Obama Orders Review Of Transfers Of Military Surplus To Local Police : The Two-Way : NPR - 0 views

  • President Obama has ordered a review of federal programs that supply local law enforcement agencies with military weapons and equipment after concerns over how the police handled unrest in Ferguson, Mo., in the aftermath of the shooting death of Michael Brown. A senior Obama administration official says the president "whether state and local law enforcement are provided with the necessary training and guidance; and whether the federal government is sufficiently auditing the use of equipment obtained through federal programs and funding." The official also says the review would include input from the Domestic Policy Council, the National Security Council, the Office of Management and Budget, as well as the departments of Defense, Justice, Homeland Security and Treasury.

The Neocons' Grim 'Victory' in Iraq | Consortiumnews - 0 views

  • Neocons do like to declare victory, especially regarding the Iraq War. So it came as no surprise that Paul Wolfowitz, apparently unimpressed by Iraq’s mounting crisis, regaled a recent panel discussion at the U.S.-Africa Summit with the blunt proclamation, “We have won it — in  2009.” Unsurprisingly, that’s when Team Bush left the White House — and approximately 150,000 troops behind in Iraq. Perhaps also not surprisingly, war-weary Americans didn’t pay much attention to Paul’s pronouncement. No doubt they are as tired of Wolfowitz as they are of the war he helped to start. It probably rang as hollow as the faint echo of his earlier pitch for a quick, all-expenses-paid war against 2003’s Hitler of the Moment — Saddam Hussein.
  • But it’s not quite as simple as that. The issue got more complicated shortly after the Africa summit when President Barack Obama — who had pinned his legacy on extricating the United States from Iraq — suddenly found himself at a podium to announce limited, but open-ended military action to halt the dreaded march of The Islamic State (often called ISIS or ISIL) through the repeatedly rocked Cradle of Civilization. Many have explained the organization’s plan for creating a fundamentalist caliphate and its reliance on shockingly brutal tactics that make ISIS something that even al-Qaeda could never be, nor perhaps ever wanted to be. Many others have prodded the dying corpse of Iraq to assign blame here, there and everywhere. But the most basic reason for more bombing is found right there in the self-aggrandizing quip by Paul Wolfowitz. The simple fact is that the Iraq War was a smashing success – at least for the neocons – because it smashed the keystone in the arch of the region’s stability. By removing Saddam Hussein, his government and the Republican Guard, neocons removed a bulwark against the very jihadism that has policymakers and pundits forever wringing their hands raw, military contractors ringing their cash registers, and the denizens of the national security state resting assured under a blanket of secrecy.
  • Considering the persistent ubiquity of U.S. forces in the Persian Gulf, their growing presence around the Horn of Africa and extension into Sub-Saharan Africa, Wolfowitz’s declaration of victory may not be ironic or delusional; it may have some measure of truth – at least from his perspective – but for a reason most would not consider victorious. That “victory” achieved something the neocons could only dream of during a fitful slumber brought on by counting the media’s sheep, i.e. a permanent war in the Middle East.

Blacklisted: The Secret Government Rulebook For Labeling You a TerroristThe Intercept - 0 views

