    MindTouch was by far and away the hottest property at the 2009 Web 2.0 Conference. And for good reason. They have figured out how to tap into the productivity value of enterprise collaborative networks. Most their underlying stuff is based on REST based data objects and services, but they also allow for proprietary data bindings. The key to MindTouch seemd to be the easy to fall into and use collaborative interface: imagine a workgroup project centered around a Web page filled with data objects, graphics and content, with each object also having a collabortaive conversation attached to it. Sounds complicated, but that's where the magic of MindTouch kicks in. It's simple. One the things that most impressed me was an interactive graph placed on one of the wiki project pages. The graph was being fed data from a local excel spreadsheet, and could be interacted with in real time. It was simple to change from a pie chart to a bar graph and so on. It was also possible to interact with the data itself and create what-if scenario's. Great stuff. With considerable persistence though, i was able to discover from Aaron that this interactivity and graphical richness was due to a Silverlight plug-in! From the article: "..... Canadian Spies Collect Domestic Emails in Secret Security Sweep - The Intercept - 0 views

  • Canada’s electronic surveillance agency is covertly monitoring vast amounts of Canadians’ emails as part of a sweeping domestic cybersecurity operation, according to top-secret documents. The surveillance initiative, revealed Wednesday by CBC News in collaboration with The Intercept, is sifting through millions of emails sent to Canadian government agencies and departments, archiving details about them on a database for months or even years. The data mining operation is carried out by the Communications Security Establishment, or CSE, Canada’s equivalent of the National Security Agency. Its existence is disclosed in documents obtained by The Intercept from NSA whistleblower Edward Snowden. The emails are vacuumed up by the Canadian agency as part of its mandate to defend against hacking attacks and malware targeting government computers. It relies on a system codenamed PONY EXPRESS to analyze the messages in a bid to detect potential cyber threats.

Members of the public routinely communicate with government employees when, for instance, filing tax returns, writing a letter to a member of parliament, applying for employment insurance benefits or submitting a passport application.

It goes into data stores for years or months at a time and then it can be used at any point in the future.” In a top-secret CSE document on the security operation, dated from 2010, the agency says it “processes 400,000 emails per day” and admits that it is suffering from “information overload” because it is scooping up “too much data.” The document outlines how CSE built a system to handle a massive 400 terabytes of data from Internet networks each month — including Canadians’ emails — as part of the cyber operation. (A single terabyte of data can hold about a billion pages of text, or about 250,000 average-sized mp3 files.)

It adds that it stores some kinds of metadata — data showing who has contacted whom and when, but not the content of the message — for “months to years.” The document says that CSE has “excellent access to full take data” as part of its cyber operations and is receiving policy support on “use of intercepted private communications.” The term “full take” is surveillance-agency jargon that refers to the bulk collection of both content and metadata from Internet traffic. Another top-secret document on the surveillance dated from 2010 suggests the agency may be obtaining at least some of the data by covertly mining it directly from Canadian Internet cables.     Well, not quite.  More IBM happy talk about interoperability and easy document interchange.  While i agree with the static versus interactive - collaborative document perspective, it's far more complicated. Today we have a world of "native"  docs and "visual" docs.   Native docs are bound to their authoring productivity environment, and are stubbornly NOT interchangeable.  Even for ODF and OOXML formats. Visual documents are spun from natives, and they are highly interchangeable, but interactively limited.  They lack the direct interaction of native authoring environments.  The Visual document phenomenon starts with PDF and the virtual print driver.  Any authoring application(s) in a productivity environment can print a PDF using the magic of the virtual print driver.   In 2008, when ISO stamped PDF with "accessibility tags", a new, highly interactive version of PDF was offically recognized.  We know this as "Tagged PDF".  And it has led the sweeping revolution of wide implementation of the paperless transaction process. The Visual Document phenomenon doesn't stop there.  The highly mobile WebKit revolution ushered in by the 2008 iPhone phenomenon led to wide acceptance of highly interactive and collaborative, but richly visual versions of SVG and HTML5-CSS3-JSON-JavaScript documents. Today we have SVG-HTML+ type visually immersive documents spun out of Server side publication presses such as FlipBoard, Cognito cComics, QWiki, Needle, Sports Illustrated, Push Pop Press, and TreeSaver to name but a few.   Clearly the visually immersive category of documents is exploding, but not for business - productivity documents.  Adobe has proposed a "CSS Regions" standard for richly immersive layout that might change that.  But mostly i think the problem for business documents, reports and forms is that they are "compound documents" bound to desktop productivity environments and workgroups. Google Releases Realtime API For Drive Apps - Development - Mobility - 0 views

