In the Dock, in Paris « EJIL: Talk! - 0 views

  • My entire professional life has been in the law, but nothing had prepared me for this. I have been a tenured faculty member  at the finest institutions, most recently Harvard and NYU.  I have held visiting appointments from Florence to Singapore, from Melbourne to Jerusalem. I have acted as legal counsel to governments on four continents, handled cases before the highest jurisdictions and arbitrated the most complex disputes among economic ‘super powers.’
  • Last week, for the first  time I found myself  in the dock, as a criminal defendant. The French Republic v Weiler on a charge of Criminal Defamation.
  • As Editor-in-Chief of the European Journal of International Law and its associated Book Reviewing website, I commissioned and then published a review of a book on the International Criminal Court. It was not a particularly favorable review. You may see all details here.  The author of the book, claiming defamation, demanded I remove it. I examined carefully the claim and concluded that the accusation was fanciful. Unflattering? Yes. Defamatory, by no stretch of imagination. It was my ‘Voltairian’ moment. I refused the request. I did offer to publish a reply by the author. This offer was declined.

  • Three months later I was summoned to appear before an Examining Magistrate in Paris based on a complaint of criminal defamation lodged by the author. Why Paris you might ask? Indeed. The author of the book was an Israeli academic. The book was in English. The publisher was Dutch. The reviewer was a distinguished German professor. The review was published on a New York website.
  • Beyond doubt, once a text or image go online, they become available worldwide, including France. But should that alone give jurisdiction to French courts in circumstances such as this? Does the fact that the author of the book, it turned out, retained her French nationality before going to live and work in Israel make a difference? Libel tourism – libel terrorism to some — is typically associated with London, where notorious high legal fees and punitive damages coerce many to throw in the towel even before going to trial. Paris, as we would expect, is more egalitarian and less materialist. It is very plaintiff friendly.
  • In France an attack on one’s honor is taken as seriously as a bodily attack. Substantively, if someone is defamed, the bad faith of the defamer is presumed just as in our system, if someone slaps you in the face, it will be assumed that he intended to do so. Procedurally it is open to anyone who feels defamed, to avoid the costly civil route, and simply lodge a criminal complaint.  At this point the machinery of the State swings into action. For the defendant it is not without cost, I discovered. Even if I win I will not recover my considerable legal expenses and conviction results in a fine the size of which may depend on one’s income (the egalitarian reflex at its best). But money is not the principal currency here. It is honor and shame. If I lose, I will stand convicted of a crime, branded a criminal. The complainant will not enjoy a windfall as in London, but considerable moral satisfaction. The chilling effect on book reviewing well beyond France will be considerable.
  • The case was otiose for two reasons: It was in our view an egregious instance of ‘forum shopping,’ legalese for libel tourism. We wanted it thrown out. But if successful, the Court would never get to the merits –  and it was important to challenge this hugely dangerous attack on academic freedom and liberty of expression. Reversing custom, we specifically asked the Court not to examine our jurisdictional challenge as a preliminary matter but to join it to the case on the merits so that it would have the possibility to pronounce on both issues.
  • The trial was impeccable by any standard with which I am familiar. The Court, comprised three judges specialized in defamation and the Public Prosecutor. Being a criminal case within the Inquisitorial System, the case began by my interrogation by the President of the Court. I was essentially asked to explain the reasons for refusing to remove the article. The President was patient with my French – fluent but bad!  I was then interrogated by the other judges, the Public Prosecutor and the lawyers for the complainant. The complainant was then subjected to the same procedure after which the lawyers made their (passionate) legal arguments. The Public Prosecutor then expressed her Opinion to the Court. I was allowed the last word. It was a strange mélange of the criminal and civil virtually unknown in the Common Law world. The procedure was less formal, aimed at establishing the truth, and far less hemmed down by rules of evidence and procedure. Due process was definitely served. It was a fair trial.
  • we steadfastly refused to engage the complainants challenges to the veracity of the critical statements made by the reviewer. The thrust of our argument was that absent bad faith and malice, so long as the review in question addressed the book and did not make false statement about the author such as plagiarism, it should be shielded from libel claims, let alone criminal libel. Sorting out of the truth should be left to academic discourse, even if academic discourse has its own biases and imperfections.

The curious double standards of Simon Singh - Telegraph Blogs - 0 views

  • Simon Singh as in the popular mathematician and bestselling author of Fermat’s Last Theorem. And also, more germanely to this story, the recent victim of an expensive libel action brought against him by the British Chiropractic Association (BCA). The BCA eventually dropped its action – but not before Singh had run up £200,000 in legal costs. Though some it his lawyers will be able to claim back, he’s still likely to lose £60,000 of his own money as a result of his brave, principled decision to fight the case rather than cave in earlier. I hugely respected him for what he did. He won a victory (albeit a financially Pyrrhic one) not just for himself but for all those of us who trade in robust opinion and who believe that English libel laws are outrageously biased in favour of vexatious complainants, which is why we have unfortunately become a haven for libel tourists, some of them representing unspeakable causes.
  • Among those “serious matters of public interest”, you might imagine, would be Climate Change.
  • Yet in the opinion of Singh, the worldwide Climate Change industry is the one area where the robust scepticism and empiricism he professes to believe in just doesn’t apply. Apparently, the job of a journalist is just to accept the word of “the scientists” and take it as read that being as they are “scientists” their word is God and it brooks no questioning or dissent. That’s it. Finished.

  • I have no doubt whatsoever that Sir Paul Nurse knows more about genetics than I do. It is, after all, where the field in which he won his Nobel prize. As for science, sure, Nurse has the advantage over me there, too. He has a PhD. He’s a science graduate and I’m an arts graduate. But then I’ve never pretended otherwise. My case is not that I “James Delingpole have taken a long hard look at the science of global warming and discovered through careful sifting of countless peer-reviewed papers that the experts have got it all wrong.”
  • What I am saying, and I say almost every day, is that the evidence is not as robust as the “consensus” scientists claim; that there are many distinguished scientists all round the world who dispute this alleged “consensus”; that true science doesn’t advance through “consensus” and never has; that the Climategate emails threw the peer-review process into serious doubt by demonstrating how eminently corruptable it is; that there are many vested interests out there determined and able to spend a great deal of money by making out that the case for catastrophic, man-made global warming is much stronger than it is. And on these specific issues I can reasonably claim to be better informed than Sir Paul Nurse, regardless of how many PhDs he has, because I’ve spent much more time than he has researching them and because they are not issues which require an exclusively scientific knowledge to understand. They just require the basic journalistic skill of being able to read and analyse.

