SUMMARY: This notice revises a notice published on Friday, December 11, 2009, in the Federal Register (74 FR 65806), which announced, in part, that the public comment period for the NRC's Draft Supplemental Environmental Impact Statement (Draft SEIS) for the Moore Ranch In-Situ Recovery (ISR) Project closes on February 1, 2010. The purpose of this notice is to extend the public comment period on the Draft SEIS for the Moore Ranch ISR Project to March 3, 2010. DATES: Members of the public have been submitting written comments on the Draft SEIS for the Moore Ranch ISR Project since the initial notice of availability was published on December 11, 2009 (74 FR 65806). In response to multiple requests received in writing, the comment period on the Draft SEIS is being extended to March 3, 2010. The NRC will consider comments received or postmarked after that date to the extent practical. Written comments should be submitted as described in the ADDRESSES section of this notice. "

Supplement to the Environmental Impact Statements for a Geologic Repository for the Disposal of Spent Nuclear Fuel and High-Level Radioactive Waste at Yucca Mountain, Nye County, NV SUMMARY: The U.S. Department of Energy (DOE or the Department) is announcing its intent to prepare a Supplement to the ``Final Environmental Impact Statement for a Geologic Repository for the Disposal of Spent Nuclear Fuel and High-Level Radioactive Waste at Yucca Mountain, Nye County, Nevada'' (DOE/EIS-0250F, February 2002) (Yucca Mountain Final EIS), and the ``Final Supplemental Environmental Impact Statement for a Geologic Repository for the Disposal of Spent Nuclear Fuel and High-Level Radioactive Waste at Yucca Mountain, Nye County, Nevada'' (DOE/EIS-0250F-S1, July 2008) (Repository SEIS). The U.S. Nuclear Regulatory Commission (NRC) staff determined, pursuant to Section 114(f)(4) of the Nuclear Waste Policy Act of 1982, as amended (NWPA), that it is practicable to adopt, with further supplementation, DOE's environmental impact statements prepared in connection with the proposed repository at Yucca Mountain, Nye County, Nevada. The NRC staff concluded that the Yucca Mountain Final EIS and Repository SEIS did not address adequately all of the repository-related impacts on groundwater, or from surface discharges of groundwater, and therefore requested that DOE prepare a supplement to these environmental impact statements. Based on a review of the NRC staff evaluation, the Department has decided to prepare the requested supplement.

ACTION: Record of Decision. ----------------------------------------------------------------------- SUMMARY: In July 2008, the Department of Energy (Department or DOE) issued the ``Final Supplemental Environmental Impact Statement for a Geologic Repository for the Disposal of Spent Nuclear Fuel and High- Level Radioactive Waste at Yucca Mountain, Nye County, Nevada--Nevada Rail Transportation Corridor'' (DOE/EIS-0250F-S2) (hereafter referred to as the final Nevada Rail Corridor SEIS), the ``Final Environmental Impact Statement for a Rail Alignment for the Construction and Operation of a Railroad in Nevada to a Geologic Repository at Yucca Mountain, Nye County, Nevada'' (DOE/EIS-0369) (hereafter referred to as the final Rail Alignment EIS), and the ``Final Supplemental Environmental Impact Statement for a Geologic Repository for the Disposal of Spent Nuclear Fuel and High-Level Radioactive Waste at Yucca Mountain, Nye County, Nevada'' (DOE/EIS-0250F-S1) (hereafter referred to as the final Repository SEIS). The final Nevada Rail Corridor SEIS analyzed the potential impacts of constructing and operating a railroad for shipments of spent nuclear fuel, high-level radioactive waste, and other materials in the Mina corridor, and DOE concluded that the Mina corridor warranted further analysis at the alignment level. This further, more detailed analysis is presented in the final Rail Alignment EIS, which analyzed the potential environmental impacts of constructing and operating a railroad along rail alignments in both the Caliente and Mina rail corridors. "Ian, Evan & Alexander Corporation (IEA) has been awarded a contract by the U.S. Nuclear Regulatory Commission (NRC). Under this contract, IEA will provide assistance for license renewal to the NRC for Supplemental Environmental Impact Statement (SEIS) and Safety Evaluation Report (SER) documentation. Since its inception, the NRC has approved 104 applications for commercial nuclear power reactors. In compliance with the Atomic Energy Act, these licenses authorize operation for up to 40 years and are renewable for an additional 20 years. For each license application renewal (LRA), the NRC staff publishes one draft SEIS, one final SEIS, one SER with open items, and one final SER. These documents can be as long as 1,000 pages each. IEA will provide project management, technical editing, and desktop publishing services to support this renewal application process. DATES AND ADDRESSES: A public scoping meeting will be held on Tuesday, September 23, 2008, from 6 p.m. to 8 p.m. at the Southeast Community Facility, Alex L. Pitcher Community Room, 1800 Oakdale Avenue, San Francisco, California 94124. The purpose of the meeting will be to receive oral and written comments on environmental concerns that should be addressed in the SEIS.

The Nuclear Regulatory Commission has published its final Generic Environmental Impact Statement (GEIS) for in situ leach uranium recovery (ISR) operations in the Western United States, and is announcing a change in the agency's approach for environmental reviews of new ISR facilities. The agency has decided to issue full Supplemental Environmental Impact Statements (SEIS) for new recovery operations, instead of Environmental Assessments as originally planned. Under the National Environmental Policy Act, an Environmental Impact Statement is the most thorough review of potential impacts of a proposed licensing action on the environment. It involves extensive opportunities for public participation, with a draft report issued for public comment before a final report is prepared. "This new approach responds to public concerns that our review of generic impacts common to all uranium recovery actions would overlook unique characteristics of each individual site," NRC Chairman Gregory B. Jaczko said. "Citizens may have confidence in the certainty of our regulatory decisions, because our reviews will be as comprehensive and transparent as possible, with maximum opportunity for the public to participate in the process."

"The Tennessee Valley Authority has issued the Final Supplemental Environmental Impact Statement on the generation options associated with Bellefonte Nuclear Plant in north Alabama. With the statement final, four of five detailed studies are complete to support a future decision by the TVA Board of Directors about building or completing a reactor at Bellefonte. "Completing a nuclear unit is one option that would help us meet our customers' growing needs and provide a reliable and safe power source at significantly less cost per installed kilowatt than other generation options," said Ashok Bhatnagar, senior vice president of TVA's Nuclear Generation Development and Construction. "At the same time, additional nuclear generation leads to a reduction of our carbon footprint." The options being studied are whether to finish one of two partially built reactors at Bellefonte, build a newly designed Westinghouse Advanced Passive 1000 reactor there or take no action. "
