Busting the 'Nothing to Hide' Argument - Tech Insider - 0 views

    We've all heard the argument before: "Why should you worry about the government looking into your personal records if you have nothing to hide?" Daniel J. Solove, an associate professor of law at The George Washington University Law School, analyzes that argument in a recently published paper titled "I've Got Nothing to Hide and Other Misunderstandings of Privacy." Solove argues that "the question assumes faulty assumptions about privacy and its value." Those who make the "nothing to hide" argument fail to understand the chilling effect that surveillance has on public discourse, the fact that small bits of private data (which an individual may not object to being uncovered) when put together form a larger and more intimate profile (which an individual may object to), and the mistake of having one's profile mistakenly associated with a group that is labeled as threatening. Here's an excerpt from the paper, which was published in the latest issue of the San Diego Law Review: [T]he problem with the "nothing to hide" argument is that it focuses on just one or two particular kinds of privacy problems - the disclosure of personal information or surveillance - and not others. It assumes a particular view about what privacy entails, and it sets the terms for debate in a manner that is often unproductive. It is important to distinguish here between two ways of justifying a program such as the NSA surveillance and data mining program. First is to not recognize a problem. This is how the "nothing to hide" argument works. It denies even the existence of a problem. The second manner of justifying such a program is to acknowledge the problems but contend that the benefits of the NSA program outweigh the privacy harms. The first justification influences the second, for the low value given to privacy is based upon a narrow view of the problem.     Another report on Sears getting slapped on the wrist for questionable data collection. Gee, why don't businesses take information law seriously? Maybe because it is more profitable to ignore it and pay a small fine? Not impressed by Obama's enforcement of privacy law.

    Sears today agreed to settle Federal Trade Commission charges that it failed to disclose the depth of consumers' personal information it collected via a downloadable software application. The settlement calls for Sears to stop collecting data from the consumers who downloaded the software and to destroy all data it had previously collected. If Sears advertises or disseminates any tracking software in the future, it must clearly and prominently disclose the types of data the software will monitor, record, or transmit, the FTC stated. Sears must also disclose whether any of the data will be used by a third party, the FTC said.

Woman gets jail for stealing identity - 0 views

    A Troy woman learned Tuesday that she will spend 180 days in the Livingston County Jail for stealing the identity of a local woman who was dying. Judge Stanley J. Latreille also sentenced Vershawn Jones, who earlier pleaded guilty to identity theft, to four years of probation. Assistant Prosecutor Pamela Maas said the victim, who was not in court Tuesday, wanted to know how Jones, 38, got his wife's identification. His wife, Maas noted, was dying in a Hospice facility at the time. Jones, who said she operated a mortgage business, said she got it from one of four employees who brought her applications from people seeking mortgages. Those applications included personal information, such as Social Security numbers, she said. When pressed for names, Jones glanced at her attorney and shrugged. "I apologize to the victim and the victim's family," she said. "I've done the best I can running my own business." Maas initially requested that the state be allowed to withdraw from the plea deal that called for her office to recommend Jones serve no more than 90 days in the county jail after noting Jones had twice been sent to jail for failing to show for court hearings. While Jones apologized, Latreille was unmoved, telling the defendant "you're fortunate you're not going to prison."

Card Data Breached, Firm Says - WSJ.com - 0 views

    A New Jersey credit-card processor disclosed a data breach that analysts said may rank among the biggest ever reported. Heartland Payment Systems Inc. said Tuesday that cyber criminals compromised its computer network, gaining access to customer information associated with the 100 million card transactions it handles each month. The company said it couldn't estimate how many customer records may have been improperly accessed, but said the data compromised include the information on a card's magnetic strip -- card number, expiration date and some internal bank codes -- that could be used to duplicate a card. Heartland, of Princeton, N.J., processes transactions for more than 250,000 businesses nationwide, including restaurants and smaller retailers. Avivah Litan, an analyst at research company Gartner, called it the largest card-data breach ever, based on her conversations with industry executives. Previously, the largest known breach occurred when around 45 million card numbers were stolen from retail company TJX Cos. in 2005 and 2006. Robert Baldwin, Heartland's president and chief financial officer, said it was too early to say how many records were accessed and that calling it the largest-ever breach would be "speculative." Representatives of Visa Inc. and MasterCard Inc. alerted Heartland to a pattern of fraudulent transactions on accounts the processor handled sometime last fall, Mr. Baldwin said. But an internal investigation and audits failed to detect a security breach. Last week, however, a forensic investigator discovered evidence of the breach. Mr. Baldwin said Heartland was targeted with malicious software that was "light-years more sophisticated" than malevolent programs commonly downloaded from the Internet.