  • The Obama administration has quietly approved a substantial expansion of the terrorist watchlist system, authorizing a secret process that requires neither “concrete facts” nor “irrefutable evidence” to designate an American or foreigner as a terrorist, according to a key government document obtained by The Intercept. The “March 2013 Watchlisting Guidance,” a 166-page document issued last year by the National Counterterrorism Center, spells out the government’s secret rules for putting individuals on its main terrorist database, as well as the no fly list and the selectee list, which triggers enhanced screening at airports and border crossings. The new guidelines allow individuals to be designated as representatives of terror organizations without any evidence they are actually connected to such organizations, and it gives a single White House official the unilateral authority to place entire “categories” of people the government is tracking onto the no fly and selectee lists. It broadens the authority of government officials to “nominate” people to the watchlists based on what is vaguely described as “fragmentary information.” It also allows for dead people to be watchlisted. Over the years, the Obama and Bush Administrations have fiercely resisted disclosing the criteria for placing names on the databases—though the guidelines are officially labeled as unclassified. In May, Attorney General Eric Holder even invoked the state secrets privilege to prevent watchlisting guidelines from being disclosed in litigation launched by an American who was on the no fly list. In an affidavit, Holder called them a “clear roadmap” to the government’s terrorist-tracking apparatus, adding: “The Watchlisting Guidance, although unclassified, contains national security information that, if disclosed … could cause significant harm to national security.”
  • The rulebook, which The Intercept is publishing in full, was developed behind closed doors by representatives of the nation’s intelligence, military, and law-enforcement establishment, including the Pentagon, CIA, NSA, and FBI. Emblazoned with the crests of 19 agencies, it offers the most complete and revealing look into the secret history of the government’s terror list policies to date. It reveals a confounding and convoluted system filled with exceptions to its own rules, and it relies on the elastic concept of “reasonable suspicion” as a standard for determining whether someone is a possible threat. Because the government tracks “suspected terrorists” as well as “known terrorists,” individuals can be watchlisted if they are suspected of being a suspected terrorist, or if they are suspected of associating with people who are suspected of terrorism activity. “Instead of a watchlist limited to actual, known terrorists, the government has built a vast system based on the unproven and flawed premise that it can predict if a person will commit a terrorist act in the future,” says Hina Shamsi, the head of the ACLU’s National Security Project. “On that dangerous theory, the government is secretly blacklisting people as suspected terrorists and giving them the impossible task of proving themselves innocent of a threat they haven’t carried out.” Shamsi, who reviewed the document, added, “These criteria should never have been kept secret.”

Hillary Clinton's Real Scandal Is Honduras, Not Benghazi - 0 views

  • What beats me is why more Democrats aren’t deeply troubled by the legacy of Clinton’s foreign policy blunder in Honduras. Maybe you’ve forgotten what happened in that small country in the first year of the Obama administration — more on that in a moment. But surely you’ve noticed the ugly wave of xenophobia greeting a growing number of Central American child refugees arriving on our southern border. Some of President Barack Obama’s supporters are trying to blame this immigration crisis on the Bush administration because of an anti-trafficking law George W. signed in 2008 specifically written to protect Central American children that preceded an uptick in their arrivals. But which country is the top source of kids crossing the border? Honduras, home to the world’s highest murder rate, Latin America’s worst economic inequality, and a repressive U.S.-backed government. When Honduran military forces allied with rightist lawmakers ousted democratically elected President Manuel Zelaya in 2009, then-Secretary of State Clinton sided with the armed forces and fought global pressure to reinstate him.
  • Washington wields great influence over Honduras, thanks to the numerous military bases built with U.S. funds where training and joint military and anti-drug operations take place. Since the coup, nearly $350 million in U.S. assistance, including more than $50 million in military aid has poured into the country. That’s a lot of investment in a nation where the police, the military, and private security forces are killing people with alarming frequency and impunity, according to Human Rights Watch. In short, desperate Honduran children are seeking refuge from a human rights nightmare that would cast a dark cloud over Clinton’s presidential bid right now if the media were paying any attention. That wouldn’t give Republicans a big advantage, of course. Until they stop alienating a majority of female voters and communities of color, I find it hard to see the party of Mitt Romney and John McCain winning the White House.
  • Given the Democratic Party’s demographic edge, progressives have nothing to lose by seizing on the GOP field’s weakness and pressing for a viable alternative to another Clinton administration. Senator Elizabeth Warren could prove a contender. Unfortunately, the consumer-rights firebrand and Massachusetts Democrat lacks any foreign policy experience. And foreign policy is no afterthought these days. Israel — the recipient of $3.1 billion a year in U.S. military aid — is waging a ground war in Gaza, and the stakes in the Russia-Ukraine conflict just grew following the downing of that Malaysia Airlines jet. Plus, Iraq is growing more violent and unstable once more. On all these issues, Clinton is more hawkish than most of the Democratic base. But other Democrats with a wide range of liberal credentials and foreign policy expertise are signaling some interest in running, especially if Clinton ultimately sits out the race. Even if Clinton does win in 2016, a serious progressive primary challenge could help shape her presidency. As more and more Honduran kids cross our border in search of a safe haven, voters should take a good look at her track record at the State Department and reconsider the inevitability of another Clinton administration.

