Retailer resells computer drive full of personal files - 0 views

    The country's largest office products store sold a returned computer hard-drive on clearance containing hundreds of personal files on it - a move privacy experts say violates key provisions of a privacy law requiring businesses to safeguard personal information of customers. The transaction occurred recently at a Staples Business Depot store in Ottawa, one of about 300 across the country. When the purchaser booted up the Maxtor mini, he found hundreds of files on the external hard drive. The files, totalling about 400, belonged to Jill Vickers, a retired political science professor from Carleton University. They included some research papers already in the public domain, but some were sensitive documents. "It is especially of concern to me as the files contain some 20 years of reference and assessment letters which are confidential documents," said Vickers, who recently purchased a new computer system for her home that initially included the Maxtor backup drive. When her son, who was tasked with transferring her files to the drive, noticed the daily automatic backup function was not functioning properly, he returned it to Staples. He thought he had deleted the files. "Even though it's not in my possession, it's my data. They should wipe it clean," Vickers said of Staples. Canwest News Service last week provided Staples with the model and serial number of equipment, as well as the receipt for the clearance purchase. A company spokeswoman said it required more time to gather the facts to comment on the specific incident. "We will continue to look into this," said Alessandra Saccal. In a statement, she reiterated, "privacy of any kind is of great concern to us, that is why we have procedures in place to clear any items with memory before being resold."

    Top attorneys for Microsoft and Google today reiterated their companies' support for tougher government rules to protect consumer privacy. But when it comes to the details, some watchdog groups say they are concerned that Web firms will continue to fight against specific provisions that would limit the ways they can collect and use people's information to serve more targeted ads. Today's panel discussion, held here at the Computers, Freedom and Privacy conference, revisited a longstanding policy debate over the government's role in online privacy. The talk ran along some familiar plotlines, with Jeff Chester of the Center for Digital Democracy thundering about the detailed personal profiles being assembled by advertising companies who are using neuroscience to manipulate consumer behavior, while industry representatives assured the audience that their data-collection practices are benign, not to mention essential to providing free content and services on the Internet. But this wasn't just an idle debate. Rep. Rick Boucher, the Virginia Democrat who chairs a House subcommittee on the Internet, is developing legislation that could seek to impose sweeping restrictions on behavioral targeting. A few blocks up Pennsylvania Avenue at the Federal Trade Commission, the principal regulatory agency with authority over online advertising, newly minted Chairman Jon Leibowitz has spoken often about the need for industry to get serious about privacy. "The FTC's central concern here is transparency, consumer control," said Jessica Rich, assistant director of the agency's privacy and identity protection division. "We don't think consumers really know what's happening with their data."

Privacy Challenges Could Stall Smart Grid | Green Business | Reuters - 0 views

    President Barack Obama's plan to overhaul U.S. infrastructure includes constructing a nationwide "smart grid" that promises to help address many of our current energy challenges. The smart grid plan offers the hope that it "will save us money, protect our power sources from blackout or attack, and deliver clean, alternative forms of energy to every corner of our nation." While these are noble societal goals, smart grid technologies and systems as envisioned also raise concerns about individual privacy rights. Part of what makes the smart grid "smart" is its ability to know a lot about the energy-consuming devices in our homes and to monitor activity for those devices to help determine when power should be used or limited. Such knowledge is useful in regulating power consumption to use energy more efficiently. In addition to reaching into homes to regulate devices, information about usage and activities could be extracted from homes. Home energy consumption patterns could be gathered and analyzed on a room-by-room and device-by-device basis to determine which devices are used and at what time of day. Although this sort of information may not be considered terribly invasive for some, for others anything that violates the sanctity of "home" may cause tremendous concern.

    The head of Calgary's Drop-In Centre says he is astounded by the controversy surrounding the shelter's use of a handprint-based security system, with the latest salvo coming from the province's privacy commissioner on Friday. "People . . . have no idea what we're going through here,"said the centre's executive director Dermot Baldwin, adding he now has three staff off work because of beatings. "We're going to (take) the measures necessary to make this place safe, secure, a good place to come . . . but in order to do that, I've got to keep the bad guys out." The comments came after Alberta's privacy commissioner said he's concerned about a new security system the Drop-In Centre is testing, which includes the scanning of clients' handprints to confirm their identification. Frank Work said Friday the home-less shelter's system of scanning and collecting handprints will likely lead to the creation of a database that will store that information.

