  • he Israeli Police Foreign Press Spokesman, Micky Rosenfeld, appears to have falsified the Israeli government’s claim that Hamas was responsible for the killing of three Israeli settler teens in June, by saying responsibility lies with a lone cell that operated without the complicity of Hamas’ leadership. The kidnapping and subsequent killing of three Israeli settler teens last month is considered to be a flashpoint for the escalated violence in Gaza -- that as of day 19 of the conflict has left 926 Palestinians, mostly civilians, dead. At the time Israeli authorities placed the blame squarely on Hamas, with Israeli Prime Minister Benyamin Netanyahu saying "They were kidnapped and murdered in cold blood by animals in human form. Hamas is responsible and Hamas will pay." Friday however, there appeared to be break in the official line when BBC journalist Jon Donnison tweeted a series of statements he attributed to the Israeli Police Foreign Press Spokesman, Micky Rosenfeld.

Syria accuses rebels of planning gas attack near Damascus | News , Middle East | THE DA... - 0 views

  • Syria is charging in a letter to the United Nations that opposition groups are planning a toxic gas attack in a rebel-held area near Damascus so they can then blame it on government security forces. In a letter dated March 25 and circulated by the U.N. this week, Syria's U.N. envoy, Bashar Ja'afari, said his government had intercepted communications between "terrorists" that showed a man named Abu Nadir was secretly distributing gas masks in the rebel-held Jobar area. "The authorities also intercepted another communication between two other terrorists, one of whom is named Abu Jihad," Ja'afari said. "In that communication, Abu Jihad indicates that toxic gas will be used and asked those who are working with him to supply protective masks." Ja'afari said in the letter addressed to U.N. Secretary-General Ban Ki-moon and the U.N. Security Council that this information "confirms that armed terrorist groups are preparing to use toxic gas in Jobar quarter and other areas, in order to accuse the Syrian government of having committed such an act of terrorism."
  • Syrian President Bashar al-Assad agreed to destroy his chemical weapons following global outrage over the large-scale sarin gas attack in Ghouta in August. The gas attack sparked a U.S. threat of military strikes, which was dropped after Assad's pledge to give up chemical arms. But the Syrian government, locked in a three-year-old war with rebels seeking to overthrow Assad, failed to meet a Feb. 5 deadline to move all of its declared chemical substances and precursors, some 1,300 tonnes, out of the country. Syria has since agreed to a new timetable to remove its chemical weapons by late April. Sigrid Kaag, head of the joint Organization for the Prohibition of Chemical Weapons and United Nations mission overseeing the removal of Syria's chemical weapons, is due to brief the Security Council on Thursday. Kaag told Reuters last month that Syria could ship out its remaining chemical weapons within a month and still meet a mid-year target for their final destruction.

CIA Seeks More Time to Declassify Interrogation Documents - Secrecy News - 0 views

  • The Central Intelligence Agency today asked a court to allow more time to declassify its response to the Senate Select Committee on Intelligence report on CIA rendition, detention and interrogation (RDI) activities, which itself is undergoing a time-consuming declassification review. “This complex process requires the careful review of over 500 pages of highly classified material. In addition, sufficient time must be allowed not only for coordination with other agencies, but — after completion of declassification review — for implementation of security measures to ensure the safety of U.S. personnel and facilities overseas,” according to a May 15 motion filed by the government in a FOIA lawsuit brought by the ACLU. “Due to the fluid nature of this process, aspects of which are beyond the CIA’s control, the Agency does not yet have a firm date by which it can complete the processing of the CIA Response [to the SSCI report] and the so-called Panetta Report, although it hopes the declassification review and accompanying processing of those documents can be completed this summer.” The CIA therefore requested an extension of time to respond, to which the ACLU plaintiffs did not consent.
  • With respect to the Senate Intelligence Committee report itself, the government promised an “expeditious” declassification review of the executive summary, findings, and conclusions. “While all declassification decisions are guided by the need to protect national security interests, the President has expressed a clear intent to declassify as much of the executive summary, findings, and conclusions of the SSCI Report as possible, and intends the declassification process to be expeditious,” the government motion said. The quoted article is misleading, attempting to conflate two distinct sets of documents that the Court ordered the CIA to disclose after removing all properly classified information. The duty to disclose segregable portions of  records that are not classified has been in place since the early 70s. It should have been done without a lawsuit having been filed and litigated. I.e.,it was a court order the CIA knew was coming since it first received the FOIA request from the ACLU. One set is the CIA response to the Senate Committee. The other set is the DoJ's Office of Legal Counsel memoranda on the legality of torture techniques. not documents documenting the torture itself and not the CIA response to the Senate Committee. Even if he CIA really needed more time for the documents in the Senate group, the legal memoranda could be shorn of classified information in a mater of hours, not days, weeks, or months.  It's the legal memoranda disclosure that CIA and DOJ are really trying to delay. At least two of them were written and/or signed by a former head of the DoJ Office of Legal Counsel whose nomination to the First Circuit Court of Appeals is now pending in Congress. And it's crystal clear that he signed memoranda arguing that torture was legal, which bears directly on his fitness to become a federal appellate judge. It takes a lawyer without ethics or morality to argue that torture is legal. It's not, under either U.S. law or the Geneva Conventions governing warfare. Neither  is grabbing people and turning them over to other governments for torture.  Those memoranda will establish that the nominee is a war criminal. We know this because we have already had a preview in the form of a white paper on the topic released by the White House last year that it's known the same nominee had worked on. And the legal arguments in that white paper are preposterous.   The delay attempt is transparently in aid of pushing that nomination through Congress before

