  • Australia’s criminlisation of dissent: anti-protest law is an ominous sign of the times Share This Tags AustraliaTasmania Brendan Gogarty (TC) : The Workplaces (Protection from Protesters) Bill – locally known as the “anti-protest” bill – was passed by Tasmanian parliament late on Tuesday night. The law was introduced as part of the government’s intention to “re-build Tasmania’s forestry industry”. That is a source of controversy and division in Tasmanian society. To achieve its aim, the government has committed itself to a wide legislative agenda. This includes: amending the uniform Defamation Act 2005 to allow large companies to sue protesters; defunding community and conservation organisations; and tearing up a “peace deal” between foresters and conservationists, which had been enacted into law before the 2014 election.
  • Recognising the potential return to hostilities, the government said it would “not try and appease” protesters, but would rather “toughen the law to deter them”. The anti-protest law is its chosen mechanism of deterrence. While such hard-line policies on political opposition are not new, the severity and breadth of the law to enforce such a policy arguably is. The shift from hard-line policy to hard-line law is worrisome in a constitutional democracy. The spread of state anti-bikie laws in Australia illustrates why this law is not just of concern for Tasmanians.
  • The new law covers all acts on, or acts inhibiting access to, a business premises (all public and private land, including forestry and mining lands) which are: … in furtherance of, or for the purposes of promoting awareness of or support for an opinion, or belief, in respect of a political, environmental, social, cultural or economic issue. Any such protest is subject to significant penalties if they interrupt “business activity”. While originally such sanctions were mandatory, the government agreed in the upper house to exchange these for discretionary penalties. However, the government agreed to this only on condition that the subsequent maximum penalties would be significantly increased. This was to “send a strong message” to protesters and the courts charged with punishing them. As a consequence, protesters who repeatedly interrupt business face fines of up to A$10,000 and four years in jail.

  • From its inception, the law has been criticised by domestic and international lawyers. Three United Nations human rights rapporteurs considered the bill to breach international law, one describing it as “shocking”. They considered the legislation, as originally envisioned, to be: … disproportionate and unnecessary [creating a] chilling effect of silencing dissenters … [who are] key to raising awareness about human rights, political, [and] social concerns … holding not just governments, but also corporations accountable. A wide range of legal professionals have voiced similar criticisms. While the removal of mandatory penalties alleviated some concerns, the larger concern about a law designed solely to punish people for protesting against controversial business activities – especially publicly supported and funded ones – remains.

  • Senior cabinet ministers are believed to be divided over whether Australia should sign up to an internationally funded infrastructure development bank that China is set to launch next month.
  • Australia has been under pressure from the United States not to participate in the new bank. The position of Prime Minister Tony Abbott is unclear on the issue, that could have ramifications for the final days of bedding down the Australia-China free trade agreement which the government wants concluded this year and preferably by the G20 leaders meeting in Brisbane next month. The Chinese plan is being viewed internationally in the wider geopolitical context of Chinese-US competition in the region. The Americans, who see the bank as potentially a way of China increasing its clout with countries in southeast Asia, have been strongly lobbying Australia to keep out of it. The issue is to come before cabinet imminently, as China plans to announce the bank at the APEC summit, which will be held in Beijing in November. Hockey will be in Beijing next week for the APEC finance ministers meeting, where the bank will be a topic of discussion.

The alleged spying took place in 2009, under the previous Australian government. "It is not possible that we can continue our co-operation when we are still uncertain that there is no spying towards us," Mr Yudhoyono said on Wednesday. He added he would also write to Australian Prime Minister Tony Abbott to seek an official explanation over spying allegations. Mr Abbot has said he regretted the embarrassment the media reports have caused. However, he also said that he does not believe Australia "should be expected to apologise for reasonable intelligence-gathering operations"

