Borrás/Ejrnaes (2011): The legitimacy of new modes of governance in the EU: S... - 1 views

  • The literature on new modes of governance suffers from a gap between the normative and the positive approaches to legitimacy. This article addresses this gap by studying the patterns of national stakeholders’ support for the Open Method of Coordination (OMC). The results of our survey demonstrate that the OMC receives greater support than previously assumed and that the support of national stakeholders is largely associated with their involvement in national procedures. These findings corroborate the assumptions of normative theories of participatory democracy about the importance of involvement. Furthermore, the study’s findings underline the pivotal role that national stakeholders play regarding matters of legitimacy in the EU’s multi-level system of governance.

28.02.11: Lukewarm response to Barroso-Van-Rompuy economic plan - 1 views

  • New proposals on joint economic governance put forward by European Commission President Jose Manuel Barroso and EU Council chief Herman Van Rompuy on Monday (28 February) have failed to overcome resistance from some member states.
  • The Barroso-Van-Rompuy plan does contain a requirement that German-style 'debt brakes' be implemented across the eurozone, however. Resistance to this element comes from those who do not want to open the Pandora's Box of constitutional amendments this could entail. Opposition to the Franco-German pact also revolved around the proposal that countries that maintain inflation-indexed wage systems abandon this practice. Belgium and Luxembourg in particular were resistant.
  • As key figures on the left in Europe, including within the commission itself, have begun to issue their misgivings over the path of austerity chosen by the EU as a response to the crisis, the commission warned social democrats that throughout the crisis, they have also backed this process. Last week, Greece's EU commissioner, Maria Damanaki, publicly distanced herself from EU austerity, saying it is leading to "social degradation." Former commission president Jacques Delors, a French Socialist, has also called the commission's recent Annual Growth Survey, a first step in the EU's new system of oversight of and intervention in national budgets, as "The most reactionary document ever produced by the commission."

    This Living Reviews article evaluates the most important strains of social science research on the impact of the European Court of Justice (ECJ) on integration, EU-level policymaking, and national legal orders. Section 2 defines the concepts of judicialization and governance, and discusses how they are related. As the article demonstrates, the "constitutionalization of the EU," and its effect on EU governance, is one of the most complex and dramatic examples of judicialization in world history. Section 3 discusses the institutional determinants of judicial authority in the EU in light of delegation theory. The European Court, a Trustee of the Treaty system rather than a simple Agent of the Member States, operates in an unusually broad zone of discretion, a situation the Court has exploited in its efforts to enhance the effectiveness of EU law. Section 4 focuses on the extraordinary impact of the European Court of Justice, and of the legal system it manages, on the overall course of market and political integration. Section 5 provides an overview of the process through which the ECJ's case law - its jurisprudence - influences the decision-making of non-judicial EU organs and officials. Section 6 considers the role of the ECJ and the national courts in monitoring and enforcing Member State compliance with EU law, a task that has provoked a steady Europeanization of national law and policymaking.

The EU's competences: The 'vertical' perspective on the multilevel system - 0 views

