Nextgov - MP3 privacy breach exposes government's privacy liability - 0 views

    Reports on Tuesday of a New Zealand man who purchased a secondhand MP3 player containing the personal information of U.S. soldiers highlighted the federal government's continuing inability to protect private information on unauthorized, third-party storage devices. New Zealander Chris Ogle bought a used MP3 player in Oklahoma about a year ago, according to New Zealand's public television station, ONE News. A few weeks ago, when he plugged the player into his computer to download a song, Ogle found 60 military files stored on the device, which included names, addresses, and phone and Social Security numbers of U.S. soldiers. The files also contained what appears to be a mission briefing and lists of equipment deployed to Iraq and Afghanistan. Most of the files are dated 2005. ONE News reported that some of the phone numbers on the player are still active. "The more I look at it, the more I see and the less I think I should be," Ogle told ONE News. Ogle offered to return the MP3 player to U.S. officials if requested. Privacy experts say the breach is just the latest example of the federal government's inability to manage the security risk posed by removable storage devices. In November the Defense Department banned the use of removable storage devices after reports that hardware that can be inserted into a USB drive could infect the computer with viruses and worms. A Pentagon spokesman said the military is aware of the latest report form New Zealand, but does not know of any action the department has taken. Michael Maloof, chief technology officer for the information security firm TriGeo Network Security in Post Falls, Idaho, said individuals do not view devices like MP3 players as computers that can store large amounts of private data. "Myself and security experts have been saying for some time that phones and MP3 players are really mass storage devices," he said. The military should "ban all mass storage devices.     A New Zealand man has found confidential United States military files on an MP3 player he bought at an op shop in the US. Chris Ogle, 29, from Whangarei, bought the player from an Oklahoma thrift shop for $NZ18 ($A14.50), and found the files when he hooked it up to his computer, TV One News reported on Monday night. The 60 files on the player contained the names and personal details of American soldiers, including ones who served in Afghanistan and Iraq. There was also information about equipment deployed to bases and a mission briefing. "The more I look at it, the more I see and the less I think I should be," Ogle said. Victoria University strategic studies director Peter Cozens said one of the first rules of military endeavour was to not give the opposition information that could compromise your position. "This is just slack administrative procedures which are indeed a cause of embarrassment. It's the sort of thing which ought not really be in the public domain, he said. Ogle said the player never worked as a music player and he would hand it over to the US Defence Department if asked.

    Now that behavioral targeting has become more pervasive (and more effective), it is being talked about not only by publishers and advertisers, but also by privacy advocates -- organizations like the NAI and IAB and, in Washington, the FTC. At issue is if BT players are doing enough to disclosure to consumers how BT works and offering them the opportunity to opt out of being tracked by BT vendors and publishers. There has been much discussion about how to regulate behavioral marketers; but no solution that satisfies everyone. The BT industry so far has contended that website privacy policies are sufficient disclosure since many of them contain links to opts out opportunities like the NAI site. Google and Bluekai have announced 'preference pages' or registries that allow Web users to say what type of BT they are interested in receiving. But, the other, more common option is to put that information in the Privacy Policy of the site. But the problem with that is that no matter where disclosures are placed on the service provider's site, most people won't ever see them. How will a customer visiting Retail SiteX know that Company Y is going to use their browsing behavior to later display relevant ads to them as they surf the Web on Network Z? The average customer won't. The only way a customer will know what forms of BT advertisers are using is if the advertisers themselves tell them. I think that it's time for advertisers to step up in this privacy debate. Thus far the pressure for disclosure has been placed on networks, behavioral marketing providers and publishers. The key players in those industries have done a good job of becoming more transparent (though there is still work ahead of us), while advertisers haven't been asked to do anything. Advertisers are clearly benefiting from behavioral marketing, and its time they disclosed what type of behavioral marketing they participate in, and allow customers to opt-out.     Don't underestimate the maddening complexity and considerable costs of digitizing health care records and processes. That was the overarching message from a dozen or so health care players, some of them doctors, following my recent column urging the industry to bring its IT practices into the 21st century. A few readers took issue with my labeling health care practitioners as "laggards." In fact, argues Dr. Daniel Essin, former director of medical informatics at Los Angeles County + USC Medical Center, "physicians are, and have always been, early adopters of technology." Essin, who's now chairman of an electronic medical records vendor, ChartWare, says many physicians have made multiple attempts to implement EMRs but failed. He cites six main reasons: * They can't articulate a set of requirements against which products can be judged. * EMR systems aren't flexible enough, requiring workarounds even before their implementation is complete. * There's a mismatch between the tasks products are expected to perform and the products' actual functionality. * Some systems are conceived as a "simple" add-on to the billing system. * System workflows consume way too much physician time and attention. * There isn't adequate integration between internal and external systems. Related to most of those obstacles is cost. One EMR kit at the entry level, offered by Wal-Mart's Sam's Club unit in partnership with Dell and eClinicalWorks, is priced at around $25,000 for the first physician and $10,000 for each additional one. After installation and training, annual maintenance and support costs are estimated at $4,000 to $6,500. That's still not chump change, especially for the smallest practices.

