The blind and other readers have the right for books to be presented to us in the format that is most useful to us, and we are not violating copyright law as long as we use readers, either human or machine, for private rather than public listening. The key point is that reading aloud in private is the same whether done by a person or a machine, and reading aloud in private is never an infringement of copyright. Amazon has taken a step in the right direction by including text-to-speech technology for reading e-books aloud on its new Kindle 2". More details are available on the Forbes website.

"We note, however, that the device itself cannot be used independently by a blind reader because the controls to download a book and begin reading it aloud are visual and therefore inaccessible to the blind. We urge Amazon to rectify this situation as soon as possible in order to make the Kindle 2 a device that truly can be used both by blind and sighted readers. By doing so, Amazon will make it possible for blind people to purchase a new book and begin reading it immediately, just as sighted people do."

Listening to the examples demonstrates that nobody non-blind and non-masochistic would use the Kindle 2 text-to-speech feature. And as blind people can't use the Kindle 2, what is the point of that feature - and of the Authors' Guild ruckus about it?

February 25, 2009. Text-to-speech (TTS) programs have been in use for a number of years, and they're improving. As Roy Blount says in an op-ed in today's New York Times, Kindle 2's TTS isn't Jim Dale reading "Harry Potter," but it's listenable. There's no need to take our word for it; have a listen to the sample below.

Amazon's Kindle, the first eBook reader that has really started to catch on with the public, deals almost exclusively with eBooks that have DRM. According to Ian Fried, the vice president of Amazon Kindle, customers don't seem to mind: "We've had very few if any customer responses that the choice we made with DRM was a problem." But DRM could become a problem if the Kindle goes bust - then all those people who bought Kindle eBooks with DRM will have no way to read them because no other device can open the files. Beyond that, not everyone agrees that DRM is a good business strategy. Publishing consultant Michael Shatzkin says it's tough to make the case that file-sharing reduces sales. He cites science fiction writer Cory Doctorow who, he says, "does the best he can to give away as much of his content as possible." And by giving it away, Shatzkin says, Doctorow's sales have skyrocketed.

Amazon's new world-beating gadget isn't the savior of the e-book, genre. It's a proprietary, market-protecting anomaly in a world of increasingly open standards and accessible media. Shame on you, Amazon. (...) The thing that e-books need, I'm convinced, is PDF. Secure, reflowable, customizable PDF. The reader devices need to be easy on the eyes, lightweight, and allow users to shunt any PDF to it, whether it's a specially formatted e-book or not. If I am paying $300+ for essentially a document storage device on steroids, I need to be able to put my own junk on it, too. (...)You might be lining your own pockets and making a few sales, Mr. Bezos, but you're also promoting confusion in the marketplace and causing division in the e-book space at a time when everyone else is pushing for convergence and open standards. Thanks for nothing.

1.1: Purpose and Scope In order for electronic-book technology to achieve widespread success in the marketplace, Reading Systems need to have convenient access to a large number and variety of titles. The Open Publication Structure (OPS) Specification describes a standard for representing the content of electronic publications. Specifically: * The specification is intended to give content providers (e.g. publishers, authors, and others who have content to be displayed) and publication tool providers, minimal and common guidelines that ensure fidelity, accuracy, accessibility, and adequate presentation of electronic content over various Reading Systems. * The specification seeks to reflect established content format standards. * The goal of this specification is to define a standard means of content description for use by purveyors of electronic books (publishers, agents, authors et al.) allowing such content to be provided to multiple Reading Systems and to insure maximum presentational equivalence across Reading Systems.

Amazon has announced that it will give authors and publishers the ability to disable the text-to-speech function on any or all of their e-books available for the Kindle 2. In February 2009, she was awarded the Columbia Scholastic Press Association Gold Key Award in a special ceremony at Columbia University for "outstanding devotion to the cause of the school press … and service above and beyond the call of delegated duty." Time and again, the Author's Guild has shown itself to be the epitome of a venal special interest group, the kind of grasping, foolish posturers that make the public cynically assume that the profession it represents is a racket, not a trade. This is, after all, the same gang of weirdos who opposed the used book trade going online. I think there's plenty not to like about the Kindle -- the DRM, the proprietary file format, both imposed on authors and publishers even if they don't want it -- and about Amazon's real audiobook section, Audible (the DRM -- again, imposed on authors and publishers even if they'd prefer not to use it). But if there's one thing Amazon has demonstrated, it's that it plans on selling several bazillion metric tons of audiobooks. They control something like 90 percent of the market. To accuse them of setting out to destroy it just doesn't pass the giggle-test.

What's really at stake with Kindle is Amazon's desire to re-invent itself as a company where the buying and selling of retail goods is not an end in itself but also a means by which to obtain valuable client data. In a more abstract sense, Amazon.com is actively producing laboring subjects in and around an everyday practice-the reading of books and periodicals-which to my knowledge has never shared as direct a relationship to economically productive activity as it does with Kindle.

The Authors Guild is pressuring Amazon to modify the Kindle 2 so that the synthetic speech function can only be used with the express authorization of the owner of the copyright of a work. A coalition of organizations that represent or work with persons with reading disabilities is organizing a protest to persuade the Guild to change its position. KEI supports the protest, and makes this statement on the Kindle 2 issue:

Closely aligned to the DRM issue is that there are a multiplicity of e-book formats, many of which cannot be read on other devices. As with DRM, consumer frustration is bound to arise if readers have to jump through hoops to read legally purchased books. This is perhaps not a problem at the moment, when the bulk of e-reader owners are early adopters, yet it will become more acute when the devices are more widely disseminated among less tech-savvy users. As Kassia Krozser, co-founder of medialoper.com who writes widely on digital entertainment issues, blogs on her publishing site Booksquare.com: "DRM, as implemented now, does not deter piracy. It does deter reading." She later reminds publishers that "your customers (again: the ones who give you money) don't read on one device, on one operating system, in one location. As you move forward with your digital initiatives, think about how real people read books."