    From the outset, European integration was about the transfer of powers from the national to the European level, which evolved as explicit bargaining among governments or as an incremental drift. This process was reframed with the competence issue entering the agenda of constitutional policy. It now concerns the shape of the European multilevel polity as a whole, in particular the way in which powers are allocated, delimited and linked between the different levels. This Living Review article summarises research on the relations between the EU and the national and sub-national levels of the member states, in particular on the evolution and division of competences in a multilevel political system. It provides an overview on normative reasonings on an appropriate allocation of competences, empirical theories explaining effective structures of powers and empirical research. The article is structured as follows: First, normative theories of a European federation are discussed. Section 2 deals with legal and political concepts of federalism and presents approaches of the economic theory of federalism in the context of the European polity. These normative considerations conclude with a discussion of the subsidiarity principle and the constitutional allocation of competences in the European Treaties. Section 3 covers the empirical issue of how to explain the actual allocation of competences (scope and type) between levels. Integration theories are presented here in so far as they explain the transfer of competence from the national to the European level or the limits of this centralistic dynamics. Normative and empirical theories indeed provide some general guidelines for evaluation and explanations of the evolution of competences in the EU, but they both contradict the assumption of a separation of power.   • This book poses two pertinent questions: First, if a European executive order is emerging, how can we empirically see it? Second, if a European executive order is emerging, how can we explain everyday decision-making processes within it? The goal of this book is two-fold: First, it identifies key institutional components of an emergent European executive order. The nucleus of this order is the European Commission. The Commission, however, is increasingly supplemented by a mushrooming parallel administration of EU-level agencies and EU committees. This book provides fresh empirical survey and interview data on the everyday decision-making behaviour, role perceptions, and identities among European civil servants who participate within these institutions. Secondly, this book claims and empirically substantiates that an emergent European executive order is a compound executive order balancing a limited set of key decision-making dynamics. One message of this book is that an emergent European executive order consists of a compound set of supranational, departmental, epistemic, and intergovernmental decision-making dynamics. Arguably, a compound European executive order transforms the inherent Westphalian order to the extent that intergovernmentalism is transcended and supplemented by a multidimensional mix of supranational, departmental and/or epistemic dynamics. This book also theoretically explores conditions under which these decision-making dynamics gain prevalence. It is argued that the decision-making dynamics emerging within an emergent European executive order are conditioned by the formal organisation of its composite parts and by the patterns of social interaction that emerge among its civil servants. Political processes and political systems can neither be adequately understood nor explained without including the organisational dimension of executive orders.

  • This Living Review presents an overview of the research on European identity in the context of EU governance by focussing on central debates in the political science literature. It departs from the problems of disagreement between European citizens and their elites as well as the lack of a European demos. Against this background, the article discusses the functions of collective identity including the legitimation function and solution of collective dilemmas. Here, two perspectives pertaining to these functions are depicted: first, the issue of European public space and second, the integrative workings of European citizenship. Next, the article explores the conceptual and methodological problems of the research on European collective identity. In particular, it focuses on the conceptual ambiguity of the collective identity term and problems of operationalization and measurement. Following this, the article discusses the literature on identity technologies of the EU and identifies the shortcomings of identity technologies with regard to EU governance.   • This essay takes stock of the literature on how European Union policies are being put into practice by the member states. It first provides an overview of the historical evolution of the field. After a relatively late start in the mid 1980s, the field has meanwhile developed into one of the growth industries within EU research. The paper identifies three different waves of EU implementation scholarship. The first wave considered implementation primarily a problem of institutional efficiency. In the second wave, the degree of compatibility between European demands and domestic policy legacies took centre stage. However, many second-wave scholars complemented the basic “misfit” argument with a set of additional explanatory factors to account for deviant cases. In the third wave, some researchers began to stress the role of domestic politics, while others re-discovered the importance of administrative capabilities. As an attempt to synthesise some of the partial explanations presented by earlier research, one group of scholars pointed to the existence of culturally-shaped country clusters, each with its own typical style of complying with EU legislation.
  • After this historical overview, the paper summarises the most important theoretical, empirical and methodological lessons to be drawn from existing studies, and it discusses promising avenues for future research. First, most scholars seem to agree on the basic set of factors that may have an impact on transposition processes. The main task to be accomplished by future research is to establish under which conditions which configurations of factors prevail. While we already know that there are country-specific patterns, the importance of sector-specific patterns will need to be explored further. Second, greater research efforts will have to be devoted to the neglected area of enforcement and application. In theoretical terms, going back to the insights of traditional domestic implementation research seems to be most promising for this type of studies. Third, the paper cautions against the poor quality of the data employed by the growing number of quantitative compliance studies. Unless the problems with the data can be solved, scholars are well advised to rely on comparative case studies, at least in addition to statistical analyses. To increase the number of cases to be covered by qualitative research, the paper makes the case for crafting collaborative qualitative research projects as a viable alternative to quantitative research.

