How Texas's Campus-Carry Law Poses a Threat to Students' and Professors' Freedom of Spe... - 0 views

  • A faculty working group at the University of Houston recently offered these recommendations to professors preparing for Texas’s new campus-carry law, set to take effect August 1.
  • The situation to which these recommendations are alluding—gun violence in response to controversial or otherwise difficult classroom discussions—is at this point only a hypothetical worst-case scenario. But critics of the legislation are still appalled: To abide by the law, and keep everyone safe in classrooms with armed students, faculty may ultimately have to resort to self-censorship.

  • the thing that struck me about the presidents’ answers wasn’t their legal insufficiency, but rather their stunning hypocrisy. And it’s that hypocrisy, not the presidents’ understanding of the law, that has created a campus crisis.
  • If Harvard, M.I.T. and Penn had chosen to model their policies after the First Amendment, many of the presidents’ controversial answers would be largely correct. When it comes to prohibiting speech, even the most vile forms of speech, context matters. A lot.
  • For example, surprising though it may be, the First Amendment does largely protect calls for violence. In case after case, the Supreme Court has held that in the absence of an actual, immediate threat — such as an incitement to violence — the government cannot punish a person who advocates violence. And no, there is not even a genocide exception to this rule.

  • But that changes for publicly-funded universities when speech veers into targeted harassment that is “so severe, pervasive, and objectively offensive that it effectively bars the victim’s access to an educational opportunity or benefit.”
  • The legal commentator David Lat explained further, writing: “If I repeatedly send antisemitic emails and texts to a single Jewish student, that is far more likely to constitute harassment than if I set up an antisemitic website available to the entire world.”
  • As a result, what we’ve seen on campus is a mixture of protected antisemitic (as well as anti-Islamic) speech and prohibited harassment.

  • Universities have censored conservatives? Then censor progressives too. Declare the extreme slogans of pro-Palestinian protesters to be harassment, and pursue them vigorously. Give them the same treatment you’ve given other groups who hold offensive views
  • But that’s the wrong answer. It’s doubling down on the problem.
  • At the same time, however, it would be wrong to carry on as if there isn’t a need for fundamental change. The rule cannot be that Jews must endure free speech at its most painful, while favored campus constituencies enjoy the warmth of college administrators and the protection of campus speech codes. The status quo is intolerable.

  • He writes that campuses should enact “clear and coherent” free speech policies. They should adopt a posture of “institutional neutrality” on public controversy.   • But reform can’t be confined to policies. It also has to apply to cultures. As Pinker notes, that means disempowering a diversity, equity and inclusion apparatus that is itself all too often an engine of censorship and extreme political bias
  • Most importantly, universities need to take affirmative steps to embrace greater viewpoint diversity. Ideological monocultures breed groupthink, intolerance and oppression.

