A senior federal nuclear expert is urging regulators to shut down California's last operating nuclear plant until they can determine whether the facility's twin reactors can withstand powerful shaking from any one of several nearby earthquake faults.Michael Peck, who for five years was Diablo Canyon's lead on-site inspector, says in a 42-page, confidential report that the Nuclear Regulatory Commission is not applying the safety rules it set out for the plant's operation.The document, which was obtained and verified by The Associated Press, does not say the plant itself is unsafe. Instead, according to Peck's analysis, no one knows whether the facility's key equipment can withstand strong shaking from those faults — the potential for which was realized decades after the facility was built.

Continuing to run the reactors, Peck writes, "challenges the presumption of nuclear safety."Peck's July 2013 filing is part of an agency review in which employees can appeal a supervisor's or agency ruling — a process that normally takes 60 to 120 days, but can be extended. The NRC, however, has not yet ruled. Spokeswoman Lara Uselding said in emails that the agency would have no comment on the document.The NRC, which oversees the nation's commercial nuclear power industry, and Diablo Canyon owner Pacific Gas and Electric Co., say the nearly three-decade-old reactors, which produce enough electricity for more than 3 million people annually, are safe and that the facility complies with its operating license, including earthquake safety standards.

The disaster preparedness of the world's nuclear plants came into sharp focus in 2011, when the coastal Fukushima Dai-ichi plant in Japan suffered multiple meltdowns after an earthquake and tsunami destroyed its power and cooling systems. The magnitude-9 earthquake was far larger than had been believed possible. The NRC has since directed U.S. nuclear plants to reevaluate seismic risks, and those studies are due by March 2015.The important of such an analysis came into sharp focus on Sunday when a magnitude 6.0-earthquake struck in Northern California's wine country, injuring scores of residents, knocking out power to thousands and toppling wine bottles at vineyards.

The cease-fire announced Tuesday between Israel and Palestinian factions — if it holds — will end seven weeks of fighting that killed more than 2,200 Gazans and 69 Israelis. But as the rival camps seek to put their spin on the outcome, one assessment of Israel’s Gaza operation that won’t be publicized is the U.S. military’s. Though the Pentagon shies from publicly expressing judgments that might fall afoul of a decidedly pro-Israel Congress, senior U.S. military sources speaking on condition of anonymity offered scathing assessments of Israeli tactics, particularly in the Shujaiya neighborhood of Gaza City. One of the more curious moments in Israel’s Operation Protective Edge came on July 20, when a live microphone at Fox News caught U.S. Secretary of State John Kerry commenting sarcastically on Israel’s military action. “It’s a hell of a pinpoint operation,” Kerry said. “It’s a hell of a pinpoint operation.”

According to this senior U.S. officer, who had access to the July 21 Pentagon summary of the previous 24 hours of Israeli operations, the internal report showed that 11 Israeli artillery battalions — a minimum of 258 artillery pieces, according to the officer’s estimate — pumped at least 7,000 high explosive shells into the Gaza neighborhood, which included a barrage of some 4,800 shells during a seven-hour period at the height of the operation. Senior U.S. officers were stunned by the report.

In the early hours of that Sunday morning, with IDF casualties mounting, senior officers directed IDF tank commanders to “take off the gloves” and “to open fire at anything that moves,” according to reports in the Israeli press. The three Israeli units assaulting Shujaiya were never in danger of being defeated, but the losses the IDF suffered in the four-day house-to-house battle embarrassed IDF commanders. By the afternoon of July 19, even before Israel had suffered most of its casualties, the scale of resistance prompted Israeli battlefield commanders to blanket Shujaiya with high-explosive artillery rounds, rockets fired from helicopters and bombs dropped by F-16s. The decision was confirmed at the highest levels of the IDF. By Sunday night, Palestinian officials were denouncing the bombardment of Shujaiya as a massacre, and international pressure mounted on the Israeli government to explain the heavy casualty toll being inflicted on Gaza civilians. The IDF told the press that Shujaiya had been a “fortress for Hamas terrorists” and reiterated that while Israel had “warned civilians” to evacuate, “Hamas ordered them to stay. Hamas put them in the line of fire.”

Everyone has noticed the contradiction of those who recently characterized the Islamic Emirate as "freedom fighters" in Syria and who are indignant today faced with its abuses in Iraq. But if that speech is incoherent in itself, it makes perfect sense in the strategic plan: the same individuals were to be presented as allies yesterday and must be as enemies today, even if they are still on orders from Washington. Thierry Meyssan reveals below US policy through the particular case of Senator John McCain, conductor of the "Arab Spring" and longtime partner of Caliph Ibrahim.

ohn McCain is known as the leader of the Republicans and unhappy 2008 US presidential candidate. This is, we will see, only the real part of his biography, which serves as a cover to conduct covert actions on behalf of his government. When I was in Libya during the "Western"attack, I was able to view a report of the foreign intelligence services. It stated that, on February 4, 2011 in Cairo, NATO organized a meeting to launch the "Arab Spring" in Libya and Syria. According to this document, the meeting was chaired by John McCain. The report detailed the list of Libyan participants, whose delegation was led by the No. 2 man of the government of the day, Mahmoud Jibril, who abruptly switched sides at the entrance of the meeting to become the opposition leader in exile. I remember that, among the French delegates present, the report quoted Bernard-Henry Lévy, although officially he had never exercised functions within the French government. Many other personalities attended the symposium, including a large delegation of Syrians living abroad.