Roger Pielke Jr.'s Blog: Good News on Poverty - 0 views

  • The Brookings Institution has a new report out by Lawrence Chandy and Geoffrey Gertz (here in PDF) on trends in global poverty
  • The new estimates of global poverty presented in this brief serve as a reminder of just how powerful high growth can be in freeing people from poverty. In the span of a decade, the share of the world’s population living in poverty could be cut by two-thirds, the number of countries where more than 1 in 6 people live in poverty could drop from 60 to 35, and 19 countries are poised to eliminate poverty altogether.
  • Of course, it is far too early to declare success in the fight against poverty. To begin with, our estimates are just that; they are not hard numbers that can be calculated in real time, and the gains we imagine might not be realized if projections of future consumption growth turn out to be overly optimistic or if the poor do not share in this growth. Moreover, even if our figures are broadly accurate, in 2015 there will still be close to 600 million people—twice the population of the United States—living on less than the meager sum of $1.25 a day. Their fates are far from secure and represent a strategic and moral failure for the rest of the world, arguably all the more so as millions of others escape poverty.

  • if a key factor in reducing poverty is economic growth, then it necessarily is the case that efforts to limit climate change by reducing growth (or as some even argue, putting growth into reverse) are in direct opposition to efforts to reduce poverty.  It is this tension that sets up what I call in The Climate Fix the "iron law" of climate policy.
  • Setting aside climate change, the trends in poverty reduction are of profound importance, as the report suggests: Over the past half century, the developing world, including many of the world’s poorest countries, have seen dramatic improvements in virtually all non-income measures of well-being: since 1960, global infant mortality has dropped by more than 50 percent, for example, and the share of the world’s children enrolled in primary school increased from less than half to nearly 90 percent between 1950 and today.5 Likewise there have been impressive gains in gender equality, access to justice and civil and political rights. Yet, through most of this period, the incomes of rich and poor countries diverged, and income poverty has proven a more persistent challenge than other measures of wellbeing.6 The rapid decline in global poverty now underway—and the early achievement of the MDG1a target—marks a break from these trends, and could come to be seen as a turning point in the history of global development.

Religion: Faith in science : Nature News - 0 views

  • The Templeton Foundation claims to be a friend of science. So why does it make so many researchers uneasy?
  • With a current endowment estimated at US$2.1 billion, the organization continues to pursue Templeton's goal of building bridges between science and religion. Each year, it doles out some $70 million in grants, more than $40 million of which goes to research in fields such as cosmology, evolutionary biology and psychology.
  • however, many scientists find it troubling — and some see it as a threat. Jerry Coyne, an evolutionary biologist at the University of Chicago, Illinois, calls the foundation "sneakier than the creationists". Through its grants to researchers, Coyne alleges, the foundation is trying to insinuate religious values into science. "It claims to be on the side of science, but wants to make faith a virtue," he says.