  • The Reserve Bank also said its website was "the subject of a denial of service attack". "The bank has protections for its website, so the bank website remains secure," a spokesman added. Australian media identified a Twitter user who described herself as a member of Anonymous Indonesia and appeared to claim responsibility for the attack.   • Meanwhile, Mark Textor, a campaign strategist who advised Australian Prime Minister Tony Abbott's Liberal Party came under fire for a series of provocative tweets that criticised Indonesia's handling of the spying row. Mr Textor wrote in a Twitter post: "Apology demanded from Australia by a bloke who looks like a 1970's Pilipino [sic] porn star and has ethics to match". The tweet has since been deleted. Australian media widely reported that he was referring to Indonesian Foreign Minister Marty Natalegawa, who has called for an apology from Australia over the spying claims.

  • The World is at a dangerous Crossroads. The Western military alliance is in an advanced state of readiness. And so is Russia. Russia is heralded as the “Aggressor”. US-NATO military confrontation with Russia is contemplated. Enabling legislation in the US Senate under “The Russian Aggression Prevention Act” (RAPA) has “set the US on a path towards direct military conflict with Russia in Ukraine.”  Any US-Russian war is likely to quickly escalate into a nuclear war, since neither the US nor Russia would be willing to admit defeat, both have many thousands of nuclear weapons ready for instant use, and both rely upon Counterforce military doctrine that tasks their military, in the event of war, to preemptively destroy the nuclear forces of the enemy. (See Steven Starr, Global Research, August 22, 2014) The Russian Aggression Prevention Act (RAPA) is the culmination of more than twenty years of US-NATO war preparations, which consist in the military encirclement of both Russia and China:
  • On July 24, in consultation with the Pentagon, NATO’s Europe commander General Philip Breedlove called for “stockpiling a base in Poland with enough weapons, ammunition and other supplies to support a rapid deployment of thousands of troops against Russia”.(RT, July 24, 2014). According to General Breedlove, NATO needs “pre-positioned supplies, pre-positioned capabilities and a basing area ready to rapidly accept follow-on forces”: “He plans to recommend placing supplies — weapons, ammunition and ration packs — at the headquarters to enable a sudden influx of thousands of Nato troops” (Times, August 22, 2014, emphasis added) Breedlove’s “Blitzkrieg scenario” is to be presented at NATO’s summit in Wales in early September, according to The London Times.  It is a “copy and paste” text broadly consistent with the  Russian Aggression Prevention Act (RAPA) which directs President Obama to:
  • “(1) implement a plan for increasing U.S. and NATO support for the armed forces of Poland, Estonia, Lithuania, and Latvia, and other NATO member-states; and (2) direct the U.S. Permanent Representative to NATO to seek consideration for permanently basing NATO forces in such countries.” (S.2277 — 113th Congress (2013-2014)) More generally, a scenario of military escalation prevails with both sides involved in extensive war games. In turn, the structure of US sponsored military alliances plays a crucial role in war planning. We are dealing with a formidable military force involving a global alliance of 28 NATO member states. In turn, the US as well as NATO have established beyond the “Atlantic Region” a network of bilateral military alliances with “partner” countries directed against Russia, China, Iran and North Korea.