Emerging from the meeting, the mysterious Syrian Revolution 2011 Facebook account called for demonstrations outside the People’s Council (National Assembly) in Damascus on February 11. Although this Facebook account at the time claimed to have more than 40,000 followers, only a dozen people responded to its call before the flashes of photographers and hundreds of police. The demonstration dispersed peacefully and clashes only began more than a month later in Deraa. [1] On February 16, 2011, a demonstration underway in Benghazi, in memory of members of the Islamic Fighting Group in Libya [2] massacred in 1996 in the Abu Selim prison, degenerated into shooting. The next day, a second event, this time in memory of those who died by attacking the Danish consulate during the Muhammad cartoons affair, also degenerated into shooting. At the same time, members of the Islamic Fighting Group in Libya ,coming from Egypt and coordinated by unidentified, hooded individuals, simultaneously attacked four military bases in four different cities. After three days of fighting and atrocities, the rebels launched the uprising of Cyrenaica against Tripolitania [3]; a terrorist attack that the western press falsely presented as a "democratic revolution" against "the regime" of Muammar el-Qaddafi.

Neocons do like to declare victory, especially regarding the Iraq War. So it came as no surprise that Paul Wolfowitz, apparently unimpressed by Iraq’s mounting crisis, regaled a recent panel discussion at the U.S.-Africa Summit with the blunt proclamation, “We have won it — in  2009.” Unsurprisingly, that’s when Team Bush left the White House — and approximately 150,000 troops behind in Iraq. Perhaps also not surprisingly, war-weary Americans didn’t pay much attention to Paul’s pronouncement. No doubt they are as tired of Wolfowitz as they are of the war he helped to start. It probably rang as hollow as the faint echo of his earlier pitch for a quick, all-expenses-paid war against 2003’s Hitler of the Moment — Saddam Hussein.

But it’s not quite as simple as that. The issue got more complicated shortly after the Africa summit when President Barack Obama — who had pinned his legacy on extricating the United States from Iraq — suddenly found himself at a podium to announce limited, but open-ended military action to halt the dreaded march of The Islamic State (often called ISIS or ISIL) through the repeatedly rocked Cradle of Civilization. Many have explained the organization’s plan for creating a fundamentalist caliphate and its reliance on shockingly brutal tactics that make ISIS something that even al-Qaeda could never be, nor perhaps ever wanted to be. Many others have prodded the dying corpse of Iraq to assign blame here, there and everywhere. But the most basic reason for more bombing is found right there in the self-aggrandizing quip by Paul Wolfowitz. The simple fact is that the Iraq War was a smashing success – at least for the neocons – because it smashed the keystone in the arch of the region’s stability. By removing Saddam Hussein, his government and the Republican Guard, neocons removed a bulwark against the very jihadism that has policymakers and pundits forever wringing their hands raw, military contractors ringing their cash registers, and the denizens of the national security state resting assured under a blanket of secrecy.

Considering the persistent ubiquity of U.S. forces in the Persian Gulf, their growing presence around the Horn of Africa and extension into Sub-Saharan Africa, Wolfowitz’s declaration of victory may not be ironic or delusional; it may have some measure of truth – at least from his perspective – but for a reason most would not consider victorious. That “victory” achieved something the neocons could only dream of during a fitful slumber brought on by counting the media’s sheep, i.e. a permanent war in the Middle East.

In the ongoing conflict between Israel and Hamas, the dominant discourse is that the Palestinian militants provoked the hostilities — while Israel, as President Barack Obama affirmed last week, is acting in legitimate self-defense. Many have attempted to problematize this narrative, for instance by arguing that Israel, as an occupying power, does not have a legitimate legal or moral claim to self-defense. Others have argued that rockets fired by Hamas do not constitute an existential crisis for Israel or its citizens and certainly did not warrant the killing of more than 500 Palestinians, mostly civilians, including women and children. While these are all valid and important points, the broader narrative remains largely unchallenged: Hamas began firing rockets at Israel first, triggering Israel’s latest military incursion. This is not true. In fact, far from acting in self-defense, the crisis is the result of deliberate actions by Israel over the last few weeks — first to stir up anti-Arab sentiment among the Israeli population and then to provoke Hamas into open conflict.

