"What we're starting to see is a move toward making people more and more identifiable," University of Ottawa law professor Ian Kerr said Wednesday. His comments followed the launch of Lessons from the Identity Trail: Anonymity, Privacy and Identity in a Networked Society, a book summing up the study's findings, at a public reading in downtown Ottawa hosted jointly with the Privacy Commissioner of Canada. Kerr led the study with University of Ottawa criminology professor Valerie Steeves. They collaborated with 35 other researchers in Canada, the U.S., the U.K., the Netherlands and Italy. The researchers reported that governments are choosing laws that require people to identify themselves and are lowering judicial thresholds defining when identity information must be disclosed to law enforcement officials. That is allowing the wider use of new technologies capable of making people identifiable, including smartcards, security cameras, GPS, tracking cookies and DNA sequencing. Consequently, governments and corporations are able to do things like: * Embrace technologies such as radio frequency identification tags that can be used to track people and merchandise to analyze behaviour. * Boost video surveillance in public places. * Pressure companies such as internet service providers to collect and maintain records of identification information about their customers. While Canada, the U.K., the Netherlands and Italy all have national laws protecting privacy - that is, laws that allow citizens to control access to their personal data - such legal protection does not exist for anonymity, Kerr said. "Canada is quite similar [to other countries] with respect to anonymity. Namely, it's shrinking here just as it is there.

"Certain companies have been disposing of records containing sensitive consumer information in very questionable ways, including by leaving in bags at the curb, tossing it in public dumpsters, leaving it in vacant properties and/or leaving it behind in the offices and other facilities once they've gone out of business and left those offices," says Jacqueline Klosek, a senior counsel in Goodwin Procter's Business Law Department and a member of its Intellectual Property Group. "In addition, company computers, often containing personal data, will find their ways to the auction block," she adds. "All too often, the discarded documents and computer files will sensitive data, such as credit card numbers, social security numbers and driver's licenses numbers. This is the just the kind of data that can be used to commit identity theft." Discarded and unguarded data is now low-hanging fruit for criminal harvesters and corporate spies. "Recent client activity supports that competitors are beginning to buy up such auction devices specifically with the intention of trying to salvage the data," says James DeLuccia, author of IT Compliance & Controls. This, he said, would save some $80 billion a year, safeguard against medical errors, reduce malpractice lawsuits, and greatly facilitate both preventive care and ongoing therapy of the chronically ill. Following his announcement, we spoke with fellow physicians at the Harvard teaching hospitals, where electronic medical records have been in use for years. All of us were dumbfounded, wondering how such dramatic claims of cost-saving and quality improvement could be true. The basis for the president's proposal is a theoretical study published in 2005 by the RAND Corporation, funded by companies including Hewlett-Packard and Xerox that stand to financially benefit from such an electronic system. And, as the RAND policy analysts readily admit in their report, there was no compelling evidence at the time to support their theoretical claims. Moreover, in the four years since the report, considerable data have been obtained that undermine their claims. The RAND study and the Obama proposal it spawned appear to be an elegant exercise in wishful thinking. To be sure, there are real benefits from electronic medical records. Physicians and nurses can readily access all the information on their patients from a single site. As many as 5,000 employees are being shown the door at Microsoft, which uses more H1-B guest-worker visas than any other U.S. company. Some employees and politicians say Microsoft should get rid of foreigners first. "If they lay people off, are they going to think of America first or are they going to think of the world first?" Chuck Grassley, a Republican Senator from Iowa, said in an interview. He sent a letter to Microsoft Chief Executive Officer Steve Ballmer the day after Microsoft announced the job cuts last month, demanding Ballmer fire visa holders first. Across the technology industry, some of the biggest users of H1-B visas are cutting jobs, including Intel Corp., International Business Machines Corp. and Hewlett-Packard Co. The firings at Microsoft, the world's largest software maker, came less than a year after Chairman Bill Gates lobbied Congress for an expansion of the visa program.     There are three reasons for breach notification laws. One, it's common politeness that when you lose something of someone else's, you tell him. The prevailing corporate attitude before the law - "They won't notice, and if they do notice they won't know it's us, so we are better off keeping quiet about the whole thing" - is just wrong. Two, it provides statistics to security researchers as to how pervasive the problem really is. And three, it forces companies to improve their security. That last point needs a bit of explanation. The problem with companies protecting your data is that it isn't in their financial best interest to do so. That is, the companies are responsible for protecting your data, but bear none of the costs if your data is compromised. You suffer the harm, but you have no control - or even knowledge - of the company's security practices. The idea behind such laws, and how they were sold to legislators, is that they would increase the cost - both in bad publicity and the actual notification - of security breaches, motivating companies to spend more to prevent them. In economic terms, the law reduces the externalities and forces companies to deal with the true costs of these data breaches.

