Omar Khan, 18, a student at Tesoro High School in Rancho Santa Margarita, now faces 34 felony counts of altering a public record, 11 felony counts of stealing and secreting a public record, seven felony counts of computer access and fraud, six felony counts of burglary, four felony counts of identity theft, three felony counts of altering a book of records, two felony counts of receiving stolen property, one felony count of conspiracy and one felony count of attempted altering of a public record.

“This cyber-safety bill is a critical step toward protecting Kentuckians from the very real threats that come with 21st century innovations and toward helping to prevent further abuses of these technologies,” said Beshear. “Kentucky families will be safer because of this bill.”HB 315, which was authored by Conway and primarily sponsored by Bell, makes it a Class D felony to solicit a minor for sexual activity through electronic communication. Through this legislation it is unlawful to “cyberstalk,” which is defined as intentionally alarming, annoying, intimidating or harassing a person with no legitimate purpose through electronic communication. This bill also includes tougher regulations for sex offenders when they use electronic communication.

In a move aimed at cracking down on cyerbullying, Texas lawmakers passed a new bill that makes it a crime to impersonate people online. The new "online harassment" statute makes it a felony to create phony profiles on social networking sites with the intent to "harm, defraud, intimidate, or threaten" others. The statute defines commercial social networking sites broadly, saying they include any sites that allow people to register to communicate with others or create Web pages or profiles. (Email programs and message boards are excluded from the definition.)

Along with marketed content for the PlayStation Portable, Nicolakis said Playboy started a service called iBod. The service started in 2005 and allows users to download soft porn to their device. Wallpaper of nude photos and explicit ring tones are some of the other materials available through built-in Web browsers in portable devices like the iPhone, Nicolakis said, and parental safeguards are nonexistent or just now becoming available. He said another avenue for pornographic material is user-generated photos or videos sent from cell phone to cell phone. Teens are reportedly taking sexually explicit photos of themselves and sending them to friends, but the images can easily be sent without consent to others, Nicolakis said. "That's child pornography, and that's a felony," he said. "If you think you're immune to it here in Modesto, you're wrong. It's probably already happened, you just don't know yet.

As eSchool News has reported before, the growing trend of teenagers distributing nude self-portraits electronically--often called "sexting" if it's done by cell phone--has parents and school administrators worried. Some prosecutors have begun charging teens who send and receive such images with child pornography and other serious felonies. But is that the best way to handle it?

Phillip Alpert found out the hard way. He had just turned 18 when he sent a naked photo of his 16-year-old girlfriend, a photo she had taken and sent him, to dozens of her friends and family after an argumen

t was a stupid thing I did because I was upset and tired and it was the middle of the night and I was an immature kid," says Alpert.

Orlando, Florida, police didn't see it that way. Alpert was arrested and charged with sending child pornography, a felony to which he pleaded no contest but was later convicted. He was sentenced to five years probation and required by Florida law to register as a sex offender.