The Obama administration has quietly approved a substantial expansion of the terrorist watchlist system, authorizing a secret process that requires neither “concrete facts” nor “irrefutable evidence” to designate an American or foreigner as a terrorist, according to a key government document obtained by The Intercept. The “March 2013 Watchlisting Guidance,” a 166-page document issued last year by the National Counterterrorism Center, spells out the government’s secret rules for putting individuals on its main terrorist database, as well as the no fly list and the selectee list, which triggers enhanced screening at airports and border crossings. The new guidelines allow individuals to be designated as representatives of terror organizations without any evidence they are actually connected to such organizations, and it gives a single White House official the unilateral authority to place entire “categories” of people the government is tracking onto the no fly and selectee lists. It broadens the authority of government officials to “nominate” people to the watchlists based on what is vaguely described as “fragmentary information.” It also allows for dead people to be watchlisted. Over the years, the Obama and Bush Administrations have fiercely resisted disclosing the criteria for placing names on the databases—though the guidelines are officially labeled as unclassified. In May, Attorney General Eric Holder even invoked the state secrets privilege to prevent watchlisting guidelines from being disclosed in litigation launched by an American who was on the no fly list. In an affidavit, Holder called them a “clear roadmap” to the government’s terrorist-tracking apparatus, adding: “The Watchlisting Guidance, although unclassified, contains national security information that, if disclosed … could cause significant harm to national security.”

The rulebook, which The Intercept is publishing in full, was developed behind closed doors by representatives of the nation’s intelligence, military, and law-enforcement establishment, including the Pentagon, CIA, NSA, and FBI. Emblazoned with the crests of 19 agencies, it offers the most complete and revealing look into the secret history of the government’s terror list policies to date. It reveals a confounding and convoluted system filled with exceptions to its own rules, and it relies on the elastic concept of “reasonable suspicion” as a standard for determining whether someone is a possible threat. Because the government tracks “suspected terrorists” as well as “known terrorists,” individuals can be watchlisted if they are suspected of being a suspected terrorist, or if they are suspected of associating with people who are suspected of terrorism activity. “Instead of a watchlist limited to actual, known terrorists, the government has built a vast system based on the unproven and flawed premise that it can predict if a person will commit a terrorist act in the future,” says Hina Shamsi, the head of the ACLU’s National Security Project. “On that dangerous theory, the government is secretly blacklisting people as suspected terrorists and giving them the impossible task of proving themselves innocent of a threat they haven’t carried out.” Shamsi, who reviewed the document, added, “These criteria should never have been kept secret.”

What beats me is why more Democrats aren’t deeply troubled by the legacy of Clinton’s foreign policy blunder in Honduras. Maybe you’ve forgotten what happened in that small country in the first year of the Obama administration — more on that in a moment. But surely you’ve noticed the ugly wave of xenophobia greeting a growing number of Central American child refugees arriving on our southern border. Some of President Barack Obama’s supporters are trying to blame this immigration crisis on the Bush administration because of an anti-trafficking law George W. signed in 2008 specifically written to protect Central American children that preceded an uptick in their arrivals. But which country is the top source of kids crossing the border? Honduras, home to the world’s highest murder rate, Latin America’s worst economic inequality, and a repressive U.S.-backed government. When Honduran military forces allied with rightist lawmakers ousted democratically elected President Manuel Zelaya in 2009, then-Secretary of State Clinton sided with the armed forces and fought global pressure to reinstate him.

Washington wields great influence over Honduras, thanks to the numerous military bases built with U.S. funds where training and joint military and anti-drug operations take place. Since the coup, nearly $350 million in U.S. assistance, including more than $50 million in military aid has poured into the country. That’s a lot of investment in a nation where the police, the military, and private security forces are killing people with alarming frequency and impunity, according to Human Rights Watch. In short, desperate Honduran children are seeking refuge from a human rights nightmare that would cast a dark cloud over Clinton’s presidential bid right now if the media were paying any attention. That wouldn’t give Republicans a big advantage, of course. Until they stop alienating a majority of female voters and communities of color, I find it hard to see the party of Mitt Romney and John McCain winning the White House.

Given the Democratic Party’s demographic edge, progressives have nothing to lose by seizing on the GOP field’s weakness and pressing for a viable alternative to another Clinton administration. Senator Elizabeth Warren could prove a contender. Unfortunately, the consumer-rights firebrand and Massachusetts Democrat lacks any foreign policy experience. And foreign policy is no afterthought these days. Israel — the recipient of $3.1 billion a year in U.S. military aid — is waging a ground war in Gaza, and the stakes in the Russia-Ukraine conflict just grew following the downing of that Malaysia Airlines jet. Plus, Iraq is growing more violent and unstable once more. On all these issues, Clinton is more hawkish than most of the Democratic base. But other Democrats with a wide range of liberal credentials and foreign policy expertise are signaling some interest in running, especially if Clinton ultimately sits out the race. Even if Clinton does win in 2016, a serious progressive primary challenge could help shape her presidency. As more and more Honduran kids cross our border in search of a safe haven, voters should take a good look at her track record at the State Department and reconsider the inevitability of another Clinton administration.