    Americans are about to re-learn that bank deposit insurance isn't free, even as Washington is doing its best to delay the coming bailout. The banking system and the federal fisc would both be better off in the long run if the political class owned up to the reality. We're referring to the federal deposit insurance fund, which has been shrinking faster than reservoirs in the California drought. The Federal Deposit Insurance Corp. reported late last week that the fund that insures some $4.5 trillion in U.S. bank deposits fell to $10.4 billion at the end of June, as the list of failing banks continues to grow. The fund was $45.2 billion a year ago, when regulators told us all was well and there was no need to take precautions to shore up the fund.

    Social networking users are more vulnerable than ever and taking more risks with their online privacy. According to the 'Bringing Social Security to the Online Community' poll by AVG, while the social networking community has serious concerns about the overall security of public spaces, few are taking the most basic of steps to protect themselves against online crimes. Participants indicated concern over growing phishing, spam and malware attacks, and nearly half of those surveyed are very concerned about their personal identity being stolen in an online community. Despite widespread use of social networks at home and/or at work, 64 per cent of users infrequently or never change their passwords on a regular basis, while 57 per cent infrequently or never adjust their privacy settings. Further, 21 per cent accept contact offerings from members they do not recognise, more than half let acquaintances or roommates access social networks on their machines, 64 per cent click on links offered by community members or contacts and 26 per cent share files within social networks. As a result of this widespread proliferation of links, files and unsolicited contacts, nearly 20 per cent have experienced identity theft, 47 per cent have been victims of malware infections and 55 per cent have seen phishing attacks.

Centrist Group Calls for Laws Curbing Online Tracking | Epicenter | Wired.com - 0 views

    "A key, centrist digital rights group is set to put out a report calling for strong federal privacy laws and guidelines to regulate the growing tracking and targeting of Americans online. It argues that the self-regulation approach that industry fights for just hasn't worked. The online ad industry has "historically failed to fully implement its self-regulatory principles," according to the 34-page draft report by the Center for Democracy and Technology. CDT is a centrist D.C. group that works with and is substantially funded by the tech industry, including companies like Facebook, Google and AOL that are deeply invested in targeted ads. "Recently revised self-regulatory principles still fall short (.pdf) even as written," charges the draft, obtained by Wired.com. These tough words spearhead a new tactic for a group more used to convening inside-the-Beltway tech policy forums than launching ACLU-style send-outraged-e-mail campaigns. The CDT, which splintered off from the rabble-rousing Electronic Frontier Foundation 15 years ago, is also planning to launch a "Take Back Your Privacy" campaign on Thursday, designed to garner support for its call for comprehensive federal privacy legislation. Dozens of tech firms, known and obscure, record users' behaviors as they interact with search engines, blogs, e-commerce sites and even government websites. The tracking goes on in the background with little knowledge by consumers and even less oversight from government authorities. The tech industry - like others subject to potentially blunt-forced government regulation - has argued that policing itself was enough to prevent egregious privacy intrusions that could proliferate without any real chance individuals would even be aware of them."

    Federal regulators will be able to take back two years of pay from executives held responsible for a large bank's failure. Executives deemed "negligent" and "substantially responsible" for a big bank's failure can lose all their compensation from the previous two years under a rule approved Wednesday by the board of the Federal Deposit Insurance Corp.

MediaPost Publications FTC Probes Facebook's EPIC Privacy Fail 01/19/2010 - 0 views

    "A privacy watchdog's criticisms of Facebook appear to have captured the attention of the Federal Trade Commission. In a letter dated Jan. 14, David Vladeck, head of the FTC's Bureau of Consumer Protection, told the Electronic Privacy Information Center that its complaint about recent privacy changes at Facebook "raises issues of particular interest for us at this time." Vladeck added that he has asked an official to arrange a followup meeting with EPIC, but also said he can't currently confirm or deny whether the FTC has opened an investigation. FTC investigations are not public until the agency either issues a complaint or closes the matter. The FTC's consumer protection chief also said in his letter to EPIC that the commission plans to focus on privacy issues raised by social networks at the next roundtable, scheduled to be held in Berkeley, Calif. on Jan. 28. "

Kaiser patient medical records compromised - 0 views

    "Medical records for about 15,500 Northern California Kaiser patients - about 9,000 of them in the Bay Area - were compromised after thieves stole an external drive from a Kaiser employee's car last month, Kaiser officials said Tuesday." Kaiser officials said the electronic device contained patients' names, medical record numbers and possibly ages, genders, telephone numbers, addresses and general information related to their care and treatment. No Social Security numbers or financial information was contained on the drive, and Kaiser officials said there's no evidence that the information has been used inappropriately. The device was not encrypted, but some of the information was password protected. Kaiser has sent letters to the 15,500 members and the employee, who Kaiser would not identify, has been fired.