  • But other researchers, both with and without Templeton grants, say that they find the foundation remarkably open and non-dogmatic. "The Templeton Foundation has never in my experience pressured, suggested or hinted at any kind of ideological slant," says Michael Shermer, editor of Skeptic, a magazine that debunks pseudoscience, who was hired by the foundation to edit an essay series entitled 'Does science make belief in God obsolete?'
  • The debate highlights some of the challenges facing the Templeton Foundation after the death of its founder in July 2008, at the age of 95.
  • With the help of a $528-million bequest from Templeton, the foundation has been radically reframing its research programme. As part of that effort, it is reducing its emphasis on religion to make its programmes more palatable to the broader scientific community. Like many of his generation, Templeton was a great believer in progress, learning, initiative and the power of human imagination — not to mention the free-enterprise system that allowed him, a middle-class boy from Winchester, Tennessee, to earn billions of dollars on Wall Street. The foundation accordingly allocates 40% of its annual grants to programmes with names such as 'character development', 'freedom and free enterprise' and 'exceptional cognitive talent and genius'.
  • Unlike most of his peers, however, Templeton thought that the principles of progress should also apply to religion. He described himself as "an enthusiastic Christian" — but was also open to learning from Hinduism, Islam and other religious traditions. Why, he wondered, couldn't religious ideas be open to the type of constructive competition that had produced so many advances in science and the free market?
  • That question sparked Templeton's mission to make religion "just as progressive as medicine or astronomy".
  • Early Templeton prizes had nothing to do with science: the first went to the Catholic missionary Mother Theresa of Calcutta in 1973.
  • By the 1980s, however, Templeton had begun to realize that fields such as neuroscience, psychology and physics could advance understanding of topics that are usually considered spiritual matters — among them forgiveness, morality and even the nature of reality. So he started to appoint scientists to the prize panel, and in 1985 the award went to a research scientist for the first time: Alister Hardy, a marine biologist who also investigated religious experience. Since then, scientists have won with increasing frequency.
  • "There's a distinct feeling in the research community that Templeton just gives the award to the most senior scientist they can find who's willing to say something nice about religion," says Harold Kroto, a chemist at Florida State University in Tallahassee, who was co-recipient of the 1996 Nobel Prize in Chemistry and describes himself as a devout atheist.
  • Yet Templeton saw scientists as allies. They had what he called "the humble approach" to knowledge, as opposed to the dogmatic approach. "Almost every scientist will agree that they know so little and they need to learn," he once said.
  • Templeton wasn't interested in funding mainstream research, says Barnaby Marsh, the foundation's executive vice-president. Templeton wanted to explore areas — such as kindness and hatred — that were not well known and did not attract major funding agencies. Marsh says Templeton wondered, "Why is it that some conflicts go on for centuries, yet some groups are able to move on?"
  • Templeton's interests gave the resulting list of grants a certain New Age quality (See Table 1). For example, in 1999 the foundation gave $4.6 million for forgiveness research at the Virginia Commonwealth University in Richmond, and in 2001 it donated $8.2 million to create an Institute for Research on Unlimited Love (that is, altruism and compassion) at Case Western Reserve University in Cleveland, Ohio. "A lot of money wasted on nonsensical ideas," says Kroto. Worse, says Coyne, these projects are profoundly corrupting to science, because the money tempts researchers into wasting time and effort on topics that aren't worth it. If someone is willing to sell out for a million dollars, he says, "Templeton is there to oblige him".
  • At the same time, says Marsh, the 'dean of value investing', as Templeton was known on Wall Street, had no intention of wasting his money on junk science or unanswerables such as whether God exists. So before pursuing a scientific topic he would ask his staff to get an assessment from appropriate scholars — a practice that soon evolved into a peer-review process drawing on experts from across the scientific community.
  • Because Templeton didn't like bureaucracy, adds Marsh, the foundation outsourced much of its peer review and grant giving. In 1996, for example, it gave $5.3 million to the American Association for the Advancement of Science (AAAS) in Washington DC, to fund efforts that work with evangelical groups to find common ground on issues such as the environment, and to get more science into seminary curricula. In 2006, Templeton gave $8.8 million towards the creation of the Foundational Questions Institute (FQXi), which funds research on the origins of the Universe and other fundamental issues in physics, under the leadership of Anthony Aguirre, an astrophysicist at the University of California, Santa Cruz, and Max Tegmark, a cosmologist at the Massachusetts Institute of Technology in Cambridge.
  • But external peer review hasn't always kept the foundation out of trouble. In the 1990s, for example, Templeton-funded organizations gave book-writing grants to Guillermo Gonzalez, an astrophysicist now at Grove City College in Pennsylvania, and William Dembski, a philosopher now at the Southwestern Baptist Theological Seminary in Fort Worth, Texas. After obtaining the grants, both later joined the Discovery Institute — a think-tank based in Seattle, Washington, that promotes intelligent design. Other Templeton grants supported a number of college courses in which intelligent design was discussed. Then, in 1999, the foundation funded a conference at Concordia University in Mequon, Wisconsin, in which intelligent-design proponents confronted critics. Those awards became a major embarrassment in late 2005, during a highly publicized court fight over the teaching of intelligent design in schools in Dover, Pennsylvania. A number of media accounts of the intelligent design movement described the Templeton Foundation as a major supporter — a charge that Charles Harper, then senior vice-president, was at pains to deny.
  • Some foundation officials were initially intrigued by intelligent design, Harper told The New York Times. But disillusionment set in — and Templeton funding stopped — when it became clear that the theory was part of a political movement from the Christian right wing, not science. Today, the foundation website explicitly warns intelligent-design researchers not to bother submitting proposals: they will not be considered.
  • Avowedly antireligious scientists such as Coyne and Kroto see the intelligent-design imbroglio as a symptom of their fundamental complaint that religion and science should not mix at all. "Religion is based on dogma and belief, whereas science is based on doubt and questioning," says Coyne, echoing an argument made by many others. "In religion, faith is a virtue. In science, faith is a vice." The purpose of the Templeton Foundation is to break down that wall, he says — to reconcile the irreconcilable and give religion scholarly legitimacy.
  • Foundation officials insist that this is backwards: questioning is their reason for being. Religious dogma is what they are fighting. That does seem to be the experience of many scientists who have taken Templeton money. During the launch of FQXi, says Aguirre, "Max and I were very suspicious at first. So we said, 'We'll try this out, and the minute something smells, we'll cut and run.' It never happened. The grants we've given have not been connected with religion in any way, and they seem perfectly happy about that."
  • John Cacioppo, a psychologist at the University of Chicago, also had concerns when he started a Templeton-funded project in 2007. He had just published a paper with survey data showing that religious affiliation had a negative correlation with health among African-Americans — the opposite of what he assumed the foundation wanted to hear. He was bracing for a protest when someone told him to look at the foundation's website. They had displayed his finding on the front page. "That made me relax a bit," says Cacioppo.
  • Yet, even scientists who give the foundation high marks for openness often find it hard to shake their unease. Sean Carroll, a physicist at the California Institute of Technology in Pasadena, is willing to participate in Templeton-funded events — but worries about the foundation's emphasis on research into 'spiritual' matters. "The act of doing science means that you accept a purely material explanation of the Universe, that no spiritual dimension is required," he says.
  • It hasn't helped that Jack Templeton is much more politically and religiously conservative than his father was. The foundation shows no obvious rightwards trend in its grant-giving and other activities since John Templeton's death — and it is barred from supporting political activities by its legal status as a not-for-profit corporation. Still, many scientists find it hard to trust an organization whose president has used his personal fortune to support right-leaning candidates and causes such as the 2008 ballot initiative that outlawed gay marriage in California.
  • Scientists' discomfort with the foundation is probably inevitable in the current political climate, says Scott Atran, an anthropologist at the University of Michigan in Ann Arbor. The past 30 years have seen the growing power of the Christian religious right in the United States, the rise of radical Islam around the world, and religiously motivated terrorist attacks such as those in the United States on 11 September 2001. Given all that, says Atran, many scientists find it almost impossible to think of religion as anything but fundamentalism at war with reason.

  • Towards the end of Templeton's life, says Marsh, he became increasingly concerned that this reaction was getting in the way of the foundation's mission: that the word 'religion' was alienating too many good scientists.
  • The peer-review and grant-making system has also been revamped: whereas in the past the foundation ran an informal mix of projects generated by Templeton and outside grant seekers, the system is now organized around an annual list of explicit funding priorities.
  • The foundation is still a work in progress, says Jack Templeton — and it always will be. "My father believed," he says, "we were all called to be part of an ongoing creative process. He was always trying to make people think differently." "And he always said, 'If you're still doing today what you tried to do two years ago, then you're not making progress.'"