Israeli spokesmen have their work cut out explaining how they have killed more than 1,000 Palestinians in Gaza, most of them civilians, compared with just three civilians killed in Israel by Hamas rocket and mortar fire. But on television and radio and in newspapers, Israeli government spokesmen such as Mark Regev appear slicker and less aggressive than their predecessors, who were often visibly indifferent to how many Palestinians were killed. There is a reason for this enhancement of the PR skills of Israeli spokesmen. Going by what they say, the playbook they are using is a professional, well-researched and confidential study on how to influence the media and public opinion in America and Europe. Written by the expert Republican pollster and political strategist Dr Frank Luntz, the study was commissioned five years ago by a group called The Israel Project, with offices in the US and Israel, for use by those "who are on the front lines of fighting the media war for Israel".

Every one of the 112 pages in the booklet is marked "not for distribution or publication" and it is easy to see why. The Luntz report, officially entitled "The Israel project's 2009 Global Language Dictionary, was leaked almost immediately to Newsweek Online, but its true importance has seldom been appreciated. It should be required reading for everybody, especially journalists, interested in any aspect of Israeli policy because of its "dos and don'ts" for Israeli spokesmen.These are highly illuminating about the gap between what Israeli officials and politicians really believe, and what they say, the latter shaped in minute detail by polling to determine what Americans want to hear. Certainly, no journalist interviewing an Israeli spokesman should do so without reading this preview of many of the themes and phrases employed by Mr Regev and his colleagues.

With the outcome of Afghanistan's controversial presidential election still in doubt, and uncertainty over Afghan forces' ability to stand against the Taliban after most US forces withdraw, it's hard to say with certainty what the US-led war there has accomplished, or failed to accomplish.But one thing is clear, as shown by latest quarterly report from the US Special Inspector General on Afghanistan Reconstruction: The $7 billion US program to eradicate poppy cultivation there over the past decade has been a flop. The country is today the world's largest supplier of opium, the purified latex sap from the Papaver somniferum poppy species that is usually then converted into heroin. It accounts for about three-quarters of the global recreational supply, and surging Afghan production is one reason why street heroin prices have been falling across the globe.

Ordinary Internet users, American and non-American alike, far outnumber legally targeted foreigners in the communications intercepted by the National Security Agency from U.S. digital networks, according to a four-month investigation by The Washington Post. Nine of 10 account holders found in a large cache of intercepted conversations, which former NSA contractor Edward Snowden provided in full to The Post, were not the intended surveillance targets but were caught in a net the agency had cast for somebody else. Many of them were Americans. Nearly half of the surveillance files, a strikingly high proportion, contained names, e-mail addresses or other details that the NSA marked as belonging to U.S. citizens or residents. NSA analysts masked, or “minimized,” more than 65,000 such references to protect Americans’ privacy, but The Post found nearly 900 additional e-mail addresses, unmasked in the files, that could be strongly linked to U.S. citizens or U.S.residents.

In order to allow time for analysis and outside reporting, neither Snowden nor The Post has disclosed until now that he obtained and shared the content of intercepted communications. The cache Snowden provided came from domestic NSA operations under the broad authority granted by Congress in 2008 with amendments to the Foreign Intelligence Surveillance Act. FISA content is generally stored in closely controlled data repositories, and for more than a year, senior government officials have depicted it as beyond Snowden’s reach. The Post reviewed roughly 160,000 intercepted e-mail and instant-message conversations, some of them hundreds of pages long, and 7,900 documents taken from more than 11,000 online accounts.

Taken together, the files offer an unprecedented vantage point on the changes wrought by Section 702 of the FISA amendments, which enabled the NSA to make freer use of methods that for 30 years had required probable cause and a warrant from a judge. One program, code-named PRISM, extracts content stored in user accounts at Yahoo, Microsoft, Facebook, Google and five other leading Internet companies. Another, known inside the NSA as Upstream, intercepts data on the move as it crosses the U.S. junctions of global voice and data networks.

Yahoo reports that it is on the verge of releasing 1,500 pages of documents related to a long court battle over its participation in the PRISM program, a National Security Agency program revealed last summer as part of the Snowden leaks. A leaked top-secret slide about PRISM shows that Yahoo was one of the first participants, having begun contributing to the database in March of 2008. It did so under severe duress. Company executives believed the government's demand for data was "unconstitutional and overbroad" and fought it in court.

