Do You Know Where Your Data Are? - WSJ.com - 0 views

    Do you know what your data did last night? Almost none of more than 27 million people who took the RealAge quiz realized that their personal health data was sold to drug companies, who in turned used that information for targeted e-mail marketing campaigns. There's a basic consumer protection principle at work here, and it's the concept of "unfair and deceptive" trade practices. Basically, a company shouldn't be able to say one thing and do another: sell used goods as new, lie on ingredients lists, advertise prices that aren't generally available, claim features that don't exist, and so on. RealAge's privacy policy doesn't mention anything about selling data to drug companies, but buried in its 2,400 words, it does say that "we will share your personal data with third parties to fulfill the services that you have asked us to provide to you." They maintain that when you join the website, you consent to receiving pharmaceutical company spam. But since that isn't spelled out, it's not really informed consent. That's deceptive. Cloud computing is another technology where users entrust their data to service providers. Salesforce.com, Gmail, and Google Docs are examples; your data isn't on your computer -- it's out in the "cloud" somewhere -- and you access it from your web browser. Cloud computing has significant benefits for customers and huge profit potential for providers. It's one of the fastest growing IT market segments -- 69% of Americans now use some sort of cloud computing services -- but the business is rife with shady, if not outright deceptive, advertising.

New Study Charges No Major Card Issuers Good for Consumers - 0 views

    "A new study from the Pew Charitable Trust has found that every one of the credit cards offered by the country's 12 largest credit card issuers are bad deals for consumers and have practices the Federal Reserve has defined as "unfair or deceptive." The Trusts' Health Group's Safe Credit Cards Project, titled STILL WAITING: "Unfair or Deceptive" Credit Card Practices Continue as Americans Wait for New Reforms to Take Effect also compared credit union card programs and found them sharply better. "Although credit unions control only a small portion of credit card outstandings, comparisons between credit union and bank product models illustrate options available to consumers and potential benchmarks for future regulatory rulemaking efforts," the organization said. The observed credit unions presented a distinct alternative to credit card pricing and other practices of the observed banks, the report said. "In July 2009, median advertised interest rates on cards from the 12 largest credit unions were between 9.90 and 13.75% annually, depending on a consumer's credit profile-approximately 20% lower than comparable bank rates," the report said. "Meanwhile, credit union penalties were generally less severe than those of banks." "

    Enforcing Privacy Promises: Section 5 of the FTC Act A key part of the Commission's privacy program is making sure companies keep the promises they make to consumers about privacy, including the precautions they take to secure consumers' personal information. To respond to consumers' concerns about privacy, many Web sites post privacy policies that describe how consumers' personal information is collected, used, shared, and secured. Indeed, almost all the top 100 commercial sites now post privacy policies. Using its authority under Section 5 of the FTC Act, which prohibits unfair or deceptive practices, the Commission has brought a number of cases to enforce the promises in privacy statements, including promises about the security of consumers' personal information. The Commission has also used its unfairness authority to challenge information practices that cause substantial consumer injury.

    Federal regulators on Tuesday met to hear about whether the benefits of cloud computing justify increased regulation, as privacy activists claim, or whether such an approach would do more harm than good. "We need to be smarter about dealing with technology, and cloud computing is posing (a) risk for us," said Hugh Stephenson, deputy director for international consumer protection at the Federal Trade Commission's Office of International Affairs. The FTC convened the two-day meeting in its offices here, which follows a series of similar workshops held in previous years on topics like spam, privacy, and behavioral advertising. The agency may file lawsuits to halt "unfair or deceptive acts or practices," meaning that if cloud computing is not unfair or deceptive, the FTC would likely not have jurisdiction. To secure personal information on the cloud, regulators may have to answer questions such as which entities have jurisdiction over data as it flows across borders, whether governments can access that information as it changes jurisdiction, and whether there is more risk in storing personal information in data centers that belong to a single entity rather than multiple data centers. The current panoply of laws at the state, national, and international level have had insufficient results; FTC Commissioner Pamela Jones Harbour cited a 2008 PricewaterhouseCoopers information security survey (PDF) in which 71 percent of organizations queried said they did not have an accurate inventory of where personal data for employees and customers is stored. With data management practices that are not always clear and are subject to change, companies that offer cloud-computing services are steering consumers into dangerous territory, said Marc Rotenberg, executive director of the Electronic Privacy Information Center.     Privacy is a central element of the FTC's consumer protection mission. In recent years, advances in computer technology have made it possible for detailed information about people to be compiled and shared more easily and cheaply than ever. That has produced many benefits for society as a whole and individual consumers. For example, it is easier for law enforcement to track down criminals, for banks to prevent fraud, and for consumers to learn about new products and services, allowing them to make better-informed purchasing decisions. At the same time, as personal information becomes more accessible, each of us - companies, associations, government agencies, and consumers - must take precautions to protect against the misuse of our information. The Federal Trade Commission is educating consumers and businesses about the importance of personal information privacy, including the security of personal information. Under the FTC Act, the Commission guards against unfairness and deception by enforcing companies' privacy promises about how they collect, use and secure consumers' personal information. Under the Gramm-Leach-Bliley Act, the Commission has implemented rules concerning financial privacy notices and the administrative, technical and physical safeguarding of personal information, and it aggressively enforces against pretexting. The Commission also protects consumer privacy under the Fair Credit Reporting Act and the Children's Online Privacy Protection Act.