  • Google has released a new application programming interface (API) that allows developers to implement real-time collaboration in Google Drive apps. Users of Google Docs, as well as Spreadsheets and Slides, now have the ability to edit a document at the same time others are doing so, and each can see the changes input by collaborators in real time. This is made possible by a technology called operational transformation, also featured in the now-discontinued Google Wave, which ensures the rapid transference of changes over a network.
  • Now developers who create apps that rely on Google Drive for storage can provide their users with the ability to interact and work together in real time. "With the new Google Drive Realtime API, you can now easily add some of the same real-time collaboration that powers Google Drive to your own apps," explained Brian Cairns, a software engineer at Google, in a blog post.   • SOPA, ACTA, the criminalization of sharing, and a myriad of other measures taken to perpetuate antiquated business models propping up enduring monopolies - all have become increasingly taxing on the tech community and informed citizens alike. When the storm clouds gather and torrential rain begins to fall, the people have managed to stave off the flood waters through collective effort and well organized activism - stopping, or at least delaying SOPA and ACTA. However, is it really sustainable to mobilize each and every time multi-billion dollar corporations combine their resources and attempt to pass another series of draconian rules and regulations? Instead of manning the sandbags during each storm, wouldn't it suit us all better to transform the surrounding landscape in such a way as to harmlessly divert the floods, or better yet, harness them to our advantage? In many ways the transformation has already begun.
  • While open source software and hardware, as well as innovative business models built around collaboration and crowd-sourcing have done much to build a paradigm independent of current centralized proprietary business models, large centralized corporations and the governments that do their bidding, still guard all the doors and carry all the keys.   • As impressive as a hydroelectric dam may be and as overwhelming as it may seem as a project to undertake, it will always start with but a single shovelful of dirt. The work required becomes in its own way part of the payoff - with experienced gained and with a magnificent accomplishment to aspire toward. In the same way, a communication network that runs parallel to existing networks, with global coverage, but locally controlled, may seem an impossible, overwhelming objective - and for one individual, or even a small group of individuals, it is. However, the paradigm has shifted. In the age of digital collaboration made possible by existing networks, the building of such a network can be done in parallel. In an act of digital-judo, we can use the system's infrastructure as a means of supplanting and replacing it with something superior in both function and in form.

