MH17: Malaysia's Barring from Investigation Reeks of Cover-up | nsnbc international - 0 views

  • It was a Malaysian jet, carrying Malaysian passengers, flown by Malaysian pilots, yet after Malaysia Airlines flight MH17 was shot down over Ukraine in July 2014, Malaysia has been systematically blocked from participating in the investigation, leaving an overwhelmingly pro-NATO bloc in charge of the evidence, investigation and outcome as well as the manner in which the investigation will be carried out. Despite the integral role Malaysia has played during several pivotal moments in the aftermath of the disaster, it appears that the closer to the truth the investigation should be getting, the further Malaysia itself is being pushed from both the evidence and any influence it has on the likely conclusions of the investigation. With the downed aircraft in question being Malaysian, Malaysia as a partner in the investigation would seem a given. Its exclusion from the investigation appears to be an indication that the investigation’s objectivity has been compromised and that the conclusions it draws will likely be politically motivated.
  • With the Dutch leading the investigation, the logic being that the flight originated from the Netherlands and the majority of the passengers were Dutch, it has formed a Joint Investigation Team (JIT). At the onset of its creation it seemed obvious that Malaysia would too be included, considering it lost the second largest number of citizens to the disaster and the plane itself was registered in Malaysia. Instead, JIT would end up comprised of Belgium, Ukraine, and Australia, specifically excluding Malaysia. Malaysia was both surprised and has protested its exclusion from JIT, and has repeatedly expressed a desire to be included directly in the investigation.
  • The Malaysian Insider cited Malaysian scholar Dr. Chandra Muzaffar who believes the decision to exclude his country from the investigation is politically motivated, aiming at excluding members that may urge caution and objectivity instead of draw conclusions first and bend the investigation’s results around those conclusions. In particular, Dr. Muzaffar believes that the investigations is intentionally being skewed to target Russia. Ukraine’s involvement in the investigation is particularly troublesome. Had MH17 crashed in Ukraine under different circumstances, Ukraine’s role would be welcome. However, it was apparently shot down specifically in a conflict in which Kiev itself is a participant. With both sides of the conflict possessing anti-aircraft weapons and with Kiev itself confirmed to possess weapons capable of reaching the altitude MH17 was flying at when it was allegedly hit, Kiev becomes a possible suspect in the investigation. Kiev’s inclusion in JIT represents a monumental conflict of interest.

  • And to compound this already glaring conflict of interest, it was revealed recently that an alleged “secret deal” was struck by JIT in which any member could bar the release of evidence. With all members of JIT being pro-NATO and decidedly arrayed against Moscow, such a “deal” could prevent crucial evidence from being revealed that would effect an otherwise distorted conclusion drawn by the investigators aimed specifically at advancing their greater political agenda in Eastern Europe. Had Malaysia been a member of JIT, the ability of other members to withhold evidence would have been greatly diminished and it is likely such a bizarre deal would not have been conceivable, real or imaged, in the first place.
  • With the ongoing conflict in Ukraine perceived as a proxy war between NATO and Moscow, JIT’s membership including the NATO-backed Kiev regime itself (a possible suspect), two NATO members (Belgium and the Netherlands) and Australia who has passed sanctions against Russia over the conflict, is a textbook case of conflict of interest.
  • To casual observers, the current investigation led by NATO members and Kiev, a possible suspect, would be no different than the Donetsk People’s Republic and Russia leading it. Few would consider a DPR or Russian led investigation impartial, and few should see a NATO-led investigation as impartial. Had Malaysia been included in the process, an argument could have been made that an actual investigation was taking place rather than a complex propaganda campaign. Malaysia’s exclusion is a troubling sign for the victims of the MH17 disaster, meaning the true culprits will never be known. The overt politically motivated nature of the investigation will on one hand  help fuel NATO’s propaganda war, but on the other hand, fuel the doubts of millions worldwide over the true events that took place in the skies of eastern Ukraine that day. Like so many other events in human history that took place amid a high stake political struggle, the downing of MH17 will be shrouded in mystery, mystery draped over the truth by the irresponsible leadership of NATO, and those in Washington, London and Brussels egging on the conflict in Ukraine to this very day.

  • And here's the spin war verdict: the current Malaysia Airlines tragedy - the second in four months - is "terrorism" perpetrated by "pro-Russian separatists", armed by Russia, and Vladimir Putin is the main culprit. End of story. Anyone who believes otherwise, shut up. Why? Because the CIA said so. Because Hillary "We came, we saw, he died" Clinton said so. Because batshit crazy Samantha "R2P" Power said so - thundering at the UN, everything duly printed by the neo-con infested Washington Post. [1] Because Anglo-American corporate media - from CNN to Fox (who tried to buy Time Warner, which owns CNN) - said so. Because the President of the United States (POTUS) said so. And mostly because Kiev had vociferously said so in the first place.
  • Right off the bat they were all lined up - the invariably hysterical reams of "experts" of the "US intelligence community" literally foaming at their palatial mouths at "evil" Russia and "evil" Putin; intel "experts" who could not identify a convoy of gleaming white Toyotas crossing the Iraqi desert to take Mosul. And yet they have already sentenced they don't need to look any further, instantly solving the MH17 riddle.