Consumer Groups Want to Halt ACTA Negotiations - 0 views

    ACTA (Anti-Counterfeiting Trade Agreement) has concerned many consumer rights organizations for some time now. Given that it could easily affect criminal laws in many countries around the world, it's not hard to see why there is demand for public disclosure and allow public debate in the matters. Still, to this day, ACTA is being negotiated behind closed doors by many countries around the world and now consumer groups want to, at least, have the negotiations disclosed to them. When it comes to the privacy and surveillance debates, which are in various stages in different countries right now, many say that for national security concerns, further surveillance measures should be taken in the law books. Many policy makers want to know every detail of day-to-day communications of millions of people including who you talk to, when, how, where, and, with a warrant, what the contents of those messages are. Unsurprisingly, consumer rights groups have a problem with that. Meanwhile, when it comes to the highly secretive negotiations happening with ACTA, many consumer rights organizations want a clear indication on how the new international standard is forming and the contents of the legislation and to have such things disclosed to the public. Ironically, policy makers seem to have a problem with that.

    The suggestion comes after a 12 month period in which the Government has admitted losing millions of personal records, including the entire child benefit database. Richard Thomas, the information commissioner, will tell MPs that its annual tracking survey has found a big jump in the way that people view loss of personal data, excessive surveillance, privacy intrusions and identity theft. Its survey of 1,000 people found 94 per cent of people ranked "protecting personal information" as their top concern, ranked equal with concerns about crime. Public awareness of access to their personal information held by public bodies has also jumped, from 74 per cent to 86 per cent between 2007 and 2008. Mr Thomas will say that part of the reason has been the 277 data breaches by public bodies, since HM Revenue and Customs said it had lost the personal details of 25 million families on the child benefit database in October 2007.

    One of my predictions for last year was that privacy would be a growing concern among mainstream users. I didn't repeat that prediction this year, but perhaps I should have. The reason? Apparently, younger web users seem to care more about privacy controls. Or at least, they use them more. According to Facebook chief privacy officer Chris Kelly, more teenagers than adults use privacy controls on the social network, at a rate of 60% to about 25-30%. That's surprising given the conventional wisdom that younger Internet users tend not to care about the privacy of their data. A recent study from Computer Associates confirms that many teens are at least somewhat concerned with online privacy. That study showed that 79% of teens aged 13-17 who are members of a social networking site like MySpace or Facebook protect their profiles from the general Internet in some way (i.e., only allow friends or friends of friends to view their information). Profiles on Facebook, of course, are automatically protected from viewing by the Internet at large, but protecting them from the rest of your network requires additional steps. That teens are more likely to utilize Facebook's granular privacy controls points to one of two things that lead to the same conclusion: 1. Teens care more about online privacy than adults, or, 2. Teens are simply more aware of social networking privacy controls than adults.

Here's what she sent me: When I was a high school student growing up in the small farming community of Kimberly, Idaho, little did I know that a song from that time could serve as an anthem for something happening in the workplace today. The Beatles' 1967 classic "Hello Goodbye" is a study in contrasts, as are the current attitudes about social media. Social media has arrived - and with it, employers and employees are singing very different songs about what constitutes appropriate social networking both on and off the job. Recently, I commissioned the third annual Deloitte LLP "Ethics & Workplace" survey. We polled 500 executives and 2,000 employees outside Deloitte. Our survey found that 60 percent of business executives believe they have a right to know how employees portray themselves and their organizations in online social networks. Perhaps because nearly three-fourths of the employees in our poll agreed that the use of social networks makes it easier to damage a company's reputation. However, more than half of employees polled say their social networking pages are not an employer's concern. That belief is especially true among younger workers, with nearly two-thirds of 18- to 34-year-old respondents stating that employers have no business monitoring their online activity.