    Google has moved forward the debate about privacy and Internet advertising, in its typical way, with deceptively simple engineering and a willingness to impose its way on others. On Wednesday, Google became the last of the big advertising companies to start keeping track of where Internet users surf online so ads can be shown to people based on what they might be interested in buying. In its approach to ad targeting, the company is responding to calls by the Federal Trade Commission and others to be more clear with users' information and control over the information it collects. It has created a window into part of its database, so users can see that Google has deduced that they are interested in "Anime & Manga" comics, or "Alternative-Punk-Metal" music or travel to Afghanistan. (Yes, those are on its list of 600 interest categories.) It also built technology to allow your browser to remember that you don't want Google (or its DoubleClick unit) to remember anything about you. It is more robust than the opt-out system used by many companies that rely on cookies in browsers. These are technical feats that other ad companies said would be too hard.

Parents can learn what Web sites must do to protect the privacy of kids younger than 13 under the Children's Online Privacy Protection Act (COPPA).     Those who are superstitious may believe that bad things happen on Friday the 13th, but we will leave it to each individual and entity to formulate conclusions regarding the Health Information Technology for Economic and Clinical Health Act (the HITECH Act), which Congress passed late on Friday, February 13, 2009, and President Obama officially signed into effect on February 17, 2009. The HITECH Act addresses various aspects relating to the use of health information technology (H.I.T.), including providing for federal funding by way of grants and incentive payments in order to promote H.I.T. implementation. This Alert focuses, however, on Subtitle D of the HITECH Act, which includes important, new and far-reaching provisions concerning the privacy and security of health information that will materially and directly affect more entities, businesses and individuals in more diverse ways than ever before. Businesses and individuals are being targeted by the scammers using web sites and emails, the organisation warned. Recipients are typically offered 'grants' from the government, and must either surrender bank details to get the funds or make a small payment. Advertisement"Web sites may advertise that they can help you get money from the stimulus fund. Many use deceptive names or images of president Obama and vice president Biden to suggest that they are legitimate. They are not," said Eileen Harrington, acting director of the FTC's Bureau of Consumer Protection. "Don't fall for it. If you do, you'll get scammed." Several variants have also been discovered that use malware to steal important data. These include pages that purport to offer links to sites that show how to get the federal funds. The pages are loaded with malware that can penetrate an improperly patched browser. "Consumers who may already have fallen for these scams should carefully check their credit card bills for unauthorised charges, and report the scam to the FTC," said Harrington.

    Sears Holdings has agreed to settle allegations it collected personal data from customers without adequate disclosures, the Federal Trade Commission said on Thursday. The FTC had accused Sears Holdings, created in 2005 with the merger of Sears and Kmart, of paying online customers $10 to allow the company to track their online browsing. But the FTC said Sears also collected information on non-Sears sites, such as online bank statements, drug prescription records and emails. "The software would also track some computer activities that were not related to the Internet," the FTC said in a statement. Sears did disclose all it would monitor in a lengthy user license agreement, but the FTC argued it was not enough. "The complaint charges that Sears' failure to adequately disclose the scope of the tracking software's data collection was deceptive and violates the FTC Act," the FTC said in a statement. Sears did not immediately reply to two telephone calls and one email seeking a comment. Under the settlement, Sears is required to destroy the data collected and make future disclosures more prominent.

    Naturally, privacy watchdogs answer the question in this post title with a resounding "Yes!" The answer is so emphatic, in fact, that the Center for Digital Democracy and U.S. Public Interest Research Group are filing a 52-page complaint with the FTC today alleging that mobile marketers collect so much "non personally identifiable information" that it infringes on users' privacy-and are "unfair and deceptive." Mobile devices, which know our location and other intimate details of our lives, are being turned into portable behavioral tracking and targeting tools that consumers unwittingly take with them wherever they go. (Shh! Don't tell them the FBI can remotely turn on the microphone of several cell phone brands and convert your phone into a roving bug, even when it's off!) But is the Internet private-and should it be? Is a profile that states that you are interested in outdoor rec and currently in the Santa Clara, CA, area an invasion of your privacy? And if so, should we ban all outdoor rec stores and centers in Santa Clara from collecting personally identifiable information like, say, a picture of you when you walk in their lobby? Should we prohibit all employees from asking your name and if you slip and mention it, make sure they never call you by it?
