It's more open today, but the Communist government still bans anything that mentions sex or violence, or that has "low class humor" - which bans an awful lot of American music. So the music most likely to come pouring out of the radio in China is syrupy ballads usually produced in Hong Kong or Taiwan. But Chinese musicians and fans are finding a whole new universe of sound on the Internet. And it's helping to create and nourish a new generation of independent artists in China. From Black-Market Discs to Napster and Beyond One of them is B6, a 27-year-old electronic musician. He lives and works on the first floor of a high-rise on the outskirts of Shanghai.   • 作为非法律专业人士和普通老百姓,我认为这个译名并不妥当。例如,针对上面的第一点理由:首先,中国老百姓真的就熟悉清楚“知识产权”及其中“知识”的概念吗?这是事实还是想象?其次,相对于“创作共用/共享”的独特、创新、易于区分等特点,“知识共享”是一个不那么像“概念”的词汇,它可以并已经被用在太多的范畴内,这并不利于一个概念的推广,稍对营销有点认识的人应该不难理解为什么产品或者理念常常要故意使用“陌生化”、有别日常生活用语的名词。实际上,我google“知识共享”返回数以百万计的结果,而前二十页里只有一条与CC有关,是一位网志作者参加了CC协议草案讨论会的所见所想,而technorati则没有找到有关CC的内容。第三,CC在中国此前已有一定普及率,看它的“创新-扩散曲线”,应当已经具备了早期使用者的基础,要准备进入S型曲线起飞期了。如果抛掉已有一定认知度的“创作共用/共享”而另起炉灶,不但不利于推广,甚至还可能带来混淆。——如果“知识共享”并不利于CC协议在中国的推广,那么这种连倡导者都承认“会牺牲通过直译所具有的准确性”的译名,其价值何在呢。

  • 紀錄片教堂的文化批判很刺耳,評論者期待用尖刺戮穿「感動論述」的表皮,觸及 921 歷史的瘀血。正如《生命》不是一部與我們生命無關的紀實電影,批判也不僅僅是一種刻板印象。正因為有網路,我們得以如此迅速地互相援引、相濡以沫,我們也因為這些批判而得以凝視我們自身,延伸在感動論述之外的行動。否則今日的紀錄片熱潮不就是重演昔日的救援災難?善意與關注接續不絕、絡繹於塗,堆積在殘骸之上宛如鮮美的綠草果醬,塗抹九份二山封存了內部真相的現身契機。
  • 在苦勞網的建檔評論裡面,在網路評論者的 blog 與回應中,這些對話讓我們有機會能夠回到那集體的創傷體驗之中,再一次的反思與面對自己。正如同我在另外一篇文章中提到,應該要有一種讓《生命》的影像能夠成為世界公民的公共財的授權形式,讓集體的生命體驗回到眾人自身。檔案共享不應該只是拿來傳遞消費取向的文化商品,也應該讓對生命的凝視、深刻的批判有機會可以讓更多人傳遞,就如同這篇文章所選擇的 creative commons(創意共用公共財)授權模式一樣:創傷作為一種文件,應該要能夠被今日的技術環境與網路環境如實地保存下來,能夠讓人們以各種可能去尋找那點亮現在潛能的片刻。

  • 既然是观点既然是声音,理应受到尊重,但我们往往只尊重自己的立场,却无视与我们相左的任何意见、观点和声音。我发现博客圈中人是相对自由也比较敏感的一个群体,一两句不合就开始打口水战,从零星作战慢慢演变成一场集团正规战,这根我们老家几个地痞赖子从单挑到群殴儿有什么区别,太不和谐了。
  • 博客生态圈(blogosphere)不是独门独派,她也不是华山论剑气宗剑宗,每天都有各种领域的博客站在各自的角度用各己的理解发表个人的观点。博客观点不存在统一口径,每个博客的观点都是非常新鲜充满个性,这既是我们喜欢博客的原因,也是博客与传统媒体不一样的地方。传统媒体拥有自己的渠道和资源,加上站的高度不同,所以往往一个鼻孔出气;博客是两个鼻孔...不,七窍出气,就算嘴里冒口气、下面排臭气那也是观点,那也是声音。

  • 为了让制度可以有持续性,我们必须用利润来进行激励。而如果企业服务的对象非常贫困,那利润就不大可能产生,那这时我们就需要另一个激励手段,那就是认可(recognition)。企业得到认可就意味着它的知名度提高了,知名度能吸引顾客,更为重要的是,它可以感召优秀的人才前来加盟。这种知名度能够让好的行为得到市场的嘉奖。当企业在市场上无法赢利的情况下,知名度可以是一种替代;而如果可以实现市场利润,则知名度又是额外的激励。   我们的挑战就是设计出一个新的制度体系,让利润和知名度这样的市场激励发挥作用,使企业更加倾向于为穷人服务。我把这种想法称为创新型资本主义(creative capitalism)。通过这种途径,政府、企业及非赢利组织可以进行合作,让市场的作用在更大的范围内发挥作用,从而更多的人可以从中赚取利润,或是得到认可,最终改善全球不平等的现象。