    We all like to think our privacy is absolute. But if your job involves working across borders, you'll want to talk about privacy as a matter of degree rather than as an uncompromising right. Why? Not only do you want to be seen as someone who can get things done globally, but you also may personally want to be part of advancing social objectives that are arguably as important as privacy. Have you ever had to re-architect your global rollout of PeopleSoft or Lawson because of European Union privacy concerns? Or adjust how your company offers technical support to medical products sold in Europe? Have you ever been part of acquiring a failing European company where the privacy of employee data was a final sticking point? If you've seen projects with obvious social benefit get held up by seemingly minor data-related questions, then you might have been running up against this notion of "nothing trumps privacy." It's a popular idea. The half-billion people of Europe do view privacy as a human right. And they're not the only ones. As one of the first acts of the UN, Eleanor Roosevelt and the U.S. delegation in 1948 lobbied for the global adoption of the Universal Declaration of Human Rights(UNDHR), whose Article 12 states, "No one shall be subjected to arbitrary interference with his privacy, family, home or correspondence, nor to attacks upon his honour and reputation." With Europe and the UN using absolute-sounding language to describe a right to privacy, it's no wonder we have all of these delayed and downsized corporate projects. People are legitimately concerned about our sometimes reckless march into the Information Age, and they want to put some brakes on it. But does privacy trump all foes?     The dark figure of fraud drove the development of best practices at Memolink. I harnessed the fear of the unknown and used basic change management to gather support internally. I knew the approach would indefinitely change how we did business and alter our company's culture. Like many dot coms, my company has an entrepreneurial spirit, and like not-so-many dot coms, we have been in business for 15 years. The culture is well established and the work we do is exciting and fun. Would a company with an innovative and "don't-box-me-in" mentality openly receive a new set of standards and expectations? The implementation of the Best Practice approach required two important change management tactics: consistent messaging and constant and varied communication. It was not enough to tell associates that the proposed transition, which included separating processes that traditionally had been managed by a sales team, would benefit the company in the long term. The main component of the message had to be the "What's in it for me?" value proposition. At the time, the sales associates had nothing to gain, and, in fact, they would lose commission. For example, when my department rolled out the Best Practice approach to partner vetting, fewer partners would meet the standard and be accepted, which meant incremental commission loss for the sales team. Money matters create major stress and tension, so it was important that this conflict be addressed early in the implementation process. Management responded by restructuring commissions so that employee motivations were aligned with business goals. This move also made the adoption period for other processes and procedures shorter and less chaotic. In essence, align the money motivators and people will buy in more quickly. Associates were not reeling about their payment structure, but were they and other stakeholders, who were originally unaffected by the commission structure, truly behind the idea?     It's often the security issue that dogs Google, Microsoft and other purveyors of personal health records (PHR): How will so much personal medical data be kept safe? A tangential question for Google, however -- one that has dogged the search giant since its Google Health offering was first made available in May 2008 -- is whether Google's search-based advertising platform creates a conflict with storing personal health data. Speaking at the Mastermind Session at Everything Channel's Healthcare Summit in San Diego in November,Google Vice President of Research and Special Initiatives Alfred Spector told health care CIOs, solution providers and other attendees that Google intended Google Health as an extension of the Google brand, and it was and would continue to be entirely separate from Google's main advertising platform. Watchdog organizations have taken Google to task over that claim, however, with one, Consumer Watchdog, even accusing Google of trying to lobby Congress to allow it to sell medical records by loosening regulatory language in the stimulus bill. "The medical technology portion of the economic stimulus bill does not sufficiently protect patient privacy, and recent amendments have made this situation worse," wrote Jerry Flanagan of Consumer Watchdog in a Jan. 27 open letter to Congress. "Medical privacy must be strengthened before the measure's final passage, rather than allowing corporate interests to take advantage of the larger bill's urgency." Flanagan in the letter states that, "Google is said to be lobbying hard ... to weaken the ban currently in the draft measure on the sale of our private medical records." While Consumer Watchdog did not cite specific evidence of Google pushing for softer restrictions, Google responded to the group's claims on its Public Policy Blog last week. "The claim -- based on no evidence whatsoever -- is 100 percent false and unfounded," wrote Pablo Chavez, Google's Senior Policy Counsel. "Google does not sell health

