23.07.09 Bulgaria, Romania remain under Commission scrutiny - 0 views

  • Having consistently made 'technical' progress, Bulgaria and Romania need help to crack down on corruption, the European Commission said on 22 July with the publication of its annual monitoring reports, pledging further support while the two EU newcomers remain under scrutiny.
  • Background: When Romania and Bulgaria joined the EU on 1 January 2007, shortcomings remained regarding judicial reform and the fight against corruption - and in the case of Bulgaria, the fight against organised crime. These shortcomings carried the risk that the two countries would be unable to apply Community law correctly and their citizens would not be able to fully enjoy their rights as EU citizens.  A Cooperation and Verification Mechanism (CVM) was set up to assist both member states. Moreover, the European Commission retained the right to use special safeguards, included in the accession treaties and invoked against new member states as a last resort. If used, the process could lead the EU to refuse to recognise court decisions or even freeze payments of EU funds. Such an unprecedented decision, if applied, would also badly hurt the countries' reputations.  In a turnaround compared to previous monitoring reports, where Bulgaria was invariably portrayed as the laggard in meeting EU standards on judicial reform and fighting corruption (EurActiv 24/07/09), the Brussels executive unveiled reports last February which depicted Romania as the slow performer this time (EurActiv 13/02/09).  The annual reports on Bulgaria and Romania are prepared by the Commission's secretariat-general under the authority of President José Manuel Barroso, in agreement with Vice-President Jacques Barrot. Recently the French Senate cautioned against "stigmatising" the EU's most recent members and suggested fine-tuning the CVM (EurActiv 30/06/09).

15.06.09: Croatia's EU talks to resume after long dispute - 0 views

  • Slovenia is expected to unblock Croatia's EU accession talks at a ministerial meeting today (15 June). The two countries have clashed for several months over disputed territories on the Adriatic coast.
  • Background: During the French EU Presidency, Slovenia blocked the opening of nine out of ten negotiating chapters with Zagreb due to an unresolved border dispute (EurActiv 18/12/08).  The Czech Presidency has so far failed to make any progress in the negotiations. Indeed, the EU recently postponed an accession conference after the two countries had failed to show any sign of conciliation (EurActiv 24/04/09).  Diplomats have serious doubts about the viability of Croatia's objective of wrapping up accession talks by the end of the year (so as to be ready to join the bloc in 2010) if the bilateral dispute is not resolved soon (see EurActiv LinksDossier on 'EU-Croatia' relations).  The border dispute between Slovenia and Croatia concerns small pockets of land along the Adriatic coast, which could prove important if accompanied by exclusive access rights to deep-sea zones. 
  • However, this may not be the end of the region's problems, as similar obstacles are expected to emerge in the Western Balkan accession process as a whole, diplomats told EurActiv.  EU diplomats said the lack of a clearly defined border between Croatia and Bosnia and Herzegovina could soon create problems "one hundred times worse" than the current dispute between Ljubljana and Zagreb, in which the European Commission has invested a huge mediation effort.

  • The Netherlands and Belgium are blocking the ratification of the EU's Stabilisation and Association Agreement with Serbia as long as Mladic is at large. Diplomats say that imposing such conditions makes it difficult for the reformist government in Belgrade to withstand the surge of nationalist and anti-European forces.

05.10.09: EU leaders face 'difficult task' naming new Commission - 0 views

  • EU heads of state and government will have to make difficult choices when they meet in Brussels for a summit on 29-30 October, with uncertainty over when the Lisbon Treaty will come into force having huge consequences for the size of the next European Commission, analysts told EurActiv.
  • Background: According to pro-EU politicians, Europe is in a "completely new" situation after the resounding 'yes' vote in the second Irish Lisbon Treaty referendum, held last Friday (EurActiv 03/10/09).  At present, 25 out of 27 EU member states have ratified the Union's reform treaty, and the news from Poland is that its president, Lech Kaczyński, will soon sign the ratification by the country's parliament, completing the procedure in that country too.  All eyes are now turning to the Czech Republic, where a group of 17 Eurosceptic senators close to the country's president, Václav Klaus, filed a second complaint against the Lisbon Treaty with the constitutional court in Prague, putting its ratification on hold (EurActiv 30/09/09).  This strategy is seen as an attempt to delay final ratification of the Lisbon Treaty until a conservative government comes to power in Britain, where elections are due next year.  Tory leader David Cameron, who leads comfortably in opinion polls, said that in the event that the Lisbon Treaty is not fully ratified by then, he will call a referendum in the UK, despite the fact that the country has already ratified the treaty in parliament (EurActiv 24/09/09). 
  • On the one hand, EU leaders can assume that the Lisbon Treaty will soon be ratified and invite member states to submit candidacies for commissioners and other top jobs. Alternatively, they can choose to avoid taking any risks and launch a procedure for nominating a smaller-size Commission under the current Nice Treaty, analysts told EurActiv.