Happiness: Do we have a choice? » Scienceline - 0 views

  • “Objective choices make a difference to happiness over and above genetics and personality,” said Bruce Headey, a psychologist at Melbourne University in Australia. Headey and his colleagues analyzed annual self-reports of life satisfaction from over 20,000 Germans who have been interviewed every year since 1984. He compared five-year averages of people’s reported life satisfaction, and plotted their relative happiness on a percentile scale from 1 to 100. Heady found that as time went on, more and more people recorded substantial changes in their life satisfaction. By 2008, more than a third had moved up or down on the happiness scale by at least 25 percent, compared to where they had started in 1984.
  • Headey’s findings, published in the October 19th issue of Proceedings of the National Academy of Sciences, run contrary to what is known as the happiness set-point theory — the idea that even if you win the lottery or become a paraplegic, you’ll revert back to the same fixed level of happiness within a year or two. This psychological theory was widely accepted in the 1990s because it explained why happiness levels seemed to remain stable over the long term: They were mainly determined early in life by genetic factors including personality traits.
  • But even this dynamic choice-driven picture does not fully capture the nuance of what it means to be happy, said Jerome Kagan, a Harvard University developmental psychologist. He warns against conflating two distinct dimensions of happiness: everyday emotional experience (an assessment of how you feel at the moment) and life evaluation (a judgment of how satisfied you are with your life). It’s the difference between “how often did you smile yesterday?” and “how does your life compare to the best possible life you can imagine?”

  • Kagan suggests that we may have more choice over the latter, because life evaluation is not a function of how we currently feel — it is a comparison of our life to what we decide the good life should be.
  • Kagan has found that young children differ biologically in the ease with which they can feel happy, or tense, or distressed, or sad — what he calls temperament. People establish temperament early in life and have little capacity to change it. But they can change their life evaluation, which Kagan describes as an ethical concept synonymous with “how good of a life have I led?” The answer will depend on individual choices and the purpose they create for themselves. A painter who is constantly stressed and moody (unhappy in the moment) may still feel validation in creating good artwork and may be very satisfied with his life (happy as a judgment).
  • when it comes to happiness, our choices may matter — but it depends on what the choices are about, and how we define what we want to change.
  • Graham thinks that people may evaluate their happiness based on whichever dimension — happiness at the moment, or life evaluation — they have a choice over.

    Instead of existing as a stable equilibrium, Headey suggests that happiness is much more dynamic, and that individual choices - about one's partner, working hours, social participation and lifestyle - make substantial and permanent changes to reported happiness levels. For example, doing more or fewer paid hours of work than you want, or exercising regularly, can have just as much impact on life satisfaction as having an extroverted personality.

  • If you know only one language, you live only once. A man who knows two languages is worth two men. He who loses his language loses his world. (Czech, French and Gaelic proverbs.)
  • The hypothesis first put forward fifty years ago by linguist Benjamin Lee Whorf—that our language significantly affects our experience of the world—is making a comeback in various forms, and with it no shortage of debate.
  • The idea that language shapes thought was taboo for a long time, said Dan Slobin, a psycholinguist at the University of California, Berkeley. “Now the ice is breaking.” The taboo, according to Slobin, was largely due to the widespread acceptance of the ideas of Noam Chomsky, one of the most influential linguists of the 20th century. Chomsky proposed that the human brain comes equipped at birth with a set of rules—or universal grammar—that organizes language. As he likes to say, a visiting Martian would conclude that everyone on Earth speaks mutually unintelligible dialects of a single language.

  • Chomsky is hesitant to accept the recent claims of language’s profound influence on thought. “I’m rather skeptical about all of this, though there probably are some marginal effects,” he said.
  • Some advocates of the Whorfian view find support in studies of how languages convey spatial orientation. English and Dutch speakers describe orientation from an egocentric frame of reference (to my left or right). Mayan speakers use a geocentric frame of reference (to the north or south).
  • Does this mean they think about space in fundamentally different ways? Not exactly, said Lila Gleitman, a psychologist from the University of Pennsylvania. Since we ordinarily assume that others talk like us, she explained, vague instructions like “arrange it the same way” will be interpreted in whatever orientation (egocentric or geocentric) is most common in our language. “That’s going to influence how you solve an ambiguous problem, but it doesn’t mean that’s the way you think, or must think,” said Gleitman. In fact, she repeated the experiment with unambiguous instructions, providing cues to indicate whether objects should be arranged north-south or left-right. She found that people in both languages are just as good at arranging objects in either orientation.
  • Similarly, Anna Papafragou, a psychologist at the University of Delaware, thinks that the extent of language’s effect on thought has been somewhat exaggerated.
  • Papafragou compared how long Greek and English speakers paid attention to clip-art animation sequences, for example, a man skating towards a snowman. By measuring their eye movements, Papafragou was able to tell which parts of the scene held their gaze the longest. Because English speakers generally use verbs that describe manner of motion, like slide and skip, she predicted they would pay more attention to what was moving (the skates). Since Greeks use verbs that describe path, like approach and ascend, they should pay more attention to endpoint of the motion (the snowman). She found that this was true only when people had to describe the scene; when asked to memorize it, attention patterns were nearly identical. According to Papafragou, when people need to speak about what they see, they’ll focus on the parts relevant for planning sentences. Otherwise, language does not show much of an effect on attention.
  • “Each language is a bright transparent medium through which our thoughts may pass, relatively undistorted,” said Gleitman.
  • Others think that language does, in fact, introduce some distortion. Linguist Guy Deutscher of the University of Manchester in the U.K. suggests that while language can’t prevent you from thinking anything, it does compel you to think in specific ways. Language forces you to habitually pay attention to different aspects of the world.
  • For example, many languages assign genders to nouns (“bridge” is feminine in German and masculine in Spanish). A study by cognitive psychologist Lera Boroditsky of Stanford University found that German speakers were more likely to describe “bridge” with feminine terms like elegant and slender, while Spanish speakers picked words like sturdy and towering. Having to constantly keep track of gender, Deutscher suggests, may subtly change the way native speakers imagine object’s characteristics.
  • However, this falls short of the extreme view some ascribe to Whorf: that language actually determines thought. According to Steven Pinker, an experimental psychologist and linguist at Harvard University, three things have to hold for the Whorfian hypothesis to be true: speakers of one language should find it nearly impossible to think like speakers of another language; the differences in language should affect actual reasoning; and the differences should be caused by language, not just correlated with it. Otherwise, we may just be dealing with a case of “crying Whorf.”
  • But even mild claims may reveal complexities in the relationship between language and thought. “You can’t actually separate language, thought and perception,” said Debi Roberson, a psychologist at the University of Essex in the U.K. “All of these processes are going on, not just in parallel, but interactively.”

