sees a thief dipping into a Salvation Army kettle in a crowd of shoppers on State Street and dials 911 from a cellphone. Within seconds, a video image of the caller's location is beamed onto a dispatcher's computer screen. An officer arrives and by police radio is directed to the suspect, whose description and precise location are conveyed by the dispatcher watching the video, leading to a quick arrest. That chain of events actually happened in the Loop in December, said Ray Orozco, the executive director of the Chicago Office of Emergency Management and Communications. "We can now immediately take a look at the crime scene if the 911 caller is in a location within 150 feet of one of our surveillance cameras, even before the first responders arrive," Mr. Orozco said. The technology, a computer-aided dispatch system, was paid for with a $6 million grant from the Department of Homeland Security. It has been in use since a trial run in December. "One of the best tools any big city can have is visual indicators like cameras, which can help save lives," Mr. Orozco said. In addition to the city's camera network, Mr. Orozco said, the new system can also connect to cameras at private sites like tourist attractions, office buildings and university campuses. Twenty private companies have agreed to take part in the program, a spokeswoman for Mr. Orozco said, and 17 more are expected to be added soon. Citing security concerns, the city would not say how many cameras were in the system. Mayor Richard M. Daley said this week that the integrated camera network would enhance regional security as well as fight street crime.     "In a case that could prove to be one of the most important privacy rights battles of the modern era, the 3rd U.S. Circuit Court of Appeals will hear argument this week on the proper legal standard to apply when prosecutors demand cell phone location data. The data, which are recorded about once every seven seconds whenever a cell phone is turned on, effectively track the whereabouts and the comings and goings of every cell phone user. Justice Department lawyers argue that, by statute, they need only show "reasonable grounds" to believe that such records are "relevant and material to an ongoing criminal investigation." But a federal magistrate judge in Pittsburgh strongly disagreed in February 2008, issuing a 52-page opinion that said the prosecutors must meet the "probable cause" standard. "This court believes that citizens continue to hold a reasonable expectation of privacy in the information the government seeks regarding their physical movements/locations -- even now that such information is routinely produced by their cell phones -- and that, therefore, the government's investigatory search of such information continues to be protected by the Fourth Amendment's warrant requirement," U.S. Magistrate Judge Lisa Pupo Lenihan wrote."

    "Got an e-mail list of customers or readers and want to know more about each - such as their full name, friends, gender, age, interests, location, job and education level? Facebook has just the free feature you're looking for, thanks to its recent privacy changes. The hack, first publicized by blogger Max Klein, repurposes a Facebook feature that lets people find their friends on Facebook by scanning through e-mail addresses in their contact list. But as Klein points out, a marketer could take a list of 1,000 e-mail addresses, either legally or illegally collected - and upload those through a dummy account - which then lets the user see all the profiles created using those addresses. Given Facebook's ubiquity and most people's reliance on a single e-mail address, the harvest could be quite rich. Using a simple scraping tool, a marketer could then turn a list of e-mail addresses into a rich, full-fledged set of marketing profiles, with names, pictures, ages, locations, interests, photos, wall posts, affiliations and names of your friends, depending on how users have their profiles set. Run a few algorithms on that data and you can start to make inferences about race, income, sexual orientation and interests. While that information isn't available for all users, Facebook changed its privacy settings in early December so that certain information can't be made private, including one's name, current city, profile picture, gender, networks and friend list (the latter can be somewhat hidden from public view). Anyone with your e-mail address can harvest that information, the company admits."

State privacy laws may undercut electronic medical records - Ars Technica - 0 views

    The US government has now adopted a policy of fostering the adoption of electronic medical records (EMR). The policy is intended to increase the efficiency of the US healthcare system, thereby lowering costs and reducing the incidence of preventable errors. At the same time, through its The Health Insurance Portability and Accountability Act (HIPAA) privacy rules, the government has set minimum standards for the security of those records. These two goals-privacy and security of these records, along with their free interchange among medical providers-can easily wind up at odds with each other. A recent study that looked at the role of state privacy laws in EMR adoption suggests that the problem is very real, as state privacy laws seem to inhibit the use of EMR by hospitals located there. The authors, based at MIT and the University of Virginia, line up a variety of data that validate their suggestion that privacy and the use of EMR may require a careful balance. So, for example, they cite some highly publicized lapses when it comes to the maintenance of patient privacy: someone once offered the records of 200,000 patients for sale on Craigslist, while hospitals have seen their own employees attempt to get at the electronic files of famous patients. Perhaps more significantly, the authors suggest that the public, as represented by their legislators, has concerns about the privacy of EMR. They found that states that have passed their own privacy laws to supplement the HIPAA rules tend to have a higher percentage of their populace signed up for the Do Not Call Registry, indicating a corresponding individual-level interest in maintaining privacy. So, they looked at whether these laws had any impact on the adoption of EMR by hospitals located in each state.

    The new Obama Administration and a stronger Democratic party control of Congress set in the midst of a struggling economy and foreign policy issues, has created an interesting environment for legislation and regulations affecting customer interactions both federally and at state levels. While contact center-and-direct marketing-affecting issues such as offshoring, privacy, and telemarketing may haven been pushed offstage, they are not out of the hall. Ironically, economic pressures may shove them back into the spotlight as governments, especially states, seek ways to keep jobs and revenue sources, which contact centers provide. Federal Legislation Here is an examination of federal industry issues that lawmakers and regulators are and may be addressing in 2009: * Offshoring Federal lawmakers may reintroduce a bill similar to HR 1776, The Call Center Consumer's Right to Know Act, which would require contact center agents to disclose the physical location of such employee at the beginning of inbound and outbound calls. Firms would also have to annually certify to the Federal Trade Commission (FTC (News - Alert)) their compliance with such requirement. HR 1776 is an attempt to restrict offshoring by making customers aware that their calls may be going to or originating out of country. The bill's supporters hope customers and negative publicity would pressure firms to bring such jobs back to the U.S. The downsides are that such bills may significantly add to contact center costs in both onshoring and time spent location disclosing and in compliance, which would ultimately be paid for by consumers. In doing so bills like it that hike contact center expenses may also be self-defeating as they may result in fewer domestic jobs. Authorities in Germany, Spain and Italy said Wednesday they were investigating Google and its Street View service, which uses camera-equipped vehicles to take street images and mark the location of Wi-Fi networks. Mr. Brin, speaking the same day at Google's developer conference in San Francisco, said the company would put "more internal controls in place" to prevent such data captures in the future, including the hiring of outside help.
