  • Since its inception, the European Union has stimulated many vigorous debates. This Living Review provides a state of the field perspective on the academic work that has been done to address the question of the perceptions of the European Union as a system of governance. It takes a broad scope in assessing the efforts of scholars and highlights significant theoretical and empirical contributions as well as identifying potential avenues for research. In order to understand perceptions of the EU, scholars have employed national-level frameworks of popular support, particularly partisanship and instrumental self-interest. As the number of members has increased, further research has taken a broader scope to include national identity, institutions, and attitudes regarding the normative and empirical function of both national and EU institutions. Additional works address political intermediaries such as parties, media, and elites. Finally, all of the works are fundamentally concerned with the supportive popular sentiment that underpins the EU’s legitimacy as a political institution. While there are far more works that can be practically included in this Living Review, we have attempted to construct an overview based on the dimensions that define this research as set out by significant contributions at the core of this literature.

Sign In Online Sample View Article: View Article (PDF) View Article (HTML) Abstract In view of the uncertainty about the final outcome of the current enlargement process, how effective is the EU's acquis conditionality in South Eastern Europe? By elaborating on the example of justice and home affairs, the article argues that the EU's external leverage has remained strong, as the EU has developed additional ways to render its conditionality approach credible. Although the hurdles for entering the EU have been raised, Croatia's compliance efforts can be considered to be similar to the logic observed in the eastern enlargement. The key to understanding the compliance of Macedonia, whose membership prospect is less certain or even questionable, is to take into account policy conditionality in addition to membership conditionality. The EU managed to compensate for less credible membership rewards by substantially increasing the value of the policy reward of visa-free travel. This strategy was effective but has created tensions with regard to the EU's broader objectives in the region. The EU's competences: The 'vertical' perspective on the multilevel system - 0 views

    From the outset, European integration was about the transfer of powers from the national to the European level, which evolved as explicit bargaining among governments or as an incremental drift. This process was reframed with the competence issue entering the agenda of constitutional policy. It now concerns the shape of the European multilevel polity as a whole, in particular the way in which powers are allocated, delimited and linked between the different levels. This Living Review article summarises research on the relations between the EU and the national and sub-national levels of the member states, in particular on the evolution and division of competences in a multilevel political system. It provides an overview on normative reasonings on an appropriate allocation of competences, empirical theories explaining effective structures of powers and empirical research. The article is structured as follows: First, normative theories of a European federation are discussed. Section 2 deals with legal and political concepts of federalism and presents approaches of the economic theory of federalism in the context of the European polity. These normative considerations conclude with a discussion of the subsidiarity principle and the constitutional allocation of competences in the European Treaties. Section 3 covers the empirical issue of how to explain the actual allocation of competences (scope and type) between levels. Integration theories are presented here in so far as they explain the transfer of competence from the national to the European level or the limits of this centralistic dynamics. Normative and empirical theories indeed provide some general guidelines for evaluation and explanations of the evolution of competences in the EU, but they both contradict the assumption of a separation of power. 19.05.08: Bulgaria and Romania face EU sanctions over corruption - 0 views

  • European Commission officials are to visit Sofia and Bucharest this week to assess judicial reforms, EurActiv Romania reports. The visit takes place amid mounting pressure in Brussels to invoke so-called "safeguard clauses" against the two countries, which could result in EU funds being slashed.
  • Background: Bulgaria and Romania joined the EU in January 2007 under precise conditions. There are three areas where safeguard measures can be invoked under Bulgaria and Romania's EU Accession Treaties: economic, internal market and judicial reforms.  The safeguard clause can be invoked up to three years after accession and could result for example in food export bans or cuts to EU funds in areas such as agriculture and "structural" policies.
  • Experts from the European Commission will visit Sofia and Bucharest in the week of 19-23 May to assess the justice reforms, EurActiv.ro writes. According to reports in the Romanian press, the mission takes place at a time when some officials in Brussels are wondering whether taking the two countries onboard as early as January 2007 was "a mistake" and are applying pressure to activate the safeguard clause on justice.  Both countries could lose EU funds or have their national court decisions annulled if a safeguard clause is triggered against them.