He apologized for bothering her and she spoke to him of her discomfort: “Stuff like this happens way too often, where people just feel, like, threatened.”
  • That night Ms. Kanoute wrote a Facebook post: “It’s outrageous that some people question my being at Smith, and my existence overall as a woman of color.”
  • Her two-paragraph post hit Smith College like an electric charge. President McCartney weighed in a day later. “I begin by offering the student involved my deepest apology that this incident occurred,” she wrote. “And to assure her that she belongs in all Smith places.”
  • Ms. McCartney did not speak to the accused employees and put the janitor on paid leave that day.
  • Ms. McCartney appeared intent on making no such missteps in 2018. In an interview, she said that Ms. Kanoute deserved an apology and swift action, even before the investigation was undertaken. “It was appropriate to apologize,” Ms. McCartney said. “She is living in a context of ‘living while Black’ incidents.”The school’s workers felt scapegoated.
  • “It is safe to say race is discussed far more often than class at Smith,” said Prof. Marc Lendler, who teaches American government at the college. “It’s a feature of elite academic institutions that faculty and students don’t recognize what it means to be elite.”
  • The repercussions spread. Three weeks after the incident at Tyler House, Ms. Blair, the cafeteria worker, received an email from a reporter at The Boston Globe asking her to comment on why she called security on Ms. Kanoute for “eating while Black.” That puzzled her; what did she have to do with this?
  • The food services director called the next morning. “Jackie,” he said, “you’re on Facebook.” She found that Ms. Kanoute had posted her photograph, name and email, along with that of Mr. Patenaude, a 21-year Smith employee and janitor.
  • “This is the racist person,” Ms. Kanoute wrote of Ms. Blair, adding that Mr. Patenaude too was guilty. (He in fact worked an early shift that day and had already gone home at the time of the incident.) Ms. Kanoute also lashed the Smith administration. “They’re essentially enabling racist, cowardly acts.”
  • Ms. Blair was born and raised and lives in Northampton with her husband, a mechanic, and makes about $40,000 a year. Within days of being accused by Ms. Kanoute, she said, she found notes in her mailbox and taped to her car window. “RACIST” read one. People called her at home. “You should be ashamed of yourself,” a caller said. “You don’t deserve to live,” said another.
  • Smith College put out a short statement noting that Ms. Blair had not placed the phone call to security but did not absolve her of broader responsibility. Ms. McCartney called her and briefly apologized. That apology was not made public.
  • By September, a chill had settled on the campus. Students walked out of autumn convocation in solidarity with Ms. Kanoute. The Black Student Association wrote to the president saying they “do not feel heard or understood. We feel betrayed and tokenized.”
  • Smith officials pressured Ms. Blair to go into mediation with Ms. Kanoute. “A core tenet of restorative justice,” Ms. McCartney wrote, “is to provide people with the opportunity for willing apology, forgiveness and reconciliation.”
  • Ms. Blair declined. “Why would I do this? This student called me a racist and I did nothing,” she said.
  • On Oct. 28, 2018, Ms. McCartney released a 35-page report from a law firm with a specialty in discrimination investigations. The report cleared Ms. Blair altogether and found no sufficient evidence of discrimination by anyone else involved, including the janitor who called campus police.
  • Still, Ms. McCartney said the report validated Ms. Kanoute’s lived experience, notably the fear she felt at the sight of the police officer. “I suspect many of you will conclude, as did I,” she wrote, “it is impossible to rule out the potential role of implicit racial bias.”
  • Ms. McCartney offered no public apology to the employees after the report was released. “We were gobsmacked — four people’s lives wrecked, two were employees of more than 35 years and no apology,” said Tracey Putnam Culver, a Smith graduate who recently retired from the college’s facilities management department. “How do you rationalize that?”
  • Rahsaan Hall, racial justice director for the A.C.L.U. of Massachusetts and Ms. Kanoute’s lawyer, cautioned against drawing too much from the investigative report, as subconscious bias is difficult to prove. Nor was he particularly sympathetic to the accused workers.
  • “It’s troubling that people are more offended by being called racist than by the actual racism in our society,” he said. “Allegations of being racist, even getting direct mailers in their mailbox, is not on par with the consequences of actual racism.”
  • Ms. Blair was reassigned to a different dormitory, as Ms. Kanoute lived in the one where she had labored for many years. Her first week in her new job, she said, a female student whispered to another: There goes the racist.
  • Anti-bias training began in earnest in the fall. Ms. Blair and other cafeteria and grounds workers found themselves being asked by consultants hired by Smith about their childhood and family assumptions about race, which many viewed as psychologically intrusive. Ms. Blair recalled growing silent and wanting to crawl inside herself.
  • The faculty are not required to undergo such training. Professor Lendler said in an interview that such training for working-class employees risks becoming a kind of psychological bullying. “My response would be, ‘Unless it relates to conditions of employment, it’s none of your business what I was like growing up or what I should be thinking of,’” he said.
  • In addition to the training sessions, the college has set up “White Accountability” groups where faculty and staff are encouraged to meet on Zoom and explore their biases, although faculty attendance has fallen off considerably.