Activists send the Senate 6 million faxes to oppose cyber bill - CBS News - 0 views

  • Activists worried about online privacy are sending Congress a message with some old-school technology: They're sending faxes -- more than 6.2 million, they claim -- to express opposition to the Cybersecurity Information Sharing Act (CISA).Why faxes? "Congress is stuck in 1984 and doesn't understand modern technology," according to the campaign Fax Big Brother. The week-long campaign was organized by the nonpartisan Electronic Frontier Foundation, the group Access and Fight for the Future, the activist group behind the major Internet protests that helped derail a pair of anti-piracy bills in 2012. It also has the backing of a dozen groups like the ACLU, the American Library Association, National Association of Criminal Defense Lawyers and others.

The faxed messages are generated by Internet users who visit faxbigbrother.com or stopcyberspying.com -- or who simply send a message via Twitter with the hashtag #faxbigbrother. To send all those faxes, Fight for the Future set up a dedicated server and a dozen phone lines and modems they say are capable of sending tens of thousands of faxes a day.

  • RAMALLAH, West Bank: In a surprise move that could jeopardize U.S. peace efforts, Palestinian President Mahmoud Abbas on Tuesday resumed a bid for further Palestinian recognition by the United Nations, despite a promise to suspend such efforts during nine months of negotiations with Israel. Abbas signed "State of Palestine" applications for 15 U.N. agencies in a hastily convened ceremony televised live from his West Bank headquarters.  Abbas said he was compelled to take action because Israel had failed to carry out a promised released of veteran Palestinian prisoners. "We will apply to 15 agencies and conventions immediately," Abbas said after leading members of his Fatah movement and the Palestine Liberation Organization supported the decision unanimously by a show of hands. Abbas insisted that he is still interested in negotiating a deal with Israel on the terms of Palestinian statehood, saying he and his aides "will continue our efforts to reach a peaceful solution through negotiations."
  • Such talks resumed in late July, after a push by U.S. Secretary of State John Kerry, and were to last for nine months, until the end of April.  During this period, Abbas promised to suspend his U.N. bid, while Israel was to release 104 veteran Palestinian prisoners in four stages. The Palestinians say the fourth group of prisoners was due to be released by the end of March, and that Israel failed to live up to its promise.   • The dangerous brinkmanship pitting Israel against the alliance of Iran, Syria and Hezbollah has brought the region closer to war than at any time since the end of the July-August 2006 conflict. A combination of bellicose rhetoric, aggressive acts, warnings and threats set against the backdrop of Syria’s grueling civil war and its critical implications for the Middle East has revived the era of miscalculation after nearly seven years of calm and restraint, with potentially disastrous consequences, diplomats and observers say. In the past two weeks, Israel has confirmed its unprecedented policy of airstrikes against suspected Hezbollah arms caches in Syria with two more attacks in swift succession after the inaugural bombing in January. Syria has warned of an “automatic response” should Israel stage a fourth strike.

Another option is to attempt to shoot down an Israeli jet in Lebanese airspace. All three Israeli airstrikes against sites west of Damascus were conducted from the Lebanese side of the border using long-range standoff missiles. The Israeli Air Force used a similar technique in October 2003 when it attacked the Ain es-Saheb training camp for the Popular Front for the Liberation of Palestine-General Command which was located 20 kilometers east of the Lebanese border and in the same general area as the more recent strikes.