  • t is worth noting that FLEETEX is one among several US-NATO naval war games directed against an unnamed enemy. In July, NATO conducted naval exercises in the Black sea, in an area contiguous to Russia’s maritime borders.
  • NATO’s “Breeze” formally hosted by Bulgaria took place from July 4 to July 13, with the participation of naval vessels from Greece, Italy, Romania, Turkey, the U.K. and the U.S. The underlying scenario was the “”destruction of enemy ships in the sea and organization of air defense of naval groups and coastal infrastructure.” The exercises were “aimed at improving the tactical compatibility and collaboration among naval forces of the alliance’s member states…” (See Atlantic Council , see also Russia, U.S. ships sail in competing Black Sea exercises, July 7, Navy Times 2014) Ironically, NATO’s July Black Sea games started on exactly the same day as those of the “unnamed enemy”[Russia], involving its Crimea Black sea fleet of some 20 war ships and aircraft:
  • Russia has made it clear they don’t welcome NATO’s presence in the Black Sea. Russia’s navy let it be known that it is following the exercises with reconnaissance aircraft and surveillance ships. “The aviation of the Black Sea Fleet is paying special attention to the missile cruiser USS Vella Gulf which, though not formally the flagship of the ‘Breeze’ exercises, effectively is leading them,” a Russian naval source told NTV.   • Since 2006, the US has been building up its weapons arsenal in Poland on Russia’s Western border (Kalingrad). The deployment of US forces in Poland was initiated  in July 2010 (within 40 miles from the border), with a view to training Polish forces in the use of US made Patriot missiles. (Stars and Stripes, 23 July 2010). In recent developments, the Pentagon announced in early August the deployment of US troops and National Guard forces to Ukraine as part of a military training operation. US-NATO is also planning further deployments of ground forces (as described by NATO General Breedlove) in Poland, Latvia, Estonia and Lithuania as well as in Georgia and Azerbaijan on Russia’s southern border. These deployments which are envisaged in the draft text of the “Russian Aggression Prevention Act” (RAPA) (S.2277 — 113th Congress (2013-2014)) are also part of a NATO “defensive” strategy in the case of a “Russian invasion”: Russia’s annexation of Crimea and the conflict in eastern Ukraine have alarmed Latvia, Estonia and Lithuania – like Ukraine, former Soviet republics with Russian-speaking minorities. NATO’s 28 leaders are expected to discuss plans to reassure Poland and the Baltics at a summit in Wales on Sept. 4-5.
  • Deployment on Russia’s Southern border is to be coordinated under a three country agreement signed on August 22, 2014 by Turkey, Georgia and Azerbaijan: Following the trilateral meeting of Azerbaijani, Turkish and Georgian defense ministers, Tbilisi announced that the three countries are interested in working out a plan to strengthen the defense capability. “The representatives of the governments of these three countries start to think about working out a plan to strengthen the defense capability,” Alasania said, adding that this is in the interests of Europe and NATO.“Because, this transit route [Baku-Tbilisi-Kars] is used to transport the alliance’s cargo to Afghanistan,” he said. Alasania also noted that these actions are not directed against anyone. (See Azeri News, August 22, 2014, emphasis added)
  • In the Far-east, Russia’s borders are also threatened by Obama’s “Pivot to Asia”. The “Pivot to Asia” from a military standpoint consists in extending US military deployments in the Asia-Pacific as well as harnessing the participation of Washington’s allies in the region, including Japan, South Korea and Australia. These countries have signed bilateral military cooperation agreements with Washington. As US allies, they are slated to be involved in Pentagon war plans directed against Russia, China and North Korea: Japan and South Korea are also both part of a grand U.S. military project involving the global stationing of missile systems and rapid military forces, as envisioned during the Reagan Administration. (Mahdi Darius Nazemroaya, Global Military Alliance: Encircling Russia and China, Global Research, October 5, 2007) This Pentagon strategy of military encirclement requires both centralized military decision making (Pentagon, USSTRATCOM) as well coordination with NATO and the various US regional commands.
