In Legal First, Data-Breach Suit Targets Auditor - 0 views

    When CardSystems Solutions was hacked in 2004 in one of the largest credit card data breaches at the time, it reached for its security auditor's report. In theory, CardSystems should have been safe. The industry's primary security standard, known then as CISP, was touted as a sure way to protect data. And CardSystems' auditor, Savvis Inc, had just given them a clean bill of health three months before. Yet, despite those assurances, 263,000 card numbers were stolen from CardSystems, and nearly 40 million were compromised. More than four years later, Savvis is being pulled into court in a novel suit that legal experts say could force increased scrutiny on largely self-regulated credit card security practices. They say the case represents an evolution in data breach litigation and raises increasingly important questions about not only the liability of companies that handle card data but also the liability of third parties that audit and certify the trustworthiness of those companies. "We're at a critical juncture where we need to decide . . . whether [network security] auditing is voluntary or will have the force of law behind it," says Andrea Matwyshyn, a law and business ethics professor at the University of Pennsylvania's Wharton School who specializes in information security issues. "For companies to be able to rely on audits . . . there needs to be mechanisms developed to hold auditors accountable for the accuracy of their audits." The case, which appears to be among the first of its kind against a security auditing firm, highlights flaws in the standards that were established by the financial industry to protect consumer bank data. It also exposes the ineffectiveness of an auditing system that was supposed to guarantee that card processors and other businesses complied with the standards. MPs to probe ISP snooping and throttling * The Register - 0 views

    MPs have today launched an investigation into the use of snooping technology by ISPs which allows them to profile customers for advertisers and throttle or block specific types of traffic. An inquiry by the All-Party Parliamentary Group on Communication will examine issues such as the emergence of Phorm's profiling system, and the restriction of bandwidth available to specific applications such as BitTorrent. Both activities are reliant on Deep Packet Inspection (DPI) technology. "Now the Internet is part of daily life, concerns are increasingly raised about a wide range of online privacy issues," the group said in a background statement. "Should there be changes to individual behaviour? Should companies be pressed to prioritise privacy issues? Or is there a need for specific regulations that go beyond mere 'data protection' and address privacy directly?" The inquiry will also consider the impact of DPI technology on ISPs' "mere conduit" protection from liability for illegal traffic such as child pornography and copyright-infringing filesharing.

Here's a look at how some folding businesses are falling short protecting data and the possible liabilities for the IT group and CIO. From HIPPA to Sarbox, a slew of regulations to protect customer and employee data force CIOs to step lively to comply. The punishment for failure to do so is costly and even dire. But once a company folds-and more are folding every week given the economy-what happens to that data? Who in the business and IT could be hit by the splatter if it all hits the fan? "Certain companies have been disposing of records containing sensitive consumer information in very questionable ways, including by leaving in bags at the curb, tossing it in public dumpsters, leaving it in vacant properties and/or leaving it behind in the offices and other facilities once they've gone out of business and left those offices," says Jacqueline Klosek, a senior counsel in Goodwin Procter's Business Law Department and a member of its Intellectual Property Group. "In addition, company computers, often containing personal data, will find their ways to the auction block," she adds. "All too often, the discarded documents and computer files will sensitive data, such as credit card numbers, social security numbers and driver's licenses numbers. This is the just the kind of data that can be used to commit identity theft." Discarded and unguarded data is now low-hanging fruit for criminal harvesters and corporate spies. "Recent client activity supports that competitors are beginning to buy up such auction devices specifically with the intention of trying to salvage the data," says James DeLuccia, author of IT Compliance & Controls. Heartland's Carr Calls for End-to-End Encryption To Stop Breaches - 0 views

    Nearly one week after news emerged of the big data breach at Princeton, N.J.-based merchant acquirer Heartland Payment Systems Inc., it remains unclear how much damage actually happened and who did it. One report suggests Heartland's breach-related legal liabilities could approach $98 million, an estimate a Heartland spokesperson dismisses as speculative. The spokesperson tells Digital Transactions News on Monday that the so-called "sniffer" program secretly planted on one of Heartland's payment-processing platforms was not being used when investigators found it about two weeks ago. "It was inactive," the spokesperson says. "I want to be specific to say it was inactive," he adds, clarifying that the hackers hadn't deliberately disabled or deactivated it. Robert Carr, Heartland's chief executive, meanwhile, issued a statement calling for better industry cooperation and new operational procedures to prevent future data compromises, including industrywide, end-to-end encryption to fully protect cardholder data. Heartland uses encryption, but industry procedures leave data unencrypted during one brief point of the authorization process-a weakness that hackers have learned to exploit. Carr also said Heartland is working on its own system of end-to-end encryption.

