    "The zombie cookies will allow AOL to "acquire demographic data on users" while simultaneously using their own advertising network to track user browsing history, use pf apps on smartphones and their geo-location coordinates. Earlier this year, ProPublica released a report regarding the advertising company called Turn and their zombie cookies that are used by large tech firms to "come back to life" even after users have deleted them. In the ProPublica report, it was revealed that Turn is "taking advantage of a hidden undeletable number that Verizon uses to monitor customers' habits on their smartphones and tablets" by respawning those "tracking cookies that users have deleted." Called unique identifier headers (UIDHs), or perma-cookies, this sneaky monitoring of customers is used "to help marketers create more targeted ads based on their customers' unique browsing habits." In 2012, UIDHs were used by Verizon to provide a way for advertisers with "demographic and third-party interest-based segments" to help them deliver "relevant ads" based on mobile devices' unique identifiers. Shockingly, more than 100 million Verizon customers were affected by this snooping by the corporation, tracking individual customer usage and reporting the findings to the federal government and advertising corporations."

  • Microsoft's new plan to keep the US government's hands off its customers' data: Germany will be a safe harbor in the digital privacy storm. Microsoft on Wednesday announced that beginning in the second half of 2016, it will give foreign customers the option of keeping data in new European facilities that, at least in theory, should shield customers from US government surveillance. It will cost more, according to the Financial Times, though pricing details weren't forthcoming. Microsoft Cloud - including Azure, Office 365 and Dynamics CRM Online - will be hosted from new datacenters in the German regions of Magdeburg and Frankfurt am Main. Access to data will be controlled by what the company called a German data trustee: T-Systems, a subsidiary of the independent German company Deutsche Telekom. Without the permission of Deutsche Telekom or customers, Microsoft won't be able to get its hands on the data. If it does get permission, the trustee will still control and oversee Microsoft's access.

  • Microsoft and T-Systems' lawyers may well think that storing customer data in a German trustee data center will protect it from the reach of US law, but for all we know, that could be wishful thinking. Forrester cloud computing analyst Paul Miller: To be sure, we must wait for the first legal challenge. And the appeal. And the counter-appeal. As with all new legal approaches, we don’t know it is watertight until it is challenged in court. Microsoft and T-Systems’ lawyers are very good and say it's watertight. But we can be sure opposition lawyers will look for all the holes. By keeping data offshore - particularly in Germany, which has strong data privacy laws - Microsoft could avoid the situation it's now facing with the US demanding access to customer emails stored on a Microsoft server in Dublin. The US has argued that Microsoft, as a US company, comes under US jurisdiction, regardless of where it keeps its data.

    The European Community's Court of Justice decision in the Safe Harbor case --- and Edward Snowden --- are now officially downgrading the U.S. as a cloud data center location. NSA is good business for Europeans looking to displace American cloud service providers, as evidenced by Microsoft's decision. The legal test is whether Microsoft has "possession, custody, or control" of the data. From the info given in the article, it seems that Microsoft has done its best to dodge that bullet by moving data centers to Germany and placing their data under the control of a European company. Do ownership of the hardware and profits from their rent mean that Microsoft still has "possession, custody, or control" of the data? The fine print of the agreement with Deutsche Telekom and the customer EULAs will get a thorough going over by the Dept. of Justice for evidence of Microsoft "control" of the data. That will be the crucial legal issue. The data centers in Germany may pass the test. But the notion that data centers in the UK can offer privacy is laughable; the UK's legal authority for GCHQ makes it even easier to get the data than the NSA can in the U.S.  It doesn't even require a court order.

The company, which sells surveillance software to government customers all over the world, from Morocco and Ethiopia to the US Drug Enforcement Agency and the FBI, has told all its customers to shut down all operations and suspend all use of the company’s spyware, Motherboard has learned. “They’re in full on emergency mode,” a source who has inside knowledge of Hacking Team’s operations told Motherboard.
  • Hacking Team notified all its customers on Monday morning with a “blast email,” requesting them to shut down all deployments of its Remote Control System software, also known as Galileo, according to multiple sources. The company also doesn’t have access to its email system as of Monday afternoon, a source said. On Sunday night, an unnamed hacker, who claimed to be the same person who breached Hacking Team’s competitor FinFisher last year, hijacked its Twitter account and posted links to 400GB of internal data. Hacking Team woke up to a massive breach of its systems.

