Law School talk on legal challenges of the interwebs tomorrow: The Sydney Law School will tomorrow host a seminar to discuss the very modern challenges of private international law jurisdiction in cyberspace. "Trade and commerce have become increasingly international - we no longer live in a world where merchants typically do business with others located in the same country. Businesses are just as likely to look to potential partners overseas, and will frequently conclude their transaction over the internet… without ever meeting or speaking to each other," says Associate Professor Chester Brown.

In the US a coalition consisting of Google, Microsoft, Ebay, AT&T, and Intel is fighting for a change of the Electronics Communications Privacy Act (ECPA) that was enacted in 1986. The coalition stresses the fact that the Internet has changed tremendously since then and the law therefore needs to be adapted. It protects files in the homes of people but law enforcement entities do not need judicial warrant to view files stored with ISPs, in the cloud or get GPS data from mobile phones.\nDefinitely a case worth fighting for - and an opportunity for Google & Co. to get good press. What about the law that allows checking and copying peoples' computer harddrives at airports though?

This article discusses the rhetorical question of how the Internet culture of youths, does not have laws that adequately serve or protect. Some laws are too concrete, while others are non existent. Laws need to be redefined, as the Internet culture does not necessarily dictate the same types of culture and attitudes we experience in person. The laws at present, provide loopholes, that either are not justified persecutions, or are simply to harsh, and or simply allow the offender to walk away.

This article eloquently discusses the importance of the internet in our lives and addresses issues of the digital divide. Internet use has become so woven into everyday life that some technology experts say online access should be legally protected, even to the point of considering it a human right. ''It's a social inclusion question,'' said Cyberspace Law and Policy Centre executive director David Vaile

Following on from the BBC's survey of 27,000 people in 26 countries which resulted in 79% of adults regarding internet access as a human right, David Vaile from the Cyberspace Law and Policy Centre and Brett Solomons, formerly of GetUp and now AccessNow.org, have both put their weight behind this approach. Some countries already include internet access as a consumer legal right and other countries regard it as a human right.

The University of Sydney's IT Alumni Association will next week bring together IT experts in networking, industry, law, child welfare and ethics to discuss the Federal Government's plans to introduce compulsory internet filtering by Internet Service Providers. The University of California published a report about Internet privacy. 1.000 Americans were interviewed last summer. The result: 55% are more concerned about privacy issues then they were five years ago - mainly because they know more about the subject now. But still only 14% read privacy policies on websites. Besides that younger Internet users belief that their privacy is protected by the law.

Australian censorship laws reach a new level.

I'm not certain how this fits into the RC internet filtering, but by requiring artists to lodge a $500 application for expert appraisal to certify an image 'art' as opposed to any old image that is subject to child pornography laws, you implicity RC everything else.

There is a call for specific cyber bullying laws to be introduced on Australia.  A recent case that led to the suicide of a 17 year old boy led to the sentencing of a man to a community service order. The Government has agreed that more needs to be done to empower and protect victims.

This offers an overview of how the debate over the proposed mandatory internet filtering law has played out to date. In particular it outlines key voices in the debate and their stance.

Nick Xenophone wants a new law introduced that  could see people being jailed for up to 5 years if they lie about their age to children.  The idea has come about after the murder of Carly Ryan in 2007. 

In an attempt by the government to modernise the 25-year-old Sex Descrimination Act, new laws have been made to protect teenagers from cyber-bullying acts such as sexting and online harrassment. It also protects breastfeeding women and gives men the same protection as women in the workplace when it comes to family responsibilities.

Very interesting article on Hollywood vs. downloads and ISPs. 

Really enjoyed this article and its historical account of Hollywood on the defensive to any new emergence of technology is apt. Unlike the open source software movement, this industry fails to understand that the circulation of its content, whether licensed or not, eventually produces indirect benefits. Hollywood defends its position through laws created in a time when the internet was yet to be conceived. The obvious flow on discussion here is that the law simply can't stay abreast of rapid technology changes.

"A national review of computer game classification laws is currently in progress and work is also under way to develop proposals to improve compliance by retailers."" The article also leads with the factlet that Aust is one of only Western nations WITHOUT an R18+. On this front, the current internet governance proposals looks like a lay down misere.

It is the first time in North America that assisted suicide laws have been applied to the Internet. William Melchert-Dinkel has been charged with assisting in 2 suicides, where he posed under several aliases and made suggestions of suicides from medication to advice on how to tie nooses. Though the argument was that suicide is the behaviour done unto oneself, and suggestion is freedom of speech, this is no different than cyberbullies who also suggest the same thing, however this heinous individual offered information to those that were indanger of commiting suicide. Based on the wording in the state of Minnesota, assisted suicides do not require the actual physical presence of the person, hence the prosecution stands.

A group of teenagers in the US have been charged after months of bullying led to victim committing suicide. The district they live in has since passed a law requiring anti-bullying to form part of the curriculum.  

Australian government is planning to accedeto the concil of Europe's Convention on Cybercrim, to further govern online content. several opinons appeared, one is saying that "age-appropriate" filtering is more effective than compelling ISPs to provide access to stored electronic communications for foreign law enforcement pruposes.

Reporters without boarders has set up the new enemes of the Internet 2010. Australia and South Korea where draconian laws are creating too many specific restrictions on Web users by challenging their anonymity and promoting selfcensorship. they are democratic countries under surveillance and their upcoming implementation of a highly developed Internet filtering system is very controversial.

This article discusses the difficulties of ensuring that cyberbullying is prevented, or monitored. It also discusses how the technology appears to supersede the school's governance of the appropriate use of technology with respect to the Internet. The article mentions an analogy to the Lord of the Flies, as children become savages when unsupervised, which contradicts the article "Cyberbullying is focus of conference," which states that children are unaware of their actions. This is a bit ironic, as the book was an actual microcosm of world war 2, and therefore the story is symbolic of war very much induced by adults.
