    The first sign that something was wrong seemed harmless: A new Dell credit card arrived in my mail one afternoon. More landed in the mailbox the next day. Macy's. Bloomingdale's. Crate and Barrel. Radio Shack. Then later: Visa Sony, Toys R Us and Lowe's cards turned up. I didn't request any of these cards. My first call to Dell revealed what I suspected. Someone had applied for a credit card using my name. I felt violated and vulnerable. Then, it hit me: I've become a statistic, a victim of identity theft. A thief had taken my name, my credit and my identity and managed to spend more than $8,000 (money that, I'm grateful, I didn't have to pay). I still don't know who the culprit was or how it happened. All I know is that if this happened to me - a Sun Sentinel consumer affairs and watchdog reporter - it can happen to anybody. Thieves move quickly Identity theft is the fastest growing crime in the United States, according to the Federal Trade Commission, which enforces identity theft laws. Experts estimate 10 million Americans become victims of identity fraud each year. Last year, businesses lost $56.6 billion to ID theft, the commission said. I've spent hours on the phone talking to fraud investigators, credit bureaus and bank staff as I've tried to sort out the mess that is now mine to clean up. I was exhausted every time a call ended. Individual investigations, conducted by fraud departments for each of the credit card companies that issued accounts in my name, took months to complete before concluding I was a victim of ID fraud. But there is a bright side to this story. I thought I knew how to protect myself. But what I've learned through this experience has taught me that you can never be too careful. I also learned some hard lessons along the way about how best to safeguard my personal information in the future - and respond, if my identity is targeted again.

    America's civil engineers think the nation's aging and rusty infrastructure is just not making the grade. The American Society of Civil Engineers issued an infrastructure report card Wednesday giving a bleak cumulative ranking of D. "We've been talking about this for many many years," Patrick Natale, the group's executive director, told CNN. "We really haven't had the leadership or will to take action on it. The bottom line is that a failing infrastructure cannot support a thriving economy." Video Watch what the report had to say » The ranking -- which grades the condition of 15 infrastructure entities such as roads, bridges and dams -- is the same as the the last time such a report was issued, in 2005. In 2001, the grade was D+, slightly better but still poor. Roads got a D-, with Americans spending more than $4.2 billion a year stuck in traffic. "Poor conditions cost motorists $67 billion a year in repairs and operating costs. One-third of America's major roads are in poor or mediocre condition and 45 percent of major urban highways are congested," the engineers' report said. Drinking water, D-. "America's drinking water systems face an annual shortfall of at least $11 billion to replace aging facilities," the report said. "Leaking pipes lose an estimated seven billion gallons of clean drinking water a day." Inland waterways, D-.     Hundreds of medical records kept by a longtime Acton family doctor who abruptly closed his practice last year are about to be destroyed, leaving patients without crucial information and exposing a gap in state law about who owns abandoned medical records. On April 8, a Lynn storage company is scheduled to discard the records and auction the equipment left by Dr. Ronald T. Moody, who was evicted from his office last September as state regulators pursued him, saying he was practicing without a license. Many of Moody's former patients have no idea that their records are slated for destruction: None has been notified, nor does the law require such notice. "We throw people's lives away on a daily basis, and, believe me, we go out of our way to try and find someone" to salvage belongings, said Jim Appleyard, owner of the storage company that was hired by Moody's former landlord to clean out the office and store the items for six months, as required by law. But the idea of dumping hundreds of patients' files without them knowing about it bothered Appleyard. Unable to find Moody, he contacted the state Board of Registration in Medicine and pleaded to take the dozens of boxes of records. The board regulates doctors and administers rules governing medical records of physicians in private and group practices.

    The country's largest office products store sold a returned computer hard-drive on clearance containing hundreds of personal files on it - a move privacy experts say violates key provisions of a privacy law requiring businesses to safeguard personal information of customers. The transaction occurred recently at a Staples Business Depot store in Ottawa, one of about 300 across the country. When the purchaser booted up the Maxtor mini, he found hundreds of files on the external hard drive. The files, totalling about 400, belonged to Jill Vickers, a retired political science professor from Carleton University. They included some research papers already in the public domain, but some were sensitive documents. "It is especially of concern to me as the files contain some 20 years of reference and assessment letters which are confidential documents," said Vickers, who recently purchased a new computer system for her home that initially included the Maxtor backup drive. When her son, who was tasked with transferring her files to the drive, noticed the daily automatic backup function was not functioning properly, he returned it to Staples. He thought he had deleted the files. "Even though it's not in my possession, it's my data. They should wipe it clean," Vickers said of Staples. Canwest News Service last week provided Staples with the model and serial number of equipment, as well as the receipt for the clearance purchase. A company spokeswoman said it required more time to gather the facts to comment on the specific incident. "We will continue to look into this," said Alessandra Saccal. In a statement, she reiterated, "privacy of any kind is of great concern to us, that is why we have procedures in place to clear any items with memory before being resold."

Privacy Challenges Could Stall Smart Grid | Green Business | Reuters - 0 views

    President Barack Obama's plan to overhaul U.S. infrastructure includes constructing a nationwide "smart grid" that promises to help address many of our current energy challenges. The smart grid plan offers the hope that it "will save us money, protect our power sources from blackout or attack, and deliver clean, alternative forms of energy to every corner of our nation." While these are noble societal goals, smart grid technologies and systems as envisioned also raise concerns about individual privacy rights. Part of what makes the smart grid "smart" is its ability to know a lot about the energy-consuming devices in our homes and to monitor activity for those devices to help determine when power should be used or limited. Such knowledge is useful in regulating power consumption to use energy more efficiently. In addition to reaching into homes to regulate devices, information about usage and activities could be extracted from homes. Home energy consumption patterns could be gathered and analyzed on a room-by-room and device-by-device basis to determine which devices are used and at what time of day. Although this sort of information may not be considered terribly invasive for some, for others anything that violates the sanctity of "home" may cause tremendous concern.

    When CardSystems Solutions was hacked in 2004 in one of the largest credit card data breaches at the time, it reached for its security auditor's report. In theory, CardSystems should have been safe. The industry's primary security standard, known then as CISP, was touted as a sure way to protect data. And CardSystems' auditor, Savvis Inc, had just given them a clean bill of health three months before. Yet, despite those assurances, 263,000 card numbers were stolen from CardSystems, and nearly 40 million were compromised. More than four years later, Savvis is being pulled into court in a novel suit that legal experts say could force increased scrutiny on largely self-regulated credit card security practices. They say the case represents an evolution in data breach litigation and raises increasingly important questions about not only the liability of companies that handle card data but also the liability of third parties that audit and certify the trustworthiness of those companies. "We're at a critical juncture where we need to decide . . . whether [network security] auditing is voluntary or will have the force of law behind it," says Andrea Matwyshyn, a law and business ethics professor at the University of Pennsylvania's Wharton School who specializes in information security issues. "For companies to be able to rely on audits . . . there needs to be mechanisms developed to hold auditors accountable for the accuracy of their audits." The case, which appears to be among the first of its kind against a security auditing firm, highlights flaws in the standards that were established by the financial industry to protect consumer bank data. It also exposes the ineffectiveness of an auditing system that was supposed to guarantee that card processors and other businesses complied with the standards.
