Heartland agreed to pay a minimum of $1 million to class members and take up settlement-related administration costs, including up to $1.5 million for the cost of notice to the settling class. The company will pay up to $760,000 of the costs of attorneys representing the class members. Heartland said it could terminate the deal if costs of notice exceeded $1.5 million, or if it received more than 2,500 requests for exclusion from the settlement class. The deal settles all intrusion-related proceedings by consumers who used the payment cards between Dec. 6, 2007 and Dec. 31, 2008, including those who may allege to have suffered losses, the company said in a statement. Heartland, which agreed to pay $3.6 million last week to settle claims with American Express Co (AXP.N) related to the criminal breach, reported in January this year that cyber thieves hacked its payment system and stole credit card information. Shares of the New Jersey-based company were down 18 cents at $13.29 Monday morning on the New York Stock Exchange. "

ChoicePoint, now a subsidiary of Reed Elsevier, will pay US$275,000 to resolve the newest FTC complaint. The FTC accused the company of failing to implement a comprehensive information security program to protect consumers' personal information, as required by the agency after the 2004 breach. The April 2008 breach compromised the personal data of 13,750 people, the FTC said in a press release. ChoicePoint turned off a "key" electronic security tool used to monitor access to one of its databases, and failed to detect that the security tool was turned off for four months, the FTC said. For a 30-day period, an unknown hacker conducted thousands of unauthorized searches of a ChoicePoint database containing sensitive consumer information, including Social Security numbers, the FTC said. After discovering the breach, the company notified the FTC. If the software tool had been working, ChoicePoint likely would have detected the intrusions "much earlier," the FTC said. "

The major credit bureaus, Experian, Equifax and TransUnion, charge about $10 to freeze and unfreeze credit reports. Affected consumers will receive about $60 for credit freezes and unfreezes for all three credit bureaus, Blumenthal said. Nearly 30,000 state residents were affected by the nationwide breach, which came to light last August after the FBI arrested a former Countrywide employee on charges of selling personal information, including Social Security numbers, for as many as 2 million loan applicants. In a survey of about 500 U.S. consumers, accounting firm KPMG found that only about 9 percent had tried mobile banking. In comparison, about 76 percent "consistently use" online banking services on computers. As many as 95 percent said they were so uncomfortable with conducting financial transactions on their phones that they've never used them to make a purchase on a retailer's Web site. About 48 percent of respondents cited security and privacy worries as their reason for not banking on their cellphones, according to KPMG. While many respondents said they believe mobile banking is important, according to the accounting firm, they do not think it is important enough to pay extra for it. Roughly 19 percent of respondents said they are "somewhat likely" to a use a mobile device for online banking in the next 12 months but only seven percent said are willing to pay a nominal fee for cellphone banking, according to the survey. And even though most of the major U.S. banks offer a mobile banking service, about 68 percent of the survey respondents said their bank does not offer the service. "The fact that the majority of U.S. consumers are not aware that their current banks offer mobile banking is clearly more perception than reality," said Carl Carande, a principal in KPMG LLP's Advisory and Banking and Finance practices. Banks offering mobile services include Citigroup Bank of America and Wells Fargo.

"Privacy advocates have provided little detail on the benefits of more privacy and have typically ignored the costs or trade-offs associated with increasing privacy," the paper said. Data collection delivers ads that people want and that advertising pays for a multitude of free services online, said the paper, co-authored by TPI President Thomas Lenard and Emory University law and economics professor Paul Rubin.

Formal notice of a settlement agreement will be sent to people who used TD Ameritrade's services before mid-September 2007. U.S. District Judge Vaughn Walker in San Francisco approved a revised version of the settlement agreement earlier this month despite some misgivings about it. Last summer, Walker rejected an earlier version of the deal. Anyone who held an Ameritrade account or provided an e-mail address to the company before Sept. 14, 2007, could benefit from the lawsuit. The database that was breached included information on 6.2 million people. The plaintiffs in the lawsuit said they received unwanted e-mail ads about certain stocks. The ads appeared to be designed to manipulate the value of thinly traded stocks. Ameritrade officials and one of the lead plaintiff's attorneys, Scott Kamber, have said the data theft has not been linked to cases of identity theft. As part of the proposed settlement, the Omaha-based company will pay nearly $1.9 million in legal fees and cover the cost of one year of anti-spam service for the victims. Ameritrade also promised to better protect customer data. Those terms have not changed from the original proposed settlement. But the new agreement will more clearly state that Ameritrade customers were at risk of identity theft, and it will preserve customers' ability to pursue identity theft claims against Ameritrade. Most of the changes to the agreement happened because the Texas Attorney General's Office and a former named plaintiff objected to the previous deal. In his order, the judge questioned whether the settlement does enough to benefit Ameritrade clients whose information was stolen. A recent report by the consumer group Families USA found monthly COBRA premiums for family coverage were $1,069, or 83.6% of the average monthly unemployment insurance benefit of $1,278. In nine states, average COBRA payments exceeded unemployment benefits, the group found. Health groups have been largely supportive of the proposal, with AHIP President Karen Ignagni writing in a letter to House Speaker Nancy Pelosi that the group believes the move would "help ensure continuity of coverage and serve as an important lifeline for many workers who do not qualify for Medicaid, but still need help paying their health insurance premiums."

Names of the patients' doctors were also included. The settlement "will restore appropriate privacy protections to tens of millions of people across the country," FTC chairman William Kovacic said in a statement. "It also sends a strong message" that organizations "are required to secure consumers' private information," he said.

A team of hackers managed to hack into StrongWebmail CEO Darren Berkovitz's Web mail account, using what's known as a cross-site scripting (XSS) attack, the company confirmed Monday. "They did it using an XSS script that took advantage of a vulnerability in the backend webmail program," StrongWebmail said in a statement. StrongWebmail launched the contest at the end of May as a way of promoting the voice-based identification technology sold by its parent company, Telesign. Hackers were given Berkovitz's e-mail address and password and challenged to break into the account. The company thought this would prove difficult because StrongWebmail requires a special password that is telephoned to the user before e-mail can be accessed.

Civic Center area, sources told The Times at the time. No accidents occurred as a result. As part of their plea deal, the engineers agreed to pay $6,250 in restitution and completed 240 hours of community service."