"Our challenge, and a later appeal in the case, did not succeed," explained Yahoo General Counsel Ron Bell in a blog post published today. "The Foreign Intelligence Surveillance Court (FISC)... ordered us to give the U.S. Government the user data it sought in the matter." After it lost, Yahoo was threatened with $250,000 per day fines if it didn't comply with the program. Not only that, but the government got permission to share the ruling with other companies in order to put pressure on them as well, according to a just-published story by The Washington Post.

Just one day after Hassan Abboud and several top leaders of the Islamic Front were killed in a blast, the Islamic Front identified a new emir for Ahrar al Sham, one of its brigades. Abboud served as the head of the Islamic Front's political office and the emir of Ahrar al Sham, an al Qaeda ally in Syria. Abboud and other Islamic Front leaders killed in the blast were mourned by several top al Qaeda leaders in Syria. And the Al Nusrah Front, al Qaeda's official branch in Syria, officially eulogized the Islamic Front leaders.

Abu Jaber's path to lead one of the more radical Islamist groups in Syria serves as a cautionary tale for the US as it seeks allies in the Free Syrian Army to battle the Islamic State. Both the Al Fajr Islamic Movement and the Musab Bin Umayr Battalion were previously units in the Free Syrian Army. Al Fajr Islamic Movement fought under the command of the Al Nusrah Front and alongside the Chechen-led Muhajireen Army in November 2012, shortly before joining Ahrar al Sham. To this day, even US-vetted Syrian rebel groups such as Harakat Hazm fight alongside the Al Nusrah Front.

The strategy that President Obama laid out Wednesday night to "degrade and ultimately destroy the terrorist group known as ISIL," is incoherent, inconsistent and, ultimately, non-credible. A year ago, Obama and John Kerry were straining at the leash to launch air strikes on Syrian President Bashar Assad for his alleged use of chemical weapons in "killing his own people." But when Americans rose as one to demand that we stay out of Syria, Obama hastily erased his "red line" and announced a new policy of not getting involved in "somebody else's civil war." Now, after videos of the beheadings of two U.S. journalists have set the nation on fire, the president, reading the polls, has flipped again. Now Obama wants to lead the West and the Arab world straight into Syria's civil war. Only this time we bomb ISIL, not Assad.

Who will provide the legions Obama will deploy to crush ISIL in Syria? The Free Syrian Army, the same rebels who have been routed again and again and whose chances of ousting Assad were derided by Obama himself in August as a "fantasy"? The FSA, the president mocked, is a force of "former doctors, farmers, pharmacists and so forth." Now Obama wants Congress to appropriate $500 million to train and arm those doctors and pharmacists and send them into battle against an army of jihadist terrorists who just bit off one-third of Iraq. Before Congress votes a dime, it should get some answers. Whom will this Free Syrian Army fight? ISIL alone? The al-Nusra Front? Hezbollah in Syria? Assad's army? How many years will it take to train, equip and build the FSA into a force that can crush both Assad and ISIL?

"Tell me how this thing ends," said Gen. David Petraeus on the road up to Baghdad in 2003. The president did not tell us how this new war ends. If Assad falls, do the Alawites and Christians survive? Does Syria disintegrate? Who will rule in Damascus? The United States spent seven years building an army to hold Iraq together. Yet when a few thousand ISIL fighters stormed in from Syria, that army broke and fled all the way to Baghdad. Even the Kurdish peshmerga broke and ran. What makes us think we can succeed in Syria where we failed in Iraq. If ISIL is our mortal enemy and Syria its sanctuary, there are two armies capable of crushing it together — the Syrian and Turkish armies. <a onClick="return adgo(5541,10783,this.href);" href="http://adserver.adtechus.com/adlink/3.0/5235/1297475/0/170/ADTECH;cookie=info;loc=300;key=key1+key2+key3+key4;grp=13579" target="_blank"><img src="http://adserver.adtechus.com/adserv/3.0/5235/1297475/0/170/ADTECH;cookie=info;loc=300;key=key1+key2+key3+key4;grp=13579" border="0" width="300" height="250"></a> But Turkey, a NATO ally, was not even mentioned in Obama's speech. Why? Because the Turks have been allowing jihadists to cross into Syria, as they have long sought the fall of Assad.

There is a new sheriff in town. Is that the message that Senator Richard Burr, the new chair of the Senate Select Committee on Intelligence, is trying to send? Senator Burr reportedly wrote to President Obama last week to ask that all copies of the classified 6,700 page Committee report on CIA interrogation practices be returned immediately to the Committee. While the redacted summary of the report has been publicly released and is even something of a bestseller for the Government Printing Office as well as a commercial publisher, the full report has not been made public. And Senator Burr seems determined to keep it that way. Senator Burr’s letter was reported in C.I.A. Report Found Value of Brutal Interrogation Was Inflated by Mark Mazzetti, New York Times, January 20. (More: Washington Post, Huffington Post.) Senator Dianne Feinstein, who chaired the Committee while the report was produced, scorned the request for its return.

