In November, the Israelis learned the contents of a proposed deal offered by the U.S. but ultimately rejected by Iran, U.S. and Israeli officials said. Israeli officials told their U.S. counterparts the terms offered insufficient protections.

Israeli officials said such fuel, which under the emerging deal would be intended for energy plants, could be used to one day build nuclear bombs. The information in the briefings, Israeli officials said, was widely known among the countries participating in the negotiations. When asked in February during one briefing where Israel got its inside information, the Israeli officials said their sources included the French and British governments, as well as their own intelligence, according to people there.

Some of these charges were crimes. Others were not. The one common denominator in all these accusations was that the Official had somehow abused the power of his office and was unfit to serve.

The report, built around detailed chronologies of dozens of CIA detainees, documents a long-standing pattern of unsubstantiated claims as agency officials sought permission to use — and later tried to defend — excruciating interrogation methods that yielded little, if any, significant intelligence, according to U.S. officials who have reviewed the document.

The information from that period was subsequently conflated with lesser intelligence gathered from Ghul at a secret CIA prison in Romania, officials said. Ghul was later turned over to authorities in Pakistan, where he was subsequently released. He was killed by a CIA drone strike in 2012.

  • A Senate Intelligence Committee report provides the first official confirmation that the CIA secretly operated a black site prison out of Guantánamo Bay, two U.S. officials who have read portions of the report have told Al Jazeera. The officials — who spoke on condition of anonymity because the 6,600-page report on the CIA’s detention and interrogation program remains classified — said top-secret agency documents reveal that at least 10 high-value targets were secretly held and interrogated at Guantánamo’s Camp Echo at various times from late 2003 to 2004. They were then flown to Rabat, Morocco, before being officially sent to the U.S. military’s detention facility at Guantánamo in September 2006. In September 2006, President George W. Bush formally announced that 14 CIA captives had been transferred to Guantánamo and would be prosecuted before military tribunals. He then acknowledged for the first time that the CIA had been operating a secret network of prisons overseas to detain and interrogate high-value targets.

The report allegedly singles out a top CIA official for botching a handful of renditions and outlines agency efforts to cover up the mistakes. The Senate report allegedly accuses “senior CIA officials” of lying during multiple closed-session briefings to members of Congress from 2003 to 2005 about the use of certain “enhanced” interrogation techniques. The report says an agency official lied to Congress in 2005 when he insisted the U.S. was adhering to international treaties barring cruel and degrading treatment of prisoners, the U.S. officials told Al Jazeera.
  • The report not only accuses certain CIA officials of deliberately misleading Congress; Al Jazeera’s sources say it also suggests that the agency sanctioned leaks to selected journalists about phantom plots supposedly disrupted as a result of information gained through the program in order to craft a narrative of success. The Senate report, like a 2009 Senate Armed Services Committee report (PDF), says Air Force psychologists under contract to the CIA reverse-engineered a decades-old resistance-training program taught to U.S. airmen known as survival evasion resistance escape (SERE). According to a SERE training document obtained by Al Jazeera titled “Coercive Exploitation Techniques,” Air Force personnel were taught that communist regimes used “deprivations” of “food, water, sleep and medical care” as well as “the use of threats” in order to weaken a captive’s mental and physical ability to resist interrogation. “Isolation” would be used, according to the SERE program, to deprive the “recipient of all social support” so that he develops a “dependency” on his interrogator. And “physical duress, violence and torture” are used to weaken “mental and physical ability to resist exploitation.” Ironically, perhaps, the SERE document (displayed below) notes that such techniques were used by the Soviet Union, China and North Korea to obtain false confessions.
  • Senate investigators allegedly obtained from the CIA a 2003 “business plan,” written by Air Force psychologists James Mitchell and Bruce Jessen, that contained erroneous details about the positive aspects of the enhanced interrogation program and the veracity of the intelligence its extracted from detainees. The “business plan” states that Al-Qaeda captives were “resistant” to “standard” interrogation techniques, an argument the Senate report found lacked merit because torture techniques were used before they were even questioned. Neither Jessen, who lives in Spokane, Wash., nor Mitchell, who resides in Land o’ Lakes, Fla., responded to phone calls or emails for comment. Both men are featured prominently in the Senate’s report, according to U.S. officials.