    Byron Deeter is right, but perhaps he's holding back on his reasoning.  Silicon Valley is all about platform, and platform plays only come about once every ten to twenty years.  They come like great waves of change, not replacing the previous waves as much as taking away and running with the future.   Cloud Computing is the fourth great wave.  It will replace the PC and Network Computing waves as the future.  It is the target of all developers and entrepreneurs.   The four great waves are mainframe, workstation, pc and networked pc, and the Internet.  Cloud Computing takes the Internet to such a high level of functionality that it will now replace the pc-netwroking wave.  It's going to be enormous.  Especially as enterprises move their business productivity and data / content apps from the desktop/workgroup to the Cloud.  Enormous. The key was the perfect storm of 2008, where mobility (iPhone) converged with the standardization of tagged PDF, which converged with the Cloud Computing application and data model, which all happened at the time of the great financial collapse.   The financial collapase of 2008 caused a tectonic shift in productivity.  Survival meant doing more with less.  Particularly less labor since cost of labor was and continues to be a great uncertainty.  But that's also the definition of productivity and automation.  To survive, companies were compelled to reduce labor and invest in software/hardware systems based productivity.  The great leap to a new platform had it's fuel; survival. Social applications and services are just the simplest manifestation of productivity through managed connectivity in the Cloud.  Wait until this new breed of productivity reaches business apps!  The platform wars have begun, and it's for all the marbles.   • Then we put the data up, but the problem with Solr was it didn’t have a user interface, so we used Project Blacklight, which is open source software normally used by librarians. We used it for the journalists. It’s simple because it allows you to do faceted search—so, for example, you can facet by the folder structure of the leak, by years, by type of file. There were more complex things—it supports queries in regular expressions, so the more advanced users were able to search for documents with a certain pattern of numbers that, for example, passports use. You could also preview and download the documents. ICIJ open-sourced the code of our document processing chain, created by our web developer Matthew Caruana Galizia. We also developed a batch-searching feature. So say you were looking for politicians in your country—you just run it through the system, and you upload your list to Blacklight and you would get a CSV back saying yes, there are matches for these names—not only exact matches, but also matches based on proximity. So you would say “I want Mar Cabra proximity 2” and that would give you “Mar Cabra,” “Mar whatever Cabra,” “Cabra, Mar,”—so that was good, because very quickly journalists were able to see… I have this list of politicians and they are in the data!

As we begin the second week of reporting on the leak, Iceland’s Prime Minister has been forced to resign, Germany has announced plans to end anonymous corporate ownership, governments around the world launched investigations into wealthy citizens’ participation in tax havens, the Russian government announced that the investigation was an anti-Putin propaganda operation, and the Chinese government banned mentions of the leak in Chinese media. As the ICIJ-led consortium prepares for its second major wave of reporting on the Panama Papers, we spoke with Mar Cabra, editor of ICIJ’s Data & Research unit and lead coordinator of the data analysis and infrastructure work behind the leak. In our conversation, Cabra reveals ICIJ’s years-long effort to build a series of secure communication and analysis platforms in support of genuinely global investigative reporting collaborations.

  • We had the data in a relational database format in SQL, and thanks to ETL (Extract, Transform, and Load) software Talend, we were able to easily transform the data from SQL to Neo4j (the graph-database format we used). Once the data was transformed, it was just a matter of plugging it into Linkurious, and in a couple of minutes, you have it visualized—in a networked way, so anyone can log in from anywhere in the world. That was another reason we really liked Linkurious and Neo4j—they’re very quick when representing graph data, and the visualizations were easy to understand for everybody. The not-very-tech-savvy reporter could expand the docs like magic, and more technically expert reporters and programmers could use the Neo4j query language, Cypher, to do more complex queries, like show me everybody within two degrees of separation of this person, or show me all the connected dots…
  • We believe in open source technology and try to use it as much as possible. We used Apache Solr for the indexing and Apache Tika for document processing, and it’s great because it processes dozens of different formats and it’s very powerful. Tika interacts with Tesseract, so we did the OCRing on Tesseract. To OCR the images, we created an army of 30–40 temporary servers in Amazon that allowed us to process the documents in parallel and do parallel OCR-ing. If it was very slow, we’d increase the number of servers—if it was going fine, we would decrease because of course those servers have a cost.

It’s not open source, it’s licensed software, but we have an agreement with them, and they allowed us to work with it. It allows you to represent data in graphs. We had a version of Linkurious on our servers, so no one else had the data. It was pretty intuitive—journalists had to click on dots that expanded, basically, and could search the names.