  • On August 12, the US and Australia signed a military agreement allowing for the deployment of US troops in Australia. This agreement is part of Obama’s Pivot to Asia: The U.S. and Australia signed an agreement Tuesday [August 12] that will allow the two countries’ militaries to train and work better together as U.S. Marines and airmen deploy in and out of the country. “This long-term agreement will broaden and deepen our alliance’s contributions to regional security,” U.S. Defense Secretary Chuck Hagel said Tuesday. He described the U.S.-Australia alliance as the “bedrock” for stability in the Asia-Pacific region.
  • Ironically, coinciding with the announcement of the US-Australia agreement (August 12), Moscow announced that it would be conducting naval exercises in the Kuril Islands of the Pacific Ocean (which are claimed by Japan): “Exercises began involving military units in the region, which have been deployed to the Kuril Islands,” Colonel Alexander Gordeyev, a spokesman for Russia’s Eastern Military District, told news agency Interfax.   • While this renewed East-West confrontation has mistakenly been labelled a “New Cold War”, none of the safeguards of The Cold War era prevail. International diplomacy has collapsed. Russia has been excluded from the Group of Eight (G-8), which has reverted to the G-7 (Group of Seven Nations). There is no “Cold War East-West dialogue” between competing superpowers geared towards avoiding military confrontation. In turn, the United Nations Security Council has become a de facto mouthpiece of the U.S. State Department. US-NATO will not, however, be able to win a conventional war against Russia, with the danger that military confrontation will lead to a nuclear war. In the post-Cold war era, however, nuclear weapons are no longer considered as a  “weapon of last resort” under the Cold War doctrine of “Mutual Assured Destruction” (MAD).  Quite the opposite. nuclear weapons are heralded by the Pentagon as “harmless to the surrounding civilian population because the explosion is underground”. In 2002, the U.S. Senate gave the green light for the use of nuclear weapons in the conventional war theater.  Nukes are part of the “military toolbox” to be used alongside conventional weapons.
  • When war becomes peace, the world is turned upside down.  In a bitter irony, nukes are now upheld by Washington as “instruments of peace”. In addition to nuclear weapons, the use of chemical weapons is also envisaged. Methods of non-conventional warfare are also contemplated by US-NATO including financial warfare, trade sanctions, covert ops, cyberwarfare, geoengineering and environmental modification technologies (ENMOD). But Russia also has  extensive capabilities in these areas.
  • The timeline towards war with Russia has been set. The Wales NATO venue on September 4-5, 2014 is of crucial importance. What we are dealing with is a World War III Scenario, which is the object of the Wales NATO Summit, hosted by Britain’s Prime Minister David Cameron. The agenda of this meeting has already been set by Washington, NATO and the British government. It requires, according to PM David Cameron in a letter addressed to heads of State and heads of government of NATO member states ahead of the Summit that: “Leaders [of NATO countries] must review NATO’s long term relationship with Russia at the summit in response to Russia’s illegal actions in Ukraine. Hand has been dubbed “one of Australia’s most wanted fugitives,” but does Australia have the political will to seek the extradition of a man widely believed to have been a CIA asset? Initial indications appear to be no.