  • A simple search at reveals that MH17 was in fact diverted 200 kilometers north from the usual flight path taken by Malaysia Airlines in the previous days - and plunged right in the middle of a war zone. Why? What sort of communication MH17 received from Kiev air control tower? Kiev has been mute about it. Yet the answer would be simple, had Kiev released the Air Traffic Control recording of the tower talking to flight MH17; Malaysia did it after flight MH370 disappeared forever. It won't happen; SBU security confiscated it. So much for getting an undoctored explanation on why MH17 was off its path, and what the pilots saw and said before the explosion. The Russian Defense Ministry, for its part, has confirmed that a Kiev-controlled Buk anti-aircraft missile battery was operational near the MH17's crash. Kiev has deployed several batteries of Buk surface-to-air missile systems with at least 27 launchers; these are all perfectly capable of bringing down jets flying at 33,000 ft.
  • Radiation from a battery's Kupol radar, deployed as part of a Buk-M1 battery near Styla (a village some 30km south of Donetsk) was detected by the Russian military. According to the ministry, the radar could be providing tracking information to another battery which was at a firing distance from MH17's flight path. The tracking radar range on the Buk system is a maximum of 50 miles. MH17 was flying at 500 mph. So assuming the "rebels" had an operational Buk and did it, they would have had not more than five minutes to scan all the skies above, all possible altitudes, and then lock on. By then they would have known that a cargo plane could not possibly be flying that high. For evidence supporting the possibility of a false flag, check here.
  • And then there's the curiouser and curiouser story of Carlos, the Spanish air traffic controller working at Kiev's tower, who was following MH17 in real time. For some Carlos is legit - not a cipher; for others, he's never even worked in Ukraine. Anyway he tweeted like mad. His account - not accidentally - has been shut down, and he has disappeared; his friends are now desperately looking for him. I managed to read all his tweets in Spanish when the account was still online - and now copies and an English translation are available. These are some of his crucial tweets: "The B777 was escorted by 2 Ukrainian fighter jets minutes before disappearing from radar (5.48 pm)" "If the Kiev authorities want to admit the truth 2 fighter jets were flying very close a few minutes before the incident but did not shoot down the airliner (5.54)" "As soon as the Malaysia Airlines B777 disappeared the Kiev military authority informed us of the shooting down. How did they know? (6.00)"
  • "Everything has been recorded on radar. For those that don't believe it, it was taken down by Kiev; we know that here (in traffic control) and the military air traffic control know it too (7.14)" "The Ministry of the Interior did know that there were fighter aircraft in the area, but the Ministry of Defense didn't. (7.15)" "The military confirm that it was Ukraine, but it is not known where the order came from. (7.31)" Carlos's assessment (a partial compilation of his tweets is collected here http://slavyangrad.wordpress.com/2014/07/18/spanish-air-controller-kiev-borispol-airport-ukraine-military-shot-down-boeing-mh17/ ): the missile was fired by the Ukraine military under orders of the Ministry of Interior - NOT the Ministry of Defense. Security matters at the Ministry of the Interior happen to be under Andriy Parubiy, who was closely working alongside US neo-cons and Banderastan neo-nazis on Maidan.
  • Assuming Carlos is legit, the assessment makes sense. The Ukrainian military are divided between Chocolate king President Petro Poroshenko - who would like a d?tente with Russia essentially to advance his shady business interests - and Saint Yulia Timoshenko, who's on the record advocating genocide of ethnic Russians in Eastern Ukraine. US neo-cons and US "military advisers" on the ground are proverbially hedging their bets, supporting both the Poroshenko and Timoshenko factions. So who profits? The key question remains, of course, cui bono? Only the terminally brain dead believe shooting a passenger jet benefits the federalists in Eastern Ukraine, not to mention the Kremlin. As for Kiev, they'd have the means, the motive and the window of opportunity to pull it off - especially after Kiev's militias have been effectively routed, and were in retreat, in the Donbass; and this after Kiev remained dead set on attacking and bombing the population of Eastern Ukraine even from above. No wonder the federalists had to defend themselves.
  • And then there's the suspicious timing. The MH17 tragedy happened two days after the BRICS announced an antidote to the IMF and the World Bank, bypassing the US dollar. And just as Israel "cautiously" advances its new invasion/slow motion ethnic cleansing of Gaza. Malaysia, by the way, is the seat of the Kuala Lumpur War Crimes Commission, which has found Israel guilty of crimes against humanity. Washington, of course, does profit. What the Empire of Chaos gets in this case is a ceasefire (so the disorganized, battered Kiev militias may be resupplied); the branding of Eastern Ukrainians as de facto "terrorists" (as Kiev, Dick Cheney-style, always wanted); and unlimited mud thrown over Russia and Putin in particular until Kingdom Come. Not bad for a few minutes' work. As for NATO, that's Christmas in July. From now on, it all depends on Russian intelligence. They have been surveying/tracking everything that happens in Ukraine 24/7. In the next 72 hours, after poring over a lot of tracking data, using telemetry, radar and satellite tracking, they will know which type of missile was launched, where from, and even produce communications from the battery that launched it. And they will have access to forensic evidence.
  • Unlike Washington - who already knows everything, with no evidence whatsoever (remember 9/11?) - Moscow will take its time to know the basic journalistic facts of what, where, and who, and engage on proving the truth and/or disproving Washington's spin. The historical record shows Washington simply won't release data if it points to a missile coming from its Kiev vassals. The data may even point to a bomb planted on MH17, or mechanical failure - although that's unlikely. If this was a terrible mistake by the Novorossiya rebels, Moscow will have to reluctantly admit it. If Kiev did it, the revelation will be instantaneous. Anyway we already know the hysterical Western response, no matter what; Russia is to blame. Putin is more than correct when he stressed this tragedy would not have happened if Poroshenko had agreed to extend a cease-fire, as Merkel, Hollande and Putin tried to convince him in late June. At a minimum, Kiev is already guilty because they are responsible for safe passage of flights in the airspace they - theoretically - control. But all that is already forgotten in the fog of war, tragedy and hype. As for Washington's hysterical claims of credibility, I leave you with just one number: Iran Air 655.

