"The U.S. Nuclear Regulatory Commission (NRC) has prepared an Environmental Assessment for the issuance of an Order as authorized by Section 274f of the Atomic Energy Act that would modify an Order issued to EnergySolutions, LLC (formerly Envirocare of Utah, Inc.) on May 7, 1999 (64 FR 27826; May 21, 1999). In accordance with 10 CFR 51.33, the NRC prepared a draft Finding of No Significant Impact (FONSI) for this amendment, which was published for public review and comment on October 7, 2009 (74 FR 51622). The public comment period closed on November 6, 2009. NRC received 12 comments from 4 commenters. The Order responds to a request by EnergySolutions dated September 26, 2006, to amend the package mass limits contained in Condition 4 of their 2006 Order, and to add or revise other conditions. The May 7, 1999, Order exempted EnergySolutions from certain NRC regulations and permitted EnergySolutions, under specified conditions, to possess waste containing special nuclear material (SNM), in greater quantities than specified in 10 CFR Part 150 at its facility located in Clive, Utah, without obtaining an NRC license under 10 CFR Part 70. As discussed below, the Order has been amended four times since it was issued in 1999. "

The Nuclear Regulatory Commission (NRC) will consider the issues raised in a petition for rulemaking (PRM) submitted by Westinghouse Electric Company LLC (petitioner) in the NRC's rulemaking process. The petition was dated November 4, 1999, and was docketed as PRM-50-69. The petitioner requested that Table 1 in 10 CFR Part 50, Appendix G, be amended by removing requirements related to the metal temperature of the closure head flange and vessel flange regions. Specifically, the petitioner requested that footnotes (2) and (6) be removed from Table 1.

The Nuclear Regulatory Commission (NRC) is denying the petition for rulemaking (PRM) filed by Mr. Raymond A. Crandall on May 17, 2007, and docketed on June 22, 2007 (Docket No. PRM-50-87). In his petition, the petitioner requested that the NRC amend the regulations that govern domestic licensing of production and utilization facilities to eliminate the specific criteria related to the radiological doses for control room habitability at nuclear power plants. The petitioner stated that the current deterministic radiological dose requirements for control room habitability have resulted in several negative safety consequences, including an increased risk to public safety. He requested that the NRC delete the 5 rem whole body dose limit and the 0.05 sievert (Sv) (5 rem) total effective dose equivalent (TEDE) limit specified in the current regulations.

Record of Decision for the Complex Transformation Supplemental Programmatic Environmental Impact Statement--Tritium Research and Development, Flight Test Operations, and Major Environmental Test Facilities AGENCY: National Nuclear Security Administration, U.S. Department of Energy. This ROD is based on information and analyses contained in the Complex Transformation Supplemental Programmatic Environmental Impact Statement (SPEIS) (DOE/EIS-0236-S4) issued on October 24, 2008 (73 FR 63460); comments received on the SPEIS; and other factors, including costs, technical and security considerations, and the missions of NNSA. The SPEIS analyzes the potential environmental impacts of alternatives for transforming the nuclear weapons complex into a smaller, more efficient enterprise that can respond to changing national security challenges and ensure the long-term safety, security, and reliability of the nuclear weapons stockpile.

Union Electric Company d/b/a Amerenue; Acceptance for Docketing of an Application for Combined License for Callaway Plant Unit 2 Nuclear Power Plant By letter dated July 28, 2008, as supplemented by letters dated September 24, 2008, November 14, 2008, and November 25, 2008, Union Electric Company d/b/a AmerenUE (AmerenUE), submitted an application to the U.S. Nuclear Regulatory Commission (NRC) for a combined license (COL) for a single unit of the U.S. Evolutionary Power Reactor (U.S. EPR) in accordance with the requirements contained in 10 CFR Part 52, ``Licenses, Certifications and Approvals for Nuclear Power Plants.'' This reactor will be identified as Callaway Plant Unit 2 and is to be located at the current Callaway County, Missouri site of the Callaway Power Plant. A notice of receipt and availability of this application was previously published in the Federal Register (73 FR 59677) on October 9, 2008, as corrected in Federal Register (73 FR 61444 on October 16, 2008).