12.11.09: EU greenlights start of Albania accession talks - 0 views

  • EU countries have agreed to proceed with Albania's application for membership of the European Union, a first step in a long process towards possible membership of the bloc, EU diplomats said.
  • Background: Albania applied for EU membership in April 2009. In July, the EU Council stated that it would return to the country's application once the Albanian election procedure had been completed. Ever since the June national elections, the two main players, the governing Democratic Party of Prime Minister Sali Berisha and the Socialist party and main challenger Edi Rama have kept on accusing each other of fraud (EurActiv 30/06/09).  In its latest report on Albania, the European Commission stressed that Tirana needs to make progress, particularly on the rule of law and the fight against corruption, as well as the proper functioning of state institutions ( EurActiv 15/10/09). 
  • Ambassadors from the 27 EU states decided at a meeting in Brussels to ask the European Commission to prepare an assessment of Albania's readiness to start membership talks, the diplomats said.  The decision is expected to be formally approved by EU foreign ministers at a meeting in Brussels on 16 and 17 November.

  • Abstract This article introduces this special issue by contextualizing learning theory within European integration studies. There are important empirical and theoretical gaps in the study of European integration which necessitate a greater attention to learning theory. This article deploys a number of conceptual distinctions about learning and non-learning processes, drawing from political science, international relations, public administration and sociological/organizational studies. It traces 'learning' in its political science context and how learning has been inserted into EU integration studies. In relating this evolution, the article examines the conditions that define the type and likelihood of learning and surveys the special issue. The article argues that studying learning in the EU is difficult, but integration requires an understanding of the micro policy processes that learning seeks to address.

16.06.10: Serbia takes decisive step in EU effort | EurActiv - 0 views

  • Serbia took a step forward yesterday (14 June) on the road to joining the European Union, with EU governments rewarding its improved cooperation with the UN war crimes tribunal for the former Yugoslavia.
  • EU foreign ministers agreed at a meeting in Luxembourg to start implementing an accord with Serbia known as the Stabilisation and Association Agreement (SAA), a prerequisite of any further assessment of a country's prospects for membership.The decision follows a positive assessment of Belgrade's assistance given to the International Criminal Tribunal, and bolsters Serbia's efforts to shake off international isolation following wars in the aftermath of the collapse of Yugoslavia.
  • Background Belgrade was offered the chance to sign an EU-Serbia Stabilisation and Association Agreement (SAA) in April 2008, as the Union moved to boost pro-European forces ahead of crucial national elections (EurActiv 30/04/08). Serbia ratified the SAA in September 2008 (EurActiv 09/09/08). However, the agreement is yet to enter into force, leading the European Commission to consider a membership application as premature. On the EU side, the Dutch government's attitude has been the only remaining obstacle to the implementation of the SAA. Some EU member states have been pushing for the SAA to be ratified since the capture of war criminal Radovan Karadzic in July 2008 (EurActiv 22/07/08). But Dutch officials insisted they will only withdraw their veto once two other wanted war criminals have been arrested and handed over to the International Criminal Tribunal for the former Yugoslavia (ICTY). They also said they were awaiting confirmation from the tribunal's chief prosecutor Serge Brammertz of Belgrade's full cooperation with the court.

Subotic (2010): Explaining Difficult States. The Problems of Europeanization in Serbia - 0 views

  • Abstract Why has Serbia’s path toward European integration been fraught with so much difficulty? This article explains Serbia’s reluctance to Europeanize by exploring why Serbian elites persistently refused to fulfill the European Union’s principal requirement—full cooperation with the Hague war crimes tribunal—even when it meant getting off the road to Brussels. The article offers a theoretical framework that incorporates domestic political identity, power of veto players, and competing elite strategies to explain how Serbian political actors used European Union norms and institutions to advance local political agendas. The article concludes that, instead of being a successful change agent that brought about policy shift in the areas of democratization and human rights, the European Union was used on many occasions by Serbian political elites to pursue strategies far removed from EU norms and standards.

Reform does not take place in a vacuum and the successful reform of the Bosnian polity is dependent on public support. Public demands for reform are likely to be influenced by how the current institutions are believed to be functioning and by the public support for the current institutional set-up as such. Still, the demands for alterations by the political elites of the different national communities highlight a continuing lack of consensus. Although the Constitution allows for a revision, the political room for such changes is limited, and the challenge remains to provide adequate degree of autonomy of national groups without diminishing the quality of democracy. The need to differentiate between the protection of legitimate national and minority rights and unacceptable nationalist demands emerges as a challenge with no easy solution. 25.02.09: Croatia advised to 'morally dominate' conflict with Slovenia - 0 views

  • Talks between Slovenian Prime Minister Borut Pahor and his Croatian counterpart Ivo Sanader held yesterday (24 February) in the Slovenian town of Mokrice failed to achieve tangible results, media from the two countries reported.  Until there is progress in solving the border dispute, Slovenia will continue to block Croatia's EU accession negotiations, Pahor reportedly said.  The two countries did not even agree on a framework for dealing with the conflict. Slovenia supports EU Enlargement Commissioner Olli Rehn's preference for Brussels mediation, while Croatia maintains that the border issue should be solved before an international court. However, that option could take several years, while Zagreb wants to join the Union in 2010.