  • HB Gary people are talking about creating "personas", what we would call sockpuppets. This is not new. PR firms have been using fake "people" to promote products and other things for a while now, both online and even in bars and coffee houses.
  • But for a defense contractor with ties to the federal government, Hunton & Williams, DOD, NSA, and the CIA -  whose enemies are labor unions, progressive organizations,  journalists, and progressive bloggers,  a persona apparently goes far beyond creating a mere sockpuppet. According to an embedded MS Word document found in one of the HB Gary emails, it involves creating an army of sockpuppets, with sophisticated "persona management" software that allows a small team of only a few people to appear to be many, while keeping the personas from accidentally cross-contaminating each other. Then, to top it off, the team can actually automate some functions so one persona can appear to be an entire Brooks Brothers riot online.
  • Persona management entails not just the deconfliction of persona artifacts such as names, email addresses, landing pages, and associated content.  It also requires providing the human actors technology that takes the decision process out of the loop when using a specific persona.  For this purpose we custom developed either virtual machines or thumb drives for each persona.  This allowed the human actor to open a virtual machine or thumb drive with an associated persona and have all the appropriate email accounts, associations, web pages, social media accounts, etc. pre-established and configured with visual cues to remind the actor which persona he/she is using so as not to accidentally cross-contaminate personas during use.

And consensus is a powerful persuader. What has more effect, one guy saying BP is not at fault? Or 20 people saying it? For the weak minded, the number can make all the difference.

But it appears from the solicitation it is contracted for use in foreign theaters like Afghanistan and Iraq. I can't imagine why this is posted on an open site. Bankers, Buyouts & Billionaires: Why Big Herba's Research Deficit Isn't About... - 0 views

  • A skeptic challenges a natural health product for the lack of an evidentiary base.  A proponent of that product responds that the skeptic has made a logical error – an absence of evidence is not evidence of absence, and in such a scenario it’s not unreasonable to rely on patient reporting and traditional uses as a guide. The skeptic chimes back with a dissertation on the limits of anecdotal evidence and arguments from antiquity — especially when the corresponding pharma products have a data trail supporting their safety and efficacy. The proponent responds that it’s unfair to hold natural health products to the same evidentiary standard, because only pharma has the money to fund proper research, and they only do so for products they can patent. You can’t patent nature, so no research into natural health products gets done.

While the industry can be difficult to get a bead on – due both to differing definitions of what it includes (organic foods? natural toothpaste?), and the fact that many of the key players are private companies that don’t report revenues – by any measure it’s sizable. A survey by the University of Guelph  references KPMG estimates that the Natural Health Products sector in Canada grew from $1.24B in 2000 to $1.82B in 2006 – a growth rate that would bring the market to about $2.5B today.   Figures from the Nutrition Business Journal quoted in the same survey seem to agree, suggesting Canada is 3% of a global “supplements” (herbal, homeopathy, vitamins) market that was $68B globally in 2006 and growing at 5% a year – bringing it to perhaps $85B today. Figures from various sources quoted in a recent Health Canada report support these estimates.

  • While certainly not as big as the ($820B) pharmaceutical industry, $85B is still an awful lot of money, and it’s hard to imagine it not being enough to carve out a research budget from. Yet research isn’t done by entire industries, but by one tier of the value chain — the companies that manufacture and distribute the products.  If they’re not big enough to fund the type of research skeptics are looking for, it won’t be done, so let’s consider some of the bigger players before we make that call.
  • French giant Boiron (EPA:BOI) is by far the largest distributor of natural health products in Canada – they’re responsible for nearly 4000 (15%) of the 26,000 products approved by Health Canada’s Natural Health Products Directorate. They’re also one of largest natural health products companies globally, with 2010 revenues of €520M ($700M CAD) – a size achieved not just through the success of killer products like Oscillococcinum, but also through acquisitions. In recent years, the company has acquired both its main French rival Dolisos (giving them 90% of the French homeopathy market) and the largest homeopathy company in Belgium, Unda. So this is a big company that’s prepared to spend money to get even bigger. What about spending some of that money on research?  Well ostensibly it’s a priority: “Since 2005, we have devoted a growing level of resources to develop research,” they proclaim in the opening pages of their latest annual report, citing 70 in-progress research projects. Yet the numbers tell a different story – €4.2M in R&D expenditures in 2009, just 0.8% of revenues.
  • To put that in perspective, consider that in the same year, GlaxoSmithKline spent 14% of its revenues on R&D, Pfizer spent 15%, and Merck spent a whopping 21%.

Hiding the Decline | Climate Etc. - 0 views

  • we need to understand the magnitude and characteristics and causes of natural climate variability over the current interglacial, particularly the last 2000 years.  I’m more interested in the handle than the blade of the hockey stick.  I also view understanding regional climate variations as much more important than trying to use some statistical model to create global average anomalies (which I personally regard as pointless, given the sampling issue).
  • I am really hoping that the AR5 will do a better job of providing a useful analysis and assessment of the paleodata for the last millennium.  However I am not too optimistic. There was another Workshop in Lisbon this past year (Sept 2010), on the Medieval Warm Period.  The abstracts for the presentations are found here.  No surprises, many of the usual people doing the usual things.
  • This raises the issue as to whether there is any value at all in the tree ring analyses for this application, and whether these paleoreconstructions can tell us anything.  Apart from the issue of the proxies not matching the observations from the current period of warming (which is also the period of best historical data), there is the further issue as to whether these hemispheric or global temperature analyses make any sense at all because of the sampling issue.  I am personally having a difficult time in seeing how this stuff has any credibility at the level of “likely” confidence levels reported in the TAR and AR4.