Dutch MH17 Investigation Omits US "Intel". Fabrications and Omissions Supportive of US-... - 0 views

  • The absence of America’s so-called “intelligence” regarding the downing of Malaysia Airlines MH17 over Ukraine in a 34 page Dutch Safety Board preliminary report raises serious questions about the credibility and legitimacy of both America’s political agenda, and all agencies, organizations, and political parties currently behind it. The report titled, “Preliminary Report: Crash involving Malaysia Airlines Boeing 777-200 flight MH17″ (.pdf), cites a wide variety of evidence in its attempt to determine the cause of flight MH17′s crash and to prevent similar accidents or incidents from occurring again in the future. Among this evidence includes the cockpit voice recorder (CVR), the flight data recorder (FDR), analysis of recorded air traffic control (ATC) surveillance data and radio communication, analysis of the meteorological circumstances, forensic examination of the wreckage (if recovered and possible foreign objects if found), results of the pathological investigation, and analysis of the in-flight break up sequence.
  • Satellite images are referenced in regards to analyzing the crash site after the disaster, however, no where in the report is mentioned any evidence whatsoever of satellite images of missile launchers, intelligence from the United States regarding missile launches, or any information or evidence at all in any regard suggesting a missile had destroyed MH17. In fact, the report concludes by stating: This report is preliminary. The information must necessarily be regarded as tentative and subject to alternation or correction if additional evidence becomes available. Further work will at least include the following areas of interest to substantiate the factual information regarding:
  • The report specifically mentions information collected from Russia, including air traffic control and radar data – both of which were publicly shared by Russia in the aftermath of the disaster. The report also cites data collected from Ukraine air traffic controllers. The United States however, apart from providing technical information about the aircraft itself considering it was manufactured in the US, provided absolutely no data in any regard according to the report.

  • In the wake of the MH17 tragedy, the West would rush through a series of sanctions against Russia as well as justify further military aid for the regime in Kiev, Ukraine and the literal Neo-Nazi militant battalions serving its pro-Western agenda amid a brutal civil war raging in the country’s eastern most provinces. With sanctions in hand, and the war raging on in earnest, the MH17 disaster dropped entirely out of Western narratives as if it never occurred. Surely if the West had solid evidence implicating eastern Ukrainian rebels and/or Russia, the world would never have heard the end of the MH17 disaster until the truth was fully aired before the public. When Dutch investigators published their preliminary report, the West merely reiterated its original claims, simply imposing their contradictory nature upon the report – most likely believing the public would never actually read its 34 pages. For example, Reuters in a report titled, “Malaysia: Dutch report suggests MH-17 shot down from ground,” would brazenly claim:
  • Had the US actually possessed any credible information to substantiate its claims that MH17 was shot down by a missile, such evidence surely would have been submitted to and included in the Dutch Safety Board’s preliminary reporting. That it is predictably missing confirms what commentators, analysts, and politicians around the world had long since suspected – the West’s premature conclusions regarding MH17′s demise were driven by a political agenda, not a factually based search for the truth. The evidence that MH17 was shot down by a missile as the West insisted is missing because it never existed in the first place. That the Dutch Safety Board possesses such a vast amount of information but is still unable to draw anything but the most tentative conclusions, exposes the alleged certainty of Western pundits and politicians in the hours and days after MH17′s loss as an utterly irresponsible, politically motivated, exploitation of tragedy at best, and at worst, exposing the West – NATO in particular – as possible suspects in a crime they clearly stood the most to benefit from.
  • Malaysia Airlines flight MH17 broke apart over Ukraine due to impact from a large number of fragments, the Dutch Safety Board said on Tuesday, in a report that Malaysia’s prime minister and several experts said suggested it was shot down from the ground. The title of Reuters’ propaganda piece directly contradicts its first paragraph which reveals “experts,” not the actual Dutch Safety Board report, claimed it was “shot down from the ground,” while the report itself says nothing of the sort. The experts cited by Reuters in fact had no association whatsoever with the preliminary report and instead are the same mainstay of cherry picked commentators the West constantly defers to while building up and perpetuating utterly fabricated narratives to advance its agenda globally.