But if a foreign leader is targeted for eavesdropping, the relevant U.S. ambassador and the National Security Council staffer at the White House who deals with the country are given regular reports, said two former senior intelligence officials, who spoke on condition of anonymity in discussing classified information. Obama may not have been specifically briefed on NSA operations targeting a foreign leader's cellphone or email communications, one of the officials said. "But certainly the National Security Council and senior people across the intelligence community knew exactly what was going on, and to suggest otherwise is ridiculous." If U.S. spying on key foreign leaders was news to the White House, current and former officials said, then White House officials have not been reading their briefing books. Some U.S. intelligence officials said they were being blamed by the White House for conducting surveillance that was authorized under the law and utilized at the White House. "People are furious," said a senior intelligence official who would not be identified discussing classified information. "This is officially the White House cutting off the intelligence community."

Any useful intelligence is then given to the president's counter-terrorism advisor, Lisa Monaco, among other White House officials. "Our review is looking across the board at our intelligence gathering to ensure that as we gather intelligence, we are properly accounting for both the security of our citizens and our allies and the privacy concerns shared by Americans and citizens around the world," Carney said.

    Good. The Intelligence community is calling BS on Obama's claim that he didn't know about the spying on foreign heads of allied states. And McCain says we need a select Congressional committee to look into what the president knew and when he knew it. That's an implicit slam of the Feinstein-led Senate Select Committee on Intelligence's oversight of the intelligence agencies and a signal that there is a scandal lurking here. More importantly, a new select committee would not have the same membership as the existing Intelligence Community, which has largely functioned as a rubber stamp for what the intelligence agencies want. We have been down this road before, in the mid-70s, when the Defense Dept. intelligence agencies were caught spying on Americans, leading to the Select Committee investigation headed by former Sen. Frank Church and to the initial passage of the Foreign Intelligence Surveillance Act, among other legislation delivering a strong message to the intelligence agencies that what happens within the U.S. is off-limits to them. But that was a lesson forgotten as new technology came along for NSA to play with. If Obama is smart, he will promptly respond to the LA Times article with a clarification that top members of his staff knew and the previous statement dealt only with his personal knowledge. But the Obama Administration has overwhelmingly demonstrated an inability to head off scandals and a big tendency to cover-up rather than get out in front of story, particularly in matters involving the NSA. So we may see a major scandal emerge from this already enormous scandal that is laid directly at Barack Obama's feet, a cover-up scandal.   Who knew what when, where, why, and how? My favorite question.

IPS - Obama's Case for Syria Didn't Reflect Intel Consensus | Inter Press Service - 0 views

  • Contrary to the general impression in Congress and the news media, the Syria chemical warfare intelligence summary released by the Barack Obama administration Aug. 30 did not represent an intelligence community assessment, an IPS analysis and interviews with former intelligence officials reveals. The evidence indicates that Director of National Intelligence James Clapper culled intelligence analyses from various agencies and by the White House itself, but that the White House itself had the final say in the contents of the document. Leading members of Congress to believe that the document was an intelligence community assessment and thus represents a credible picture of the intelligence on the alleged chemical attack of Aug. 21 has been a central element in the Obama administration’s case for war in Syria. That part of the strategy, at least, has been successful. Despite strong opposition in Congress to the proposed military strike in Syria, no one in either chamber has yet challenged the administration’s characterisation of the intelligence. But the administration is vulnerable to the charge that it has put out an intelligence document that does not fully and accurately reflect the views of intelligence analysts. Former intelligence officials told IPS that that the paper does not represent a genuine intelligence community assessment but rather one reflecting a predominantly Obama administration influence.

In a radical departure from normal practice involving summaries or excerpts of intelligence documents that are made public, the Syria chemical weapons intelligence summary document was not released by the Office of the Director of National Intelligence but by the White House Office of the Press Secretary. It was titled “Government Assessment of the Syrian Government’s Use of Chemical Weapons on August 21, 2013.” The first sentence begins, “The United States government assesses,” and the second sentence begins, “We assess”. The introductory paragraph refers to the main body of the text as a summary of “the intelligence community’s analysis” of the issue, rather than as an “intelligence community assessment”, which would have been used had the entire intelligence community endorsed the document.
  • A former senior intelligence official who asked not to be identified told IPS in an e-mail Friday that the language used by the White House “means that this is not an intelligence community document”. The former senior official, who held dozens of security classifications over a decades-long intelligence career, said he had “never seen a document about an international crisis at any classification described/slugged as a U.S. government assessment.” The document further indicates that the administration “decided on a position and cherry-picked the intelligence to fit it,” he said. “The result is not a balanced assessment of the intelligence.” Greg Thielmann, whose last position before retiring from the State Department was director of the Strategic, Proliferation and Military Affairs Office in the Bureau of Intelligence and Research, told IPS he has never seen a government document labeled “Government Assessment” either. “If it’s an intelligence assessment,” Thielmann said, “why didn’t they label it as such?”