  • Google said Thursday it will by default encrypt data warehoused in its Cloud Storage service. The server-side encryption is now active for all new data written to Cloud Storage, and older data will be encrypted in the coming months, wrote Dave Barth, a Google product manager, in a blog post.
  • The data and metadata around an object stored in Cloud Storage is encrypted with a unique key using 128-bit Advanced Encryption Standard algorithm, and the "per-object key itself is encrypted with a unique key associated with the object owner," Barth wrote. "These keys are additionally encrypted by one of a regularly rotated set of master keys," he wrote. "Of course, if you prefer to manage your own keys then you can still encrypt data yourself prior to writing it to Cloud Storage."

    Google paints a deceptive picture of security in a new default encryption service for customer data stored on Google Cloud Storage. See Google blog article linked from the bookmarked page. ITWorld goes part way in unmasking the deception but could have been far more blunt. The claimed fact that Google does not turn encryption keys over to the NSA, et ilk, is irrelevant if Google still decrypts the customer data upon NSA/FBI demand, which it very apparently does. But the Google blog article doesn't mention that and paints a picture seemingly intended to deceive customers into not encrypting their own data before parking it on Google Cloud Storage, thus aiding the NSA/FBI, et cet., in their surveillance efforts.  Deceptive advertising is a serious legal no-no. Hopefully, Google Cloud Storage users will be perceptive enough not to be misled by Google's advertising. But it's a sign that Google managers may be getting worried about losing customers to companies operating in nations that have far stronger protection for digital privacy than the U.S.

The key wrinkle with cloud computing platforms is that there is no standardization of the APIs and platform technologies that underlie these services. The APIs provided by Amazon's cloud computing platform (EC2/S3/EBS/etc) are radically different from those provided by Google App Engine (Datastore API/Python runtime/Images API/etc). For zero lock-in to occur in this space, there need to be multiple providers of the same underlying APIs. Otherwise, migrating between cloud computing platforms will be more like switching your application from Ruby on Rails and MySQL to Django and PostgreSQL (i.e. a complete rewrite)...." Although cloud computing vendors are not explicitly trying to lock-in customers to their platform, the fact is that today if a customer has heavily invested in either platform then there isn't a straightforward way for customers to extricate themselves from the platform and switch to another vendor.   • (AP) -- Federal regulators are urging consumers to go through their phone bills line by line after they accused T-Mobile US of wrongly charging customers for premium services, like horoscope texts and quirky ringtones, the customers never authorized. The Federal Trade Commission announced Tuesday that it is suing T-Mobile in a federal court in Seattle with the goal of making sure every unfairly charged customer sees a full refund. The lawsuit, the first of its kind against a mobile provider, is the result of months of stalled negotiations with T-Mobile, which says it is already offering refunds. "It's wrong for a company like T-Mobile to profit from scams against its customers when there were clear warning signs the charges it was imposing were fraudulent," FTC Chair Edith Ramirez in a statement.
  • The practice is called "cramming": A third party stuffs a customer's bill with bogus charges such as $10-per-month horoscopes or updates on celebrity gossip. In this case, the FTC said, T-Mobile was working with third-party vendors being investigated by regulators and known to be the subject of numerous customer complaints. T-Mobile then made it difficult for customers to notice the added charge to their bill and pocketed up to 40 percent of the total, according to the FTC.
  • The FTC told reporters in a conference call Tuesday that it had been in negotiations with T-Mobile for months in an attempt to guarantee refunds would be provided to customers but that the two sides couldn't reach an agreement. T-Mobile appears to have been laying the groundwork to head off the federal complaint. The company agreed to pay a $2.3 million civil penalty and to submit to a "compliance plan," in which regulators will monitor Comcast for the next five years to ensure it cleans up its act.
  • The FCC said it received over 1,000 complaints from customers, who said Comcast charged them for premium channels, cable boxes, DVRs or other products that they never ordered. In many cases, the FCC said, customers expressly told Comcast that they didn't want the add-on options, but they were charged anyway. Complaints also describe how customers spent "significant time and energy to attempt to remove the unauthorized charges" and get refunds, the commission said. The complaints spurred the FCC to launch an investigation nearly two years ago. Today's settlement marks the conclusion of the probe. Under the five-year compliance plan, Comcast must begin sending customers special notifications every time a new charge or service is added to their bill. The company also has to add a way for customers to easily "block the addition of new services or equipment to their accounts," according to an FCC press release.