WASHINGTON (AP) — Senior U.S. intelligence officials said Tuesday that Russia was responsible for "creating the conditions" that led to the shooting down of Malaysia Airlines Flight 17, but they offered no evidence of direct Russian government involvement. The intelligence officials were cautious in their assessment, noting that while the Russians have been arming separatists in eastern Ukraine, the U.S. had no direct evidence that the missile used to shoot down the passenger jet came from Russia. The officials briefed reporters Tuesday under ground rules that their names not be used in discussing intelligence related to last week's air disaster, which killed 298 people. The plane was likely shot down by an SA-11 surface-to-air missile fired by Russian-backed separatists in eastern Ukraine, the intelligence officials said, citing intercepts, satellite photos and social media postings by separatists, some of which have been authenticated by U.S. experts. But the officials said they did not know who fired the missile or whether any Russian operatives were present at the missile launch. They were not certain that the missile crew was trained in Russia, although they described a stepped-up campaign in recent weeks by Russia to arm and train the rebels, which they say has continued even after the downing of the commercial jetliner.

But if they possess satellite or other imagery of the missile being fired, they did not release it Tuesday. A graphic they made public depicts their estimation of the missile's flight path with a green line. The jet's flight path was available from air traffic control data.

The working theory is that the SA-11 missile came from Russia, although the U.S. doesn't have proof of that, the officials said. U.S. Ambassador to the U.N. Samantha Power said last week that "because of the technical complexity of the SA-11, it is unlikely that the separatists could effectively operate the system without assistance from knowledgeable personnel. Thus, we cannot rule out technical assistance from Russian personnel in operating the systems," she said. Asked about evidence, one of the senior U.S. intelligence officials said it was conceivable that Russian paramilitary troops are operating in eastern Ukraine, but that there was no direct link from them to the missile launch. Asked why civilian airline companies were not warned about a possible threat, the officials said they did not know the rebels possessed SA-11 missiles until after the Malaysian airliner was shot down. (WHAT?  Even I new this, just by reading the reports about the seized Buks, reports which even included photos.  They are really insulting our collective intelligence again!)

Turkey's Erdogan: 'I stopped talking to Obama' - RT USA - 0 views

  • Turkish Prime Minister Recep Tayyip Erdogan said he ceased direct phone contact with US President Barack Obama once the US backed away from use of military force against Syria last fall. Erdogan, a supporter of rebel fighters opposed to Syrian President Bashar Assad’s government, was upset, he said, that the United States did not follow through with military action against Damascus amid the fierce civil war there.
  • The last phone conversation between Erdogan and Obama took place on February 20, according to AFP, after which the White House released a scathing statement accusing Erdogan of misrepresenting the content of their conversation. Erdogan has also been at odds with the US over Israel’s current offensive in the Gaza Strip that has killed more than 580 Palestinians in two weeks. Erdogan accused Israel of “state terrorism” and a “genocide” of Palestinians. He also chastised the US for defending Israel’s “disproportionate” use of force, adding that Israel had “surpassed Hitler in barbarism.”

European leaders (especially Merkel of Germany, Hollande of France, and Putin of Russia) urged him not to resume his bombing campaign against the southeast, but the U.S. (specifically President Obama) supports the bombings, and that’s enough for Poroshenko; so, he did it. As the U.S. State Department said, “he has a right to defend his country.” Reuters reports that Poroshenko gave as his reason for the resumption, “to rid Ukraine of ‘parasites’.”  Adolf Hitler had given the same reason for ethnically cleansing his country. Here are videos and photos of the Obama Administration’s sponsored ethnic cleansing to reduce the population in the areas of Ukraine that had voted overwhelmingly “the wrong way” in Ukraine’s final nationwide election, in 2010:  the areas of Ukraine that overwhelmingly chose as Ukraine’s President the man whom Obama’s coup overthrew in February 2014. After this ethnic cleansing, maybe Ukraine can have another nationwide election, which will produce the type of outcome that the U.S. Government likes. But on 25 May 2014, we held in Ukraine an election where people voted only in the pro-American portion of Ukraine, and only leaders who were acceptable to the U.S. White House were allowed onto the ballot. America’s “news” media are not reporting on America’s ethnic-cleansing program in Ukraine. It’s happening in the dark, as far as the American public are concerned: they don’t know about it. But, here it is: this, is what they are hiding from you.