The other janitor, Mr. Patenaude, who was not working at the time of the incident, left his job at Smith not long after Ms. Kanoute posted his photograph on social media, accusing him of “racist cowardly acts.”

When any other students say they feel disempowered, the campus left’s impulse is to validate their statements. This does a huge disservice to everyone except white male students.
  • That isn’t to dismiss all complaints by Yale students. If contested claims that black students were turned away from a party due to their skin color are true, for example, that is outrageous.   • Nonwhite students weren’t spared; a group of them agreed to “like” Patrick’s comment in a show of support. A RAR member demanded those “non-black pocs [people of color]” explain themselves, calling them “anti-black pos [pieces of shit].”
  • As tensions continued to mount, one student decided to create an online forum to debate Hum 110. Laura, a U.S. Army veteran who served twice in Afghanistan, named the Facebook page “Reed Discusses Hum 110.” But it seemed like people didn’t want to engage publicly:
  • Another student wrote to Laura in a private message, “I'm coming into this as a ‘POC’ but I disagree with everything [RAR has been] saying for a long time [and] it feels as if it isn't safe for anyone to express anything that goes against what they're saying.”
  • Laura could relate—her father “immigrated from Syria and was brown”—so she stood in front of Hum 110 just before class to distribute an anonymous survey to gauge opinions about the protests, an implicit rebuke to RAR. Laura, who lives in the neighboring city of Beaverton, said she saw this move as risky. “I would’ve rethought what I did had I lived on campus,” she said.
  • If Facebook is no place to debate Hum 110, what about the printed page? Not so much: During the entire 2016–17 school year, not a single op-ed or even a quote critical of RAR’s methods—let alone goals—was published in the student newspaper, according to a review of archived issues. Another student, Isabel, ridiculed the group for its “unsolicited emotional theater.
  • I met the student who shot the video. A sophomore from India, he serves as a mentor for international students. (He asked not to be identified by name.) “A lot of them told me how disappointed they were—that they traveled such a long distance to come to this school, and worked so hard to get to this school, and their first lecture was canceled,” he said. He also recalled the mood last year for many students of color like himself: “There was very much a standard opinion you had to have [about RAR], otherwise people would look at you funny, and some people would say stuff to you—a lot of people were called ‘race traitors.
  • Another student from India, Jagannath, responded to the canceled lecture by organizing a freshmen-only meeting on the quad. “For us to rise out of this culture of private concerns, hatred, and fear, we need to find a way to think, speak, and act together,” he wrote in a mass email. Jagannath told me that upperclassmen warned him he was “very crazy” to hold a public meeting, but it was a huge success; about 150 freshmen showed up, and by all accounts, their debate over Hum 110 was civil and constructive. In the absence of Facebook and protest signs, the freshmen were taking back their class.
  • In the intervening year, the Reed administration had met many of RAR’s demands, including new hires in the Office of Inclusive Community, fast-tracking the reevaluation of the Hum 110 syllabus that traditionally happens every 10 years, and arranging a long series of “6 by 6 meetings”—six RAR students and six Hum professors—to solicit ideas for that syllabus. (Those meetings ended when RAR members stopped coming; they complained of being “forced to sit in hours of fruitless meetings listening to full-grown adults cry about Aristotle.”)

  • “In this context, Nazi is not a slur. It’s not an attack. It’s an accurate description,” he said.
  • “Most of these people are malignant contrarians who have a lot of loyalty and trust issues,”
  • It was the perfect recipe for a television segment: the white supremacist, the black students arguing against him. “It was an easy story,”
  • At a campus town hall meeting, Evans recalled, Heimbach had said: “I am going to bleed this university white.”
  • “It sent shockwaves through the campus,” Evans said. As a result of Heimbach’s activism, he thought attendance at campus events dropped. People didn’t want to leave their rooms.
  • Evans countered Heimbach’s views publicly – and, as a result, he was featured on white supremacist websites, one of which dubbed him a “black supremacist”.
  • Evans said he had received a death threat at his college graduation, and walked across the stage fearing that he would be shot in front of his mother and his girlfriend.
  • Jonathan Munshaw, who covered Heimbach’s early tactics for the Towson student newspaper, said he only ever verified one Towson student who was part of the White Student Union: Heimbach himself. But students on campus truly believed that the group was much bigger, Munshaw said – and they were terrified.