  • The Regional Cooperation Council (RCC), an initiative launched in February to promote regional cooperation in the Western Balkans, is hanging in the balance as the region hovers between resolving the conflicts it has inherited or a prolonged period of stagnation, according to RCC Secretary General Hido Biscevic.     This Living Reviews article evaluates the most important strains of social science research on the impact of the European Court of Justice (ECJ) on integration, EU-level policymaking, and national legal orders. Section 2 defines the concepts of judicialization and governance, and discusses how they are related. As the article demonstrates, the "constitutionalization of the EU," and its effect on EU governance, is one of the most complex and dramatic examples of judicialization in world history. Section 3 discusses the institutional determinants of judicial authority in the EU in light of delegation theory. The European Court, a Trustee of the Treaty system rather than a simple Agent of the Member States, operates in an unusually broad zone of discretion, a situation the Court has exploited in its efforts to enhance the effectiveness of EU law. Section 4 focuses on the extraordinary impact of the European Court of Justice, and of the legal system it manages, on the overall course of market and political integration. Section 5 provides an overview of the process through which the ECJ's case law - its jurisprudence - influences the decision-making of non-judicial EU organs and officials. 10.04.08: Poll: Serbs pro-EU, but not ready to give up Kosovo - 0 views

  • A large majority of Serbs still want their country to join the EU (63.9%), although the figure has dropped compared to last October, when 71.5% voiced their support for EU accession, reveals the poll, which was released yesterday (9 April).  However, 71.3% of Serbian citizens consider it unacceptable that the possibility of EU membership is made conditional on Serbia's recognition of its former province's secession. 
  • Serbia's Kosovo Minister Slobodan Samardzic added that it would be interesting to see whether the EU would continue the stabilisation and association process now that Kosovo is an independent state.  "Should the EU happen to do that, and does it only with independent states, that would automatically mean that the EU was breaching Article 135 of our agreement on stabilisation and association with the EU, where Kosovo's position is clearly defined," the minister explained.

  • Europe's centre-right leaders are gathering in Helsinki to prepare the political family's strategy ahead of two crucial summits on economic issues later this month. An overhaul of the bloc's emergency lending fund, fiscal discipline and measures to boost economic competitiveness are all high on the agenda of Friday (4 March) evening's meeting. 19.11.08: 'Balkan wars' move to UN court - 0 views

  • Battlefields are no longer the place to solve conflicts in the Balkans. In recent days and weeks, several bilateral conflicts involving countries in the region, which are also hindering their EU accession prospects, are moving to more dignified surroundings: the International Court of Justice at the UN.
  • Background: The International Court of Justice (ICJ) is the principal judicial organ of the United Nations (UN). It was established in June 1945 by the Charter of the United Nations and began work in April 1946.  The seat of the court is at the Peace Palace in The Hague (Netherlands). Of the six principal organs of the United Nations, it is the only one not located in New York .  The court's role is to settle, in accordance with international law, legal disputes submitted to it by states and to give advisory opinions on legal questions referred to it by authorised United Nations organs and specialised agencies.  Although the UN International Court of Justice's opinion is advisory, without binding effect, it nevertheless remains that the authority and prestige attached to the court's advisory opinions, especially when the organ or agency concerned endorses that opinion, means that its decisions are often sanctioned as such by international law. 
  • In a very short timeframe, several conflicts between Balkan countries have been referred to the UN's highest court.  In the first of a recent string of lawsuits, Serbia tested the legality of Kosovo's unilateral declaration of independence before the Hague Tribunal in October (EurActiv 09/10/08), while on Monday (17 November), Macedonia instituted proceedings against Greece after its neighbour long-time foe had blocked its NATO bid over a name dispute (EurActiv 02/04/08).  Yesterday (18 November), Croatia won the right to sue Serbia for genocide after the court ruled that it had the legal power to decide on the case. In return, Serbia indicated that it would sue Croatia for war crimes.

