Police Lineups Start to Face Fact - Eyes Can Lie - NYTimes.com - 0 views

    "The decision by New Jersey's Supreme Court last week to overhaul the state's rules for how judges and jurors treat evidence from police lineups could help transform the way officers conduct a central technique of police work, criminal justice experts say. In its ruling, the court strongly endorsed decades of research demonstrating that traditional eyewitness identification procedures are flawed and can send innocent people to prison. By making it easier for defendants to challenge witness evidence in criminal cases, the court for the first time attached consequences for investigators who fail to take steps to reduce the subtle pressures and influences on witnesses that can result in mistaken identifications. "No court has ever taken this topic this seriously or put in this kind of effort," said Gary L. Wells, a professor of psychology at Iowa State University who is an expert on witness identification and has written extensively on the topic. Other courts are likely to follow suit, and in November the United States Supreme Court will take up the question of identification for the first time since 1977. But changing how the nation's more than 16,000 independent law enforcement agencies handle the presentation of suspects to witnesses will be no easy task, many experts say."

Yet scientists have long cautioned that the brain is not a filing cabinet, storing memories in a way that they can be pulled out, consulted and returned intact. Memory is not so much a record of the past as a rough sketch that can be modified even by the simple act of telling the story. For scientists, memory has been on trial for decades, and courts and public opinion are only now catching up with the verdict. It has come as little surprise to researchers that about 75 percent of DNA-based exonerations have come in cases where witnesses got it wrong. This month, the Supreme Court heard its first oral arguments in more than three decades that question the validity of using witness testimony, in a case involving a New Hampshire man convicted of theft, accused by a woman who saw him from a distance in the dead of night. And in August the New Jersey Supreme Court set new rules to cope with failings in witness accounts, during an appeal by a man picked from a photo lineup, and convicted of manslaughter and weapons possession in a 2003 fatal shooting. Rather than the centerpiece of prosecution, witness testimony should be viewed more like trace evidence, scientists say, with the same fragility and vulnerability to contamination. Why is a witness's account so often unreliable? Partly because the brain does not have a knack for retaining many specifics and is highly susceptible to suggestion. We illustrate with our re-examination of the case of Jane Doe; she was videotaped twice, once when she was six years old and then eleven years later when she was seventeen. During the first interview she reported sexual abuse by her mother. During the second interview she apparently forgot and then remembered the sexual abuse. Jane's case has been hailed by some as the new proof of recovery of repressed or dissociated traumatic memories, and even as proof of the reliability of recovered memories of repeated abuse. Numerous pieces of "supporting evidence" were given in the original article for believing that the abuse occurred. Upon closer scrutiny, however, there are reasons to doubt not only the "supporting evidence," but also that the sexual abuse ever happened in the first place. Our analysis raises several general questions about the use of case histories in science, medicine, and mental health. There is a cautionary tale not only for those professionals who advance the case history, but also for those who base their theories on it or would readily accept it as proof."

    "FOR the last few weeks, the sex abuse scandal at Penn State and the harassment claims against the Republican presidential candidate Herman Cain have been fodder for discussion at my house. The same is true, I assume, around the country. Putting aside the specifics of each case, one question that has come up is, "What would I do?" That is, if I saw what seemed to be a crime or unethical act committed by a respected colleague, coach, teacher or friend, would I storm in and stop it? Would I call the authorities immediately? Would I disregard the potentially devastating impact on my job or workplace or beloved institution? Absolutely, most of us would probably reply. I think so, others might respond. And the most honest answer? I don't know. As much as we would like to think that, put on the spot, we would do the right - and perhaps even heroic - thing, research has shown that that usually isn't true. "People are routinely more willing to be critical of others' ethics than of their own," said Francesca Gino, an associate professor at Harvard Business School, and two other authors in the journal article "See No Evil: When We Overlook Other People's Unethical Behavior." The article appeared as a chapter in the book "Social Decision Making" (Psychology Press, 2009). "People believe they are more honest and trustworthy than others and they try harder to do good." But our faith in ourselves isn't borne out by history or research, something the Times columnist David Brooks pointed out in his column this week. The most well-known example of this in academia is the experiment conducted by the Yale University psychologist Stanley Milgram in the early 1960s. Working with rats, LeDoux's team first taught the animals to fear both a beep and a siren by giving them an electric shock every time either of the tones sounded. Then LeDoux gave half the rats the drug U0126, which is known to interfere with memory storage, and replayed the beep without electric shocks. A day later, when LeDoux played back both tones to the rats, the animals that hadn't been given the drug were still fearful of both sounds. Exactly how U0126 exerts its amnesiac effect is unknown, but it may block the synthesis of proteins that help strengthen connections between neurons and establish memories. The opportunity for erasure occurs during the act of retrieving a memory because that's when the memory is being updated and stabilized again for long-term storage. "Only those memories that are activated are vulnerable," LeDoux says. Drugs like U0126 may someday help sufferers of traumatic memories. A small group of human studies have been done on a drug called propranolol, which blocks the action of stress neurotransmitters that help cement memories in the brain, but LeDoux's work shows the potential for greater precision. "You might be able to reduce the traumatic impact of memories in people with PTSD," says LeDoux. "The good news is you wouldn't be erasing their memory bank." "