“I strongly disagree that the administration should relinquish copies of the full committee study, which contains far more detailed records than the public executive summary. Doing so would limit the ability to learn lessons from this sad chapter in America’s history and omit from the record two years of work, including changes made to the committee’s 2012 report following extensive discussion with the CIA,” she said in a statement. Among other things, the proposed return of the full report may be intended to prevent its potential future accessibility through the Freedom of Information Act, which does not apply to records in congressional custody. But if so, this seems short-sighted and probably futile, given that all of the evidentiary material on which the report is based originated in the executive branch anyway. Moreover, the Committee report has spawned an entire literature of agency evaluations and responses (such as the so-called Panetta Review). That literature belongs to the agencies, and sooner or later it should be subject to public disclosure regardless of the fate of the SSCI report.

In a new court filing, the Department of Justice revealed that it kept a secret database of telephone metadata—with one party in the United States and another abroad—that ended in 2013. The three-page partially-redacted affidavit from a top Drug Enforcement Agency (DEA) official, which was filed Thursday, explained that the database was authorized under a particular federal drug trafficking statute. The law allows the government to use "administrative subpoenas" to obtain business records and other "tangible things." The affidavit does not specify which countries records were included, but specifically does mention Iran. This database program appears to be wholly separate from the National Security Agency’s metadata program revealed by Edward Snowden, but it targets similar materials and is collected by a different agency. The Wall Street Journal, citing anonymous sources, reported Friday that this newly-revealed program began in the 1990s and was shut down in August 2013.

The criminal case involves an Iranian-American man named Shantia Hassanshahi, who is accused of violating the American trade embargo against Iran. His lawyer, Mir Saied Kashani, told Ars that the government has clearly abused its authority. "They’ve converted this from a war on drugs to a war on privacy," he said. "[Hassanshahi] is not accused of any drug crime but they used this drug enforcement information to gather information against him, that's contrary to the law, and we will revisit that. We will bring motions in the court and we will appeal if necessary." Neither the DEA nor the Department of Justice immediately responded to Ars' query as to whether this program is continuing under a different authority.

The story begins in 2011, when a Department of Homeland Security (DHS) agent received a tip about someone who might be in violation of American sanctions against Iran. The source provided an e-mail from an Iranian businessman, Manoucher Sheiki, who was involved in acquiring power grid equipment. A second Homeland Security agent, Joshua Akronowitz, wrote in a 2013 affidavit that he searched Sheiki’s Iranian phone number in this database, but declined to explain exactly what kind of database it was. Akronowitz found that the Iranian number came up exactly one time in the database, and was linked to an 818 number, based in Los Angeles County. That number turned out to be the Google Voice number of Hassanshahi. DHS then subpoenaed Google, and got Hassanshahi’s call log and later, metadata on his Gmail account. By early 2012, the agency found out that he was set to return to Los Angeles from Iran. At LAX Airport, customs agents seized his phone, laptop, thumb drives, camcorder, and SIM cards and sent them to Homeland Security. Last year, Kashani, Hassanshahi’s lawyer, argued that this evidence should be suppressed on account that it was the "fruit of the poisonous tree"—obtained via illicit means. In support of his arguments, Kashani cited an important ongoing NSA-related lawsuit, Klayman v. Obama, which remains the only instance where a judge has order the NSA metadata program to be shut down—that order was stayed pending an appeal. (Earlier this month, Ars explored Klayman and other pending notable surveillance cases.)

Almost before the votes were counted in the recent Greek elections, battle lines were being drawn all over Europe. While Alexis Tsipras, the newly elected Prime Minister from Greece’s victorious Syriza Party, was telling voters, “Greece is leaving behind catastrophic austerity, fear and autocratic government,” Jens Weidmann, president of the German Bundesbank, was warning the new government not to “make promises it cannot keep and the country cannot afford.”   On Feb. 12 those two points of view will collide when European Union (EU) heads of state gather in Brussels. Whether the storm blowing out of Southern Europe proves an irresistible force, or the European Council an immovable object, is not clear, but whatever the outcome, the continent is not likely to be the same after that meeting.   The Jan 25 victory of Greece’s leftwing Syriza Party was, on one hand, a beacon for indebted countries like Spain, Portugal, Italy and Ireland. On the other, it is a gauntlet for Germany, the Netherlands, Finland, and the “troika”—the European Central bank, the European Commission, and the International Monetary Fund (IMF)—the designers and enforcers of loans and austerity policies that have inflicted a catastrophic economic and social crisis on tens of millions of Europeans.

