    To help parents better understand their childrens' online privacy rights, the Federal Trade Commission has developed a new article, Protecting Kids' Privacy. The article is posted at OnGuardOnline.gov, a Web site sponsored by the federal government and the technology industry to help users stay on guard against Internet fraud, secure their computers, and protect their personal information. Parents can learn what Web sites must do to protect the privacy of kids younger than 13 under the Children's Online Privacy Protection Act (COPPA). For example, with very few exceptions, sites must get parents' permission if they want to collect or share their kids' personal information. Parents also will find tips for talking to their kids about online privacy, knowing what their kids are doing online, reporting a Web site that may be violating COPPA, and more.     Cablevision Systems announced it will expand its addressable-advertising capabilities to be able to deliver TV spots based on an individual subscriber's demographic data to some 500,000 households across the New York metro area this summer. The half-million-homes deployment -- representing cable's largest with addressable advertising to date -- comes after an 18-month trial covering 100,000 households, in which Cablevision tested the targeted form advertising for its Optimum-branded services. According to Cablevision, the trial showed a "double-digit" lift in sales in areas that received the addressable ads compared with homes that did not. After building out to 500,000 households across multiple zones within the New York DMA, Cablevision ultimately expects to bring addressability to all of its 2.8 million digital TV subscribers. The expanded deployment includes unidentified "top national brands," represented by media agencies GroupM, Starcom MediaVest Group and Universal McCann. Cablevision said it already has placed addressable ads from outside advertisers, but it has not identified those customers publicly. Addressable advertising, considered a holy grail of advertising in combining broad reach with demographic targeting, is also a core part of the mission for Canoe Ventures, the joint venture of Cablevision and five other MSOs. But Canoe, at least initially, will provide targeting at the zone level not the household level. Independent of Canoe, Cablevision is moving ahead on several advanced-advertising initiatives. Earlier this week Cablevision and its Rainbow Media programming unit announced plans to offer interactive advertising products and applications to media buyers during this year's upfronts, which would be available in inventory on five Rainbow networks and be viewable to Cablevision digital cable subscribers. CVS to pay $2.25 million to settle privacy case - 0 views

    Woonsocket-based CVS Caremark Corp., the largest U.S. drugstore chain, has agreed to pay $2.25 million to settle federal charges that company employees compromised customer privacy by throwing prescription records and drug bottles into open trash bins. The Federal Trade Commission said its investigation with the Health and Human Services Department followed media reports that trash bins behind CVS pharmacies contained pill bottles bearing patient names, credit-card and insurance information, and Social Security numbers. The company also did not have adequate policies for disposing of that information, and did not sufficiently train employees to dispose of the information properly, the agencies said. The items that were not properly discarded included pill bottles, medication instruction sheets, computer order forms, payroll information, job applications and credit-card and insurance information. Those labels and forms contained personal information including Social Security numbers and credit card and insurance information, and in some cases, driver's license numbers and account numbers. Names of the patients' doctors were also included. The settlement "will restore appropriate privacy protections to tens of millions of people across the country," FTC chairman William Kovacic said in a statement. "It also sends a strong message" that organizations "are required to secure consumers' private information," he said.

Thousands of Floridians may have been affected by hotel data breach -- South Florida Su... - 0 views

    Up to 21,000 Floridians may have been affected by a data breach at Wyndham Hotels & Resorts last year, prompting Attorney General Bill McCollum to ask consumers to keep a close eye on their credit statements. According to a statement released today, Wyndham reported to the Attorney General's Office that it contacted affected consumers in December and notified them that unauthorized access to Wyndham systems had potentially compromised their personal data on their debit and credit cards. The data breach has since been disabled. McCollum encouraged consumers to report any suspicious activity on their accounts to law enforcement. Affected consumers are encouraged to take precautionary steps, including obtaining a free fraud alert from one of the credit reporting agencies. Anyone who believes they may be a victim of identity theft should also request that the national credit bureaus place a fraud alert on their credit reports. Consumers should notify banks and creditors involved of questionable charges or accounts, keep records of all telephone calls and follow up in writing with credit bureaus, banks and creditors.