  • There is a plethora of studies on interest groups in the European Union. While these studies have generated a wealth of insights, it is not actually clear what they have accomplished. This Living Review seeks to identify those areas of interest group studies in which our knowledge is fairly consolidated and in which major research gaps or major controversies can be noted. I argue that these research gaps and controversies stem from both the empirical variance in the interest group landscape and the theoretical segmentation of EU interest group studies. These have been shaped by influences from Comparative Politics, International Relations, Policy Analysis, and Democratic Theory. I suggest that future research should engage to a greater extent in cross-cutting theoretical debates in order to overcome the pronounced demarcation of research areas and in more rigorous theory testing than has sometimes been the case. The article starts by discussing the problem of conceptualizing interest groups before moving on to the fissured theoretical landscape. Thereafter, major research themes are discussed. First, I review the relation between EU institutions and interest groups. Here, I look both into multilevel governance and Europeanization studies that focus on the vertical interaction and into analyses that stress the horizontal segmentation of the EU system in different institutions and sectors. Second, I analyze core themes of EU and comparative interest group studies, namely the issue of collective action, the access of interest groups to policy-makers and their influence on EU policymaking.

  • While Brussels is home to an estimated 15-20,000 lobbyists, who daily and doggedly attempt to win lawmakers to their clients' point of view, up to now, only around 300 lobbying organisations have signed up to the European Commission's voluntary registry.
  • None of the major lobbying firms have registered, and only three think-tanks have done so. "I do not see yet the big professional public relations consultancies, nor many law firms - only two have registered so far," Ms Rampi noted. "However, I want to stress the importance of being cautious about the numbers that could be used to measure the 300 figure against," Ms Rampi said. "The figure often quoted in the media of around 15,000 individual lobbyists is an external estimate, which the commission does not endorse," she added, pointing out that this is an estimate of the number of individuals, whereas the commission's register lists organisations.

Eberlein/Kerwer (2002) Theorising the New Modes of European Union Governance - 0 views

  • Recently, 'new modes of governance' based on voluntary performance standards, rather than compulsory regulation, have gained salience in European Union governance. Can these 'new modes of governance' offer a credible solution to the challenges faced by EU policy making? We argue that a critical appraisal is difficult when it is based a) on the scarce empirical evidence, or b) the programmatic pronouncements of policy makers. We suggest instead c) assessing the potential of new governance in the light of theoretical approaches to the EU polity. While current theories of European governance shed some light on the challenges to be addressed by new governance, we argue that the theory of democratic experimentalism makes it possible to better identify the potential and the problems of new EU governance. This theoretical perspective suggests, first, that coordination by voluntary performance standards can lead to more effective rules and more opportunties for political participation, second, that the scope of this mode of governance in the EU is not confined to cases which are explicitly flagged as 'new governance', and third, that one of the main problems is how a voluntary mode of governance can coexist with compulsory regulation.

  • The European Commission has adopted a code of conduct regulating lobbyists' behaviour as a forerunner to the voluntary register to be launched by Administration and Anti-Fraud Commissioner Siim Kallas on 23 June.
  • The 'Code of Conduct for Interest Representatives ', officially adopted on 28 May, contains "clear and precise rules" for lobbyists to follow in their relations with Commission staff, according to the EU executive. 
  • The code of conduct is intended to complement the lobbyists register the Commission is set to publish on 23 June and constitutes part of the wider transparency initiative launched by Vice President Kallas in 2005.

  • Since its inception, the European Union has stimulated many vigorous debates. This Living Review provides a state of the field perspective on the academic work that has been done to address the question of the perceptions of the European Union as a system of governance. It takes a broad scope in assessing the efforts of scholars and highlights significant theoretical and empirical contributions as well as identifying potential avenues for research. In order to understand perceptions of the EU, scholars have employed national-level frameworks of popular support, particularly partisanship and instrumental self-interest. As the number of members has increased, further research has taken a broader scope to include national identity, institutions, and attitudes regarding the normative and empirical function of both national and EU institutions. Additional works address political intermediaries such as parties, media, and elites. Finally, all of the works are fundamentally concerned with the supportive popular sentiment that underpins the EU’s legitimacy as a political institution. While there are far more works that can be practically included in this Living Review, we have attempted to construct an overview based on the dimensions that define this research as set out by significant contributions at the core of this literature.

  • Abstract:      The concept of 'civil society' has been rediscovered in contemporary discourses concerning the relationship between democracy and governance. This paper analyses this rediscovery in the more specific context of the European Commission's 2001 White Paper on European Governance. However, processes of transnationalisation, governmentalisation and autonomisation may compromise much of the potential of 'European civil society' as an intermediating sphere of social action. By reinforcing these processes, the White Paper undermines the normative claims made for a civil society premised upon the voluntary nature of its associative forms and its distinctive open, communicative and deliberative rationality.