    "Is free will an illusion? Some leading scientists think so. For instance, in 2002 the psychologist Daniel Wegner wrote, "It seems we are agents. It seems we cause what we do… It is sobering and ultimately accurate to call all this an illusion." More recently, the neuroscientist Patrick Haggard declared, "We certainly don't have free will. Not in the sense we think." And in June, the neuroscientist Sam Harris claimed, "You seem to be an agent acting of your own free will. The problem, however, is that this point of view cannot be reconciled with what we know about the human brain." Many neuroscientists are employing a flawed notion of free will. Such proclamations make the news; after all, if free will is dead, then moral and legal responsibility may be close behind. As the legal analyst Jeffrey Rosen wrote in The New York Times Magazine, "Since all behavior is caused by our brains, wouldn't this mean all behavior could potentially be excused? … The death of free will, or its exposure as a convenient illusion, some worry, could wreak havoc on our sense of moral and legal responsibility." Indeed, free will matters in part because it is a precondition for deserving blame for bad acts and deserving credit for achievements. It also turns out that simply exposing people to scientific claims that free will is an illusion can lead them to misbehave, for instance, cheating more or helping others less.     "Henri Tajfel's interest in identity and group prejudice was sparked by his own experiences as a Polish Jew during the Second World War. As Professor of Social Psychology at Bristol university he developed a series of experiments known as the Minimal Group Studies, the purpose of which was to establish the minimum basis on which people could be made to identify with their own group and show bias against another. Claudia Hammond re-visits the Minimal Group Studies of 1971, where Tajfel and his collaborators got boys at a comprehensive school to view abstract paintings and then assigned them to the 'Klee' group or the 'Kandinsky' group, apparently because of the preferences they declared, but in fact entirely at random. Even though the boys didn't know who else was allocated to their group, they consistently awarded more points to their own group than to the other. So even though who belonged to which group was meaningless, they always tended to favour their own. This proved to be the first step towards Social Identity Theory, as developed by Henri Tajfel and John Turner, which stressed that our identification with groups varies according to how significant that group is at the time: if we're at war our national identity is important, at a football match it's our team identity that's to the fore... Tajfel died in 1982, but his legacy can be seen in the work many of his former students continue in the same field. Claudia Hammond hears from four of them, including Michael Billig - Professor of Social Sciences at Loughborough University, who helped run the 1971 studies, Miles Hewstone, Rupert Brown and Steve Reicher, Professors of Social Psychology at Oxford, Sussex and St Andrews respectively."

New research suggests that one difference is that the experts use more of their brains. In a study in the current issue of the journal PLoS One, a team of scientists in Germany showed experts and novices simple geometric objects and simple chess positions and asked the subjects to identify them. Reaction times were measured and brain activity was monitored using functional M.R.I. scans. On the identification of the geometric objects, the subjects performed the same, showing that the chess experts had no special visualization skills. When the subjects were shown the chess positions, the experts identified them faster. "

I'm delighted to see a scientist of Gazzaniga's stature provide these cautions. Others have also worried about the over-interpretations of brain scans, a question I raised in my Psychology Today blog posting "MRI's: The new phrenology?" How many times have you heard the expression "the brain lights up"? The brain does not behave in technicolor; it's just that the colors make for a better story when researchers are trying to sell their results to the public and funding agencies. It's important that we not over-interpret the pretty colors that brain scans provide but instead recognize that everyone's brain is a little bit different and that activity in a region doesn't signify exactly what a person is thinking or feeling. I hope that we will keep these cautions in mind even as brain scans become more and more commonplace. "