Luminant Generation Company LLC; Comanche Peak Nuclear Power Plant Units 3 and 4 Combined License Application; Notice of Intent To Prepare an Environmental Impact Statement and Conduct Scoping Process Luminant Generation Company LLC (Luminant) has submitted an application for two combined licenses (COLs) to build Units 3 and 4 at its Comanche Peak Nuclear Power Plant (CPNPP) site, located on approximately 7,950 acres in Somervell and Hood Counties, Texas. CPNPP is located on Squaw Creek Reservoir, approximately 5.2 miles (mi) north of Glen Rose, Texas. Luminant submitted the application for the COL to the U.S. Nuclear Regulatory Commission (NRC) by letter dated September 19, 2008, pursuant to Title 10 of the Code of Federal Regulations (10 CFR) Part 52. A notice of receipt and availability of the application for the COLs, including the Environmental Report (ER), was published in the Federal Register on November 7, 2008 (73 FR 66276).

A requirement placed upon nuclear power reactor licensees by the NRC is that licensees must annually adjust the estimate of the cost of decommissioning their plants, in dollars of the current year, as part of the process to provide reasonable assurance that adequate funds for decommissioning will be available when needed. This report, which is revised periodically, explains the formula that is acceptable to the NRC for determining the minimum decommissioning fund requirements for nuclear power plants. The sources of information used in the formula are identified, and the values developed for the estimation of radioactive waste burial/disposition costs, by site and by year, are given.

In the Matter of AmerGen Energy Company, LLC; Exelon Generation Company, LLC (Three Mile Island Nuclear Station, Unit 1); Order Approving Transfer of License and Conforming Amendment I AmerGen Energy Company, LLC (AmerGen or licensee) is the holder of Facility Operating License No. DPR-50, which authorizes the possession, use, and operation of the Three Mile Island Nuclear Station, Unit 1 (TMI-1). AmerGen is a wholly owned subsidiary of Exelon Generation Company, LLC (EGC). The facility is located at the licensee's site in Dauphin County Pennsylvania.

The Department of Health and Human Services (HHS) gives notice of a decision to designate a class of employees at the Connecticut Aircraft Nuclear Engine Laboratory in Middletown, Connecticut, as an addition to the Special Exposure Cohort (SEC) under the Energy Employees Occupational Illness Compensation Program Act of 2000. On October 24, 2008, the Secretary of HHS designated the following class of employees as an addition to the SEC: All employees of the Department of Energy (DOE), its predecessor agencies, and DOE contractors or subcontractors who worked at the Connecticut Aircraft Nuclear Engine Laboratory in Middletown, CT, from January 1, 1958 through December 31, 1965 for a number of work days aggregating at least 250 work days occurring either solely under this employment or in combination with work days within the parameters established for one or more other classes of employees in the Special Exposure Cohort.

Amergen Energy Company, LLC, Three Mile Island Nuclear Station, Unit 1; Notice of Availability of the Draft Supplement 37 to the Generic Environmental Impact Statement for License Renewal of Nuclear Plants, and Public Meeting for the License Renewal of Three Mile Island Nuclear Station, Unit 1 Notice is hereby given that the U.S. Nuclear Regulatory Commission (NRC, Commission) has published a draft plant-specific supplement to the Generic Environmental Impact Statement for License Renewal of Nuclear Plants (GEIS), NUREG-1437, regarding the renewal of operating license DPR-50 for an additional 20 years of operation for Three Mile Island Nuclear Station, Unit 1 (TMI-1). TMI-1 is located in Londonderry Township in Dauphin County, Pennsylvania, on the northern end of Three Mile Island near the eastern shore of the Susquehanna River.