  • Former National Intelligence Officer Paul Pillar, who has participated in drafting national intelligence estimates, said the intelligence assessment summary released by the White House “is evidently an administration document, and the working master copy may have been in someone’s computer at the White House or National Security Council.” Pillar suggested that senior intelligence officials might have signed off on the administration paper, but that the White House may have drafted its own paper to “avoid attention to analytic differences within the intelligence community.” Comparable intelligence community assessments in the past, he observed – including the 2002 Iraq WMD estimate – include indications of differences in assessment among elements of the community. The same “senior administration official” indicated that DNI Clapper had “approved” submissions from various agencies for what the official called “the process”. The anonymous speaker did not explain further to journalists what that process preceding the issuance of the White House paper had involved. However, an Associated Press story on Aug. 29 referred to “a report by the Office of the Director of National Intelligence outlining the evidence against Syria”, citing two intelligence officials and two other administration officials as sources. That article suggests that the administration had originally planned for the report on intelligence to be issued by Clapper rather than the White House, apparently after reaching agreement with the White House on the contents of the paper. But Clapper’s name was not on the final document issued by the White House, and the document is nowhere to be found on the ODNI website. All previous intelligence community assessments were posted on that site.
  • The issuance of the document by the White House rather than by Clapper, as had been apparently planned, points to a refusal by Clapper to put his name on the document as revised by the White House. Clapper’s refusal to endorse it – presumably because it was too obviously an exercise in “cherry picking” intelligence to support a decision for war – would explain why the document had to be issued by the White House. Efforts by IPS to get a comment from the Office of the Director of National Intelligence suggest strongly that Clapper is embarrassed by the way the Obama White House misrepresented the Aug. 30 document.
  • An e-mail query by IPS to the media relations staff of ODNI requesting clarification of the status of the Aug. 30 document in relation to the intelligence community was never answered. In follow-up phone calls, ODNI personnel said someone would respond to the query. After failing to respond for two days, despite promising that someone would call back, however, ODNI’s media relations office apparently decided to refuse any further contact with IPS on the subject. A clear indication that the White House, rather than Clapper, had the final say on the content of the document is that it includes a statement that a “preliminary U.S. government assessment determined that 1,429 people were killed in the chemical weapons attack, including at least 426 children.” That figure, for which no source was indicated, was several times larger than the estimates given by British and French intelligence. The document issued by the White House cites intelligence that is either obviously ambiguous at best or is of doubtful authenticity, or both, as firm evidence that the Syrian government carried out a chemical weapons attack. It claims that Syrian chemical weapons specialists were preparing for such an attack merely on the basis of signals intelligence indicating the presence of one or more individuals in a particular location. The same intelligence had been regarded prior to Aug. 21 as indicating nothing out of the ordinary, as was reported by CBS news Aug. 23.

But the evidence appears to indicate that the alleged intercept was actually passed on to the United States by Israeli intelligence. U.S. intelligence officials have long been doubtful about intelligence from Israeli sources that is clearly in line with Israeli interests. Opponents of the proposed U.S. strike against Syria could argue that the Obama administration’s presentation of the intelligence supporting war is far more politicised than the flawed 2002 Iraq WMD estimate that the George W. Bush administration cited as part of the justification for the invasion of Iraq.