  • U.S. President Barack Obama's war against Russia isn't only causing Russia to cooperate more strongly with the other BRIC countries to break the U.S. dollar's reign as the global reserve currency, but it's also causing Russian President Vladimir Putin's job-approval rating in Russia to soar, and the confidence that the Russian people have in their own Government to soar likewise.
  • The latest of these signs came on 5 August 2014 in a report from Gallup Analytics (by subscription only) headlined "Russians' Confidence in Many Institutions Reaches All-Time High." Especially sharp has been the rise in "Confidence in national government," which was only 39% in 2013 prior to the overthrow by Obama in February 2014 of Ukraine's government which had been friendly to Russia, but which confidence-level stands now at 64% -- a gain of 64/39 or 1.64 times higher than it was a year ago. Confidence in the military has risen from 65% in 2013 to 78% now. Confidence in the "honesty of elections" has risen from a very low 23% in 2013 to 39% today (which is 39/23 or 1.70 times higher), as increasing numbers of Russians have come to conclude that their political system is producing better results for them than they had expected, perhaps better than in the longer-established "democratic" nations, such as the United States, whose President Barack Obama is far less highly regarded now by Russians, after his overthrowing Ukraine's Government, than he was prior to that. Remarkably, more Russians than ever before, 65%, answer "Yes" when asked "are you satisfied ... with your freedom to choose what you do with your life?" Last year, only 56% did, down 2% from the prior all-time high of 58% in 2006.
  • A Gallup poll issued on 18 July 2014 headlined "Russian Approval of Putin Soars to Highest Level in Years," and reported that "President Vladimir Putin's popularity in Russia is now at its highest level in years, likely propelled by a groundswell of national pride with the annexation of Crimea in March on the heels of the Sochi Olympic Games in February. The 83% of Russians saying they approve of Putin's leadership in late April/early June ties his previous high rating in 2008 when he left office the first time." Furthermore, "The 29-percentage-point increase in Putin's job approval between 2013 and 2014 suggests he has solidified his previously shaky support base. For the first time since 2008, a majority of Russians (73%) believe their country's leadership is leading them in the right direction." Pointedly, Gallup says: "At the same time that their faith in their own leadership has been renewed, Russians' approval of the leadership of the U.S. and the EU are at all-time lows. The single-digit approval of the leadership of the U.S. and EU at least partly reflects Russians' displeasure with the position each has taken on their country's ongoing involvement in Ukraine and its annexation of Crimea." Moreover, "Despite U.S. and European sanctions earlier this year over Moscow's intervention in Ukraine, more Russians see their economy getting better now than has been the case since 2008."

  • All of these changes are largely attributable to Obama's replacement of the democratic but corrupt government in Ukraine by a dictatorial but corrupt one (now elected only by voters in the areas of the country that the new regime isn't ethnically cleansing to get rid of the people who had voted into office the President -- Viktor Yanukovych -- whom Obama and the CIA overthrew in February 2014). Furthermore, there was no serious possibility of Crimea's rejoining Russia (of which Crimea had been a part between 1783 and 1954) until the new Ukrainian regime massacred hundreds of its opponents inside the Odessa Trade Unions Building on May 2nd, the event that caused Yanukovych's voters to fear for their lives. That massacre was co-masterminded by Ihor Kolomoysky, the billionaire gas oligarch who recently hired Joe Biden's son.

Moreover, "Additionally, in the Crimean region -- Ukraine's farthest southeast area, which our President, Barack Obama, says that Russia forcibly seized when the people there voted overwhelmingly on 16 March 2014 to become part of Russia again (as they had been until 1954) -- only 2.8% of the public there view the U.S. favorably; more than 97% of Crimeans do not." Moreover, Gallup surveyed Crimeans a few months before Obama's coup in Ukraine, and headlined "Public Opinion Survey: Residents of the Autonomous Republic of Crimea, May 16-30, 2013." They found that when asked "Regardless of your passport, what do you consider yourself?" 40% said "Russian," 25% said "Crimean," and only 15% said "Ukrainian." So: when the Autonomous Republic voted after Obama's coup, when even fewer Crimeans self-identified with the now-fascist-run Ukraine, it had to have been a foregone conclusion they'd choose Russia, because even prior to that, there was nearly a three-to-one preference of Russia over Ukraine. That same poll showed 68% favorability for Russia and 6% favorability for "USA." 53% wanted to be part of the Customs Union with Russia, Belarus and Kazakhstan, while only 17% wanted to be part of the EU. Obama lies through his teeth about Crimea. On 25 March 2014, the Los Angeles Times headlined "President Obama Says Russia Seized Crimea."