Fannie Mae IT contractor indicted for planting malware; Mortgage giant didn't revoke se... - 0 views

    A former Fannie Mae IT contractor has been indicted for planting a virus that would have nuked the mortgage agency's computers, caused millions of dollars in damages and even shut down operations. How'd this happen? The contractor was terminated, but his server privileges were not. Rajendrasinh Makwana was indicted on Tuesday in the U.S. District Court for Maryland (press report, complaint and indictment PDFs). From early 2006 to Oct. 24, Makwana was a contractor for Fannie Mae. According to the indictment, Makwana allegedly targeted Fannie Mae's network after he was terminated. The goal was to "cause damage to Fannie Mae's computer network by entering malicious code that was intended to execute on January 31, 2009." And given Fannie Mae-along with Freddie Mac-was nationalized in an effort to stabilize the mortgate market Makwana could caused a good bit of havoc. Makwana worked at Fannie Mae's data center in Urbana, MD as a Unix engineer as a contractor with a firm called OmniTech. He had root access to all Fannie Mae servers. The tale of Makwana malware bomb plot is a warning shot to all security teams and IT departments. Given the level of layoffs we've seen lately the ranks of disgruntled former employees is likely to grow. Is there any company NOT lopping off a big chunk of its workforce? And some of these workers may even have Makwana's access privileges and knowledge of the corporate network.

The large aging population has health care employers in need of qualified workers: stat. Therefore, despite the current economic conditions, health care employers will continue to increase staff in 2009, according to CareerBuilder.com's annual health care hiring forecast, conducted online within the U.S. by Harris Interactive. Close to one-in-five (17 percent) of large health care employers (50 or more employees) plan to increase the number of full-time, permanent employees in 2009, while 67 percent foresee either making no change in the number of employees or are unsure. Sixteen percent plan to decrease the number of employees. "The health care industry continues to boast high demand for qualified workers.     Ask a room full of security practitioners for a list of security settings that'll make Internet Explorer (IE) safe to use and you'll either hear laughter or advice to get a new browser like Mozilla Firefox, Opera, Safari or Google Chrome. Even as Microsoft has worked diligently to improve security in its troubled browser, especially in IE7 and the newly-released IE8, security pros simply don't trust it. Most have turned to alternative browsers, especially Firefox. [See: Microsoft Releases IE8, Stresses Security] But the intoxication security pros find in Firefox and the other alternatives comes with a big hangover. When one wakes up from an evening of online adventuring on one of the alternative browsers, the painful reality is that they will never be able to get away from IE completely. The obvious reason is that IE is so tightly integrated into the Windows operating system, though some industry voices have called on Microsoft to divorce it from the OS. Besides the tight integration with Windows, there's the simple reality that some business applications will only work when used in IE. At CSOonline and other media outlets, for example, the programs used to post content online tend to be allergic to non-IE browsers. Those who have no choice but to use IE have turned to a number of coping mechanisms.
