Creative Commons and Open Access

"Carlo Govoni von der Beobachtungsstelle für technische Maßnahmen ersucht um Mitteilung von Problemen im Zusammenhang mit DRM. Insbesondere von Seiten von Open Source Software Entwicklern werden Meldungen erwartet. Es wären aber auch allgemeine Hinweise hilfreich, damit Herr Govoni auf allenfalls noch unentdeckte Kanäle stößt, über die er eine allenfalls mißbräuchliche Verwendung von technischen Schutzmaßnahmen erkennen kann. Herr Govoni hat anhand von praktischen Beispielen erläutert, wo mißbräuchliche Situationen bestehen könnten. Zum Beispiel verwies er auf die Praxis von Online Shops in preislicher Hinsicht danach zu differenzieren, ob ein Musikwerk mit oder ohne Kopierschutz zum Download angeboten wird. Wenn die Version mit Kopierschutz den Privatgebrauch einschränkt, die Version ohne Kopierschutz jedoch nur gegen einen Aufpreis zu bekommen ist, könnte darin ein Mißbrauch liegen. Die Beobachtungsstelle klärt diesen Fall derzeit ab."

Abstract: Technically it is entirely possible to attach a Creative Commons license to a sound recording - but does the law permit it? This study examines the rights of performers and producers in the sound recordings they create, the collective management systems in place for the exploitation of those rights, and the relevant terms of the Creative Commons licenses. On this basis, it attempts to assess whether Creative Commons licenses can be attached to sound recordings, whether the use of such licenses can be combined with the collective management of related rights in sound recordings and, if so, under what circumstances and conditions this can be achieved.

"At a time when we have the technologies to enable global access to and distributed processing of scientific research and data, legal and technical restrictions are making it difficult to connect the dots. Even when research and data is made public, it's often locked up by regimes or contracts that prohibit changing file formats or languages, integrating data, semantic enrichment, text mining and more. It Is About Time: Getting Our Values Around Copyright Right - Nov 5th, 2009 In this talk, Lawrence Lessig will review the progress of the "open access" movement in education. He will make a call for educators to finally resolve this issue in a way that enables the potential of technology for education.