NSA Spying Relies on AT&T's 'Extreme Willingness to Help' - ProPublica - 0 views

  • he National Security Agency’s ability to spy on vast quantities of Internet traffic passing through the United States has relied on its extraordinary, decades-long partnership with a single company: the telecom giant AT&T. While it has been long known that American telecommunications companies worked closely with the spy agency, newly disclosed NSA documents show that the relationship with AT&T has been considered unique and especially productive. One document described it as “highly collaborative,” while another lauded the company’s “extreme willingness to help.”
  • AT&T’s cooperation has involved a broad range of classified activities, according to the documents, which date from 2003 to 2013. AT&T has given the NSA access, through several methods covered under different legal rules, to billions of emails as they have flowed across its domestic networks. It provided technical assistance in carrying out a secret court order permitting the wiretapping of all Internet communications at the United Nations headquarters, a customer of AT&T.     The Barcelona World Mobility Conference is under way, and Microsoft is making a show of force.  They are hitting with features that support both "Social Network Hubs" (People Hub) and "Productivity Hubs" (Office Hub).  The key to Microsoft's Windows 7 Smartphone success is not that of new and exciting features competitive with Apple and Google smartphones.  No, the key feature that Microsoft owns is that of integration into legacy desktop productivity business systems based on the MSOffice productivity platform, and, more importantly, integration into the emerging Web centered but proprietary Microsoft Business Productivity Platform.  Stay tuned. excerpt on the new Windows 7 feature set:  The Office Hub lets you easily sync your documents between your phone and your PC. Office Hub comes with OneNote, for notetaking, Documents and Sharepoint for presentation collaboration.     Not sure what to make of this news.  XP continues to rule the desktop, Office 2003-2007 the productivity sweet spot.  I have used and researched Office 2010 and emphatically insist that it is a honey-trap for SharePoint and Live.com cloud-computing.  The MS-Cloud becomes THE default hard drive for Office 2010, with social networking-Facebook like contagion based on shared documents, crap collaboration and in-your-face insistent Live.com/Hotmail eMail.  Everytime i wanted to do something in Office 2010, there were 20 road blocks and hurdles MS put in the path forcing their Facebook-virus on my associates and myself.  Incredibly anti-productive.  Yet it's the only cloud-productivity solution capable of easing the difficult transition from desktop to cloud productivity environments.  Office 2010 does this by integrating into legacy desktop productivity  systems just enough that users will not realize until it's too late that a mine filed of hurdles and gotchas lies ahead. excerpt: Businesses are now deploying Office 2010 five times faster than they deployed Office 2007.     I wonder about those numbers. 6 million copies of Office 2010 sold; total of 750 million users of all versions. That makes 0.8 per cent of Office users who had upgraded between June and October of 2010? Five times faster than Office 2007 would make Office 2007 sales in the same period of its release cycle 0.16 per cent of the 750 million, assuming the number of users had remained constant. I suspect there are some apples and oranges in that wood pile, to mix a metaphor. E.g., retail sales that exclude sales to OEMs?

    Google programmers open source two components of the Google Wave messaging and collaboration prototype. One includes the Operational Transform, which forms the complex center of the Wave model. Google Wave is an example of the Pushbutton Web, where real-time communications rule the roost. Google July 24 said it released to open source the OT (Operational Transform) code, the framework that enables multiple people to edit a single document in real time across a wide-area network, as well as a basic client/server prototype that uses the wave protocol. The Google Wave Federation Protocol is an open extension to the XMPP core protocol, geared to allow near real-time communication of wave updates between two wave servers.

How Secret Partners Expand NSA's Surveillance Dragnet - The Intercept - 0 views

  • Huge volumes of private emails, phone calls, and internet chats are being intercepted by the National Security Agency with the secret cooperation of more foreign governments than previously known, according to newly disclosed documents from whistleblower Edward Snowden. The classified files, revealed today by the Danish newspaper Dagbladet Information in a reporting collaboration with The Intercept, shed light on how the NSA’s surveillance of global communications has expanded under a clandestine program, known as RAMPART-A, that depends on the participation of a growing network of intelligence agencies.
  • It has already been widely reported that the NSA works closely with eavesdropping agencies in the United Kingdom, Canada, New Zealand, and Australia as part of the so-called Five Eyes surveillance alliance. But the latest Snowden documents show that a number of other countries, described by the NSA as “third-party partners,” are playing an increasingly important role – by secretly allowing the NSA to install surveillance equipment on their fiber-optic cables. According to the intelligence community’s classified “Black Budget” for 2013, RAMPART-A enables the NSA to tap into three terabits of data every second as the data flows across the compromised cables – the equivalent of being able to download about 5,400 uncompressed high-definition movies every minute. In an emailed statement, the NSA declined to comment on the RAMPART-A program. “The fact that the U.S. government works with other nations, under specific and regulated conditions, mutually strengthens the security of all,” said NSA spokeswoman Vanee’ Vines. “NSA’s efforts are focused on ensuring the protection of the national security of the United States, its citizens, and our allies through the pursuit of valid foreign intelligence targets only.”