However, selecting the right people to fill these positions will prove a politically sensitive task in the months ahead.
  • Policy Summary Links The EU's new 'Reform Treaty' was agreed upon by EU leaders at a summit in June 2007 and the updated final text was formally approved in October at an intergovernmental conference (IGC) (EurActiv 19/10/08).   • The big question: who to choose?  In the absence of formal criteria, much speculation has broken out over who should take up the role of EU president. According to Stanley Crossick, a veteran EU policy analyst and founding chairman of the European Policy Centre (EPC) - a Brussels think tank - the new EU Troika needs to strike a balance between the following criteria (see blog post on Blogactiv for full analysis ):  Nationality;  geography;  size of country, and;  political affiliation.

13.05.08: EP report on European External Action Service (EEAS) - 0 views

  • The European Parliament is trying to influence the ongoing preparations for the establishment of a 'European External Action Service' (EEAS), to be set up jointly between the EU Council of Ministers and the Commission after the entry into force of the Lisbon Treaty. But critics say this major novelty in the EU architecture is about to be introduced in almost complete secrecy.
  • On 6 May, the European Parliament Foreign Affairs Committee put forward a draft report on the Common Foreign and Security Policy, which is intended to constitute MEPs' wish-list vis-à-vis the Council and the Commission on establishing EEAS.  The report points out that the future office of High Representative/Vice-President of the Commission will derive its legitimacy directly from the European Parliament. It also stresses the need for "transparency and democratic input" into the process of setting up the planned European External Action Service, and calls for a mechanism to be set up to provide confidential information to select Foreign Affairs Committee Members. 
  • "The key expectation of the Parliament is that it has more to say on that and Parliament can add additional democratic legitimacy from taking positions. And we expect to be involved in shaping these decisions ex ante, and not only post factum," Saryusz-Wolsky said.

06.05.08: Serbia's EU course turns into question of life and death - 0 views

  • Just days before crucial parliamentary elections (11 May), the question of Serbia's future accession to the EU has become an issue of existential importance as the country's President Boris Tadic has received a death threat over his pro-EU stance.
  • A threatening letter was sent to Tadic following his signature of a Stabilisation and Association Agreement (SAA) with the EU, considered to be the first step towards membership of the bloc (EurActiv 30/04/08). It accused the president of being a "proven traitor to the Serb nation" and threatens him with a "bullet to the forehead," the Belgrade daily Blic reports. 
  • Opposition between the country's pro-European politicians and hardline nationalist parties is currently at its highest since the breakaway Kosovar province unilaterally declared its independence from Serbia on 17 February 2008 - with the backing of several EU countries. A recent poll conducted by the Strategic Marketing agency showed Serbia's nationalist Radical Party slightly ahead of Tadic's pro-European bloc (33.2% to 31.5%), with the nationalist coalition of Prime Minister Vojislav Kostunica ranked third (13.8%).

11.04.08: Slovakia, Poland ratify Lisbon Treaty - 0 views

  • Slovakia has become the ninth country to ratify the new EU Treaty as deputies approved the text by a margin of 103 votes to five - after settling a dispute over a controversial media bill that had dragged on for months.
  • Slovak Prime Minister Robert Fico expressed his relief following the vote, saying "with this document, the EU will be closer to Slovak citizens"
  • Meanwhile, Polish President Lech Kaczynski added his signature to the Treaty, clearing the final hurdle in the country's ratification process. It had already been approved by both chambers of the Polish Parliament last week (EurActiv 02/04/08).  The Polish president and his brother, former prime minister and current opposition leader Jaroslaw Kaczynski, had long delayed ratification, demanding legal guarantees that the new Treaty would not threaten Polish interests.  Ahead of Poland and Slovakia,  seven countries have ratified the Treaty, namely Bulgaria, France, Hungary, Malta, Romania, Slovenia and Austria, which was the most recent signatory (EurActiv 10/04/08). The text has to be approved by all 27 member states to enter into force.