  • The secret arrests and detentions came to light Dec. 21 when the suspects made a brief appearance in a Brooklyn courtroom. The men are the latest example of how the Obama administration has embraced rendition — the practice of holding and interrogating terrorism suspects in other countries without due process — despite widespread condemnation of the tactic in the years after the Sept. 11, 2001, attacks. Renditions are taking on renewed significance because the administration and Congress have not reached agreement on a consistent legal pathway for apprehending terrorism suspects overseas and bringing them to justice.

IS welcomed them with minefields, booby-trapped buildings, an array of snipers and hardcore mortar fire. How convenient that Obama's "humanitarian" bombs are not involved in R2P ("responsibility to protect") Saddam's birthplace. What really matters is the US consulate in Erbil, scores of CIA operatives and vast Big Oil interests in Iraqi Kurdistan.

    Pelosi calling for Congression to decide whether to authorize airstrikes and military action against ISIL is a bit of a puzzler. Many members of Congress do not want to face that issue before the fall election. Obama has been careful to signal his intent to decide the question himself on grounds that ISIL constitutes an imminent threat to the U.S. But Pelosi's voice is a hard one to ignore for a Democratic president. Recent polls show a bump in public support for foreign wars, but that was to be expected after the War Party's shock and awe propaganda campaign about ISIL. They will probably sink again fairly soon because articles by cooler heads are just beginning to roll. Israel Crosses the Threshold II: The Nixon Administration Debates the Emergence of the ... - 0 views

  • Washington, D.C., September 12, 2014 – During the spring and summer of 1969, officials at the Pentagon, the State Department, the Central Intelligence Agency, and the White House debated and discussed the problem of the emergence of a nuclear Israel. Believing that Israel was moving very close to a nuclear weapons capability or even possession of actual weapons, the Nixon administration debated whether to apply pressure to restrain the Israelis or even delay delivery of advanced Phantom jets whose sale had already been approved. Recently declassified documents produced in response to a mandatory declassification review request by the National Security Archive, and published today by the Archive in cooperation with the Nuclear Proliferation International History Project, show that top officials at the Pentagon were especially supportive of applying pressure on Israel. On 14 July 1969, Deputy Secretary of Defense (and Hewlett-Packard co-founder) David Packard signed a truly arresting memorandum to Secretary of Defense Melvin Laird, arguing that failure to exert such pressure "would involve us in a conspiracy with Israel which would leave matters dangerous to our security in their hands." In the end, Laird and Packard and others favoring pressure lost the debate. While National Security Advisor Henry Kissinger supported some of their ideas, he also believed that, at the minimum, it would be sufficient for U.S. interests if Israel kept their nuclear activities secret. As he put on his draft memo to President Nixon on or around July 19, "public knowledge is almost as dangerous as possession itself." Indeed, Nixon opposed pressure and was willing to tolerate Israeli nuclear weapons as long as they stayed secret.
  • Earlier this year (2014), in response to a mandatory declassification review appeal filed by the National Security Archive in July 2009, the Interagency Security Classification Appeal Panel (ISCAP) declassified additional documents and information that shed brighter light on this highly sensitive policy debate. NSSM 40 is now declassified and published for the first time as is the formal interagency response to it. The intelligence reports prepared during the NSSM process remain classified, however. These along with other documents in the ISCAP release (including records that were declassified in 2007 and material published in 2006) elucidate the complexity and the enormous sensitivity of the internal debate over how far to apply pressure and what exactly the U.S. should ask of Israel. The interagency response revealed unanimity in goals-Israel should sign the Nuclear Nonproliferation Treaty (NPT) and halt its weapons program-but exposed significant divisions over how far Israel should be pressed and whether Washington should use military sales-in particular, withholding the delivery of Phantom jets, as leverage. There were also differences in how various officials assessed and conceptualized Israel's nuclear status at that time, and what commitments could realistically be asked of Israel. It might well be that the split of opinion between Defense and State allowed President Nixon even more freedom in making his own decision.
  • It appears now that a long memorandum written by Assistant Secretary of Defense Paul Warnke, a holdover from the Lyndon Johnson administration, to the new secretary of defense, Melvin Laird, was important element in the instigation of NSSM 40. Believing that it would be a danger to US interests if Israel acquired nuclear weapons, Warnke argued in his memo of 15 February 1969 that the United States must respond to the new Israeli nuclear reality and asked Laird to "consider another serious, concerted, and sustained effort to persuade Israel to halt its work on strategic missiles and nuclear weapons." Warnke believed that Washington must be ready to exert heavy pressure on Israel, starting with a presidential demarche. The view that it would be a danger to US security interests if Israel acquired nuclear weapons was at that time a largely non-partisan matter. Senior Democrats and Republicans within both the Johnson and Nixon administrations held that view, and both Laird and his deputy David Packard were responsive to Warnke's arguments that the US should apply pressure. To some extent, as Packard suggested in his July memorandum, even Kissinger seems at one time to have been part of that consensus, though his views were somewhat more subtle and variable. This nonpartisan consensus highlights how at the end independent-in fact, secretive and aloof-President Nixon was as he made his own decisions on the matter. Thus, he ruled against using the Phantoms as pressure and in doing so left the United States with no leverage whatsoever.

