  • 如果法理学不能回答具体的问题，或者说，中国的法理学甚至连中国的问题都回答不了，解决不了，你怎么可能回答普遍的问题，全人类的问题。因此，我个人认为，中国的法理学必须也只能扎根于当代中国，必须首先努力回答当代中国的问题。 　　这种回答，不能只是在一般层面，或在形而上层面，在我看来，它必须汲取各个部门法的知识，汲取其他学科的知识；只要可能，还要努力对各个部门法能有些许用处。这不是说要建立某种高于部门法学或实践的法学理论，而是说，基础理论的研究必须能解说部门法的某些问题，促使部门法的理论整合，形成某种融贯的话语。如果法学理论做不到这一点，就不会有人关心所谓的法学理论，所谓理论研究成果就可能成了小圈子里几个人的自娱自乐。 　　我也不是说一个人不能做某些自娱自乐的研究。个人完全可以。但作为整体的一个民族的法律理论，它必须与部门法和部门法的社会实践有关。
  • 而且，当代中国的法学理论还承担了重要的历史使命。随着中国的迅速和平崛起，随着金融危机，中国正在走向世界舞台中央，甚至是被拽进这个舞台中央的，在中国还没有做好足够的准备，没有完备的规划，各方面的实力还不够的条件下。而法学和法律理论是中国国力的一个重大薄弱点。如果中国走上世界舞台，没有或最终形成自己的政治观、法律观，没有自己的国际政治法律观，没有相应的理论，没有相应的建立在对人性、经济、社会和国际政治深刻理解基础上的系统的经验的和实证的理论，显然不行。那就缺乏软实力。
  • 我把政治观放在法律观之前，不是笔误。因为在国际之间，或对普通人来说，不可能理解和把握细致的法律理论，他们能理解和把握的往往只是复杂系统理论中衍生或抽象出来的几个命题，甚至就几个概念。因此在这个意义上，我大胆地，冒失地或者说政治不正确地说一句，所谓法律理论，在社会功能上，就是一种政治意识形态。这就像今天西方主张的人权、民主、自由一样。中国的法理学当然要吸纳这些命题和概念，但还需要我们的贡献，需要中国人的贡献，包括中国的政治意识形态。