  • There is no question that the diagrams and accompanying text in the IPCC TAR, AR4 and WMO 1999 are misleading.  I was misled.  Upon considering the material presented in these reports, it did not occur to me that recent paleo data was not consistent with the historical record.  The one statement in AR4 (put in after McIntyre’s insistence as a reviewer) that mentions the divergence problem is weak tea.
  • It is obvious that there has been deletion of adverse data in figures shown IPCC AR3 and AR4, and the 1999 WMO document.  Not only is this misleading, but it is dishonest (I agree with Muller on this one).  The authors defend themselves by stating that there has been no attempt to hide the divergence problem in the literature, and that the relevant paper was referenced.  I infer then that there is something in the IPCC process or the authors’ interpretation of the IPCC process  (i.e. don’t dilute the message) that corrupted the scientists into deleting the adverse data in these diagrams.
  • McIntyre’s analysis is sufficiently well documented that it is difficult to imagine that his analysis is incorrect in any significant way.  If his analysis is incorrect, it should be refuted.  I would like to know what the heck Mann, Briffa, Jones et al. were thinking when they did this and why they did this, and how they can defend this, although the emails provide pretty strong clues.  Does the IPCC regard this as acceptable?  I sure don’t.
  • paleoproxies are outside the arena of my personal research expertise, and I find my eyes glaze over when I start reading about bristlecones, etc.  However, two things this week have changed my mind, and I have decided to take on one aspect of this issue: the infamous “hide the decline.” The first thing that contributed to my mind change was this post at Bishop Hill entitled “Will Sir John condemn hide the decline?”, related to Sir John Beddington’s statement:  It is time the scientific community became proactive in challenging misuse of scientific evidence.
  • The second thing was this youtube clip of physicist Richard Muller (Director of the Berkeley Earth Project), where he discusses “hide the decline” and vehemently refers to this as “dishonest,” and says “you are not allowed to do this,” and further states that he intends not to read further papers by these authors (note “hide the decline” appears around minute 31 into the clip).  While most of his research is in physics, Muller has also published important papers on paleoclimate, including a controversial paper that supported McIntyre and McKitrick’s analysis.

It concerned the philosopher Saul Kripke’s lectures — later to be called “Naming and Necessity” — which he had originally given at Princeton in 1970 and planned to give again in the Fall, 1972.
  • Whiggishness — in history of science, the tendency to evaluate and interpret past scientific theories not on their own terms, but in the context of current knowledge. The term comes from Herbert Butterfield’s “The Whig Interpretation of History,” written when Butterfield, a future Regius professor of history at Cambridge, was only 31 years old. Butterfield had complained about Whiggishness, describing it as “…the study of the past with direct and perpetual reference to the present” – the tendency to see all history as progressive, and in an extreme form, as an inexorable march to greater liberty and enlightenment. [3] For Butterfield, on the other hand, “…real historical understanding” can be achieved only by “attempting to see life with the eyes of another century than our own.” [4][5].

If so, then let's see if we can agree on the meaning of the word 'know' because that may be the crux of the matter. When I use the word 'know' I mean more than the capacity to apprehend some aspect of the world through language or some other represenational symbolism. Included in the word 'know' is the direct sensorial perception of some aspect of the world. For example, I sense the floor that my feet are now resting upon. I 'know' the floor is really there, I can sense it. Perhaps I don't 'know' what the floor is made of, who put it there, and other incidental facts one could know through the usual symbolism such as language as in a story someone tells me. Nevertheless, the reality I need to 'know' is that the floor, or whatever you may wish to call the solid - relative to my body - flat and level surface supported by more structure then the earth, is really there and reliably capable of supporting me. This is true and useful knowledge that goes directly from the floor itself to my knowing about it - via sensation - that has nothing to do with my interpretive system.
  • Now I am interested in 'knowing' my feet in the same way that my feet and the whole body they are connected to 'know' the floor. I sense my feet sensing the floor. My feet are as real as the floor and I know they are there, sensing the floor because I can sense them. Furthermore, now I 'know' that it is 'I' sensing my feet, sensing the floor. Do you see where I am going with this line of thought? I am including in the word 'know' more meaning than it is commonly given by everyday language. Perhaps it sounds as if I want to expand on the Cartesian formula of cogito ergo sum, and in truth I prefer to say I sense therefore I am. It is my sensations of the world first and foremost that my awareness, such as it is, is actively engaged with reality. Now, any healthy normal animal senses the world but we can't 'know' if they experience reality as we do since we can't have a conversation with them to arrive at agreement. But we humans can have this conversation and possibly agree that we can 'know' the world through sensation. We can even know what is 'I' through sensation. In fact, there is no other way to know 'I' except through sensation. Thought is symbolic representation, not direct sensing, so even though the thoughtful modality of regarding the world may be a far more reliable modality than sensation in predicting what might happen next, its very capacity for such accurate prediction is its biggest weakness, which is its capacity for error
  • Sensation cannot be 'wrong' unless it is used to predict outcomes. Thought can be wrong for both predicting outcomes and for 'knowing' reality. Sensation alone can 'know' reality even though it is relatively unreliable, useless even, for making predictions.
  • If we prioritize our interests by placing predictability over pure knowing through sensation, then of course we will not value the 'knowledge' to be gained through sensation. But if we can switch the priorities - out of sheer curiosity perhaps - then we can enter a realm of knowledge through sensation that is unbelievably spectacular. Our bodies are 'made of' reality, and by methodically exercising our nascent capacity for self sensing, we can connect our knowing 'I' to reality directly. We will not be able to 'know' what it is that we are experiencing in the way we might wish, which is to be able to predict what will happen next or to represent to ourselves symbolically what we might experience when we turn our attention to that sensation. But we can arrive at a depth and breadth of 'knowing' that is utterly unprecedented in our lives by operating that modality.
  • One of the impressions that comes from a sustained practice of self sensing is a clearer feeling for what "I" is and why we have a word for that self referential phenomenon, seemingly located somewhere behind our eyes and between our ears. The thing we call "I" or "me" depending on the context, turns out to be a moving point, a convergence vector for a variety of images, feelings and sensations. It is a reference point into which certain impressions flow and out of which certain impulses to act diverge and which may or may not animate certain muscle groups into action. Following this tricky exercize in attention and sensation, we can quickly see for ourselves that attention is more like a focused beam and awareness is more like a diffuse cloud, but both are composed of energy, and like all energy they vibrate, they oscillate with a certain frequency. Roger Pielke Jr.'s Blog: Julia Gillard Goes All In - 0 views