The troika’s policies were billed as “bailouts” for countries mired in debt—one largely caused by the 2008 financial speculation bubble over which indebted countries had little control—and as a way to restart economic growth. In return for the loans, the EU and the troika demanded massive cutbacks in social services, huge layoffs, privatization of pubic resources, and higher taxes.   However, the “bailouts” did not go toward stimulating economies, but rather to repay creditors, mostly large European banks. Out of the $266 billion loaned to Greece, 89 percent went to investors. After five years under the troika formula, Greece was the most indebted country in Europe. Gross national product dropped 26 percent, unemployment topped 27 percent (and over 50 percent for young people), and one-third of the population lost their health care coverage.   Given a chance to finally vote on the austerity strategy, Greeks overwhelmingly rejected the parties that went along with the troika and elected Syriza.

Gerry Adams of Sinn Fein—now the third largest party in the Irish Republic—hailed the vote as opening “up the real prospect of democratic change, not just for the people of Greece, but for citizens right across the EU.” Unemployment in Ireland is 10.7 percent, and tens of thousands of jobless young people have been forced to emigrate.   The German Social Democrats are generally supportive of the troika, but the Green Party hailed the Syriza victory and Die Linke Party members marched with signs reading, “We start with Greece. We change Europe.”   Italian Prime Minister Matteo Renzi—who has his own issues with the EU’s rigid approach to debt—hailed the Greek elections, and top aide Sandro Gozi said that Rome was ready to work with Syriza. The jobless rate in Italy is 13.4 percent, but 40 percent among youth.

Argentine Chief of Cabinet Jorge Capitanich accused U.S. Republican senator Marco Rubio of “imperialist behavior,” after the right-wing politician expressed doubts about the Argentine government's ability to conduct the investigation into the death of the prosecutor Alberto Nisman.  “The Republic of Argentina is an autonomous, sovereign and independent country, Marco Rubio with his imperialist vision fails to recognize the United Nations charter since the meddling in the affairs of other states constitutes imperialist interference,” Capitanich said Friday during a press conference. On Thursday, Rubio urged U.S. Secretary of State John Kerry to support the creation of an “independent, internationally assisted investigation” into the case.  “I am increasingly concerned about the ability of the Government of Argentina to conduct a fair and impartial investigation into his death, or its capacity to ensure the independence of a prosecutor that would continue Mr. Nisman's work,” said Rubio, who has spearheaded the push for hostile policies towards left-leaning governments in Latin America. “I thus urge the Administration to support the establishment of an independent, internationally assisted investigation into Mr. Nisman's suspicious death.” Capitanich called the proposal “unwarranted meddling” into the South American country's affairs.

Cables revealed by Wikileaks suggest that Nisman was being advised by U.S. and Israeli intelligence services, and Argentina officials investigating Nisman's death say the attorney’s 300-page report indicate he was manipulated and being fed him false information. Officials also say rogue agents from Argentina own intelligence services were behind the death.  President Cristina Fernandez, whose husband and late President Nestor Kirchner ordered the investigation into the AMIA bombing, was quick to cast doubt on the apparent suicide of the attorney.

We’ve long noted that Saudi Arabia is a huge supporter of terrorism. But the new Saudi king is particularly bad. Investors Business Daily notes: King Salman has a history of funding al-Qaida, and his son has been accused of knowing in advance about the 9/11 attacks. *** Salman once ran a Saudi charity tied to al-Qaida and has been named a defendant in two lawsuits accusing the Saudi royal family of helping the 9/11 terrorists, one of which the U.S. Supreme Court recently let move forward after years of being blocked by the State Department and the well-funded Saudi lobby. Plaintiffs have provided an enormous amount of material to source their accusations against Salman. Here’s why his ascension to the throne is not good news, especially as the terrorism threat grows: • Salman once headed the Saudi High Commission for Relief to Bosnia and Herzegovina, which served as a key charitable front for al-Qaida in the Balkans. • According to a United Nations-sponsored investigation, Salman in the 1990s transferred more than $120 million from commission accounts under his control — as well as his own personal accounts — to the Third World Relief Agency, another al-Qaida front and the main pipeline for illegal weapons shipments to al-Qaida fighters in the Balkans.

• A U.N. audit found that the money was transferred following meetings with Salman, transfers that had no legitimate “humanitarian” purpose. • Former CIA officer Robert Baer has reported that an international raid of Saudi High Commission offices found evidence of terrorist plots against America. • Baer also revealed that Salman “personally approved” distribution of funds from the International Islamic Relief Organization, which also has provided material support to al-Qaida. • A recent Gulf Institute report says Salman and former Saudi intelligence chief Prince Turki al-Faisal knowingly aided and abetted al-Qaida in the run-up to 9/11. • Salman works closely with Saudi clerics Saleh al-Moghamsy, a radical anti-Semite, and Safar Hawali, a one-time mentor of Osama bin Laden, according to the Washington Free Beacon. • In “Why America Slept,” author Gerald Posner claimed that Salman’s son Ahmed bin Salman also had ties to al-Qaida and even advance knowledge of the Sept. 11, 2001 attacks.