  • The secret documents reveal that the NSA has set up at least 13 RAMPART-A sites, nine of which were active in 2013. Three of the largest – codenamed AZUREPHOENIX, SPINNERET and MOONLIGHTPATH – mine data from some 70 different cables or networks. The precise geographic locations of the sites and the countries cooperating with the program are among the most carefully guarded of the NSA’s secrets, and these details are not contained in the Snowden files. However, the documents point towards some of the countries involved – Denmark and Germany among them. An NSA memo prepared for a 2012 meeting between the then-NSA director, Gen. Keith Alexander, and his Danish counterpart noted that the NSA had a longstanding partnership with the country’s intelligence service on a special “cable access” program. Another document, dated from 2013 and first published by Der Spiegel on Wednesday, describes a German cable access point under a program that was operated by the NSA, the German intelligence service BND, and an unnamed third partner.
  • The Danish and German operations appear to be associated with RAMPART-A because it is the only NSA cable-access initiative that depends on the cooperation of third-party partners. Other NSA operations tap cables without the consent or knowledge of the countries that host the cables, or are operated from within the United States with the assistance of American telecommunications companies that have international links. One secret NSA document notes that most of the RAMPART-A projects are operated by the partners “under the cover of an overt comsat effort,” suggesting that the tapping of the fiber-optic cables takes place at Cold War-era eavesdropping stations in the host countries, usually identifiable by their large white satellite dishes and radomes. A shortlist of other countries potentially involved in the RAMPART-A operation is contained in the Snowden archive. A classified presentation dated 2013, published recently in Intercept editor Glenn Greenwald’s book No Place To Hide, revealed that the NSA had top-secret spying agreements with 33 third-party countries, including Denmark, Germany, and 15 other European Union member states:

Bulk Collection Under Section 215 Has Ended… What's Next? | Just Security - 0 views

  • The first (and thus far only) roll-back of post-9/11 surveillance authorities was implemented over the weekend: The National Security Agency shuttered its program for collecting and holding the metadata of Americans’ phone calls under Section 215 of the Patriot Act. While bulk collection under Section 215 has ended, the government can obtain access to this information under the procedures specified in the USA Freedom Act. Indeed, some experts have argued that the Agency likely has access to more metadata because its earlier dragnet didn’t cover cell phones or Internet calling. In addition, the metadata of calls made by an individual in the United States to someone overseas and vice versa can still be collected in bulk — this takes place abroad under Executive Order 12333. No doubt the NSA wishes that this was the end of the surveillance reform story and the Paris attacks initially gave them an opening. John Brennan, the Director of the CIA, implied that the attacks were somehow related to “hand wringing” about spying and Sen. Tom Cotton (R-Ark.) introduced a bill to delay the shut down of the 215 program. Opponents of encryption were quick to say: “I told you so.”
  • But the facts that have emerged thus far tell a different story. It appears that much of the planning took place IRL (that’s “in real life” for those of you who don’t have teenagers). The attackers, several of whom were on law enforcement’s radar, communicated openly over the Internet. If France ever has a 9/11 Commission-type inquiry, it could well conclude that the Paris attacks were a failure of the intelligence agencies rather than a failure of intelligence authorities. Despite the passage of the USA Freedom Act, US surveillance authorities have remained largely intact. Section 702 of the FISA Amendments Act — which is the basis of programs like PRISM and the NSA’s Upstream collection of information from Internet cables — sunsets in the summer of 2017. While it’s difficult to predict the political environment that far out, meaningful reform of Section 702 faces significant obstacles. Unlike the Section 215 program, which was clearly aimed at Americans, Section 702 is supposedly targeted at foreigners and only picks up information about Americans “incidentally.” The NSA has refused to provide an estimate of how many Americans’ information it collects under Section 702, despite repeated requests from lawmakers and most recently a large cohort of advocates. The Section 215 program was held illegal by two federal courts (here and here), but civil attempts to challenge Section 702 have run into standing barriers. Finally, while two review panels concluded that the Section 215 program provided little counterterrorism benefit (here and here), they found that the Section 702 program had been useful.
  • There is, nonetheless, some pressure to narrow the reach of Section 702. The recent decision by the European Court of Justice in the safe harbor case suggests that data flows between Europe and the US may be restricted unless the PRISM program is modified to protect the information of Europeans (see here, here, and here for discussion of the decision and reform options). Pressure from Internet companies whose business is suffering — estimates run to the tune of $35 to 180 billion — as a result of disclosures about NSA spying may also nudge lawmakers towards reform. One of the courts currently considering criminal cases which rely on evidence derived from Section 702 surveillance may hold the program unconstitutional either on the basis of the Fourth Amendment or Article III for the reasons set out in this Brennan Center report. A federal district court in Colorado recently rejected such a challenge, although as explained in Steve’s post, the decision did not seriously explore the issues. Further litigation in the European courts too could have an impact on the debate.