  • It is here where I think that Gillard has made a bad bet. Carbon pricing is supposed to create jobs by making fossil fuels appreciably more expensive, thereby creating a market signal that disfavors carbon-intensive industry and stimulates less carbon-intensive economic activity. The economic parts of theory seem sound enough.
  • However, it is the political realities that the theory does not account for.  Australia's economy is very carbon intensive (PDF). Thus, if carbon pricing were to work exactly as the Prime Minister describes, it will necessary lead to a great deal of economic dislocation and change -- Consider that to meet the 5% emissions reduction target (from 2000 levels), without relying on offsets or other tricks, implies that Australia's economy would need to become as carbon efficient as Japan's by the end of this decade. How such a profoundly disruptive transitional period would be managed is the one issue that advocates of a high carbon price have never really dealt with -- the market's invisible hand will take care of it I guess.
  • How does one become "reskilled"?  Without an explanation, many people will translate "reskilled" to mean "unemployed".  The oft-stated idea that the proceeds of a carbon tax will be used to compensate those who fact higher costs does not address the issue of dislocation in the economy. There is a element of "magical thinking" in the idea that transforming a national economy starts with a simple decision: . . . clean energy will open up opportunities we are only just beginning to imagine. Those opportunities begin with that simple but momentous decision: Putting a price on carbon. Friends, a price on carbon is the cheapest way to drive investment and jobs.

  • There are only two realistic outcomes here. One is that the carbon tax proposal is scrapped. With this speech it seems highly unlikely that Gillard will be the one doing any scrapping.  So it would probably be via an election or a change in leadership, such as if Kevin Rudd becomes captain of the Brisbane Broncos. The second possible outcome is that the carbon pricing is watered down so far that its enactment allows Labor to claim success while limiting any actual impact from the tax on the economy.  Of course, that would undercut its stated purpose -- to transform the economy.
  • A better strategy is the one proposed in The Climate Fix -- start with a very low carbon tax, one that is politically acceptable, and use the proceeds to invest in innovation. The carbon price would rise over time as the fruits of innovation make it politically acceptable to raise that price.  I expect that Australia will soon provide (yet aonpther) lesson in how not to try to put a price on carbon.

  • Nobody can say for sure how this crisis is headed. As of today, the risk of a total meltdown has been reduced. However, if one was listening to some segments of the media earlier this week, disaster was the only possible outcome. Fear and panic itself would have caused a disaster Imagine the mess created by millions fleeing Tokyo in a haphazard manner - the sick, old and invalid left behind, food & water distribution disrupted - would have led to more deaths much worse than the worst case meltdown that would have led to reactors being entombed. It also shows us the importance of leadership we can trust - the Japanese Minister Yukio Edano held 5 press conference every day[Link] to update the nation on the dynamic situation (compare that with the initial handling of SARS outbreak).

  • there is a tendency to conclude that govts with the best expert advice have made this decision because there is a real danger of something sinister happening. But remember govts are also under pressure to act because they are made up of politicians - also they may be making precautionary moves because they have little to lose and have to be seen as being pro-active. How real is the danger of harmful radiation reaching Tokyo and should you leave if you're in Tokyo? There were many people doing a "wait and see" before Wednesday but once the US & UK govt called for a pull-out, the fear factor rose several notches and if you're a Japanese in Tokyo watching all the foreigners "abandoning" your city, you start to feel some anxiety and later panic. One EU official used the word "apocalypse"[Link] to describe the situation in Japan and the fear index hit the roof....then a whole herd of experts came out to paint more dire scenarios saying the Japanese have lost all control of the nuclear plants. All this lead the public to think that calamity is the most likely outcome of the unfolding saga and if make a decision from all this, you will just run for the exits if you're in Tokyo. All this is happening while the Japanese govt is trying to calm the people and prevent a pandemonium after the triple disaster hit the country. In China, people have emptied the supermarket shelves of iodized salt because of media reports that the consumption of iodine can block radioactive iodine from being absorbed by thyroid glands causing thyroid cancer. There are also reports of people getting ill after ingesting iodine pills out of fear of radiation.

Ads Implant False Memories | Wired Science | Wired.com - 0 views

  • The experiment went like this: 100 undergraduates were introduced to a new popcorn product called “Orville Redenbacher’s Gourmet Fresh Microwave Popcorn.” (No such product exists, but that’s the point.) Then, the students were randomly assigned to various advertisement conditions. Some subjects viewed low-imagery text ads, which described the delicious taste of this new snack food. Others watched a high-imagery commercial, in which they watched all sorts of happy people enjoying this popcorn in their living room. After viewing the ads, the students were then assigned to one of two rooms. In one room, they were given an unrelated survey. In the other room, however, they were given a sample of this fictional new popcorn to taste. (A different Orville Redenbacher popcorn was actually used.) One week later, all the subjects were quizzed about their memory of the product. Here’s where things get disturbing: While students who saw the low-imagery ad were extremely unlikely to report having tried the popcorn, those who watched the slick commercial were just as likely to have said they tried the popcorn as those who actually did. Furthermore, their ratings of the product were as favorable as those who sampled the salty, buttery treat. Most troubling, perhaps, is that these subjects were extremely confident in these made-up memories. The delusion felt true. They didn’t like the popcorn because they’d seen a good ad. They liked the popcorn because it was delicious.