08.02.08 French lawmakers approve EU Treaty, Slovakia postpones again - 0 views

  • Three years after French citizens said 'no' to the European constitution, French MPs and senators on Thursday voted to adopt the EU's new 'Reform Treaty'. Meanwhile, the Slovakian parliament indefinitely postponed a vote on its ratification amid wrangling in parliament.
  • Thus far, Hungary, Romania, Slovenia and Malta have already ratified the treaty. All four did so by parliamentary vote (see EurActiv 18/12/07, 30/01/08, 05/02/08).  French approval of the Lisbon Treaty is seen as crucial to restore the country's European reputation after the French people rejected the European Constitution - written by former French President Valery Giscard d’Estaing - in 2005.  The rejection, which was considered a personal defeat for then-President Jacques Chirac, delivered a serious blow to the project of European integration and left Europe reeling for several years.

07.05.09: Croatia, Slovenia edge closer to solving border dispute - 0 views

  • Slovenia yesterday (6 May) welcomed Croatia's decision the previous day to accept Enlargement Commissioner Olli Rehn's proposal for solving the border dispute between the two countries, which had frozen Zagreb's accession negotiations and become an irritant for the EU.
  • Background: During the French EU Presidency, Slovenia blocked the opening of nine out of ten negotiating chapters with Zagreb due to an unresolved border dispute (EurActiv 18/12/08).  The succeeding Czech Presidency has also failed to make any progress in the negotiations so far. Indeed, the EU recently postponed an accession conference after the two countries had failed show any signs of conciliation (EurActiv 24/04/09).  Diplomats have serious doubts about Croatia's ability to wrap up accession talks by the end of the year (so as to be ready to join the bloc in 2010) if the bilateral dispute is not resolved soon (see EurActiv LinksDossier on 'EU-Croatia' relations).  The border dispute between Slovenia and Croatia concerns small pockets of land along the Adriatic coast, which could prove important if accompanied by exclusive access rights to deep-sea zones. Unlike Slovenia, Croatia has a long coastline, prompting Ljubljana to attempt to assert its rights as a "geographically disadvantaged state". 
  • Slovenia welcomed the Croatian government's positive response to Rehn's plan, Foreign Minister Samuel Zbogar told the press hours later.  "We welcome today's [...] response. It will enable the resumption of talks," Zbogar told the press. He added that Slovenia would comments on the proposal after internal consultation. The minister declined to comment on media reports that Rehn's proposal was not in his country's interest, but made it plain that Slovenia would table amendments to the text.  Zbogar also disagreed with Croatian President Mesic's statement that the Rehn proposal was a "take it or leave it" offer.

29.04.09: Albania files EU membership application - 0 views

  • Albania formally applied to join the European Union yesterday (28 April), embarking on a lengthy path toward membership of the bloc, which is still digesting past enlargements and finds itself engulfed by economic crisis at present.
  • Background: Applications for EU membership are usually filed in coordination between the applicant country and the European Commission. Besides Albania, the only countries in the Western Balkans who have yet to file membership applications are Serbia and Bosnia and Herzegovina. Kosovo, which declared independence in February 2008, is a special case, as it has not been recognised by all EU countries.  Last December, Montenegro surprisingly filed a formal application for EU membership during the final days of the French EU Presidency, despite the fact that the subsequent Czech Presidency is more supportive of the Balkan country's accession bid (EurActiv 16/12/08). Montenegro's move was widely expected to encourage Serbia and Albania to follow suit by formally applying for EU membership too.  Taking advantage of the pro-enlargement Czech EU Presidency, Albanian Prime Minister Sali Berisha announced last month that his country would present its European Union membership application before the end of June (EurActiv 10/03/09).  In an exclusive interview with EurActiv, Erhard Busek, special enlargement adviser to the Czech EU Presidency, recently confirmed that Tirana was preparing to file its application (EurActiv 17/04/09).  Albania is one of Europe's poorest countries, and faces an uphill struggle to join the EU. Brussels remains unconvinced of the West Balkan country's democratic credentials.