  • The facts speak clear and loud and are beyond the realm of speculation: The cockpit shows traces of shelling! You can see the entry and exit holes. The edge of a portion of the holes is bent inwards. These are the smaller holes, round and clean, showing the entry points most likely that of a 30 millimeter caliber projectile.   • Based on detailed analysis Peter Haisenko reached  the conclusion that the MH17 was not downed by a missile attack: This aircraft was not hit by a missile in the central portion. The destruction is limited to the cockpit area. Now you have to factor in that this part is constructed of specially reinforced material The OSCE Mission It is worth noting that the initial statements by OSCE observers (July 31) broadly confirm the findings of Peter Haisenko: Monitors from the Organization for Security and Cooperation in Europe reported that shrapnel-like holes were found in two separate pieces of the fuselage of the ill-fated Malaysia Airlines aircraft that was believed to have been downed by a missile in eastern Ukraine. Michael Bociurkiw of the OSCE group of monitors at his daily briefing described part of the plane’s fuselage dotted with “shrapnel-like, almost machine gun-like holes.” He said the damage was inspected by Malaysian aviation-security officials .(Wall Street Journal, July 31, 2014)
  • The monitoring OSCE team has not found evidence of a missile fired from the ground as conveyed by official White House statements. As we recall, the US ambassador to the UN Samantha Power stated –pointing a finger at Russia– that the Malaysian MH17 plane was “likely downed by a surface-to-air missile operated from a separatist-held location”: The team of international investigators with the Organisation for Security and Cooperation in Europe (OSCE) are uncertain if the missile used was fired from the ground as US military experts have previously suggested, the Wall Street Journal (WSJ) reported. (Malay Mail online, emphasis added) The initial OSCE findings tend to dispel the claim that a BUK missile system brought down the plane. Evidently, inasmuch as the perforations are attributable to shelling, a shelling operation conducted from the ground could not have brought down an aircraft traveling above 30,000 feet.

  • Peter Haisenko’s study is corroborated by the Russian Ministry of Defense which pointed to a Ukrainian Su-25 jet in the flight corridor of the MH17, within proximity of the plane. Ironically, the presence of a military aircraft is also confirmed by a BBC  report conducted at the crash site on July 23. All the eyewitnesses  interviewed by the BBC confirmed the presence of a Ukrainian military aircraft flying within proximity of Malaysian Airlines MH17 at the time that it was shot down: 
  • Eyewitness #1: There were two explosions in the air. And this is how it broke apart. And [the fragments] blew apart like this, to the sides. And when … Eyewitness #2: … And there was another aircraft, a military one, beside it. Everybody saw it. Eyewitness #1: Yes, yes. It was flying under it, because it could be seen. It was proceeding underneath, below the civilian one. Eyewitness #3: There were sounds of an explosion. But they were in the sky. They came from the sky. Then this plane made a sharp turn-around like this. It changed its trajectory and headed in that direction [indicating the direction with her hands]. BBC Report below
  • The original BBC Video Report published by BBC Russian Service on July 23, 2014 has since been removed from the BBC archive.  In a bitter irony, The BBC is censoring its own news productions. Media Spin The media is now saying that a missile was indeed fired but it was not the missile that brought down the plane, it was the shrapnel from the missile which punctured the plane and then led to a loss of pressure.  According to Ukraine’s National security spokesman Andriy Lysenko in a contradictory statement, the MH17 aircraft “suffered massive explosive decompression after being hit by a shrapnel missile.”  (See IBT, Australia) In an utterly absurd report, the BBC quoting the official Ukraine statement  says that:
  • The downed Malaysia Airlines jet in eastern Ukraine suffered an explosive loss of pressure after it was punctured by shrapnel from a missile. They say the information came from the plane’s flight data recorders, which are being analysed by British experts. However, it remains unclear who fired a missile, with pro-Russia rebels and Ukraine blaming each other. Many of the 298 people killed on board flight MH17 were from the Netherlands. Dutch investigators leading the inquiry into the crash have refused to comment on the Ukrainian claims.
  • The shrapnel marks should be distinguished from the small entry and exit holes “most likely that of a 30 millimeter caliber projectile” fired from a military aircraft. These holes could not have been caused by a missile attack as hinted by the MSM. While the MSN is saying that the “shrapnel like holes” can be caused by a missile (see BBC report above), the OSCE has confirmed the existence of what it describes as “machine gun like holes”, without however acknowledging that these cannot be caused by a missile. In this regard, the GSh-302 firing gun operated by an Su-25 is able to fire 3000 rpm which explains the numerous entry and exit holes. According to the findings of Peter Haisenko: If we now consider the armament of a typical SU 25 we learn this: It is equipped with a double-barreled 30-mm gun, type GSh-302 / AO-17A, equipped with: a 250 round magazine of anti-tank incendiary shells and splinter-explosive shells (dum-dum), arranged in alternating order. The cockpit of the MH 017 has evidently been fired at from both sides: the entry and exit holes are found on the same fragment of it’s cockpit segment (op cit)
  • The accusations directed against Russia including the sanctions regime imposed by Washington are based on a lie. The evidence does not support the official US narrative to the effect that the MH17 was shot down by a BUK missile system operated by the DPR militia.

Pay close attention at the Alleged Map of the MH17 Catastrophe.
  • And, so, we have the background. Let’s see how the picture unfolds: The launch is alleged to have been made from Chernukhino. The maximum distance of the launch is 16 kilometres. The aircraft fell between Snezhnoye and Torez. That’s 37 kilometres, which is 20 kilometres more than the maximum possible point at which the plain could have been hit. You know, even a plane with turned-off engines can’t glide like that. But the trouble is that the aircraft was not whole. According to the pattern of the spread of fuselage fragments and bodies, the plane was ruptured practically with the first shot. Here it must be mentioned that the high-explosive/fragmentation warhead of the rocket has a mass of approximately 50 kilograms (by the way, Ukrainians have an outdated modification, which is only 40 kilograms).
  • Overall, that’s not too little; however, it must be understood that it detonates not when it sticks into an airplane, but when it is still at a certain, and fairly significant distance. Moreover, the main strike factor is not the blast wave, but far more significantly – the stream of fragments. These fragments are previously prepared rods (and in the earlier versions – little cubes, if I recall correctly). And yes, for a jet fighter, that, in itself, is more than sufficient. However, here we are dealing with a huge airliner. Yes, one rocket will rip the casing, cause depressurization, and will kill a lot of passengers. But it will not break up the airliner into pieces. Given certain conditions, the pilots may even be able to land it. And, in fact, there have been precedents (to be provided in future posts). For example – the very same An-28, which is alleged to have been the first victim of a BUK system; even though it was done for, but the crew was able to successfully catapult out. Which, in some way, symbolizes. An An-28, by the way, is far smaller than a Boeing.