    The Department of Homeland Security's Data Privacy and Integrity Advisory Committee has offered DHS Secretary Janet Napolitano 16 recommendations on how to best address privacy issues currently facing the department. The panel stressed that "the need to update the government's legal authority to protect and defend cyberspace in the U.S. classified intelligence systems raise specific and sometimes significant privacy issues, including the conflict between transparency and redress." The committee has asked that each DHS component - such as the Federal Emergency Management Agency and Office of Intelligence and Analysis - have a designated privacy officer that would report to the head of the section. The committee also "encourages DHS to continue to work toward policy and functional interoperability in the development of new systems and when making major modifications to existing systems," according to a letter from the committee hand delivered to Napolitano. Additionally, the panel said the 1974 Privacy Act has "not kept pace with the evolution of technology and developments in how data is collected, used, shared and stored. To the extent the Secretary is asked to submit recommendations to Congress for making the act more relevant and effective, the committee recommends that the secretary seek guidance from the Privacy Office staff, who are experts in applying the Act's provisions throughout the department."     Stunned applicants filling out immigration forms are now being warned their personal information can be shared with the RCMP, national security and intelligence agents, and even foreign cops. The immigrants, many who arrive here from brutal regimes, are being told that they must sign a consent form or their requests will not be dealt with by federal immigration officials. One form, which was obtained by Sun Media, said the data can be shared with the Canada Border Services Agency, RCMP, Canadian Security Intelligence Service and foreign police. TARGET FRIENDS The information can be used to target friends or family members of those who say negative things about their homelands, said Jamal Kaker, of the Afghan Association of Ontario. "This will impact a lot of immigrants in many communities," he said yesterday. "This is scary because the information will get back to Afghanistan in no time." Toronto lawyer Guidy Mamann said it can be deadly for immigrants who give information that may be negative to their governments and are then refused by Canada. "The rights of these immigrants are being trampled," Mamann said. "All this was done under the radar without an announcement." He said foreign police -- some working for the worst regimes -- will be able to find out where their nationals who fled to Canada live and allegations they have leveled against their homelands. "All this information will now be shared," Mamann said. "The lives of immigrants and some Canadian citizens will become an open book." SIGN FORMS He said Canadian citizens are affected if they sign forms to sponsor a spouse or loved ones. "It's another nail in the coffin for civil rights in Canada," Mamann said.     Washington insiders say that the Obama administration will be more aggressive with actions to protect consumers online. Two consumer advocacy groups, the Center for Digital Democracy and the U.S. Public Interest Research Group, have asked the Federal Trade Commission to investigate behavioral targeting practices aimed at mobile phone users. The day the FTC received the request and one week before the Obama administration took office, four marketing and advertising associations announced their intent to create an enhanced set of self-regulatory principles for online behavioral advertising. The American Association of Advertising Agencies, Association of National Advertisers, Direct Marketing Association and Interactive Advertising Bureau are said to be reviewing the areas for self-regulation set forth in the FTC's proposed self-regulatory principles issued in December 2007.     Hackers broke into the Federal Aviation Administration's computer system last week, accessing the names and national identification numbers of 45,000 employees and retirees, a union leader says. Tom Waters, president of American Federation of State, County and Municipal Employees Local 3290, said FAA officials briefed union leaders Monday about the security breach. FAA spokeswoman Laura Brown confirmed the agency's computers were hacked last week. One file had the names and Social Security numbers of 45,000 employees and retirees on the FAA's rolls as of February 2006. Social Security is the U.S. government-directed pension system, and in the absence of a national identity card, other people's social security numbers can be used to steal identities for illicit purposes. Waters said the other file contained medical information that was encrypted. "These government systems should be the best in the world, and apparently they are able to be compromised," said Waters, an FAA contracts attorney. "Our information technology systems people need to take a long hard look at themselves and their capabilities. This is malpractice in their world." FAA officials told union leaders the incident was the first of its kind at the agency. But Waters said his union complained about three or four years ago about an incident in which employees received anti-union mail that used names and addresses that appeared to be generated from FAA computer files.