"People put information on a Facebook page to share with friends. But it's pretty much with the understanding that they're deciding what to post and who has access to it.     As arguments swirl over online privacy, a new survey indicates the issue is a dominant concern for Americans. More than 90 percent of respondents called online privacy a "really" or "somewhat" important issue, according to the survey of more than 1,000 Americans conducted by TRUSTe, an organization that monitors the privacy practices of Web sites of companies like I.B.M., Yahoo and WebMD for a fee. When asked if they were comfortable with behavioral targeting - when advertisers use a person's browsing history or search history to decide which ad to show them - only 28 percent said they were. More than half said they were not. And more than 75 percent of respondents agreed with the statement, "The Internet is not well regulated, and naïve users can easily be taken advantage of." The survey arrives at a fractious time. Debate over behavioral advertising has intensified, with industry groups trying to avoid government intervention by creating their own regulatory standards. Still, some Congressional representatives and the Federal Trade Commission are questioning whether there are enough safeguards around the practice. Last month, the F.T.C. revised its suggestions for behavioral advertising rules for the industry, proposing, among other measures, that sites disclose when they are participating in behavioral advertising and obtain consumers' permission to do so. One F.T.C. commissioner, Jon Leibowitz, warned that if the industry did not respond, intervention would be next. "Put simply, this could be the last clear chance to show that self-regulation can - and will - effectively protect consumers' privacy," Mr. Leibowitz said, or else "it will certainly invite legislation by Congress and a more regulatory approach by our commission."     Compared to other key corporate executives, CEOs appear to underestimate the IT security risks faced by their own organizations, according to a survey of C-level executives released today by the Ponemon Institute. The Ponemon survey (download PDF) of 213 CEOs, CIOs, COOs and other senior executives reveals what appears to be a perception gap between CEOs and other senior managers concerning information security issues. For instance, 48% of CEOs surveyed said they believe hackers rarely try to access corporate data. On the other hand, some 53% of other C-level executives believe that their company's data is under attack on a daily or even hourly basis. The survey also found that the top executives were less aware of specific security incidents at their companies than other C-level executives and are more confident that data breaches can be easily avoided. Ponemon found that CEOs tend to view data protection efforts as vital to maintaining good customer satisfaction levels and to the company's brand image. The other managers, however, were more likely to say that the most important role for data security efforts is to satisfy regulatory requirements. The survey also found that CEOs and other top managers differed in their opinion of who is responsible for protecting corporate data. While eight out of 10 respondents said they believe there is one person responsible for data protection in their organization, there was a sharp difference of opinion on just who that person was. More than half of the CEOs said that CIOs are responsible for protecting data at their companies; only 24% of other senior managers felt the same way. And 85% of respondents said someone else would be held responsible for a data breach. "On the issue of accountability, we found that while people acknowledged that data breaches were a problem, very few people felt that if [their company] suffered a breach, they would be held responsible," said Larry Ponemon, founder of the Ponemon Institute.

    The Internet contributes about US$300 billion a year to the U.S. economy, and U.S. lawmakers should be careful about tinkering with the advertising-supported Internet content model in the name of privacy, the Interactive Advertising Bureau (IAB) said. An IAB-commissioned study by two Harvard University professors, released Wednesday, found that 1.2 million U.S. residents are directly employed in Internet-related jobs, and another 1.9 million U.S. jobs support those Internet workers. IAB released the study Wednesday, as 30 publishers of small Web sites converged on Washington, D.C., to urge U.S. lawmakers to avoid passing legislation that would harm their ad-supported business models. Chief among those publishers' concern was talk in the U.S. Congress about requiring Web sites to gain opt-in permission from users before tracking their Web habits as a way to deliver personalized advertising to them. Many users wouldn't give the permission, and without offering targeted advertising, many small Web sites could fold, some small publishers said. Small Web publishers and sellers "are the face of small business" in the U.S. in recent years, said Susan Martin, publisher of Ikeafans.com, a home improvement site.

    "If you live in Texas, your medical records are definitely up for sale by the state. If you live anywhere else in the United States, they probably are for sale there, too. Medical health records provide key information to researchers, who have lobbied hard to keep them accessible, despite government concerns about the privacy of patient data. The controversy dates back to 1996, when Congress passed the Health Insurance Portability and Accountability Act (HIPAA) to protect patients. "Researchers have very broad access rights to health care records under HIPAA," says Pam Dixon, director of a non-profit called the World Privacy Forum "The rules are pretty loose, and there are a lot of ways to get around them." That's especially true since the act wasn't designed to cover common scenarios today: records stored online in a vast, hackable cloud. In the rush to digitize all electronic health records, Dixon says not everyone is taking the proper steps to de-personalize the data and protect patients."