  • In other words, the rocket caught up to the plane no closer than 25 kilometres away from Chernukhino. Which is absolutely impossible for a BUK system. By the way, we can’t overlook the fact that, at maximum distances, BUK can be used only provided there is support from an external radar installation for location and guiding purposes. In other words, even if a rockets flies far, BUK’s mobile radar does not cover its entire distance.
  • And that is what is so strange here: SBU literally offers evidence that proves that that the Militia had no part in the shooting down of the Boeing! The fact that they blame themselves in the recording is quite understandable. Unlike the fascists, they have a conscience, which takes its toll until you are sure it was not you who did it. Ok. But somebody did, in fact, shoot down the plane? Of course it was shot down. And here we have another question: what if this recording is a falsification through and through? Then it had to have been prepared somehow? And then disseminated? That’s when smoke starts to clear, and mirrors – to break. That’s the problem with tricks.
  • #14 – An Industry Outlet Confirms Carlos (@spainbuca) as ATC at Borispol Airport in Kiev Original: EturboNews (ETN Global Travel Industry News) – July 17, 2014 ETN received information from an air traffic controller in Kiev on Malaysia Airlines flight MH17. This Kiev air traffic controller is a citizen of Spain and was working in the Ukraine. He was taken off duty as a civil air-traffic controller along with other foreigners immediately after a Malaysia Airlines passenger aircraft was shot down over the Eastern Ukraine killing 295 passengers and crew on board. The air traffic controller suggested in a private evaluation and basing it on military sources in Kiev, that the Ukrainian military was behind this shoot down. Radar records were immediately confiscated after it became clear a passenger jet was shot down.   • Exclusive: U.S. intelligence officials suggest that the person who fired the missile that downed Malaysia Airlines Flight 17 may have been “a defector” from the Ukrainian army, an apparent attempt to explain why some CIA analysts thought satellite images revealed men in Ukrainian army uniforms manning the missile battery, writes Robert Parry. By Robert Parry As the U.S. government seeks to build its case blaming eastern Ukrainian rebels and Russia for the shoot-down of Malaysia Airlines Flight 17, the evidence seems to be getting twisted to fit the preordained conclusion, including a curious explanation for why the troops suspected of firing the fateful missile may have been wearing Ukrainian army uniforms. On Tuesday, mainstream journalists, including for the Los Angeles Times and the Washington Post, were given a briefing about the U.S. intelligence information that supposedly points the finger of blame at the rebels and Russia. While much of this circumstantial case was derived from postings on “social media,” the briefings also addressed the key issue of who fired the Buk anti-aircraft missile that is believed to have downed the airliner killing all 298 people onboard.
  • After last Thursday’s shoot-down, I was told that U.S. intelligence analysts were examining satellite imagery that showed the crew manning the suspected missile battery wearing what looked like Ukrainian army uniforms, but my source said the analysts were still struggling with whether that essentially destroyed the U.S. government’s case blaming the rebels. The Los Angeles Times article on Tuesday’s briefing seemed to address the same information this way: “U.S. intelligence agencies have so far been unable to determine the nationalities or identities of the crew that launched the missile. U.S. officials said it was possible the SA-11 [anti-aircraft missile] was launched by a defector from the Ukrainian military who was trained to use similar missile systems.” That statement about a possible “defector” might explain why some analysts thought they saw soldiers in Ukrainian army uniforms tending to the missile battery in eastern Ukraine. But there is another obvious explanation that the U.S. intelligence community seems unwilling to accept: that the missile may have been launched by someone working for the Ukrainian military.
  • In other words, we may be seeing another case of the U.S. government “fixing the intelligence” around a desired policy outcome, as occurred in the run-up to war with Iraq. The Los Angeles Times also reported: “U.S. officials have not released evidence proving that Russia’s military played a direct role in the downing of the jet or in training separatists to use the SA-11 missile system. But they said Tuesday that the Russian military has been training Ukrainian separatists to operate antiaircraft batteries at a base in southwestern Russia.” Though that last charge also has lacked verifiable proof – and could refer to training on less powerful anti-aircraft weapons like so-called Manpads – the key question is whether the Russian government trained the rebels in handling a sophisticated anti-aircraft system, like the SA-11, and then was reckless enough to supply one or more of those missile batteries to the rebels — knowing that these rockets could reach above 30,000 feet where passenger airlines travel. The Russian government has denied doing anything that dangerous, if not crazy, and the eastern Ukrainian rebels also deny ever possessing such a missile battery. But the question that needs answering is: Are the Russians and the rebels lying?

  • That requires a serious and impartial investigation, but what the Obama administration and most of the mainstream U.S. news media have delivered so far is another example of “information warfare,” assembling a case to make an adversary look bad regardless of the actual evidence — and then marginalizing any dissents to the desired conclusion. That was exactly the “group think” that led the United States into the disastrous invasion of Iraq – and it appears that few if any lesson were learned.