    The departments of Defense, State, and Health and Human Services have not met legal requirements meant to protect Americans' civil liberties, and a board that's supposed to enforce the mandates has been dormant since 2007, according to federal records. All three departments have failed to comply with a 2007 law directing them to appoint civil liberties protection officers and report regularly to Congress on the safeguards they use to make sure their programs don't undermine the public's rights and privacy, a USA TODAY review of congressional filings shows. An independent Privacy and Civil Liberties Oversight Board set up to monitor the departments hasn't met publicly since 2006; it no longer has members. Government missteps such as putting innocent people on terrorist watch lists and misusing administrative warrants, known as national security letters, "might have been dealt with much sooner if we had … cops on the beat to make sure there are standards that are being upheld," says Caroline Fredrickson, legislative director at the American Civil Liberties Union (ACLU). The lack of civil liberties officers at State and Health and Human Services is troubling because the departments hold passport and medical records, says James Dempsey, vice president of the Center for Democracy and Technology. "Security of that information is very important," he says, and these officers should monitor how it's used and shared. The Pentagon also has sparked concerns. Its Counterintelligence Field Activity office was criticized by the ACLU for wrongly tracking anti-war groups - a charge confirmed by the Pentagon in 2006.     In May 2008, the Office of the National Coordinator for Health Information Technology (ONC) awarded an approximately $450,000 contract to Booz Allen Hamilton to assess and evaluate the scope of the medical identity theft problem in the U.S. Medical Identity Theft Medical identity theft is a specific type of identity theft which occurs when a person uses someone else's personal health identifiable information, such as insurance information, Social Security Number, health care file, or medical records, without the individual's knowledge or consent to obtain medical goods or services, or to submit false claims for medical services. There is limited information available about the scope, depth, and breadth of medical identity theft. Dr. Robert Kolodner, National Coordinator for Health Information Technology, has noted that medical identity theft stories are being documented at an increasing rate, bringing to light serious financial, fraud, and patient care issues. ONC recognizes that health IT is an important tool to combat the threat of medical identity theft. We are seeking input from the public and other government agencies to better understand how health IT can be utilized to prevent and detect medical identity theft as well as build consumer trust in electronic health information exchange. ONC believes it is imperative to obtain a more comprehensive understanding of this issue from a variety of perspectives, and to create an open forum for dialogue to work proactively to address medical identity theft.     On Monday two women from Fort Pierce were arrested for committing 300 different cases of Identity theft on the Treasure Coast and South Florida. The two women go by the names of Tychell Letrein Robinson, 33 and Patrice V. Johnson, 26. According to the Federal Trade Commission, in 2007 Florida took fifth place in nation with regards to the number of ID theft victims per 100,000 residents. The FTC also estimated that about 9 million Americans have their identities stolen every year. The Fort Pierce Police Department, the Port St. Lucie Police Department, the Sheriff's Office as well as the U.S. Postal Service worked together in a two year investigation in order to track down these two criminals. Law enforcement agencies discovered that the arrested had somehow managed to steal the personal information of several victims and open new accounts in their names. Authorities believe that the women bought a lot of their identifying information from accomplices. In a news conference on Monday afternoon, Sheriff Ken Mascara mentioned that criminal circles were well aware that the arrested would pay accomplices $50 in exchange for peoples sensitive information. Authorities discovered that the two women met while they were both under the employment of Liberty Medical. Apparently Robinson headed the criminal operation and taught Johnson all she needed to know with regards to making thousands of dollars every week through identity theft. The arrested managed to target victims in Florida from Orlando to Clearwater and even Palm Beach. The majority of victims were from St. Lucie County and the Treasure Coast.     Online ad industry will probably continue to be a hot-button if FTC Commissioner Jon Leibowitz is named chairman. The Federal Trade Commission may strengthen its focus on online advertising and privacy if, as is expected, current FTC Commissioner Jon Leibowitz is named chairman of the agency. "He would certainly keep privacy and online advertising as a focus of the FTC, so I think [his potential appointment] does matter," said Mike Zaneis, VP of public policy at the Internet Advertising Bureau. Reports indicate Leibowitz will be named as head of the commission, replacing William Kovacic. Kovacic replaced former Chairman Deborah Platt Majoras in March 2008, when she left to join the private sector as VP and general counsel of Procter & Gamble. "A kind of privacy switch is going to go on at the FTC [once the new chairman is named] and they're going to engage in this issue in a much more serious way," said Center for Digital Democracy Executive Director Jeff Chester. "Under a Leibowitz regime we would get the kind of serious industry analysis that so far has been lacking from the Bush era approach." "Leibowitz has been a leader on privacy issues," said Zaneis, who expects a Leibowitz-run FTC to continue along the agency's current path of pushing for industry self-regulation, rather than creating new regulations for online advertisers. As a commissioner, Leibowitz, a Democrat, has not ruled out FTC regulation of things like behavioral targeting. During a two-day FTC forum held in Washington, D.C. in 2007, Leibowitz noted, "The marketplace alone may not be able to solve all problems inherent in behavioral marketing."     