    Rarely is the response to a new government initiative a unanimous round of "thumbs up," but so far that seems to be the case regarding yesterday's (April 9) announcement that The Defense Department and the Department of Veterans Affairs will collaborate on building an electronic database of administrative and medical information for U.S. servicemen and women. Since developing a broad electronic health records (EHRs) initiative is a prominent feature of the Obama Administration's economic stimulus plan, it makes sense to start (or at least focus) on a defined segment of the population -- current and past military personnel. But, apart from the specific technology, architecture and technical administration aspects of this program, there will be other challenges in pursuing the goal of EHRs for the military -- challenges that insurance technology executives know only too well. These include collaboration among different and sometimes competing interests (in this case, the Department of Defense (DOD) and the Department of Veterans Affairs (VA), which historically have not worked together as closely as one might imagine); and concerns about privacy and security. In fact, the ways in which the military EHRs initiative addresses the privacy issue could provide some interesting best practices (or actions to avoid) for private-sector players. "Currently, there is no comprehensive system in place that allows for a streamlined transition of health records between DOD and the VA," President Barack Obama said at yesterday's announcement, "and that results in extraordinary hardship for an awful lot of veterans who end up finding their records lost, unable to get their benefits processed in a timely fashion.     It's never been easier to get information on the run. Smart devices such as the G1 and Apple iPhone let you put the Internet in your pocket and go - down the block or across the country. But this convenience could cost plenty in lost privacy, consumer advocates and tech analysts say. Once data have been collected and warehoused, you lose control of it forever. "The Big Brother aspect of it is troubling," says Rep. Edward Markey, D-Mass., former chairman of the powerful House Subcommittee on Telecommunications and the Internet. Mobile consumers are especially vulnerable, Markey says. Unlike PCs, cellphones tend to be used by one person exclusively. The information they telegraph - on Web browsing, lifestyle and more - tends to be "highly personalized." That's the main reason mobile data are so prized: The information is incredibly accurate.     A leading technology advisor to President Obama said in a research note for his investment firm today that privacy and net neutrality will be among the biggest telecommunications issues facing the Federal Communications Commission and the administration going forward. Analyst Blair Levin, who was the co-lead of Obama's technology and innovation team along with nominated FCC Chair Julius Genachowski, wrote in a Stifel Nicolaus research note that the economic crisis and change of administration will shift the focus of telecom policy away from traditional phone companies to "Internet/edge" players. Indeed, Google and other Web video and voice companies like Skype have been increasingly active in recent years at the FCC, pushing particularly for net neutrality rules that would prevent carriers from blocking or charging more for certain content that travels over the Web. Levin said in a note that net neutrality will emerge again as an issue in the new administration for wireless networks. On the other hand, there won't likely be a push for new net neutrality rules for cable, DSL, and fiber network carriers at the FCC. "(There is a) consensus emerging that disputes about whether a wireline network management tool is 'reasonable' (or is actually blocking or degrading traffic) to be resolved on a case-by-case basis," Levin wrote in the note with analysts Rebecca Arbogast and David Kaut. It would be a tough climb to impose rules that force wireless carriers to open their networks. Apple and AT&T successfully argued to lawmakers and regulators to keep their exclusive iPhone contract. Industry Giants to Weigh in on US Privacy Laws - PC World - 0 views

    A group of U.S. companies, led by technology giants Microsoft, Hewlett-Packard and eBay, is set to outline recommendations for new federal data-privacy legislation that could make life easier for consumers and lead to a standard federal breach-notification law. The recommendations, which were developed by a group of industry players called the Consumer Privacy Legislative Forum, are set to be released at an upcoming privacy conference six weeks from now, according to Peter Cullen, Microsoft's chief privacy officer. The companies have been working for the past three years to encourage the adoption of federal consumer data-privacy laws and to answer the question of what federal legislation should look like, Cullen said in an interview. Other forum members include Google, Oracle, Procter & Gamble and Eli Lilly. One idea is that laws should make it easier for consumers to understand what they're getting into when they share their personal data with Web sites, Cullen said. "The whole focus on consent really puts an unfair burden on the consumer," he said. "My mom doesn't know what an IP address is." The recommendations will cover rules around data use and the ability of consumers to correct inaccurate data. And they will cover data breach notification, which is now covered by a patchwork of state laws. Simplifying breach-notification laws by creating a single federal standard is important, Cullen said Wednesday while speaking at a discussion of privacy policy in San Francisco. "It's not that there is no privacy law. There's actually too much privacy law," he said. "If you think about data-breach notification laws just as an example, there are 38 state laws, many of them very different." "We need to think about much more of a framework approach." Congress has passed some laws covering consumer data privacy, such as the 1996 Health Insurance Portability and Accountability Act (HIPAA), but existing laws do not comprehensively cover consumer privacy in general.