  • Trump was Heimbach’s dream come true. In early 2016, Heimbach had described the presidential candidate as the “gateway drug” to outright white nationalism.
  • “I don’t think I ever even heard him say the word white,” she said. Instead, it was: “‘People are coming in, close the border, and they’re taking our jobs and our communities’ – it was very dog whistle-y.
  • When the protester’s group finally raised their banners toward the end of Trump’s speech, Heimbach’s group immediately rushed them, not just to tear down their anti-Trump banner but also to punch them, several protesters alleged in a lawsuit. The onslaught “was so intense and violent” that the protester, who was in the back, said she was overwhelmed.
  • The protester said Heimbach and his group had insinuated their way into the middle of the crowd, and when a moment of tension arrived they suddenly turned violent, and other men around them mirrored their behavior, shouting, pushing, furious. Trump, from the stage, had called: “Get ’em out!”
  • American neo-Nazis look at Golden Dawn’s rise and take hope. Heimbach has met with far-right nationalists across Europe, he said, including three visits with Golden Dawn over the past three years.
  • Heimbach can put on a show of moderation. He doesn’t think everyone should have to live in a white ethno-state. That’s just his preference. He doesn’t hate other races. He just thinks that black Americans have, on average, a “lower future time orientation”.

  • He is a Holocaust denier, believing that the systematic murder of 6 million European Jews by the Nazi regime did not happen, that it’s all a “Bolshevik conspiracy”. He has expressed sympathy for the racist killer Dylann Roof and praised white supremacist Norwegian mass murderer Anders Breivik.
  • Real Christianity, he said, is “patriarchal, homophobic, racist and antisemitic”. He laughed. “I see that as a good thing.”
  • Heimbach lives in Paoli, Indiana, with his wife and son; his fellow party leader, Matt Parrott; and Jason, the young white nationalist who moved from New York City to join him and who now edits his video projects and produces white nationalist music. Three other white families who support their views have moved to Paoli to join them, Heimbach said – two from northern Indiana, one from Virginia. They try to get together weekly for board game nights and home-brewed mead. They play Risk – “of course, the battle of world domination” – and Cards Against Humanity.
  • “My parents didn’t exactly know what I was thinking or up to. I think in modern America, [there are] a tremendous amount of parents who would be horrified and scandalized with what their young sons and daughters are reading on white nationalist forums or reading on the Daily Stormer,” he said.
  • “My folks said that they didn’t raise me like this, that they didn’t approve of this and that I had to make a choice, if I was going to do this or choose my family. And I said to them, this is choosing my family, because I want my siblings and their grandchildren to have a future. They didn’t understand.”
  • Heimbach’s speech was well received. But as the night went on, the divide between the traditional neo-Nazi groups and the new, internet-savvy “alt-right” began to show. The speeches grew so dull, despite the periodic Nazi salutes and chants of white power, that most of the younger extremists melted away into the dark, leaving a smaller and smaller audience to listen to old Nazis drone on.
  • In the political analysis of Trump voters, neo-Nazi advocates like Heimbach and some on the left tend to agree: Trump voters are a white identity movement, motivated to vote for him at least in part by outright racism, a claim Trump supporters vehemently reject.
  • The locals in Pikeville greeted the influx with outrage and shock. Outside a Pikeville tattoo parlor the day before the neo-Nazis were coming to town, a group of local men expressed disgust at the agenda and concern that the event would discourage students of different races from coming to the local university.
  • Both women were increasingly angry that Heimbach had chosen to come to Kentucky to spread his message. “He’s targeting us,” Wooton said, “because he thinks that we’re stupid.” “And he’s wrong about that,” Porter said.