One evening, when he was about 7 years old, he stayed late at a friend's house, past the 6 p.m. curfew. The intellectual, cultural and scientific findings that land on the columnist's desk nearly every day. He turned his sweater inside out to hide the star and tried to sneak home. A German SS trooper approached him on the street, picked him up and gave him a long, emotional hug. The soldier displayed a photo of his own son, spoke passionately about how much he missed him and gave Kahneman some money as a sentimental present. The whole time Kahneman was terrified that the SS trooper might notice the yellow star peeking out from inside his sweater. Kahneman finally made it home, convinced that people are complicated and bizarre. He went on to become one of the world's most influential psychologists and to win the Nobel in economic science. Kahneman doesn't actually tell that childhood story in his forthcoming book. "Thinking, Fast and Slow" is an intellectual memoir, not a personal one. The book is, nonetheless, sure to be a major intellectual event (look for an excerpt in The Times Magazine this Sunday) because it superbly encapsulates Kahneman's research, and the vast tide of work that has been sparked by it. I'd like to use this column not to summarize the book but to describe why I think Kahneman and his research partner, the late Amos Tversky, will be remembered hundreds of years from now, and how their work helped instigate a cultural shift that is already producing astounding results. One thing she did recall: Her amnesia had started right after having sex with her husband just an hour before. While sex can be forgettable or mind-blowing, for some people, it can quite literally be both at the same time. The woman, whose case was reported in the September issue of The Journal of Emergency Medicine, was experiencing transient global amnesia, a rare condition in which memory suddenly, temporarily, disappears. People with transient global amnesia suffer no side effects, and the memory problems usually reverse themselves in the span of a few hours. It's a rare condition, affecting only about 3 to 5 people per 100,000 each year. But what makes transient global amnesia so eerie is that researchers aren't sure what causes it, or why patients remain otherwise chatty and alert while missing large chunks of their memories."

I will continue to disrupt at the highest levels." Solo scanned thousands of U.S. government machines and discovered glaring security flaws in many of them. U.S. attorney Paul McNulty called his campaign "the biggest military computer hack of all time." But despite his expertise, Solo didn't cover his tracks. He was soon traced to a small apartment in London. In March 2002, the United Kingdom's National Hi-Tech Crime Unit arrested Gary McKinnon, a quiet 36-year-old Scot with elfin features and Spock-like upswept eyebrows. He'd been a systems administrator, but he didn't have a job at the time of his arrest; he spent his days indulging his obsession with UFOs. In fact, McKinnon claimed that UFOs were the reason for his hack. Convinced that the government was hiding alien antigravity devices and advanced energy technologies, he planned to find and release the information for the benefit of humanity. He said his intrusion was detected just as he was downloading a photo from NASA's Johnson Space Center of what he believed to be a UFO.     Once, experts feared that young children exposed to more than one language would suffer "language confusion," which might delay their speech development. Today, parents often are urged to capitalize on that early knack for acquiring language. Upscale schools market themselves with promises of deep immersion in Spanish - or Mandarin - for everyone, starting in kindergarten or even before. Yet while many parents recognize the utility of a second language, families bringing up children in non-English-speaking households, or trying to juggle two languages at home, are often desperate for information. And while the study of bilingual development has refuted those early fears about confusion and delay, there aren't many research-based guidelines about the very early years and the best strategies for producing a happily bilingual child. But there is more and more research to draw on, reaching back to infancy and even to the womb. As the relatively new science of bilingualism pushes back to the origins of speech and language, scientists are teasing out the earliest differences between brains exposed to one language and brains exposed to two. Researchers have found ways to analyze infant behavior - where babies turn their gazes, how long they pay attention - to help figure out infant perceptions of sounds and words and languages, of what is familiar and what is unfamiliar to them. Now, analyzing the neurologic activity of babies' brains as they hear language, and then comparing those early responses with the words that those children learn as they get older, is helping explain not just how the early brain listens to language, but how listening shapes the early brain.     "The new technology is, to its critics, Orwellian. Others view it as a silver bullet against terrorism that could render waterboarding and other harsh interrogation methods obsolete. Some scientists predict the end of lying as we know it. Now, well before any consensus on the technology's readiness, India has become the first country to convict someone of a crime relying on evidence from this controversial machine: a brain scanner that produces images of the human mind in action and is said to reveal signs that a suspect remembers details of the crime in question. For years, scientists have peered into the brain and sought to identify deception. They have shot infrared beams through liars' heads, placed them in giant magnetic resonance imaging machines and used scanners to track their eyeballs. Since the Sept. 11 attacks, the United States has plowed money into brain-based lie detection in the hope of producing more fruitful counterterrorism investigations. The technologies, generally regarded as promising but unproved, have yet to be widely accepted as evidence - except in India, where in recent years judges have begun to admit brain scans. But it was only in June, in a murder case in Pune, in Maharashtra State, that a judge explicitly cited a scan as proof that the suspect's brain held "experiential knowledge" about the crime that only the killer could possess, sentencing her to life in prison."