  • They say what goes around comes around, and there's perhaps nowhere that rings more true than in the world of government surveillance. Such was the case on Monday morning when Hacking Team, the Italian company known for selling electronic intrusion tools to police and federal agencies around the world, awoke to find that it had been hacked itself—big time—apparently exposing its complete client list, email spools, invoices, contracts, source code, and more. Those documents show that not only has the company been selling hacking tools to a long list of foreign governments with dubious human rights records, but it’s also establishing a nice customer base right here in the good old US of A. The cache, which sources told Motherboard is legitimate, contains more than 400 gigabytes of files, many of which confirm previous reports that the company has been selling industrial-grade surveillance software to authoritarian governments. Hacking Team is known in the surveillance world for its flagship hacking suite, Remote Control System (RCS) or Galileo, which allows its government and law enforcement clients to secretly install “implants” on remote machines that can steal private emails, record Skype calls, and even monitor targets through their computer's webcam.     Amazing must read!  BackBlaze offers unlimited cloud storage/backup for $5 per month.  Now they are releasing the "storage" aspect of their service as an open source design.  The discussion introducing the design is simple to read and follow - which in itself is an achievement.   They held back on open sourcing the BackBlaze Cloud software system, which is understandable.  But they do disclose a Debian Linux OS running Tomcat over Apache Server 5.4 with JFS and HTTPS access.  This is exciting stuff.  I hope the CAR MLS-Cloud guys take notice.  Intro: At Backblaze, we provide unlimited storage to our customers for only $5 per month, so we had to figure out how to store hundreds of petabytes of customer data in a reliable, scalable way-and keep our costs low. In an effort to better serve advertisers, Verizon Wireless has been silently modifying its users' web traffic on its network to inject a cookie-like tracker. This tracker, included in an HTTP header called X-UIDH, is sent to every unencrypted website a Verizon customer visits from a mobile device. It allows third-party advertisers and websites to assemble a deep, permanent profile of visitors' web browsing habits without their consent.Verizon apparently created this mechanism to expand their advertising programs, but it has privacy implications far beyond those programs. This means that users' behavior in apps can be correlated with their behavior on the web, which would be difficult or impossible without the header. But Verizon bypasses the 'Limit Ad Tracking' settings in iOS and Android that are specifically intended to limit abuse of unique identifiers by mobile apps.

Only two months ago, the wireline sector of Verizon's business was hit with a $7.4 million fine by the Federal Communications Commission after it was caught using its "customers' personal information for thousands of marketing campaigns without even giving them the choice to opt out." With this header, it looks like Verizon lets its customers opt out of the marketing side of the program, but not from the disclosure of their browsing habits.

  • Vodafone, one of the world's largest mobile phone groups, has revealed the existence of secret wires that allow government agencies to listen to all conversations on its networks, saying they are widely used in some of the 29 countries in which it operates in Europe and beyond.The company has broken its silence on government surveillance in order to push back against the increasingly widespread use of phone and broadband networks to spy on citizens, and will publish its first Law Enforcement Disclosure Report on Friday. At 40,000 words, it is the most comprehensive survey yet of how governments monitor the conversations and whereabouts of their people.The company said wires had been connected directly to its network and those of other telecoms groups, allowing agencies to listen to or record live conversations and, in certain cases, track the whereabouts of a customer. Privacy campaigners said the revelations were a "nightmare scenario" that confirmed their worst fears on the extent of snooping.

    The Vodafone disclosures will undoubtedly have a very large ripple effect. Note carefully that this is the first major telephone service in the world to break ranks with the others and come out swinging at secret government voyeur agencies. Will others follow. If you follow the links to the Vodafone report, you'll find a very handy big PDF providing an overview of the relevant laws in each of the customer nations. There's a cute Guardian table that shows the aggregate number of warrants for interception of content via Vodafone for each of those nations, broken down by content type. That table has white-on-black cells noting where disclosure of those types of surveillance statistics are prohibited by law. So it is far from a complete picture, but it's a heck of a good start.  But several of those customer nations are members of the E.U., where digital privacy rights are enshrined as human rights under an EU-wide treaty. So expect some heat to roll downhill on those nations from the European treaty organizations, particularly the European Court of Human Rights, staffed with civil libertarian judges, from which there is no appeal.
