"The Atomic Safety and Licensing Board handling the Diablo Canyon nuclear reactor license renewal proceeding will hear oral argument May 26 on the request by the San Luis Obispo Mothers for Peace (SLOMFP) for an evidentiary hearing. The Board is an independent quasi-judicial arm of the Nuclear Regulatory Commission that decides legal challenges to applications and proposed licensing actions by the NRC. The oral argument will be presented by the lawyers representing SLOMFP, Pacific Gas & Electric (PG&E), and NRC staff. The session will begin at 8:30 a.m. PDT and may extend into the evening, if necessary, on Wednesday, May 26, in the San Luis Obispo County Board Chambers of the County Government Center, 1055 Monterey St. in San Luis Obispo. Although the oral argument will be limited to the lawyers for the litigants, the session is open to the public for observation. Early arrival is suggested to allow for security screening for all members of the public interested in attending. NRC policy prohibits signs, banners, posters or displays in the hearing room. PG&E submitted a license renewal application on Nov. 24, 2009, seeking a 20-year renewal of the operating licenses for Diablo Canyon Power Plant Units 1 and 2. The units are located approximately 12 miles southwest of San Luis Obispo. The Atomic Safety & Licensing Board is considering whether SLOMFP should be granted intervenor status in the proceeding. SLOMFP has submitted contentions challenging five aspects of PG&E's application, along with a request to waive two NRC regulations so as to allow the admission of two of the contentions. All parties have filed extensive legal briefs on these issues. Updated Version of the Guidance for Electronic Submissions to the NRC AGENCY: Nuclear Regulatory Commission (NRC). ACTION: Notice of availability. SUMMARY: The latest revision of the Guidance for Electronic Submissions to the NRC (Revision 4) is now available for review. The document can be found under Submittal Instructions at http://www.nrc.gov/site-help/ e-submittals.html. There are two significant changes to this document that are of interest to stakeholders. The first change covers the recommended file size for documents submitted to the NRC via the Electronic Information Exchange (EIE). In the past, the NRC suggested that the file size be limited to no more than 50 megabytes (MB). Based on operational experience, the NRC is modifying that recommendation and now suggests that files sent electronically to the NRC be no more than 15 MB. This revised guidance is intended to address issues that have arisen because of file size limitations

"The Nuclear Regulatory Commission staff is citing Florida Power & Light Co. for three violations and has proposed a $70,000 civil penalty against the company for an issue with the Unit 3 spent fuel pool racks at the Turkey Point nuclear power plant near Homestead, Fla., about 20 miles south of Miami. In December 2009, the NRC became aware that the neutron-absorbing material called Boraflex in the Unit 3 spent fuel pool had degraded below the levels spelled out in the plant's design basis documents. Although FPL had taken compensatory measures including the addition of soluble boron, the regulatory requirements that ensure the spent fuel pool remains safe were not met. The company's actions ensured the pool's condition did not pose an immediate safety concern, but the NRC found that FPL did not promptly identify and correct the condition. The NRC issued the civil penalty because the agency felt the company did not report the condition in a timely fashion. The NRC has determined that the issue has low to moderate safety significance and may result in additional inspections. The NRC staff held a regulatory and enforcement conference with FPL in April, and the company disagreed with some aspects of the NRC's evaluation. After considering information provided by FPL, the NRC staff issued its final determination including the three violations and $70,000 fine."

"The Nuclear Regulatory Commission has accepted for review the Early Site Permit (ESP) application for the Victoria County site near Victoria, Texas. The applicant, Exelon Nuclear Texas Holdings, submitted the application and associated information on March 25. The application, minus proprietary and security-related details, is available on the NRC Web site at: http://www.nrc.gov/reactors/new-reactors/esp/victoria.html. Exelon's ESP application seeks resolution of safety and environmental issues for the site, approximately 13 miles south of Victoria. Docketing the Victoria County application does not indicate whether the Commission will approve or reject the request. The NRC has established docket number 52-042 for this application, and the agency will subsequently publish a notice of opportunity to intervene in the required adjudicatory hearing. Petitions to intervene in a hearing may be filed within 60 days of the notice, by anyone whose interest may be affected by the proposed license and who wishes to participate as a party in the proceeding. The Nuclear Regulatory Commission announced today that an application for a 20-year renewal of the operating license for the Crystal River Nuclear Generating Plant Unit 3 is available for public review. NRC received an application for renewal of the operating license from Crystal River's operator, Progress Energy Florida, Inc., Dec. 18. The Crystal River Nuclear Generating Plant is a pressurized-boiling water reactor located in Crystal River, Fla. The current operating license will expire on Dec. 3, 2016. The application will be available electronically through the Agencywide Document Access and Management System through the NRC Web page at www.nrc.gov/reading-rm/adams/web-based.html. The accession number is ML090080053. A copy is also available at the Coastal Region Library, 8619 W. Crystal St., Crystal River, Fla. This is the U.S. Nuclear Regulatory Commission (NRC) staff's report of its monitoring of U.S. Department of Energy (DOE) non-high-level waste disposal actions in calendar year 2008, pursuant to Section 3116(b) of the Ronald W. Reagan National Defense Authorization Act for Fiscal Year 2005 (the NDAA). Section 3116 of the NDAA requires that DOE consult with the NRC on its non-high-level waste determinations and plans and that the NRC, in coordination with the covered States of South Carolina and Idaho, monitor disposal actions that DOE takes to assess compliance with NRC regulations in Title 10 of the Code of Federal Regulations (10 CFR) Part 61, "Licensing Requirements for Land Disposal of Radioactive Waste," Subpart C, "Performance Objectives." The NRC has prepared this report in accordance with NUREG-1854, "NRC Staff Guidance for Activities Related to U.S. Department of Energy Waste Determinations," issued August 2007.