Benz (2008): The EU's competences: The 'vertical' perspective on the multilevel system - 0 views

  • This Living Review deals with the division of competences between the EU and its member states in a multilevel political system. The article summarises research on the relations between the EU and the national and sub-national levels of the member states. It provides an overview on normative and theoretical concepts and empirical research. From the outset, European integration was about the transfer of powers from the national to the European level, which evolved as explicit bargaining among governments or as an incremental drift. This process was reframed with the competence issue entering the agenda of constitutional policy. It now concerns the shape of the European multilevel polity as a whole, in particular the way in which powers are allocated, delimited and linked between the different levels. The article is structured as follows: First of all, normative theories of a European federation are discussed. Section 2 deals with different concepts of federalism and presents approaches of the economic theory of federalism in the context of the European polity. The normative considerations conclude with a discussion of the subsidiarity principle and the constitutional allocation of competences in the European Treaties. Section 3 covers the empirical issue of how to explain the actual allocation of competences (scope and type) between levels. Integration theories are presented here only in so far as they explain the transfer of competence from the national to the European level or the limits of this centralistic dynamics.

19.06.08: What about the size of the eu-commission after the No vote in Ireland? - 0 views

  • The EU summit, which starts in Brussels today (19 June), was meant to give EU leaders the opportunity to discuss their first full-time president. But following the 'no' vote in Ireland, they now face the less pleasant prospect of having to reduce the size of the European Commission as currently required by the Nice Treaty.
  • Background: The Nice Treaty stipulates that when the number of EU member states reaches 27, the number of commissioners appointed in the subsequent EU executive would have to be less than this number, without giving a precise figure.  With the EU now having numbered 27 members since 1 January 2007, there is an understanding that the current number of commissioners exceeds the realistic number of portfolios.  As an example, to accommodate Bulgaria and Romania, Markos Kyprianou, the Cypriot health and consumer protection commissioner, had to abandon the second part of his portfolio in favour of his new Bulgarian colleague, Meglena Kuneva (EurActiv 26/10/06) Similarly, the multilingualism portfolio was taken from Ján Figel, the Slovak commissioner for education, training and culture, and handed to Leonard Orban, the Romanian commissioner (EurActiv 31/10/06).
  • But following the failed Irish referendum, heads of state and government will instead have to revert to the provisions of the Nice Treaty, which is designed for a Europe of 27 member states, diplomats said.  In short, this means having to consider reducing the number of commissioners to below 27, as foreseen under the current treaty agreed upon in Nice in 2001. In contrast, the Lisbon Treaty envisages reducing the number of commissioners to 15 by 2014.

  • "Under Lisbon, this would only have happened in 2014," Sellal told journalists in Brussels on 18 June. The question of which country (or countries) should give up their commissioner will therefore now have to be open to negotiation between EU heads of state. And because such decisions have to be taken by unanimity, this raises the prospect of endless haggling between member states.  "As long as there will be no Lisbon Treaty, this question will remain open," Sellal said.

Kaina/Karolewski (2009): EU governance and European identiy, Living Reviews in European... - 0 views

  • This Living Review presents an overview of the research on European identity in the context of EU governance by focussing on central debates in the political science literature. It departs from the problems of disagreement between European citizens and their elites as well as the lack of a European demos. Against this background, the article discusses the functions of collective identity including the legitimation function and solution of collective dilemmas. Here, two perspectives pertaining to these functions are depicted: first, the issue of European public space and second, the integrative workings of European citizenship. Next, the article explores the conceptual and methodological problems of the research on European collective identity. In particular, it focuses on the conceptual ambiguity of the collective identity term and problems of operationalization and measurement. Following this, the article discusses the literature on identity technologies of the EU and identifies the shortcomings of identity technologies with regard to EU governance. EurActiv outlines various scenarios for Ukraine's expected rocky path towards closer EU integration.
  • Background: Ukraine, a country of 46 million people wedged between the EU and Russia, has broken with its Soviet and totalitarian past, but its democracy is still young and fragile.  While enlargement to Ukraine is not officially on the table and is widely seen as premature, the option is supported by Central European countries and many Ukrainian politicians. On the other hand, the EU's readiness to absorb large countries like Turkey or Ukraine is currently limited.  Ukraine's record has been shaky since independence from the Soviet Union in 1991 and the Orange Revolution in 2004, notably due to government instability, fights between the prime minister and the president, and numerous scandals (see EurActiv 04/09/08).  In parallel, Ukraine is negotiating an association agreement with the EU, which would essentially see the two open their markets to one another, like any free trade agreement, but one step short of the customs union in force with Turkey. Creating visa-free travel with Ukraine could also be an important step in its EU rapprochement.  Ukrainian membership of NATO was rejected at the Bucharest Summit in April 2008, at the same time as Georgia's was turned down (EurActiv 02/04/09). According to some analysts, the decision facilitated the latter's invasion of South Ossetia and Abkhazia four months later. 
  • Many politicians in Ukraine wish to see their country enter the EU through the main entrance. The reality, however, is that the process will likely result in entry via a side door after hanging around in several waiting rooms in the meantime, experts in Brussels and Kyiv told EurActiv.