  • After almost two decades of discussion, the ASEAN Economic Community (AEC) will be proclaimed on 31st December. The AEC is a potentially significant and competitive economic region, should it be allowed to develop according to the aspiration of being a “single market and production base, with free flow of services, investments, and labour, by the year 2020”.
  • The ASEAN region as a composite trading block has the third highest population at 634 million, after China and India. GDP per capita is rapidly rising. The AEC would be the 4th largest exporter after China, the EU, and the United States, with still very much scope for growth from Cambodia, Myanmar, the Philippines, and Vietnam from a diverse range of activities ranging from agriculture, food, minerals and commodities, electronics, and services. The coming AEC is already the 4th largest importer of goods after the United States, EU, and China, making it one of the biggest markets in the world. Unlike the other trade regions, the AEC still has so much potential for growth with rising population, rising incomes, growing consumer sophistication, and improving infrastructure. Perhaps the biggest benefit of the upcoming AEC is the expected boost this will give to intra-ASEAN trade. Most ASEAN nations have previously put their efforts into developing external relationships with the major trading nations like the EU, Japan and the US through bilateral and free trade agreements. To some extent, the potential of intra-ASEAN trade was neglected, perhaps with the exception of the entrepot of Singapore. The AEC is an opportunity to refocus trade efforts within the region, especially when Vietnam, Cambodia, Indonesia are rapidly developing, and Myanmar is opening up for business with the rest of the region.
  • There are no integrated banking structures, no agreement on common and acceptable currencies (some ASEAN currencies are not interchangeable), no double taxation agreements, and no formal agreements on immigration. There is not even any such thing as a common ASEAN business visa. These issues are going to hinder market access for regional SMEs. Any local market operations will have to fulfil local laws and regulations which may not be easy for non-citizens to meet and adhere to. Even though there are some preferential tariffs for a number of classes of ASEAN originating goods, non-tariff barriers are still in existence, which are insurmountable in some cases like the need for import licenses (APs) in Malaysia, and the need to have a registered company which can only be formed by Thai nationals within Thailand. Some of these problems are occurring because of the very nature of ASEAN itself. ASEAN was founded on the basis of consultation, consensus, and non-interference in the internal affairs of other members. This means that no formal problem solving mechanism exists, and the ASEAN Secretariat is a facilitator rather than implementer of policy. Illegal workers, human trafficking, money laundering, and haze issues between member states have no formal mechanisms through which these issues can be solved from an ASEAN perspective. This weakens the force for regional integration.

  • However the necessary infrastructure to support intra-ASEAN trade growth is lagging behind with a delay in the completion of the Trans-Asia Highway in Cambodia, and vastly inadequate border checkpoints between Malaysia and Thailand in Sadao and Kelantan. Some infrastructure development projects have been severely hit by finance shortfalls within member states. There are a number of outstanding issues concerning the growth and development of the AEC. The ASEAN Secretariat based in Jakarta has a small staff, where the best talent is lacking due to the small salaries paid. The Secretariat unlike the EU bureaucratic apparatus in Brussels relies on cooperation between the member state governments for policy direction, funding and implementation of the AEC. Thus the frontline of AEC implementation are the individual country ministries, which presents many problems, as some issues require multi-ministry cooperation and coordination, which is not always easy to achieve as particular ministries have their own visions and agendas. Getting cooperation of these ministries isn’t easy. There are numerous structural and procedural issues yet to be contended with. At the inter-governmental level, laws and regulations are yet to be coordinated and harmonized. So in-effect there is one community with 10 sets of regulations in effect this coming January 1st. Consumer laws, intellectual property rights, company and corporate codes (no provision for ASEAN owned companies), land codes, and investment rules are all different among the individual member states.
  • One of the major issues weakening the potential development of the AEC is the apparent lack of political commitment for a common market by the leadership of the respective ASEAN members. Thailand is currently in a struggle to determine how the country should be governed. Malaysia is in the grip of corruption scandals where the prime minister is holding onto power. Myanmar is going through a massive change in the way it will be governed. Indonesia is still struggling with how its archipelago should be governed. There is a view from Vietnam that business within the country is not ready for the AEC. Intense nationalistic sentiments among for example Thais, exasperated by the recent Preach Vihear Temple conflict along the Thai-Cambodian border need to be softened to get full advantage out of the AEC. The dispute in the International Court of Justice over Pedra Branca, and the Philippine rift with China over the South China Sea show the delicacy of relationships among ASEAN members. The recent Thai court decision on the guilt of Zaw Lin and Win Zaw Tun in the murder of two young British tourists may also show how fragile intra-ASEAN relationships can be. The AEC is going to fall far short of achieving its full potential of becoming a major influence in global trade. The AEC is not intended to be the same model as the EEC. The AEC is far from being any fully integrated economic community. The lack of social, cultural, and political integration within the ASEAN region indicates the massive job ahead that Europe had been through decades ago. There is still a lot of public ignorance about what the AEC is, and lack of excitement or expectation for what should be a major event within the region. Respective national media are scant on information about the forthcoming launch of the AEC.

