    Gilens examines the extent to which different social groups find their policy preferences reflected in actual government policy and the variation in these patterns across time and policy domains. For example, when Americans with low and high incomes disagree on policy, are policy outcomes more likely to reflect the preferences of affluent Americans? If so, does the advantage of more affluent Americans differ over time (e.g., depending on which party controls the congress and presidency) or across policy domains? Similarly, are Republicans or Democrats in the population more likely to get the policies they prefer when their party is in control of national political institutions? Because his database contains policy preferences broken down by income, education, partisanship, sex, race, region, religion, and union/non-union status, Gilens will be able to address a multitude of questions concerning government responsiveness to public preferences. For this study, Gilens uses data on public preferences and policy outcomes based on 754 national survey questions from 1992 through 1998 and restrict his attention to divergent policy preferences of low- and high-income Americans. Each of these survey questions asks respondents whether they support or oppose some proposed change in U.S. national policy, and he has used historical information sources to determine whether each proposed change occurred or not (within a four-year coding window from the date of the survey question). When Gilens looks separately at respondents with different incomes, he finds that the higher an individual's income, the more likely it is that government policy will reflect his or her preferences. This relationship, however, does not increase in a linear fashion: the difference between poor and middle-income Americans is modest compared with the difference between those with middle and high incomes.     I have a legal question about the Wikileaks case, prompted by this this Guardian piece, by John Naughton, linked in Henry's comments. I must confess: I wasn't surprised or particularly scandalized when Amazon kicked Wikileaks off its cloud, because I figured Amazon was probably technically in the right. Wikileaks had probably violated whatever terms of service were in place. I thought this sounded like the sort of thing any private company was likely to do, whether or not Joe Lieberman actually brought pressure to bear. If you have a problem customer who has violated your terms of service, you terminate service. (Just to be clear: I think ongoing attempts to shut down Wikileaks in patently legally dodgy ways are an utter scandal. Joe Lieberman pressuring Amazon is a scandal. I'm with Glenn Greenwald. I also think existing intellectual property laws are, by and large, an atrocious mess. Still, the law is what it is, so the question of how a private company like Amazon can and should be expected to react to this sort of situation is narrower than certain other more general questions about free speech and the press and so forth.)

    A whopping 70,000 questions poured into Change.gov over the past week, in response to the Obama transition team's call for citizen queries to the President-Elect. After votes from about 100,000 people, the top ranked question asks Obama whether he will appoint a special prosecutor to investigate allegations of torture and illegal surveillance by the U.S. government. I've been working with activist Bob Fertik to organize support for the question, and several progressive bloggers urged readers and Obama supporters to vote for it last week. The speech pertains to the evolution of my views on media criticism, the nature of media propaganda and what drives it, and what can be done to combat it. I want to note one example, from today, that vividly illustrates many of the themes I discussed in that speech.  It is found in the following passage from this Reuters article on Obama's escalation of the covert war in Yemen and his targeting of U.S. citizen Anwar Awlaki for assassination: A U.S. official confirmed to Reuters that a U.S. strike last Friday killed Abu Ali al-Harithi, a midlevel al Qaeda operative, which followed last month's attempted strike against Anwar al-Awlaki, the leader of al Qaeda in the Arabian Peninsula. Whether Awlaki has any operational role in Al Qaeda at all is a matter of intense controversy.  The U.S. Government has repeatedly asserted that he does, but has presented no verifiable evidence to support that accusation.  But what is not in dispute is the notion that Awlaki is "the leader of al Qaeda in the Arabian Peninsula."  He unquestionably is not, and never has been, as multiple Yemen experts have repeatedly noted.  The Reuters claim is factually and entirely false. Whatever one's views are on Obama's assassination program, targeting U.S. citizens without due process obviously raises extraordinary and vitally important questions.  As The New York Times' Scott Shane put it when confirming Awlaki's inclusion on Obama's hit list: "The Obama administration has taken the extraordinary step of authorizing the targeted killing of an American citizen. . . .   • Reconciliation was created through the Budget Reform Act of 1974 in an effort to streamline the budget process, strengthen the ability of Congress to make tough decisions regarding deficits, and to make legislative decision-making more efficient. Congress quickly expanded on the types of measures that could be considered under reconciliation until 1985 and 1986, when the Senate passed rules proposed by Sen. Robert Byrd that limited what could or could not be included when using this process. Before moving forward, Democrats must consider two questions. The first is whether using reconciliation to pass health care is legitimate or an abuse of the process. Republicans have charged that this would be akin to forcing the program through the chamber rather than passing the bill through negotiation and compromise. On this question, the answer is easy. Reconciliation has been as much a part of the Senate in the past three decades as the filibuster. According to an article that was published in The New Republic, Congress passed 22 reconciliation bills between 1980 and 2008. Many important policy changes were enacted through this process, including the Children's Health Insurance Program, COBRA (which allows people who switch jobs to keep their health care), student aid reform, expansions in Medicaid and several major tax cuts. NPR's Julie Rovner reported that most of the health care reforms enacted in the past two decades have gone through reconciliation. President Ronald Reagan was one of the first presidents to make aggressive use of reconciliation when he pushed through his economic program in 1981. Senate Majority Leader Howard Baker said then that speed had been essential because "Every day that this is delayed makes it more difficult to pass. This is an extraordinary proposal, and these are extraordinary times." Presidents Jimmy Carter, George H.W. Bush, Bill Clinton and George W. Bush all used reconciliation as well. It is worth noting that these presidents, particularly George W. Bush, also made use of sweeping executive power to circumvent Congress altogether. The second question is more difficult and it involves perceptions. If the Democratic leadership wants to use this tactic, they have to convince enough members of their own party that this won't scare off independent voters. This argument was harder to make in 2009 than in 2010. But after a year of dealing with paralysis in the Senate and highly effective Republican obstruction, more Democrats are coming on board. The leadership must be proactive in responding to the criticism about reconciliation. They will have to explain that reconciliation is a legitimate process by pointing to the history. They will also have to connect the dots for voters frustrated with the ineffective government by explaining that the constant use of the filibuster has turned the Senate into a supermajority institution where both parties have found it extraordinarily difficult -- virtually impossible -- to pass major legislation.On this point, Republicans and Democrats actually agree. Indeed, as Democrats make this decision, Kentucky Republican Senator Jim Bunning is objecting to a unanimous consent order and single-handedly preventing the Senate from passing an important bill to assist unemployed workers.

    After the Republicans and Democrats met at the White House summit on health care, it was clear that the parties are very far away from a bipartisan agreement. Indeed, few participants walked away with the sense that they were any closer to a deal. The White House did make clear that it was willing to move forward on health care without Republican support. The choice now becomes whether Democrats should use the budget reconciliation process to pass some parts of health care legislation. According to recent reports, Democrats are considering having the House pass the bill that was already approved in the Senate and then dealing with a package of additional reforms through reconciliation.
