Für das Urheberrecht existieren traditionellerweise unterschiedliche Begründungslinien: Vor allem im angloamerikanischen Raum wird darin ein Mittel zur Kulturförderung gesehen, während der Rechtsschutz im kontinentaleuropäischen Raum als Konsequenz des Schaffensaktes verstanden wird. Diese Rechtfertigungen werden heute mit der Wahrnehmung konfrontiert, das Urheberrecht verhindere neue Werke eher als deren Schöpfung zu fördern. Weite Kreise betrachten den Rechtsschutz im Kontext des Internets als Anachronismus und reagieren mit Nichtbeachtung. Dessen ungeachtet erlebt der Urheberrechtsschutz in der westlichen Welt nach wie vor einen steten Ausbau, etwa in der Form verlängerter Schutzfristen. Wo führt dies hin? Sind die üblichen Rechtfertigungen des Urheberrechts heute noch zeitgemäss? Wäre es angezeigt, das traditionelle Urheberrecht ganz oder teilweise durch andere Systeme zu ersetzen oder zu überlagern? Vermöchte beispielsweise eine allgemeine Kulturabgabe einen Interessenausgleich zu bewirken? Im ersten Teil der Veranstaltung werden die grundlegenden Fragen aufbereitet und mögliche Lösungsansätze vorgestellt. Dazzling books with newly created art, text and multimedia will far outnumber works filled with historical materials. So, you build on a BY-NC work and register your copyright. You license your new work also BY-NC. Someone violates the copyright on your work. You sue. You are entitled to statutory damages right? You collect. Are you now guiilty of violating the NC licneses of the works yours built upon?

Doctorow's summary in his newsletter: "My latest Locus column, "Special Pleading," talks about the damned-if-you-do/ damned-if-you-don't nature of free ebook scepticism. When I started out giving away my print novels as free ebooks, critics charged that it only worked because I was so obscure that I needed the exposure. Now that I've had a book on the NYT bestseller list, a new gang of critics claim my strategy only works so well because I'm established and can afford to lose sales to free ebooks. The arguing tactic is called "special pleading," and it's a dirty rhetorical trick indeed!"

The victim is informed that an "Antipiracy foundation scanner" has found illegal torrents from the system.