    Blast from the past! In ye olde days, The Wall Street Journal covered this scandal as it unfolded. Nugan Hand Bank was beyond shady; it was a classic Ponzi scheme and its board of directors was like a who's who of former high U.S. government officials. Its director of legal affairs was former CIA Director William Colby. Nugan Hand funneled drug money and illicit treasure for, inter alia, the Shah of Iran, Imelda Marcos, wealthy Saudis, gun-runners, et ilk. But it also bilked many Australians out of millions of dollars. Then poof! It was gone and so was co-founder Michael Hand. Turns out he's been living in Idaho under an assumed name, but using the same Social Security number he got as a teen-ager, which suggests that the FBI didn't look for him very hard when the Interpol and Australian arrest warrrants were received.

One of the World's Safest Places for Banking Is Rocked by Scandals - WSJ - 0 views

  • Commonwealth Bank of Australia ’s oversight of money transfers from that account to Lebanon last year was among many failures cited by the Australian federal government’s financial intelligence agency in its nearly US$530 million fine of the bank on Monday. If approved, the fine—meant to settle a lawsuit brought by the agency and founded on breaches of the country’s Anti-Money Laundering and Counter-Terrorism Act—would be the largest corporate civil penalty ever paid in Australia. Australia’s banks have long held a reputation for being among the world’s safest for investors. But a series of scandals over the past year has rocked the country’s top financial institutions. Commonwealth Bank has seen separate penalties for conduct in alleged interest-rate rigging and bad governance. On Friday, Australia & New Zealand Banking Group Ltd. said it would defend against criminal prosecution for alleged cartel conduct in a 2015 capital raising. A public inquiry into the sector, launched last autumn by Prime Minister Malcolm Turnbull, has heard accusations against Australia’s leading financial firms of inappropriate lending, collecting fees from dead customers for financial advice and lying to regulators. The tribunal has already claimed several big scalps. Beginning in late April, the chief executive, chairman and several board members at Australia’s largest wealth management company, AMP Ltd. , resigned after the company admitted it had misled regulators and been slow to compensate customers for fees charged for financial advice it didn’t deliver.
  • Disoriented investors now fear tighter regulation of a sector that has reliably returned a run of record annual underlying profits and solid dividends. The government has already beefed up penalties for corporate wrongdoing, including prison time, and strengthened the corporate regulator’s investigative powers. Commonwealth Bank shares recently tumbled to 5-year lows.

  • A non-binding international tribunal at The Hague has found Australia, the United Kingdom and the United States were complicit in facilitating the 1965 mass killings in Indonesia.
  • An estimated half a million people perished in what was one of the worst massacres of the 20th Century. The killings were triggered by a failed coup that led to the deaths of six army generals, followed by the mass targeting of communists.The International People's Tribunal at The Hague has now ruled that Indonesia committed crimes against humanity, but the finding is non-binding and carries no legal weight.The judges found allegations of "cruel and unspeakable murders" and the "unjustifiable imprisonment of hundreds of thousands of people without trial" was well founded."It has also been demonstrated that sexual violence, particularly against women, was systematic and routine, especially during the period 1965 to 1967," the report said.The judges found Indonesia responsible for the crimes and called for the current administration to apologise and to institute investigations and prosecutions of those perpetrators who are still alive."Furthermore, the archives should be opened and the real truth on these crimes against humanity should be established," the judges said.The tribunal's report found Australia, the US and the UK complicit by using propaganda to manipulate international opinion in favour of the Indonesian army.

  • Information about ordinary Australian citizens has been offered to Australia's global spying partners, according to the latest reports of leaked intelligence from US whistleblower Edward Snowden. In revelations that will add pressure to the Abbott government, which is still reeling from the Indonesian spying leak, The Guardian is reporting that Australia's surveillance agency has indicated it would share “bulk” data with its “5-eyes” partners – an intelligence-sharing network comprising the US, Britain, Canada, New Zealand and Australia.
  • “The document shows the partners discussing whether or not to share 'medical, legal or religious information',” the report states. Mr Snowden's document reveals notes of what was discussed at a “5-eyes” conference hosted by Britain's GCHQ in Cheltenham on April 22-23, 2008. According to the report, Australia's intelligence agency, then known as the Defence Signals Directorate, told its global intelligence partners it could share “bulk, unselected, unminimised metadata as long as there is no intent to target an Australian national”.
  • The partners also agreed that medical, legal or religious would not be automatically excluded from the sharing arrangement, but would instead be considered by the owning agency ‘‘on a case-by-case basis’’.  The Australian intelligence agency was reportedly willing to reveal more about its country's citizens, with fewer privacy restraints, than other countries. MH17: Malaysia's Barring from Investigation Reeks of Cover-up | nsnbc international - 0 views