  • It appears that the Russians got tired of waiting.  I suggest that you all carefully parse the Statement of the Russian Ministry of Foreign Affairs I posted earlier today.  This is an interesting document because besides an explanation of the Russian decision to move it, it is also, potentially, a legal defense or an unprecedented Russian decision: to overtly violate the Ukrainian sovereignty.  Let me explain. First, the case of Crimea was also a "special case".  The Russian were legally present there and, in the Russian rationale, all the "Polite Armed Men in Green" did was to protect the local population to make it possible for the latter to freely express its will.  Only after that will was expressed did Russia agree to formally re-incorporate Crimea into Russia.  So from the legal Russian point of view, none of the Russian actions in Crimea included any form of  violation of Ukrainian sovereignty.  I know, most western analyst will not agree, but that is the official Russian stance.  And official stances are important because they form the basis for a legal argument.
  • Second, the aid which Russia has been sending to Novorussia has been exclusively covert.  Covert operations, no matter their magnitude, do not form the basis for a legal position.  The official position of Moscow has been that not only was there absolutely no military aid to Novorussia, but even when Ukie artillery shells landed inside Russia did the Kremlin authorize any retaliation, again in (official) deference to the Ukrainian national sovereignty. This time, however, there is no doubt at all that the Russians did deliberately and officially chose to ignore Kiev and move in.  Now, in fact, in reality, this is clearly the logically, politically and morally right thing to do.  But in legal terms, this clearly a violation of Ukrainian sovereignty.  From a legal point of view, the Ukies had the right to keep the Russian convoy at the border for another 10'000 years if they wanted and Russia had no legal right to simply move in.  What apparently happened this morning is that the Ukie officials did not even bother showing up, so the Kremlin just said "forget it!" and ordered the trucks in.
  • The US and their main agent in Kiev, Nalivaichenko, immediately and correctly understood the threat: not only did this convoy bring much needed humanitarian aid to Lugansk, it also provided a fantastic political and legal "cover" for future Russian actions inside Novorussia.  And by "actions" I don't necessarily mean military actions, although that is now clearly and officially possible.  I also mean legal actions such as recognizing Novorussia.  From their point of view, Obama, Poroshenko, Nalivaichenko are absolutely correct to be enraged, because I bet you that the timing, context and manner in which Russia moved into Novorussia will not result in further sanctions or political consequences.   Russia has now officially declared the Ukie national sovereignty as "over" and the EU will probably not do anything meaningful about it. That, by itself, is a nightmare for Uncle Sam. Furthermore, I expect the Russian to act with a great deal of restraint.  It would be stupid for them to say "okay, now that we violated the territorial integrity of the Ukraine and ignored its sovereignty we might as well bomb the junta forces and move our troops in".  I am quite confident that they will not do that.  Yet.  For the Russian side, the best thing to do now is to wait.  First, the convoy will really help.  Second, it will become a headache for the Ukies (bombing this convey would not look very good).  Third, this convoy will buy enough time for the situation to become far clearer.  What am I referring to here?

  • Not only did the Russians move in, but they did that without the ICRC whose personnel refused to go because of the lack of security guarantees from Kiev. The Russian response to that lack of security guarantees was a) to order this unarmed convoy in and b) to clearly state in the official statement: We are warning against any attempts to thwart this purely humanitarian mission which took a long time to prepare in conditions of complete transparency and cooperation with the Ukrainian side and the ICRC. Those who are ready to continue sacrificing human lives to their own ambitions and geopolitical designs and who are rudely trampling on the norms and principles of international humanitarian law will assume complete responsibility for the possible consequences of provocations against the humanitarian relief convoy. Again, from a logical, political or moral point of view, this is rather self-obvious, but from a legal point of view this is a threat to use force ("complete responsibility for the possible consequences") inside the putatively sovereign territory of the Ukraine.
  • The Ukie plan has been to present some major "victory" for the Sunday the 24, when they plan a victory parade in Kiev to celebrate independence day (yup, the US-controlled and Nazi-administered "Banderastan" will celebrate its "independence"... this is both sad and hilarious).  Instead, what they have a long streak of *very* nasty defeats during the past 5-6 days or so.  By all accounts, the Ukies are getting butchered and, for the first time, even pushed back (if only on a tactical level).  That convoy in Luganks will add a stinging symbolical "f**k you!" to the junta in Kiev.  It will also exacerbate the tensions between the ruling clique in power, the Right Sector and Dmitri Iarosh and the growing protest movement in western Ukraine. Bottom line: this is a risky move no doubt, probably brought about by the realization that with water running out in Luganks Putin had to act.  Still it is also an absolutely brilliant move which will create a massive headache for the US and its Nazi puppets in Kiev.

What Ukraine and the U.S. have been doing to delay humanitarian relief to Lugansk is beyond despicable. And though not dwelled on here, Kerry's State Dept. lodged an outraged demand that the Russian humanitarian aid convoy return to Russia post haste without unloading any of the supplies in Ukraine. Or else. Or else what? The U.S. also exercised its veto power on the U.N. Security Council to block a draft resolution instructing a temporary cease fire for delivery of the relief supplies.  Dumbout. Now Russia has officially violated Ukraine sovereignty under circumstances that are beyond reproach. The U.S. has no moral high ground to cry foul; the Russians have all of it.  I truly enjoy watching Mr. Lavrov play chess brilliantly while John Kerry steadfastly clings to his belief that the game is checkers. Kerry just can't accept that he's hopelessly outclassed by Lavrov.  And that blunt Russian promise to retaliate militarily if Kiev attacks the convoy? That's an announcement that future Russian humanitarian aid convoys into Ukraine will not be delayed or Russia will simply ignore the Kiev government and ride on through the border. Giving credit where it's due, Lavrov undoubtedly coordinated this action with Vladimir Putin.

According to insiders, participants “agreed there is a strong and credible case to recommend listing”.

There is no form of legal authority that the left accepts as a permanent institution. It only utilizes forms of authority selectively when it controls them.