  • How could a stupid commercial trick me into believing that I loved a product I’d never actually tasted? Or that I drank Coke out of glass bottles? The answer returns us to a troubling recent theory known as memory reconsolidation. In essence, reconsolidation is rooted in the fact that every time we recall a memory we also remake it, subtly tweaking the neuronal details. Although we like to think of our memories as being immutable impressions, somehow separate from the act of remembering them, they aren’t. A memory is only as real as the last time you remembered it. What’s disturbing, of course, is that we can’t help but borrow many of our memories from elsewhere, so that the ad we watched on television becomes our own, part of that personal narrative we repeat and retell.
  • This idea, simple as it seems, requires us to completely re-imagine our assumptions about memory.  It reveals memory as a ceaseless process, not a repository of inert information. The recall is altered in the absence of the original stimulus, becoming less about what we actually remember and more about what we’d like to remember. It’s the difference between a “Save” and the “Save As” function. Our memories are a “Save As”: They are files that get rewritten every time we remember them, which is why the more we remember something, the less accurate the memory becomes. And so that pretty picture of popcorn becomes a taste we definitely remember, and that alluring soda commercial becomes a scene from my own life. We steal our stories from everywhere. Marketers, it turns out, are just really good at giving us stories we want to steal.

  • Corballis's theories also help make sense of apparent anomalies such as linguist and anthropologist Daniel's Everett's work on the Pirahã, an Amazonian people who hit the headlines because of debates over whether their language has any words for colours, and, crucially, numbers. Corballis now thinks that the Pirahã language may not be that unusual, and cites the example of other languages from oral cultures, such as the Iatmul language of New Guinea, which is also said to lack recursion.

When they exposed the cell to pulses of light, it emitted green fluorescent light that focused into a laser beam with the aid of the parallel mirrors. As Gather and Yun pointed out in their paper, the single-cell biological laser avoids the use of “artificial or engineered optical gain materials, such as doped crystals, semiconductors, synthetic dyes and purified gases.”

Media Reacts to News That Norwegian Terror Suspect Isn't Muslim - Global - The Atlantic... - 0 views

  • The editorial remains up on the Post, "sixteen hours after its claims were shown to be false and hysterical, it's still there, with no correction or apology," according to James Fallows at The Atlantic. Fallows responded to Rubin's piece, in a blog post titled, "The Washington Post Owes the World an Apology for this Item," writing that: No, this is a sobering reminder for those who think it's too tedious to reserve judgment about horrifying events rather than instantly turning them into talking points for pre-conceived views. On a per capita basis, Norway lost twice as many people today as the U.S. did on 9/11. Imagine the political repercussions through the world if double-9/11-scale damage had been done by an al-Qaeda offshoot. The unbelievably sweeping damage is there in either case.

  • Ibrahim Hewitt writes an editoral at Al-Jazeera, where he observes that once media outlets noted that the suspect was not Muslim, they disassociated connections between the suspect's beliefs and his alleged violent actions. ...the perpetrator was a "blond, blue-eyed Norwegian" with "political traits towards the right, and anti-Muslim views." Not surprisingly, the man's intentions were neither linked to these "traits," nor to his postings on "websites with Christian fundamentalist tendencies." Any influence "remains to be seen"; echoes of Oklahoma 1995. Interestingly, this criminal is described by one unnamed Norwegian official as a "madman."

    Programmer Jonathan Stark, vice president of Mobiquity, has begun a truly cool experiment: sharing his Starbucks card with the world. While researching ways one can pay-by-mobile, Stark took an interesting perspective on Starbucks' system. He realized there was (at the time) no app for Android users, so he simply took a picture of his card and posted it online. He loaded it with $30 and then encouraged others to use it - and reload it, if they see fit. Not surprisingly, people took him up on it. Since those $30, the card has seen over $9,000 worth of anonymous donations. Stark says that "every time the balance gets really high, it brings out the worst in people: Someone goes down to Starbucks and makes a huge purchase. I don't know if they are buying coffee beans or mugs, or transferring money to their own card or what. But as long as the balance stays low, say $20 to $30, it seems like it manages itself. I haven't put any money on it in a while. All the money going through the card right now is the kindness of strangers."

And if they are expecting that I understand their disappointment because my bot is far from being performant !   • For the positive responses it's mainly people who understood that rep.licants is not about giving performant bots but is more like an experiment (and also a kind of critics about how most of the users are using social networks) where users can mix themselves with a bot and see what is happening. Because even if my bots are crap they can be, sometimes, surprising.
  • But I was kind of surprised that so many people would really expect to have a real bot to manage their social networks account. Twitter never responded and Facebook responded by banning, three times already, my Facebook applications which is managing and running all the Facebook's bots.

My bot made me discover a lot of interesting things, by posting them on Twitter, that I wouldn't never find without him. New informations are coming so fast and in so big quantities that it becomes really difficult to deal with that. For example just on Twitter I follow 80 persons (which is not a lot) all of those persons that I follow is because I know that they might tweet interesting stuffs related to my interests. But I have maybe 10 of those 80 followers who are tweeting quiet a lot (maybe 1-2 tweet per hour) and as I check my twitter feed only one time per day I sometimes loose more than one hour to find interesting tweets in the amount of tweets that my 80 persons posted. And this is only for Twitter ! I really think that we need more and more personal robots for filtering information for us. And this is a very positive point I found about having a bot that I could never imagine when I was beginning my project.

  • The questions that rep.licants poses are deep human and social ones – laced with uncertainties about the kinds of interactions we count as normal and the responsibilities we owe to ourselves and each other.  Seeing these bots carry out conversations with themselves and with human counterparts (much less other non-human counterparts) allows us to take tradition social and technological research into a different territory – asking not only what it means to be human – but also what it means to be non-human.