  • It was a Malaysian jet, carrying Malaysian passengers, flown by Malaysian pilots, yet after Malaysia Airlines flight MH17 was shot down over Ukraine in July 2014, Malaysia has been systematically blocked from participating in the investigation, leaving an overwhelmingly pro-NATO bloc in charge of the evidence, investigation and outcome as well as the manner in which the investigation will be carried out. Despite the integral role Malaysia has played during several pivotal moments in the aftermath of the disaster, it appears that the closer to the truth the investigation should be getting, the further Malaysia itself is being pushed from both the evidence and any influence it has on the likely conclusions of the investigation. With the downed aircraft in question being Malaysian, Malaysia as a partner in the investigation would seem a given. Its exclusion from the investigation appears to be an indication that the investigation’s objectivity has been compromised and that the conclusions it draws will likely be politically motivated.
  • With the Dutch leading the investigation, the logic being that the flight originated from the Netherlands and the majority of the passengers were Dutch, it has formed a Joint Investigation Team (JIT). At the onset of its creation it seemed obvious that Malaysia would too be included, considering it lost the second largest number of citizens to the disaster and the plane itself was registered in Malaysia. Instead, JIT would end up comprised of Belgium, Ukraine, and Australia, specifically excluding Malaysia. Malaysia was both surprised and has protested its exclusion from JIT, and has repeatedly expressed a desire to be included directly in the investigation.

With both sides of the conflict possessing anti-aircraft weapons and with Kiev itself confirmed to possess weapons capable of reaching the altitude MH17 was flying at when it was allegedly hit, Kiev becomes a possible suspect in the investigation. Kiev’s inclusion in JIT represents a monumental conflict of interest.

  • And to compound this already glaring conflict of interest, it was revealed recently that an alleged “secret deal” was struck by JIT in which any member could bar the release of evidence. With all members of JIT being pro-NATO and decidedly arrayed against Moscow, such a “deal” could prevent crucial evidence from being revealed that would effect an otherwise distorted conclusion drawn by the investigators aimed specifically at advancing their greater political agenda in Eastern Europe. Had Malaysia been a member of JIT, the ability of other members to withhold evidence would have been greatly diminished and it is likely such a bizarre deal would not have been conceivable, real or imaged, in the first place.
  • With the ongoing conflict in Ukraine perceived as a proxy war between NATO and Moscow, JIT’s membership including the NATO-backed Kiev regime itself (a possible suspect), two NATO members (Belgium and the Netherlands) and Australia who has passed sanctions against Russia over the conflict, is a textbook case of conflict of interest.

Like so many other events in human history that took place amid a high stake political struggle, the downing of MH17 will be shrouded in mystery, mystery draped over the truth by the irresponsible leadership of NATO, and those in Washington, London and Brussels egging on the conflict in Ukraine to this very day.

Duncan Campbell reports from the United States on the secret Anglo-American plan for a global electronic spy system for the 21st century capable of listening in to most of us most of the time   American, British and Allied intelligence agencies are soon to embark on a massive, billion-dollar expansion of their global electronic surveillance system. According to information given recently in secret to the US Congress, the surveillance system will enable the agencies to monitor and analyse civilian communications into the 21st century. Identified for the moment as Project P415, the system will be run by the US National Security Agency (NSA). But the intelligence agencies of many other countries will be closely involved with the new network, including those from Britain, Australia, Germany and Japan--and, surprisingly, the People's Republic of China. New satellite stations and monitoring centres are to be built around the world, and a chain of new satellites launched, so that NSA and its British counterpart, the Government Communications Headquarters (GCHQ) at Cheltenham, may keep abreast of the burgeoning international telecommunications traffic.

They rely on near total interception of international commercial and satellite communications in order to locate the telephone or other messages of target individuals. Last month, a US newspaper, the Cleveland Plain Dealer, revealed that the system had been used to target the telephone calls of a US Senator, Strom Thurmond. The fact that Thurmond, a southern Republican and usually a staunch supporter of the Reagan administration, is said to have been a target has raised fears that the NSA has restored domestic, electronic, surveillance programmes. These were originally exposed and criticised during the Watergate investigations, and their closure ordered by President Carter. After talking to the NSA, Thurmond later told the Plain Dealer that he did not believe the allegation. But Thurmond, a right-wing Republican, may have been unwilling to rock the boat. Staff members of the Permanent Select Committee on Intelligence said that staff were "digging into it" despite the "stratospheric security classification" of all the systems involved. The Congressional officials were first told of the Thurmond interception by a former employee of the Lockheed Space and Missiles Corporation, Margaret Newsham, who now lives in Sunnyvale, California. Newsham had originally given separate testimony and filed a lawsuit concerning corruption and mis-spending on other US government "black" projects. She has worked in the US and Britain for two corporations which manufacture signal intelligence computers, satellites and interception equipment for NSA, Ford Aerospace and Lockheed. Citing a special Executive Order signed by President Reagan. she told me last month that she could not and would not discuss classified information with journalists. She was fired from Lockheed four years ago after complaining about the corruption, and sexual harassment.