With Breaches Rising, Insurer Offers Card-Compromise Coverage - 0 views

    Fireman's Fund Insurance Co. this week unveiled what it says is the first coverage available to small and medium-sized businesses for losses from payment card data breaches. News of the policy came on the same day that a non-profit research organization reported that data breaches increased 47% last year. The idea behind the coverage, according to Brian Gerritsen, product director at Novato, Calif.-based Fireman's, is to give peace of mind to business owners who are diligent about complying with the Payment Card Industry data-security standard, or PCI, the card networks' uniform protection rules that all card acceptors are supposed to meet. "That's what we're really trying to insure against-business owners trying to do everything in their power to protect their customers' cardholder data, but still find themselves in a data-breach situation and out of compliance with the PCI standards or other security standards that may apply to them," he tells Digital Transactions News. To get the coverage, however, a merchant must clear a number of hurdles. An applicant must already have property or liability coverage from Fireman's as well as the company's general data-breach policy first offered in 2006. The new payment card coverage is an add-on to that earlier product. Coverage is available to retailers and most other card-accepting merchants, but not schools and hospitals, says Gerritsen. The insurer excluded the former because of their high rate of data breaches and the latter because they hold extremely sensitive medical and personal data. If breached, a covered merchant could recoup about $160,000 in resulting expenses. That includes up to $50,000 for a PCI-specific forensic investigation, system scans and software, and hardware upgrades to get card security up to snuff. The policy also provides up to $100,000, with a 5% deductible, for PCI fines-"contractual penalties" in industry lingo-and related costs such as chargebacks and issuersâ€

Data Explosion Expands Breach Exposure, But Insurers More Open To Handling Risk - 0 views

    The problem with securing data and insuring its safety is that there is simply so much more stored electronically these days that opportunities for outside hackers or insiders to steal valuable, confidential information off a company's computer systems are growing exponentially, according to those in the insurance industry who make it their business to cover this expanding exposure. Indeed, "you can take out more data in a thumb drive now than people could take out in a super-computer 10 years ago," according to Kevin Kalinich, co-national managing director for Professional Risk Solutions at Aon. The risk of a data breach is very real for companies large and small across almost any industry, noted Mr. Kalinich. He cited a report from the University of California, Berkeley, that more data has been aggregated and stored in the last three years than in the entire history of mankind. He also noted that between 75 and 85 percent of Fortune 2000 companies have suffered a "material data breach," meaning there is a growing market for those selling insurance coverage for liability and repair costs, as well as loss control services. Companies that take an "it won't happen to me" approach to securing data need only look at news headlines to see that organizations are often hit by breaches, and as more data is being stored electronically, the potential for, and impact of possible breaches increase. Princeton, N.J.-based credit and debit processing company Heartland Payment Systems reported that it had been compromised in 2008 in a breach that involved up to 100 million records, which would be tops for number of records accessed in a breach. The Heartland incident would displace the 2007 breach of TJX, in which over 45.6 million credit and debit card numbers were stolen. The TJX breach, in turn, took the record set by a breach of CardSystems Solutions in 2005.

    Data security represents both a new market opportunity to sell insurance coverage and a new risk - especially for independent insurance agencies that may not be compliant with data security laws or have plans in place to protect their own companies from data breaches. While data security is an evolving issue, failing to protect data can have a huge financial impact on a company. The average total per-incident cost of a data security breach was $6.65 million, compared to an average per-incident cost of $6.3 million in 2007, according to the "U.S. Cost of Data Breach Study" conducted by data protection company PGP Corp. and information management research firm The Ponemon Institute. The PGP/Ponemon study indicated that data breach incidents cost U.S. companies $202 per compromised customer record in 2008, meaning that companies incur additional costs with an abnormal churn in lost customers. More than 84 percent of data breach cases in 2008 involved organizations that had more than one data breach. And, more than 88 percent of all cases in the study involved insider negligence. The cost of lost business continued to be the most costly effect of a breach, averaging $4.59 million or $139 per record compromised. Lost business now accounts for 69 percent of data breach costs, up from 65 percent in 2007, compared to 54 percent in the 2006 study. "After four years of conducting this study, one thing remains constant: U.S. businesses continue to pay dearly for having a data breach," said Dr. Larry Ponemon, chairman and founder of The Ponemon Institute. "As costs only continue to rise, companies must remain on guard or face losing valuable customers in this unpredictable economy." Nextgov - MP3 privacy breach exposes government's privacy liability - 0 views

    Reports on Tuesday of a New Zealand man who purchased a secondhand MP3 player containing the personal information of U.S. soldiers highlighted the federal government's continuing inability to protect private information on unauthorized, third-party storage devices. New Zealander Chris Ogle bought a used MP3 player in Oklahoma about a year ago, according to New Zealand's public television station, ONE News. A few weeks ago, when he plugged the player into his computer to download a song, Ogle found 60 military files stored on the device, which included names, addresses, and phone and Social Security numbers of U.S. soldiers. The files also contained what appears to be a mission briefing and lists of equipment deployed to Iraq and Afghanistan. Most of the files are dated 2005. ONE News reported that some of the phone numbers on the player are still active. "The more I look at it, the more I see and the less I think I should be," Ogle told ONE News. Ogle offered to return the MP3 player to U.S. officials if requested. Privacy experts say the breach is just the latest example of the federal government's inability to manage the security risk posed by removable storage devices. In November the Defense Department banned the use of removable storage devices after reports that hardware that can be inserted into a USB drive could infect the computer with viruses and worms. A Pentagon spokesman said the military is aware of the latest report form New Zealand, but does not know of any action the department has taken. Michael Maloof, chief technology officer for the information security firm TriGeo Network Security in Post Falls, Idaho, said individuals do not view devices like MP3 players as computers that can store large amounts of private data. "Myself and security experts have been saying for some time that phones and MP3 players are really mass storage devices," he said. The military should "ban all mass storage devices.