Most intriguing, we still do not know much about President Nixon's direct involvement in the debate, in particular exactly how, when, and why he ultimately overruled strong advice from senior officials to use pressure against the Israeli government. Indeed, it appears that no record exists in the national archives of either country that reveals what was agreed to at the meeting

Former FBI Agent Mark Rossini Says The CIA Kept Him From Helping To Stop 9/11 - Busines... - 0 views

  • An FBI special agent who lost his job in 2008 told Newsweek columnist Jeff Stein his story about how the 9/11 hijackers slipped through the cracks at the FBI and CIA more than a decade ago. Mark Rossini said the CIA prevented him from going to FBI headquarters with the information that two known terrorists, who later went on to carry out the 9/11 attacks on the World Trade Center, had entered the US. Government reports on 9/11 blame a vague "intelligence failure" for the terrorist attack that killed about 3,000 people in 2001 and provide little clarity on why the CIA didn't communicate crucial information about the hijackers to the FBI. This information, in theory, could have helped the US to prevent the attacks.
  • Rossini said that after 9/11, when congressional investigators started asking him questions about his work with the CIA's Osama bin Laden unit, he and another FBI agent stayed quiet at the direction of CIA officers. "It was just understood in the office that they were not to be trusted, that [the congressional investigators] were trying to pin this on someone, that they were trying to put someone in jail," Rossini told Newsweek. "They said [the investigators] weren’t authorized to know what was going on operationally. … When we were interviewed, the CIA had a person in the room, monitoring us." He eventually told the FBI in 2004 about what happened. He said he regrets obeying CIA orders and not going to FBI headquarters with the information that Khalid al-Mihdhar, who would go on to hijack one of the planes used in the 9/11 attack, was in the country. The CIA had been tracking al-Mihdhar for some time already. It wasn't until the agency lost track of him and another future hijacker, Nawaf al-Hazmi, in the summer of 2001 that the CIA went to the FBI with the information that the terrorists were in the US.
  • Rossini pointed out that al-Mihdhar was "a known terrorist that [the CIA] follows around the globe. He’s a subject of several cables, he comes to America ... and they allow him to leave America and go back to Yemen for the birth of his baby. And he comes back." If it was the CIA's plan to recruit al-Mihdhar and al-Hazmi, as former White House counterterrorism adviser Richard A. Clarke has suggested, it obviously did not work. A few months after the CIA lost track of the two terrorists, the 9/11 attacks were carried out. The US still doesn't have an official explanation as to why CIA officers forbade Rossini from going to FBI headquarters with the information about al-Mihdhar and al-Hazmi. Several top government officials have gone on the record with doubts about the CIA's version of events leading up to 9/11.

