    While the candidate Media Queries specification is interesting and a step in the right direction, W3C continues to butcher the meaning of "interoperability." In this latest sleight of hand, we now have "interoperable" *user agents*, a term of art used by W3C for implementations that only receive and cannot return data, e.g., web browsers.  But under competition law, "interoperability" requires implementations that can exchange data and *mutually* use data that has been exchanged. See e.g., European Commission v. Microsoft, European Community Court of First Instance (Grand Chamber Judgment of 17 September, 2007), para. 230, 374, 421, http://tinyurl.com/23md42c (rejecting Microsoft's argument that "interoperability" has a 1-way rather than 2-way meaning; "Directive 91/250 defines interoperability as 'the ability to exchange information and *mutually* to use the information which has been exchanged'") (emphasis added). W3C, the World Wide Web Conspiracy, continues down its rut of broadcasting information whilst denying the world the power to round-trip the data received.

OpenSolaris Governance Board resigns - The H Open Source: News and Features - 0 views

  • As it had previously threatened, the OpenSolaris Governance Board (OGB) has now resigned. The dissolution motion was proposed and passed unopposed in a fourteen minute long meeting of the OGB. The motion cited the fact that Oracle had ignored requests to see a liaison appointed to work with the OGB and had distributed an internal email terminating the OpenSolaris project. Another part of the dissolution motion stated, "The desire and enthusiasm for continuing open development of the OpenSolaris code base has clearly passed out of Oracle's (and thus this community's) hands into other communities" before resolving that the members of the OGB collectively resigned.

    It's official now. OpenSolaris is abandonware, leaving OpenBSD as the major open Unix platform still supported.

    [.... "Gang of Crookes" Newton is the publisher of p2pnet, a site which has for years chronicled the online file-sharing world. Back in 2006, Newton wrote a piece about local Vancouver businessman Wayne Crookes, the owner of West Coast Title Search Ltd. Crookes had just sued a man named Mike Pilling for writing allegedly defamatory articles about Crookes and publishing them on the Internet (Crookes had previously fired Pilling from Canada's Green Party, in which Crookes volunteers). Pilling's articles relied on the obvious pun here, using titles like "Friends of Crookes" and "Gang of Crookes." In covering the free speech aspects of the case, Newton linked to the articles in question. Crookes demanded Newton remove those links, saying that Newton himself could be liable for defamation.   • The Sixth Circuit Court of Appeals has handed down a ruling that delights privacy advocates and Fourth Amendment purists: In U.S. v. Warshak, it found that the government should have obtained a search warrant before seizing and searching defendant Stephen Warshak's emails, which were stored by email service providers.
  • It is an important ruling, because it is the first time a federal court of appeals has extended the Fourth Amendment to email with such careful consideration, and it is likely to be influential on both legal and practical levels
  • The decision is particularly important because the Stored Communications Act does allow the government to secretly obtain emails without a warrant in many situations, according to the EFF, which filed an amicus brief in the case.

    [ The European Commission just launched a new consulation on its disastrously dogmatic report on IPRED, a directive on the enforcement of intellectual property rights, adopted by the EU in 2004. The report -- whose logic is similar to ACTA -- is based on an analysis of the application of IPRED. It calls for the massive filtering of the Internet to tackle file-sharing: according to the Commission, Internet Service Providers (ISPs) should "cooperate" in the war against sharing to avoid the threat of litigation.