    The use of data in the online world is being governed by the rules of the "Wild West," the European Commission will argue this week, in the clearest warning yet to Internet companies to curb how they use the information they collect on users. With concern growing over the amount of data gathered by the biggest players on the Internet, the comments will challenge the industry to agree on new principles for its use - or face a clampdown. Meglena Kuneva, the European consumer affairs commissioner, will argue that basic consumer rights are being violated by companies that profile and target consumers, according to a draft of a speech seen by the International Herald Tribune. "From the point of view of commercial communications," the draft speech reads, "the World Wide Web is turning out to be the world 'Wild West."' Kuneva is to deliver the speech to a meeting of around 200 industry and consumer representatives on Wednesday. Her comments reflect the anxiety of regulators on both sides of the Atlantic about the commercial use of information garnered through online tracking made possible via "cookies" - small files dropped into users' computers by the Web sites they visit. These cookies help companies take note of users' habits and can be sold to advertisers to help them target their marketing efforts. But their use raises serious questions about who knows which sites we visit and what they do with that information. In the United States, the chairman of the Federal Trade Commission, Jon Leibowitz, warned recently that, if the industry does not show it can protect users' privacy, it will invite legislation from Congress and a more regulatory approach from the F.T.C.

    On Monday, U.K.-based digital rights organization Open Rights Group submitted an open letter to major online media players, urging them to prevent ISP-level behavioral targeting firm Phorm from tracking user interactions on their Web sites. The letter, sent to Google, AOL, Microsoft, Facebook, Yahoo, Amazon and Ebay, said, "[ORG] believes that it is clearly in your company's interest, it is in the interests of all of your customers, and it will serve to protect your brand's reputation, if you insist that the Phorm/Webwise system does not process any data that passes to or from your website." "We have received the letter and are giving it careful consideration from privacy and business perspectives," a spokesperson for AOL and its social network Bebo told ClickZ News. Similarly, in reference to the ORG correspondence, a Google spokesperson told ClickZ, "We've received the ORG's letter, but we're still considering the points they raised, so we don't have a response to make at this time." According to information published on the British Telecom Web site (one of Phorm's ISP-partners,) site owners can specifically request that their properties are not "scanned" by Phorm's technology, by contacting the firm directly. Phorm announced deals with three major U.K. ISPs over a year ago, but its technology is still yet to be fully deployed. BT has, however, carried out live trials of the platform with some of its customers. Phorm's CEO, Kent Ertugrul, claims that BT will implement his company's technology by the end of the year, but BT itself remains less committed to that timeline. Both AOL and Google have vested interests in the behavioral targeting space, although not in the controversial area of deep packet inspection (DPI), in which Phorm's technology lies. AOL-owned Tacoda targets ads based on users' activity across a range of partner sites, but does not directly intercept ISP-data.     A very heated reaction has followed the interview I conducted yesterday with Robert Carr, CEO of Heartland Payment Systems. One reader even said the resulting Q&A made his "blood boil." Why the outrage? Because Carr did something a lot of people find unacceptable. He threw someone else under the proverbial bus for his company's failure to keep customer credit and debit card numbers out of evil hands. Specifically, he thrust an angry finger at the QSAs who came in to inspect the security controls Heartland had in place to meet the requirements of PCI security. In the article, [Heartland CEO on Data Breach: QSAs Let Us Down] Carr said, "The audits done by our QSAs (Qualified Security Assessors) were of no value whatsoever. To the extent that they were telling us we were secure beforehand, that we were PCI compliant, was a major problem. The QSAs in our shop didn't even know this was a common attack vector being used against other companies. We learned that 300 other companies had been attacked by the same malware. I thought, 'You've got to be kidding me.' That people would know the exact attack vector and not tell major players in the industry is unthinkable to me. I still can't reconcile that." That one comment brought down the house, and not in a favorable way. "I just read Bill Brenner's interview with Heartland Payment Systems' CEO Bob Carr and truthfully, my blood is boiling," Mike Rothman, SVP of strategy at eIQnetworks and chief blogger at Security Incite wrote in a counterpoint piece CSOonline ran today. "Basically, he's throwing his QSA under the bus for the massive data breach that happened under his watch. Basically, because the QSA didn't find anything, therefore he should be off the hook. I say that's a load of crap."

Users increasingly falling victim to malware distributed on Digg, YouTube - SC Magazine US - 0 views

    Infection of the adware called "VideoPlay," which has been spreading through malicious posts and comments on Digg and YouTube, increased 400 percent from January to February, according to Panda Security. Attackers have been posting comments on news stories and videos posted to the social networking sites Digg.com and YouTube.com, claiming users will be able to see videos of celebrities - some of which claim to be pornographic - by clicking a link that is provided, Sean-Paul Correll, threat researcher and security evangelist for Panda Security, told SCMagazineUS.com in an email Tuesday. But, when a user follows the link, they will be re-directed to a page where they will be prompted to download a codec to view the video. The download is the VideoPlay adware - a worm that aims to steal email login credentials and other information stored in a user's browser and then further propagate itself through removable drives.