  • The sponsors of the latest Kirk-Menendez Iran sanctions bill appear determined to move the legislation as quickly as possible, although it has yet to be formally introduced. Of course, both Obama and visiting British Prime Minister David Cameron came out strongly against any sanctions legislation during their joint press appearance at the White House Friday, warning that approval risked sabotaging not only the ongoing negotiations, but also unity among the P5+1 (U.S., U.K, France, Russia, China plus Germany) themselves. In olden times one would have expected most Republicans to take seriously what a British prime minister–especially one from Winston Churchill’s Conservative Party–has to say about a foreign policy issue of mutual interest. But the combination of their real hatred for Obama and purported love for Israel (and especially for the campaign funds from wealthy Republican Jewish Coalition donors like Sheldon Adelson) is likely to supersede the historic “special relationship” extolled by Churchill himself. In any event, the best and most up-to-date summary of where things stand was provided in the weekly Legislative Round-Up by Lara Friedman of Americans for Peace Now (APN), lengthy excerpts of which are reproduced below with permission. (APN legislative round-ups are an excellent source for tracking what’s happening on Capitol Hill on Middle East policy.) Note that there are two parts to her account: the first is regarding an AIPAC draft that circulated earlier this week (and Lara’s analysis of that legislation); the second, an updated version circulated at week’s end apparently in the hope of securing more Democratic support, as well as Lara’s analysis of that draft.
  • Updated analysis of Kirk-Menendez text (as of 3pm, 1/16) In some annoying corollary to Murphy’s Law, shortly after posting analysis of the draft text of the new Kirk-Menendez sanctions bill (in which it was noted that the text should not be considered final or authoritative), a newer draft of the bill began circulating (underscoring the oddness of AIPAC circulating a “summary” of the bill while it was/is apparently still being tweaked).  Bearing in mind that this new text should still not be considered final or authoritative, the following are some observations about this newer text:
  • Existing sanctions don’t snap back, but additional sanctions relief remains elusive: This newer text repeats language in the earlier draft to the effect that while following an agreement (and required notification to Congress) the President may not waive any sanctions on Iran until Congress has had time to review the deal and the Administration’s plans to verify Iranian compliance. The newer version includes language – completely absent in the earlier draft – stipulating that this ban on waiving sanctions does not apply to sanctions previously waived under the JPOA. Notably, the updated version of the bill still stipulates that the Congressional review period during which the President is barred from waiving any new sanctions must last “30 days of continuous session of Congress,” and defines “continuous session” as not including periods where Congress is in recess for more than 3 days.  What does this mean? Looking at the House Calendar for 2105 and counting the days, it means that if the President sends the details of a deal and the required “verification assessment” to Congress on July 5, no new sanctions may be waived until at least November 13.

  • Automatic new sanctions if no agreement or further delay: Like the earlier version, this text stipulates that new sanctions would automatically be imposed, escalating over a period of months, in the event that  the Presidents fails to send to Congress the details of a comprehensive deal reached with Iran and the required “verification assessment” by July 5. This appears to apply even in the case of an additional extension or the sides agreeing to a period to iron out the details of implementation of an agreement.  It also stipulates that in the event that the President fails to send to Congress the details of a comprehensive deal reached with Iran and the required “verification assessment” by July 5, any sanctions previously waived by the President under the JPOA will automatically snap back on.
  • Laying out far-reaching parameters for a deal: Like in the previous version, the Sense of Congress included in the bill is, by definition, non-binding. It nonetheless sends a strong statement of Congressional intent. And this Sense of Congress, like the previous version, sends a statement of hardline red lines in order for any deal to be acceptable to Congress (and the lengthy review period imposed by this bill clearly implies that Congress will be reviewing any agreement to determine if it meets its standards – and implies that if it does not meet its standards, there will be concrete consequences). Promising that sanctions will continue, regardless of a deal. While, like in the previous version, the Sense of Congress is by definition non-binding, it nonetheless sends a strong statement of Congressional intent. And this Sense of Congress once again makes clear that even if there is a deal that verifiably addresses U.S. concerns about Iran’s nuclear program, Congress will seek to continue to impose far-reaching sanctions against Iran for other reasons.
  • Planting the seeds for a deal to far apart:  The key provisions of this updated version of the bill, even amended, are a clear poison pill for any agreement.  In effect, this bill undermines negotiations and weakens U.S. negotiators. Rather than offering more sanctions relief to Iran in exchange for a deal, it prohibits it, and establishes a 4-month period during which the President is explicitly deprived of any authority to deliver anything to Iran beyond what was already delivered during negotiations. Assuming Iran would agree to a deal under such circumstances – which is doubtful – this bill sets into motion a dynamic in which Iranian opponents of a diplomacy will have an easy time arguing against the deal, and in which mischief-makers in Congress will have ample time to push ahead with new legislation rejecting a deal or putting new conditions on its implementation and limitations on sanctions relief. And given the Sense of Congress in this bill – which makes the case for continued Iran sanctions even after a nuclear deal, it is not a stretch to imagine that members of Congress would adopt such an approach during this 4 month waiting period.

    Remember that the Israeli-firsters goal is not actually do do anything about Iranian nuclear weapons: there are none. There goal is to shoot down the negotiations and for the U.S. to bomb Iran back into the Stone Age.