  • The US intelligence community’s broadest surveillance authorities are enshrined in Executive Order 12333, which primarily covers the interception of electronic communications overseas. The Order authorizes the collection, retention, and dissemination of “foreign intelligence” information, which includes information “relating to the capabilities, intentions or activities of foreign powers, organizations or persons.” In other words, so long as they are operating outside the US, intelligence agencies are authorized to collect information about any foreign person — and, of course, any Americans with whom they communicate. The NSA has conceded that EO 12333 is the basis of most of its surveillance. While public information about these programs is limited, a few highlights give a sense of the breadth of EO 12333 operations: The NSA gathers information about every cell phone call made to, from, and within the Bahamas, Mexico, Kenya, the Philippines, and Afghanistan, and possibly other countries. A joint US-UK program tapped into the cables connecting internal Yahoo and Google networks to gather e-mail address books and contact lists from their customers. Another US-UK collaboration collected images from video chats among Yahoo users and possibly other webcam services. The NSA collects both the content and metadata of hundreds of millions of text messages from around the world. By tapping into the cables that connect global networks, the NSA has created a database of the location of hundreds of millions of mobile phones outside the US.
  • Given its scope, EO 12333 is clearly critical to those seeking serious surveillance reform. The path to reform is, however, less clear. There is no sunset provision that requires action by Congress and creates an opportunity for exposing privacy risks. Even in the unlikely event that Congress was inclined to intervene, it would have to address questions about the extent of its constitutional authority to regulate overseas surveillance. To the best of my knowledge, there is no litigation challenging EO 12333 and the government doesn’t give notice to criminal defendants when it uses evidence derived from surveillance under the order, so the likelihood of a court ruling is slim. The Privacy and Civil Liberties Oversight Board is currently reviewing two programs under EO 12333, but it is anticipated that much of its report will be classified (although it has promised a less detailed unclassified version as well). While the short-term outlook for additional surveillance reform is challenging, from a longer-term perspective, the distinctions that our law makes between Americans and non-Americans and between domestic and foreign collection cannot stand indefinitely. If the Fourth Amendment is to meaningfully protect Americans’ privacy, the courts and Congress must come to grips with this reality.

YouTube gets the yuck out in comments cleanup | Internet & Media - CNET News - 0 views

