United States v. Dougherty was a 1972 decision by the United States Court of Appeals for the District of Columbia in which the court ruled that members of the D.C. Nine, who had broken into Dow Chemical Company, vandalized office furniture and equipment, and spilled about a bloodlike substance, were not entitled to a new trial on the basis of the judge's failing to allow a jury nullification jury instruction. The Appeals Court ruled, by a 2-1 vote: " The fact that there is widespread existence of the jury's prerogative, and approval of its existence as a "necessary counter to casehardened judges and arbitrary prosecutors," does not establish as an imperative that the jury must be informed by the judge of that power. On the contrary, it is pragmatically useful to structure instructions in such wise that the jury must feel strongly about the values involved in the case, so strongly that it must itself identify the case as establishing a call of high conscience, and must independently initiate and undertake an act in contravention of the established instructions. This requirement of independent jury conception confines the happening of the lawless jury to the occasional instance that does not violate, and viewed as an exception may even enhance, the over-all normative effect of the rule of law. An explicit instruction to a jury conveys an implied approval that runs the risk of degrading the legal structure requisite for true freedom, for an ordered liberty that protects against anarchy as well as tyranny. " Nonetheless, the defendants were given a new trial on the grounds that they had been denied their right of self-representation.[1] The Circuit Judges' assumption that jurors know about their nullification prerogative has since been brought into question by other empirical evidence.[2] According to Irwin Horowitz, "Beyond the empirical issue, lack of nullification instructions maintains a deceit. That is why on major strategic and international questions today, Americans are from Mars and Europeans are from Venus: They agree on little and understand one another less and less. And this state of affairs is not transitory - the product of one American election or one catastrophic event. The reasons for the transatlantic divide are deep, long in development, and likely to endure. When it comes to setting national priorities, determining threats, defining challenges, and fashioning and implementing foreign and defense policies, the United States and Europe have parted ways."

The laws and policies of the legislature of the United States of America are now effectively on eBay, for sale to the highest bidder. Are you a Wall Street boss who wants to party like it's 2007? Are you a Big Coal baron who wants to burn, baby, burn? Are you an insurance company that wants to be able to kick sick people off your rolls? Meet John Boehner, the most powerful Republican and soon-to-be Speaker of the House. But -- of course! -- you already have. Here's an example of how you have worked together. In 1995, the House was going to finally repeal subsidies for growing tobacco, because an addictive cancer-causing drug didn't seem like the most deserving recipient of taxpayers' cash -- until Boehner walked the floor of the House handing out checks from tobacco lobbyists to his fellow elected representatives. They changed their minds. The subsidy stayed. Explaining his check-dispensing, Boehner says: "It's gone on here for a long time." So get your bids in: The House is open for business.

It could be argued that the costs to the United States of providing such services for the rest of the world are modest, but that is ultimately a judgment call. To be sure, the dollar costs will not bankrupt us as a nation, but Americans spend $2,700 per person on our military, while the average European spends less than $700. The bottom line is that Europeans have little incentive to spend more because they don't feel particularly threatened, and they aren't anxious to take on responsibilities that are ably handled by the United States. The advocates of hegemonic stability theory would declare that a feature, not a bug. Mission accomplished. And that might be true, if the greatest threat to global security were a resurgence of conflict in Europe, and if it is truly in the U.S. interest to forever have allies with few capabilities and many liabilities. But that seems extremely shortsighted. The sweeping political and economic integration in Europe has dramatically reduced the likelihood of another European war. In the meantime, the fact that we have many allies with little to offer by way of military assets, and even less political will to actually use them, is forcing the U.S. military to bear the disproportionate share of the burdens of policing the planet. And in the medium- to long-term, while I doubt that we will be facing "a militarily superior, post-Soviet Russia," allies with usable military power might ultimately serve a purpose if Moscow proves as aggressive (and capable) as the hawks claim.

If Israel can reduce its defense spending because of its domestic economic problems, shouldn't the United States consider reducing its aid to Israel?

The Land of the Free punishes or imprisons more of its citizens than any other nation. The project will unfold over a two year period, beginning with the release of this feature-length documentary and then continuing on with the release of short films and complete interviews from each of the 100 participants in the project, meant to represent the 1 in 100 Americans that are currently sitting behind bars.