  • After agreeing to pay a whopping $3.9 billion in fines and restitution, Goldman Sachs has finally been freed from one of its biggest albatrosses for its international business: Malaysian prosecutors have dropped all criminal charges in the 1MDB episode.
  • Reuters reports that, on Friday morning local time, Malaysian prosecutors announced that they would be withdrawing criminal charges against three Goldman Sachs units accused of misleading investors over a series of bond sales worth a combined $6.5 billion which helped fund the ill-fated sovereign wealth fund 1MDB (it stands for 1Malaysia Development Berhad). The Goldman subsidiaries based in London, Hong Kong and Singapore had pleaded not guilty to criminal charges back in February and the bank has consistently denied wrongdoing, though gallons of ink have been spilled about the alleged skulduggery that reportedly involved officials as senior as CEO Lloyd Blankfein. Now, the bank needs to settle things with the DoJ, which is also pursuing a criminal investigation. The DoJ estimates that $4.5 billion was siphoned from the fund by a group of insiders led by the fugitive financier Jho Low, the alleged mastermind, and former PM Najib Razak, who received hundreds of millions of dollars in proceeds from the fraud. Late last year, the bank was reportedly on the verge of a settlement with US authorities for roughly $2 billion, but those talks have reportedly fallen apart.

China to Start Payments With Russia in National Currencies on December 29 / Sputnik Int... - 0 views

  • China will start swaps and forwards between the yuan and the national currencies of Russia, Malaysia and New Zealand on December 29, the China Foreign Exchange Trade System (CFETS) reported Friday. Earlier in December, China's Minister of Commerce Gao Hucheng claimed that China could increase the usage of yuan in trade with Russia amid the ruble's depreciation, which falls in line with China's intention to increase the usage of national currencies in international payments in order to weaken the US dollar's dominance in global finance and promote the yuan as an alternative.
  • In October, the Russian Central Bank and the People's Bank of China reached a three-year agreement on currency swaps worth 150 billion yuan (over $24 billion). Both the Russian and the Chinese leaders have repeatedly praised the decision, saying it would bring positive effects for the countries' economies and currencies. The main benefits of mutual payments in national currencies are the absence of charges for the conversion of the currencies, direct payments and higher transparency in relations between the banks.

  • U.S.–Russian tensions are building in a precarious way over Ukraine, and we are far from certain that your advisers fully appreciate the danger of escalation. The New York Times and other media outlets are treating sensitive issues in dispute as flat-fact, taking their cue from U.S. government sources. Twelve days after the shoot-down of Malaysian Airlines Flight 17, your administration still has issued no coordinated intelligence assessment summarizing what evidence exists to determine who was responsible – much less to convincingly support repeated claims that the plane was downed by a Russian-supplied missile in the hands of Ukrainian separatists.

  • As intelligence professionals we are embarrassed by the unprofessional use of partial intelligence information. As Americans, we find ourselves hoping that, if you indeed have more conclusive evidence, you will find a way to make it public without further delay. In charging Russia with being directly or indirectly responsible, Secretary of State John Kerry has been particularly definitive. Not so the evidence. His statements seem premature and bear earmarks of an attempt to “poison the jury pool.”
  • Regarding the Malaysia Airlines shoot-down of July 17, we believe Kerry has typically rushed to judgment and that his incredible record for credibility poses a huge disadvantage in the diplomatic and propaganda maneuvering vis-a-vis Russia. We suggest you call a halt to this misbegotten “public diplomacy” offensive. If, however, you decide to press on anyway, we suggest you try to find a less tarnished statesman or woman.
  • If the U.S. has more convincing evidence than what has so far been adduced concerning responsibility for shooting down Flight 17, we believe it would be best to find a way to make that intelligence public – even at the risk of compromising “sources and methods.” Moreover, we suggest you instruct your subordinates not to cheapen U.S. credibility by releasing key information via social media like Twitter and Facebook. The reputation of the messenger for credibility is also key in this area of “public diplomacy.” As is by now clear to you, in our view Secretary Kerry is more liability than asset in this regard. Similarly, with regard to Director of National Intelligence James Clapper, his March 12, 2013 Congressional testimony under oath to what he later admitted were “clearly erroneous” things regarding NSA collection should disqualify him. Clapper should be kept at far remove from the Flight 17 affair. What is needed, if you’ve got the goods, is an Interagency Intelligence Assessment – the genre used in the past to lay out the intelligence. We are hearing indirectly from some of our former colleagues that what Secretary Kerry is peddling does not square with the real intelligence. Such was the case late last August, when Kerry created a unique vehicle he called a “Government (not Intelligence) Assessment” blaming, with no verifiable evidence, Bashar al-Assad for the chemical attacks near Damascus, as honest intelligence analysts refused to go along and, instead, held their noses.
  • We believe you need to seek out honest intelligence analysts now and hear them out. Then, you may be persuaded to take steps to curb the risk that relations with Russia might escalate from “Cold War II” into an armed confrontation. In all candor, we see little reason to believe that Secretary Kerry and your other advisers appreciate the enormity of that danger. In our most recent (May 4) memorandum to you, Mr. President, we cautioned that if the U.S. wished “to stop a bloody civil war between east and west Ukraine and avert Russian military intervention in eastern Ukraine, you may be able to do so before the violence hurtles completely out of control.” On July 18, you joined the top leaders of Germany, France, and Russia in calling for an immediate ceasefire. Most informed observers believe you have it in your power to get Ukrainian leaders to agree. The longer Kiev continues its offensive against separatists in eastern Ukraine, the more such U.S. statements appear hypocritical. We reiterate our recommendations of May 4, that you remove the seeds of this confrontation by publicly disavowing any wish to incorporate Ukraine into NATO and that you make it clear that you are prepared to meet personally with Russian President Putin without delay to discuss ways to defuse the crisis and recognize the legitimate interests of the various parties. The suggestion of an early summit got extraordinary resonance in controlled and independent Russian media. Not so in “mainstream” media in the U.S. Nor did we hear back from you.     Veteran Intelligence Professionals for Sanity (VIPS) savage thecredibility of John Kerry and James Clapper, saying that Kerry's claims of Russian responsibility for shooting down MH17 are at odds with what they are being told by intelligence analysts still working for the government, and challenge Obama to release any evidence he has to support Kerry's version of events.   • Former U.S. President George W. Bush recently dedicated his Presidential Library in Dallas. The ceremony included speeches by President Obama, ex-President Bush, and every other living ex-president. But none of the speeches so much as mentioned to Iraq war — the undertaking that dominated George W. Bush’s presidency, and will define his historic legacy. This omission might be due, at least in part, to the fact that Mr. Bush is now a convicted war criminal who dares not travel abroad out of fear of being arrested. In February 2011, Bush was forced to cancel a scheduled appearance in Geneva, Switzerland after human rights groups filed a criminal complaint charging him with violating international treaties against torture. His trouble increased dramatically a year ago when Bush — along with former Vice President Dick Cheney, former Defense Secretary Donald Rumsfeld, and several other top Bush administration officials — were convicted of war crimes in absentia by a special war crimes tribunal in Kuala Lumpur, Malaysia.