  • Laugh all you want, fuzzball, but Google is changing how YouTube uploaders manage comments on their videos. The new system, which began rolling out to a limited number of uploaders on Tuesday, favors relevancy over recency and introduces enhanced moderation tools. The new commenting system, which is powered by Google+ and was developed in collaboration between the YouTube and Google+ teams, provides several new tools for moderation, said Nundu Janakiram, product manager at YouTube. It will default to showing YouTube viewers the most relevant comments first, such as those by the video uploader or channel owner. "Currently, you see comments from the last random person to stop by," Janakiram said. "The new system tries to surface the most meaningful conversation to you. We're trying to shift from comments to meaningful conversations," he said.
  • He explained that three main factors determine which comments are more relevant: community engagement by the commenter, up-votes for a particular comment, and commenter reputation. If you've been flagged for spam or abuse, don't be surprised to find your comments buried, but that also means that celebrities who have strong Google+ reputations will be boosted above others. There's more to the system than just relevancy, though. Because the system is powered by Google+, comments made on posts with YouTube links in the social network will show up on YouTube itself. So, you'll see comments from people in your Google+ Circles higher up, too. Just because it's powered by Google+ doesn't mean that you'll lose your YouTube identity, though. "You are still allowed to use pseudonyms," said Janakiram, whether you're "a Syrian dissident or SoulPancake". Another feature, and one that speaks directly to YouTube's goal of fostering conversations, is that you'll be able to comment publicly or privately to people in your Circles. Replies will be threaded like Gmail. The hope is that new moderation tools will make it easier for video owners to guide the conversation, Janakiram explained. "There have been challenges in the past with certain comments and what's been shown there."

NZ Prime Minister John Key Retracts Vow to Resign if Mass Surveillance Is Shown - 0 views

  • In August 2013, as evidence emerged of the active participation by New Zealand in the “Five Eyes” mass surveillance program exposed by Edward Snowden, the country’s conservative Prime Minister, John Key, vehemently denied that his government engages in such spying. He went beyond mere denials, expressly vowing to resign if it were ever proven that his government engages in mass surveillance of New Zealanders. He issued that denial, and the accompanying resignation vow, in order to reassure the country over fears provoked by a new bill he advocated to increase the surveillance powers of that country’s spying agency, Government Communications Security Bureau (GCSB) — a bill that passed by one vote thanks to the Prime Minister’s guarantees that the new law would not permit mass surveillance.
  • Since then, a mountain of evidence has been presented that indisputably proves that New Zealand does exactly that which Prime Minister Key vehemently denied — exactly that which he said he would resign if it were proven was done. Last September, we reported on a secret program of mass surveillance at least partially implemented by the Key government that was designed to exploit the very law that Key was publicly insisting did not permit mass surveillance. At the time, Snowden, citing that report as well as his own personal knowledge of GCSB’s participation in the mass surveillance tool XKEYSCORE, wrote in an article for The Intercept: Let me be clear: any statement that mass surveillance is not performed in New Zealand, or that the internet communications are not comprehensively intercepted and monitored, or that this is not intentionally and actively abetted by the GCSB, is categorically false. . . . The prime minister’s claim to the public, that “there is no and there never has been any mass surveillance” is false. The GCSB, whose operations he is responsible for, is directly involved in the untargeted, bulk interception and algorithmic analysis of private communications sent via internet, satellite, radio, and phone networks.
  • A series of new reports last week by New Zealand journalist Nicky Hager, working with my Intercept colleague Ryan Gallagher, has added substantial proof demonstrating GCSB’s widespread use of mass surveillance. An article last week in The New Zealand Herald demonstrated that “New Zealand’s electronic surveillance agency, the GCSB, has dramatically expanded its spying operations during the years of John Key’s National Government and is automatically funnelling vast amounts of intelligence to the US National Security Agency.” Specifically, its “intelligence base at Waihopai has moved to ‘full-take collection,’ indiscriminately intercepting Asia-Pacific communications and providing them en masse to the NSA through the controversial NSA intelligence system XKeyscore, which is used to monitor emails and internet browsing habits.” Moreover, the documents “reveal that most of the targets are not security threats to New Zealand, as has been suggested by the Government,” but “instead, the GCSB directs its spying against a surprising array of New Zealand’s friends, trading partners and close Pacific neighbours.” A second report late last week published jointly by Hager and The Intercept detailed the role played by GCSB’s Waihopai base in aiding NSA’s mass surveillance activities in the Pacific (as Hager was working with The Intercept on these stories, his house was raided by New Zealand police for 10 hours, ostensibly to find Hager’s source for a story he published that was politically damaging to Key).