NRC delays review of Entergy NY Indian Pt renewal * NRC delays environment report by three months * Delay due to new information from Entergy * Entergy filed for renewal in 2007 NEW YORK, Feb 12 (Reuters) - The U.S. Nuclear Regulatory Commission delayed the schedule for the review of the renewal of Entergy Corp's (ETR.N) Indian Point nuclear power reactors in New York, the NRC said in an email Friday. In a letter dated Feb. 2, the NRC told Entergy, of New Orleans, it delayed the issuance of the final supplemental environmental impact statement until May 31. Earlier, the NRC had expected to issue that report on Feb. 12. The statement is the last report needed before the commission can make a decision on Entergy's request to renew the reactors' operating licenses for an additional 20 years. The NRC said it delayed the report due to new information from Entergy including replacement aquatic data and revised severe accident mitigation analyses. In April 2007, Entergy filed with the NRC for the 20-year extensions of the units' original 40-year operating licenses."

The Nuclear Regulatory Commission (NRC) is denying a petition for rulemaking (PRM-20-26) submitted by James Salsman (petitioner). The petitioner requested that NRC amend its regulations to modify exposure and environmental limits for heavy metal radionuclides, in particular uranium. NRC is denying the petition because current NRC regulations provide adequate protection of public health and safety. The petitioner has not presented sufficient peer-reviewed data, pertinent to the types and levels of exposures associated with the concentration values used in NRC's regulations, to provide a sufficient reason for NRC to initiate a revision of its regulations. Thus, the NRC has decided not to expend limited resources on initiating a rulemaking at this time.

The Nuclear Regulatory Commission has suspended the principal portions of its reviews of Combined License (COL) applications for the River Bend site near Baton Rouge, La., and the Grand Gulf site near Vicksburg, Miss., following a request from the applicant, Entergy. The NRC has also cancelled a public meeting on the River Bend application originally planned for Thursday, Jan. 29, in St. Francisville, La. Entergy applied to the NRC in February 2008 for Grand Gulf, and in September 2008 for River Bend, for COLs to build and operate an Economic Simplified Boiling Water Reactor at each site. Entergy informed the NRC in a Jan. 9 letter that the company is currently considering alternate reactor technologies for both sites, and asked the agency to halt its work on the COL applications. In honoring this request, the NRC is conducting an orderly closeout of environmental reviews done for the Grand Gulf COL. The NRC will also continue interactions with the Federal Emergency Management Agency regarding emergency preparedness issues associated with the potential of additional reactors at the sites.

The Nuclear Regulatory Commission today announced the opportunity to request a hearing on an application to renew the operating license for the Cooper Nuclear Station for an additional 20 years. Cooper is a boiling water reactor located 23 miles south of Nebraska City, Neb. The plant owner, Nebraska Public Power District, submitted the renewal application Sept. 30. The current operating license for Cooper expires Jan. 18, 2014. The NRC staff has determined that the application contains sufficient information for the agency to formally "docket," or file, the application and begin its safety and environmental reviews. Docketing the application does not preclude requesting additional information as the reviews proceed, nor does it indicate whether the Commission will renew the license. A notice of opportunity to request a hearing has been published in the Federal Register, and the deadline for requesting a hearing is March 2, 2009. Petitions may be filed by anyone whose interest may be affected by the license renewal and who wishes to participate as a party in the proceeding. The Nuclear Regulatory Commission announced today that applications for a 20-year renewal of the operating licenses for Salem Nuclear Generating Station Units 1 and 2, and Hope Creek Generating Station are available for public review. Both plants are located in Hancock Bridge, N.J., about 18 miles south of Wilmington, Del. The current operating licenses for Salem Nuclear Generating Station Units 1 and 2 expire on Aug. 13, 2016 and April 18, 2020; and the Hope Creek license expires on April 11, 2026. The licensee, PSEG Nuclear LLC, submitted the renewal applications on August 18 for Salem and Hope Creek, respectively.