David Andrew Weinberg provides a superb round-up of Salman’s ties to terrorism and extremism: As former CIA official Bruce Riedel astutely pointed out, Salman was the regime’s lead fundraiser for mujahideen, or Islamic holy warriors, in Afghanistan in the 1980s, as well as for Bosnian Muslims during the Balkan struggles of the 1990s. In essence, he served as Saudi Arabia’s financial point man for bolstering fundamentalist proxies in war zones abroad. As longtime governor of Riyadh, Salman was often charged with maintaining order and consensus among members of his family. Salman’s half brother King Khalid (who ruled from 1975 to 1982) therefore looked to him early on in the Afghan conflict to use these family contacts for international objectives, appointing Salman to run the fundraising committee that gathered support from the royal family and other Saudis to support the mujahideen against the Soviets. Riedel writes that in this capacity, Salman “work[ed] very closely with the kingdom’s Wahhabi clerical establishment.” Another CIA officer who was stationed in Pakistan in the late 1980s estimates that private Saudi donations during that period reached between $20 million and $25 million every month. And as Rachel Bronson details in her book, Thicker Than Oil: America’s Uneasy Partnership With Saudi Arabia, Salman also helped recruit fighters for Abdul Rasul Sayyaf, an Afghan Salafist fighter who served as a mentor to both Osama bin Laden and 9/11 mastermind Khalid Sheikh Mohammed.

In highly unusual testimony inside the federal supermax prison, a former operative for Al Qaeda has described prominent members of Saudi Arabia’s royal family as major donors to the terrorist network in the late 1990s and claimed that he discussed a plan to shoot down Air Force One with a Stinger missile with a staff member at the Saudi Embassy in Washington.The Qaeda member, Zacarias Moussaoui, wrote last year to Judge George B. Daniels of United States District Court for the Southern District of New York, who is presiding over a lawsuit filed against Saudi Arabia by relatives of those killed in the Sept. 11, 2001, terrorist attacks. He said he wanted to testify in the case, and after lengthy negotiations with Justice Department officials and the federal Bureau of Prisons, a team of lawyers was permitted to enter the prison and question him for two days last October.

He said in the prison deposition that he was directed in 1998 or 1999 by Qaeda leaders in Afghanistan to create a digital database of donors to the group. Among those he said he recalled listing in the database were Prince Turki al-Faisal, then the Saudi intelligence chief; Prince Bandar Bin Sultan, the longtime Saudi ambassador to the United States; Prince al-Waleed bin Talal, a prominent billionaire investor; and many of the country’s leading clerics.“Sheikh Osama wanted to keep a record who give money,” he said in imperfect English — “who is to be listened to or who contributed to the jihad.”Mr. Moussaoui said he acted as a courier for Bin Laden, carrying personal messages to prominent Saudi princes and clerics. And he described his training in Qaeda camps in Afghanistan.

The 9/11 trial judge on Wednesday froze pretrial hearings in a death-penalty case over a controversial Pentagon order requiring the judges to move permanently to this remote outpost until their cases are over.In a 10-page order, Army Col. James L. Pohl abated the prosecution of alleged 9/11 mastermind Khalid Sheik Mohammed and four accused accomplices until the Pentagon rescinds its move-in order.He ruled that the circumstances surrounding the controversial Jan. 7 relocation order “raise the issue of Unlawful Influence by creating the appearance of improper pressure on the military judge to adjust the pace of the litigation.”Defense lawyers in both the Sept. 11 and USS Cole death-penalty cases have alleged the move is an attempt to illegally rush justice, describing it as a pressure play designed to exile the military judges to Cuba, cut short pretrial hearings and move straight to trial. Unlawful Command Influence, or commanders meddling in the judicial function, is a crime in the U.S. military.

Prosecutors have defended the order, designed by a retired Marine general functioning as a war court overseer, as part of an effort to improve resourcing at the crude compound here called Camp Justice.Deputy Secretary of Defense Robert Work signed it within a month of getting a recommendation from the overseer, retired Marine Maj. Gen. Vaughn A. Ary. It stripped military judges hearing Guantánamo cases of their other duties, including presiding at U.S. service members’ courts martial, without consultation with the top lawyers of the Army, Navy and Air Force.So far none of the judges has obeyed it pending clarifications from their overall commanders, called The Judge Advocates General.

One 9/11 defense attorney, Jay Connell, said that Pohl “was right to pull the plug on the case” — and recited what he saw as a pattern of government interference.“The FBI has infiltrated a defense team, a former CIA contractor became a defense interpreter, and the Deputy Secretary of Defense has unlawfully attempted to influence the military judge,” said Connell, the death-penalty defender of Mohammed’s nephew, Ammar al Baluchi.