Every day, 200,000 domestic workers in New York, mostly women of color, make it possible for others to work. But these nannies, elderly caregivers, and housekeepers are excluded from the most basic labor laws (including the National Labor Relations Act), and isolated with no power or leverage to negotiate. But the truth is, our economy is broken, producing more pollution, greenhouse gasses and garbage than any other country. In these and so many other ways, it just isn't working. But rather than invest in something better, we continue to keep this 'dinosaur economy' on life support with hundreds of billions of dollars of our tax money. The Story of Broke calls for a shift in The United States isn't broke; we're the richest country on the planet and a country in which the richest among us are doing exceptionally well. But the truth is, our economy is broken, producing more pollution, greenhouse gasses and garbage than any other country. In these and so many other ways, it just isn't working. A definitive review and close reading of medical peer-review journals, and government health statistics shows that American medicine frequently causes more harm than good. The number of people having in-hospital, adverse drug reactions (ADR) to prescribed medicine is 2.2 million. (1) Dr. Richard Besser, of the CDC , in 1995, said the number of unnecessary antibiotics prescribed annually for viral infections was 20 million. Dr. Besser, in 2003, now refers to tens of millions of unnecessary antibiotics. (2, 2a) The number of unnecessary medical and surgical procedures performed annually is 7.5 million. (3) The number of people exposed to unnecessary hospitalization annually is 8.9 million. (4) The total number of iatrogenic [induced inadvertently by a physician or surgeon or by medical treatment or diagnostic procedures] deaths is 783,936. The 2001 heart disease annual death rate is 699,697; the annual cancer death rate is 553,251. (5) It is evident that the American medical system is the leading cause of death and injury in the United States.

David Garland is a well-respected sociologist and legal scholar who taught courses on crime and punishment at the University of Edinburgh before relocating to the United States over a decade ago. As a voice at the megaphone of the Portland protest said, "The United States does not have a deficit problem. The United States has a revenue problem." According to a 2008 report by the Government Accountability Office, 25 percent of the biggest corporations pay no federal income tax. B of A, the recipient of $45 billion in bailout funds, shuttles its would-be tax dollars into 115 offshore tax havens. Meanwhile, budget deficits are cited as justification for pay freezes for public workers and cuts to heating assistance programs, Social Security, and other social safety nets.

Why Impeachment? The Constitution, Article II, Section 4: The President, Vice President and all civil Officers of the United States, shall be removed from Office on Impeachment for, and Conviction of, Treason, Bribery, or other high Crimes and Misdemeanors. It has become clear that the federal government has lost legitimacy. Mass scale impeachments (and/or Egypt style calls for resignation via mass strikes) should be pushed for immediately. Let's detail why the first to go should be the president of the United States.

Beijing (CNN) -- Although the United States narrowly avoided an unprecedented default following congressional approval of a last-minute compromise plan to raise the debt ceiling, China's leading credit rating agency Wednesday downgraded U.S. sovereign debt after putting it on negative watch last month. The Dagong Global Credit Rating Company, which lowered the United States to A+ last November after the U.S. Federal Reserve decided to continue loosening its monetary policy, announced a further downgrade to A, indicating heightened doubts over Washington's long-term ability to repay its debts.

I've written before about the crisis of inequality in the United States and about the quasi-religious abhorrence of "wealth redistribution" that causes many Americans to oppose tax increases, even on the ultra rich. The conviction that taxation is intrinsically evil has achieved a sadomasochistic fervor in conservative circles-producing the Tea Party, their Republican zombies, and increasingly terrifying failures of governance. Happily, not all billionaires are content to hoard their money in silence. Earlier this week, Warren Buffett published an op-ed in the New York Times in which he criticized our current approach to raising revenue. As he has lamented many times before, he is taxed at a lower rate than his secretary is. Many conservatives pretend not to find this embarrassing. Conservatives view taxation as a species of theft-and to raise taxes, on anyone for any reason, is simply to steal more. Conservatives also believe that people become rich by creating value for others. Once rich, they cannot help but create more value by investing their wealth and spawning new jobs in the process. We should not punish our best and brightest for their success, and stealing their money is a form of punishment. Of course, this is just an economic cartoon. We don't have perfectly efficient markets, and many wealthy people don't create much in the way of value for others. In fact, as our recent financial crisis has shown, it is possible for a few people to become extraordinarily rich by wrecking the global economy. Nevertheless, the basic argument often holds: Many people have amassed fortunes because they (or their parent's, parent's, parents) created value. Steve Jobs resurrected Apple Computer and has since produced one gorgeous product after another. It isn't an accident that millions of us are happy to give him our money. But even in the ideal case, where obvious value has been created, how much wealth can one person be allowed to keep? A trillion doll

Seems like only yesterday conservative nabobs of negativity predicted America's ballooning budget deficit would generate soaring inflation and crippling costs of additional federal borrowing.  Remember Standard & Poor's downgrade of the United States? Recall the intense worry about investors' confidence in government bonds - America's IOUs?  Hmmm. Last week ten-year yields on U.S. Treasuries closed at 1.83 percent. In other words, they were wrong. In fact, it's cheaper than ever for the United States to borrow. That's because global investors desperately want the safety of dollars. Almost everywhere else on the globe is riskier. Europe is in a debt crisis, many developing nations are gripped by fears the contagion will spread to them, Japan remains in critical condition, China's growth is slowing.  Put this together with two other facts: Unemployment in America remains sky-high. 14 million Americans are out of work and 25 million are looking for full-time jobs. The nation's infrastructure is crumbling. Our roads, bridges, water and sewer systems, subways, gas pipelines, ports, airports, and school buildings are desperately in need of repair. Deferred maintenance is taking a huge toll. Now connect the dots. Anyone with half a brain will see this is the ideal time to borrow money from the rest of the world to put Americans to work rebuilding the nation's infrastructure.  Problem is, too many in Washington have less than half a brain.