  • That the New Zealand government engages in precisely the mass surveillance activities Key vehemently denied is now barely in dispute. Indeed, a former director of GCSB under Key, Sir Bruce Ferguson, while denying any abuse of New Zealander’s communications, now admits that the agency engages in mass surveillance.
  • Meanwhile, Russel Norman, the head of the country’s Green Party, said in response to these stories that New Zealand is “committing crimes” against its neighbors in the Pacific by subjecting them to mass surveillance, and insists that the Key government broke the law because that dragnet necessarily includes the communications of New Zealand citizens when they travel in the region.
  • So now that it’s proven that New Zealand does exactly that which Prime Minister Key vowed would cause him to resign if it were proven, is he preparing his resignation speech? No: that’s something a political official with a minimal amount of integrity would do. Instead — even as he now refuses to say what he has repeatedly said before: that GCSB does not engage in mass surveillance — he’s simply retracting his pledge as though it were a minor irritant, something to be casually tossed aside:
  • When asked late last week whether New Zealanders have a right to know what their government is doing in the realm of digital surveillance, the Prime Minister said: “as a general rule, no.” And he expressly refuses to say whether New Zealand is doing that which he swore repeatedly it was not doing, as this excellent interview from Radio New Zealand sets forth: Interviewer: “Nicky Hager’s revelations late last week . . . have stoked fears that New Zealanders’ communications are being indiscriminately caught in that net. . . . The Prime Minister, John Key, has in the past promised to resign if it were found to be mass surveillance of New Zealanders . . . Earlier, Mr. Key was unable to give me an assurance that mass collection of communications from New Zealanders in the Pacific was not taking place.” PM Key: “No, I can’t. I read the transcript [of former GCSB Director Bruce Ferguson’s interview] – I didn’t hear the interview – but I read the transcript, and you know, look, there’s a variety of interpretations – I’m not going to critique–”
  • Interviewer: “OK, I’m not asking for a critique. Let’s listen to what Bruce Ferguson did tell us on Friday:” Ferguson: “The whole method of surveillance these days, is sort of a mass collection situation – individualized: that is mission impossible.” Interviewer: “And he repeated that several times, using the analogy of a net which scoops up all the information. . . . I’m not asking for a critique with respect to him. Can you confirm whether he is right or wrong?” Key: “Uh, well I’m not going to go and critique the guy. And I’m not going to give a view of whether he’s right or wrong” . . . . Interviewer: “So is there mass collection of personal data of New Zealand citizens in the Pacific or not?” Key: “I’m just not going to comment on where we have particular targets, except to say that where we go and collect particular information, there is always a good reason for that.”
  • From “I will resign if it’s shown we engage in mass surveillance of New Zealanders” to “I won’t say if we’re doing it” and “I won’t quit either way despite my prior pledges.” Listen to the whole interview: both to see the type of adversarial questioning to which U.S. political leaders are so rarely subjected, but also to see just how obfuscating Key’s answers are. The history of reporting from the Snowden archive has been one of serial dishonesty from numerous governments: such as the way European officials at first pretended to be outraged victims of NSA only for it to be revealed that, in many ways, they are active collaborators in the very system they were denouncing. But, outside of the U.S. and U.K. itself, the Key government has easily been the most dishonest over the last 20 months: one of the most shocking stories I’ve seen during this time was how the Prime Minister simultaneously plotted in secret to exploit the 2013 proposed law to implement mass surveillance at exactly the same time that he persuaded the public to support it by explicitly insisting that it would not allow mass surveillance. But overtly reneging on a public pledge to resign is a new level of political scandal. Key was just re-elected for his third term, and like any political official who stays in power too long, he has the despot’s mentality that he’s beyond all ethical norms and constraints. But by the admission of his own former GCSB chief, he has now been caught red-handed doing exactly that which he swore to the public would cause him to resign if it were proven. If nothing else, the New Zealand media ought to treat that public deception from its highest political official with the level of seriousness it deserves.