It was anticipated, correctly, that electronic monitoring of communications signals would continue to be the largest and most important form of post-war secret intelligence, as it had been through the war. Although it is impossible for analysts to listen to all but a small fraction of the billions of telephone calls, and other signals which might contain "significant" information, a network of monitoring stations in Britain and elsewhere is able to tap all international and some domestic communications circuits, and sift out messages which sound interesting. Computers automatically analyse every telex message or data signal, and can also identify calls to, say, a target telephone number in London, no matter from which country they originate.
  • If Margaret Newsham's testimony is confirmed by the ongoing Congressional investigation, then the NSA has been behaving illegally under US law--unless it can prove either that Thurmond's call was intercepted completely accidentally, or that the highly patriotic Senator is actually a foreign spy or terrorist. Moreover NSA's international phone tapping operations from Menwith Hill and at Morwenstow, Cornwall, can only be legal in Britain if special warrants have been issued by the Secretary of State to specify that American intelligence agents are persons to whom information from intercepts must or should be given. This can not be established, since the government has always refused to publish any details of the targets or recipients of specific interception warrants.
  • Both British and American domestic communications are also being targeted and intercepted by the ECHELON network, the US investigators have been told. The agencies are alleged to have collaborated not only on targeting and interception, but also on the monitoring of domestic UK communications. Special teams from GCHQ Cheltenham have been flown in secretly in the last few years to a computer centre in Silicon Valley near San Francisco for training on the special computer systems that carry out both domestic and international interception.

And I have been told that junior intelligence staff can feed target names into the system at all levels, without any check on their authority to do so. Witnesses giving evidence to the Congressional inquiry have discussed whether the Democratic presidential contender Jesse Jackson was targeted; one source implied that he had been. Even test engineers from manufacturing companies are able to listen in on private citizens' communications, the inquiry was told. But because of the special Executive Order signed by President Reagan, US intelligence operatives who know about such politically sensitive operations face jail sentences if they speak out--despite the constitutional American protection of freedom of speech and of the press. And in Britain, as we know, the government is in the process of tightening the Official Secrets Act to make the publication of any information from intelligence officials automatically a crime, even if the information had already been published, or had appeared overseas first.

  • On Thursday, Attorney-General George Brandis introduced a new national security bill into the Senate. This is the fifth tranche of national security legislation to be introduced into parliament since July 2014.
  • This bill includes a host of new measures designed to address the evolving threat posed by terrorism. These include: a new offence of advocacy of genocide; amendments to the control order regime, so it applies to persons 14 years and older, and new measures to monitor controlees; and clarification of the basis for issuing a preventative detention order. But the bill’s most concerning aspect is the proposal to expand the secrecy provisions available to courts in control order proceedings. Keeping national security information secret in court Since 2004, legislation has been in place to deal with information that is likely to prejudice national security in federal court proceedings. This legislation created a special closed hearing procedure to determine whether national security information could be disclosed in court and, if so, in what form. This process regulates disclosure between the parties – that is, who gets to see what.
  • The bill expands this by creating special provisions that allow the court to consider sensitive material that the controlee and legal representative have not seen in proceedings to impose, confirm or vary a control order.   • “Secret evidence” is that which is not disclosed to an affected party and their legal representative. It is not new. A successful claim of public interest immunity, for example, results in secret material being excluded from the evidence presented in court. What is new in the anti-terror context is legislation that allows the courts to rely on secret evidence in control order proceedings.