What is the significance of that tribunal? Is its verdict legally binding?     I did not bookmark the news about this tribunal's decision last year because I mistakenly assumed that it was a mock trial, that it had no legal force.  But in this interview with renowned international law professor Francis Boyle, who served as co-prosecutor, I learned that the trial was legally constituted, and that international law requires other nations to either extradite Bush and his top officials or independently try them for war crimes and crimes against humanity. Note that Boyle gives Obama no points either, calling for his impeachment and prosecution. So we might look forward to a similar prosecution of Obama and his top officials after he leaves office.

  • Most Americans, their minds focused at the moment on the tragic slaughter of 20 young children aged 5 and 6, along with five teachers and a school principal in Connecticut by a heavily-armed psychotic 21-year-old, are blissfully unaware that their previous president, George W. Bush, along with five key members of his administration, were recently convicted in absentia of war crimes at a tribunal in Kuala Lumpur, Malaysia. They are unaware because the US corporate media have ignored the story, just as that same corporate media have failed to note that the crimes of which Bush, Vice President Dick Cheney, former Defense Secretary Donald Rumsfeld and five White House lawyers, were convicted all could apply equally well to current President Barack Obama and his administration. Bush, Cheney, White House counsel (and later Attorney General) Alberto Gonzalez and others were found guilty earlier this month of war crimes and crimes against humanity relating to the executive orders that launched the wars against Iraq and Afghanistan, as well as of authorizing and failing to punish torture and other war crimes by US forces, including the military and the CIA.
  • But as international law expert Francis Boyle, a professor of law at the University of Illinois, notes, under the Geneva Convention, failing to take action to prosecute those guilty of war crimes such as the “Crime against Peace” (invading a country that does not pose an imminent threat to the attacker), and torture, are war crimes in and of themselves. Speaking last week at a Summit Conference on Human Rights held at the University of the Sacred Heart in the US island colony of Puerto Rico, Boyle said US authorities, including President Obama, are engaged in an “ongoing criminal conspiracy under international law” both to cover up and protect criminals like Bush, Cheney and Rumsfeld, and to continue the commission of war crimes by the US government.
  • Obama, when initially campaigning in 2008 for the presidency, vowed that he wanted to restore the respect for the law and the Constitution, once elected President, he and his attorney general Eric Holder quickly made it clear that they were “looking forward, not backward,” and that there would be no prosecutions or indictments for war crimes of any Bush administration people.   The thing is, at that moment, both President Obama and AG Holder became war criminals themselves under the UN Charter and the Nuremberg Principles, which declare that covering up war crimes by prior government and military leaders, and failure to prosecute such war crimes, are in themselves war crimes.

  • But as Boyle noted in his address in San Juan, P.R., Obama, Vice President Joseph Biden, and the various secretaries of defense and state, the head of the CIA and the Pentagon Chiefs of Staff, as well as other Obama administration personnel, are also guilty of perpetrating ongoing war crimes themselves. Boyle accuses the Obama administration of continuing to conduct a “bogus” war on “international terrorism” including the ever escalating campaign of drone strikes in Pakistan, Afghanistan, Somalia, Yemen and other jurisdictions. He termed the president’s program of “targeted killings,” in which President Obama himself draws up the “kill list,” to be simply a case of “pure murder” under both traditional British common law and international law, and says these attacks constitute a “Crime against Humanity under Article 7(1)(a) of the Rome Statute for the International Criminal Court.”

    While the charge that Obama and other administration officials committed crimes under the Rome Statute for the International Criminal Court might seem odd because the U.S. never acceded to that treaty or to the jurisdiction of the ICC, the statute applies to those who commit war crimes within the jurisdictions of nations that have acceded to the treaty and to their superiors who either knew of should have known that such crimes would be committed and did not act to prevent them.  Pakistan  and Yemen have acceded to the treaty. The Rome treaty requires the arrest of those classified as war criminals under that treaty if they set foot in any nation that has acceded to the treaty. So just as Bush administration figures have done, Obama and crew will need to restrict where they travel after he leaves office.