The Electronic Privacy Information Center formally asked the Federal Trade Commission on Tuesday to investigate the privacy and security safeguards of Gmail, Google Docs and other so-called cloud computing services offered by Google to consumers. The filing points to a security breach earlier this month that may have improperly exposed the files of Google Docs users to others. It asks the F.T.C. to look into the adequacy of privacy and security safeguards of Google's services and to require Google to be accountable for breaches. It also asks the agency to force Google to make its security policies more transparent and to disclose any breaches. It also asks the F.T.C. to enjoin Google from offering cloud computing services until it establishes verifiable safeguards. The full filing is available here. Marc Rotenberg, EPIC's executive director, said he was concerned about all cloud computing services, which encourage users to store a growing number of documents on the servers of companies like Google, Yahoo, Microsoft and others.     Federal regulators on Tuesday met to hear about whether the benefits of cloud computing justify increased regulation, as privacy activists claim, or whether such an approach would do more harm than good. "We need to be smarter about dealing with technology, and cloud computing is posing (a) risk for us," said Hugh Stephenson, deputy director for international consumer protection at the Federal Trade Commission's Office of International Affairs. The FTC convened the two-day meeting in its offices here, which follows a series of similar workshops held in previous years on topics like spam, privacy, and behavioral advertising. The agency may file lawsuits to halt "unfair or deceptive acts or practices," meaning that if cloud computing is not unfair or deceptive, the FTC would likely not have jurisdiction. To secure personal information on the cloud, regulators may have to answer questions such as which entities have jurisdiction over data as it flows across borders, whether governments can access that information as it changes jurisdiction, and whether there is more risk in storing personal information in data centers that belong to a single entity rather than multiple data centers. The current panoply of laws at the state, national, and international level have had insufficient results; FTC Commissioner Pamela Jones Harbour cited a 2008 PricewaterhouseCoopers information security survey (PDF) in which 71 percent of organizations queried said they did not have an accurate inventory of where personal data for employees and customers is stored. With data management practices that are not always clear and are subject to change, companies that offer cloud-computing services are steering consumers into dangerous territory, said Marc Rotenberg, executive director of the Electronic Privacy Information Center. Now, I'm not talking about the predilection of some people to share intimate details about themselves on social networking sites. I'm actually referring to the other things that might help contribute to your financial ruin. Those most enthusiastic about social networking are cybercriminals. They drool at the prospect of seeing the personal information of the 175 million people on Facebook. And they know how to use that information. For example, cybercrooks take great interest in the names of pets or grandparents on Facebook pages. That's the kind of information that banks and credit-card companies use to verify who you are when you bank online. "There are so many people on social-networking sites that it is becoming profitable for bad guys to go there," David Perry, global director of education at software security firm Trend Micro, recently told Agence France-Presse (AFP). "Bad guys can see all the things you post. You may be revealing personal information that is extremely valuable." Now Facebook has made revealing personal information even easier. This past week, it announced that users can change their privacy settings so everyone can see their profile. Marketers are spending billions worldwide to get the endorsements of key bloggers and groups on social networking sites. One tactic, used by Microsoft and others, is to send products to bloggers on 'long-term loans' on the understanding that they will comment about them on their sites. AdvertisementUnder the new regulations being proposed, such bloggers would be legally liable if they make untrue statements about the products or services. The companies too would face sanctions. "This impacts every industry and almost every single brand in our economy, and that trickles down into social media," Anthony DiResta, an attorney representing several advertising associations, told The Financial Times. This is the first revision of the rules on this kind of advertising by the FTC since 1980 and is needed, according to the organisation, because new forms of communication have opened up new fields to marketing. "The guides needed to be updated to address not only the changes in technology, but the consequences of new marketing practices," said Richard Cleland, assistant director for the FTC's division of advertising practices. " Word-of-mouth marketing is not exempt from the laws of truthful advertising." Advertisers are resisting the changes, however, which threaten a highly effective form of marketing new products and services. The rules, designed to reduce identity theft, requires that creditors and financial institutions create and implement an identity theft prevention program. The website describes the entities covered by the rule and provides information, articles and guidance to help entitles develop ID theft prevention programs, the FTC said in a news release. One of the resources on the site is a how-to guide that provides tips for identifying and stopping ID theft. The rules became effective Nov. 1 but will not be enforced by the FTC until May 1. Last October, the FTC extended the original Nov. 1 enforcement deadline because many companies were not prepared to meet the original requirements, the FTC said. Eduard Goodman, general counsel and chief privacy officer for vendor Identity Theft 911, told SCMagazineUS.com Friday that the FTC has been tight-lipped about how the rule is going to be enforced -- likely because they don't want companies looking for ways to get around it. Goodman said that based on his conversations with those in the industry, the FTC will likely enforce the rule on a case-by-case basis. The FTC maintains a database that tracks all identity theft cases reported to the agency. If they hear of instances of identity theft associated with a company, the FTC may ask for a copy of the company's identity theft prevention program, if any, Goodman said. If the entity has a program in place, the FTC will make a determination of whether it's adequate. The May 1 enforcement deadline extension applies to entities under the FTC's jurisdiction, which includes state-chartered credit unions. The extension did apply to the the majority of the estimated 11 million businesses that must comply with the requirements, Goodman has said