  • ince being seized in a raid in Pakistan in 2002, Abu Zubaydah has had his life controlled by American officials, first at secret sites where he was tortured, and since 2006 in a small cell in Guantanamo Bay, Cuba. And, thanks to one of the strangest—and perhaps most troubling—legal cases to grow out of the War on Terror, it appears he’s not going to be leaving anytime soon, which was exactly what the CIA always intended. Today, not even his lawyers understand what’s transpired behind closed doors in a Washington, D.C., courtroom. In June 2008, the Supreme Court ruled that detainees at Guantanamo had the right to challenge their imprisonment in federal court and that their cases should be handled “promptly” by the judicial system. The next month, lawyers for Abu Zubaydah, a detainee whose torture and waterboarding in secret prisons was among the most notorious of the Bush years, filed a lawsuit in federal court challenging his detention. The progress of that case has been anything but prompt. While more than 100 Guantanamo detainees have been released since then, and the military tribunals of even more high-profile detainees like 9/11 mastermind Khalid Sheikh Mohammed are moving forward in Guantanamo’s courtrooms, the federal judge hearing Zubaydah’s case has failed to rule on even the preliminary motions.
  • The seemingly intentional inaction has left even experienced court observers baffled. Richard W. Roberts, the U.S. District Court judge handling the suit, is not a particularly slow-moving jurist. His median time for resolving entire cases is slightly over two years; Zubaydah’s case has already been pending 6 years 9 months and 13 days. Because almost the entire file has been kept secret, it’s not possible to know why Roberts, who is the chief judge of the D.C. circuit, has let Zubaydah’s case languish. But this much is clear: Keeping Zubaydah from telling his story is exactly what the CIA wanted from the moment it began to torture him. And it’s exactly what they promised they’d do in 2002 during one of the darkest chapters of the War on Terror. Abu Zubaydah was one of the first al Qaeda suspects to face the harsh new regime implemented by the CIA following 9/11—a regime that FBI agents at the scene tried to prevent.
  • Soon after the agency’s contractors began their program of “enhanced interrogation” at the secret black site in Thailand—placing him in a coffin-size box, slamming him against wall, depriving him of sleep, bombarding him with loud music, as well as waterboarding—they sent an encrypted cable to Washington. The CIA interrogators said that if Zubaydah died during questioning, his body would be cremated. And if he survived the ordeal, the interrogators wanted assurances that he would “remain in isolation and incommunicado for the remainder of his life.” Senior officials gave the assurances. Zubaydah, a Saudi citizen, “will never be placed in a situation where he has any significant contact with others and/or has the opportunity to be released,” the head of the CIA’s ALEC Station, the code name of the Washington-based unit hunting Osama bin Laden, replied. “All major players are in concurrence,” the cable said, that he “should remain incommunicado for the remainder of his life.”

    "The Senate passed a bill Friday night to put the Trans-Pacific Partnership (TPP) on the Fast Track to approval. Its passage followed a series of stops and starts-an indication that this legislation was nearly too rife with controversy to pass. But after a series of deals and calls from corporate executives, senators ultimately swallowed their criticism and accepted the measure. If this bill ends up passing both chambers of Congress, that means the White House can rush the TPP through to congressional ratification, with lawmakers unable to fully debate or even amend agreements that have been negotiated entirely in secret. JPMorgan’s investment bank would be nearly as large, followed by its commercial bank and an asset management company.” Richard Ramsden, analyst for Goldman Sachs and author of the report explained: “even splitting JPMorgan in two—dividing the investment bank from the traditional bank, returning the company roughly to what was allowed before the Glass Steagall Act was repealed in the early 2000s—would boost the overall value of the current bank by 16%. Breaking up the large banks makes sense.” Ramsden asserts “the new capital requirements for big banks proposed by the Federal Reserve in early December make now a good time to consider such a split.”

Journalist David Weidner explained: “Now, the ‘push-out’ rule is gone, so we’re in the same position again. And the Fed has delayed a potential roadblock to a taxpayer bailout.   • It appears that the Russians got tired of waiting.  I suggest that you all carefully parse the Statement of the Russian Ministry of Foreign Affairs I posted earlier today.  This is an interesting document because besides an explanation of the Russian decision to move it, it is also, potentially, a legal defense or an unprecedented Russian decision: to overtly violate the Ukrainian sovereignty.  Let me explain. First, the case of Crimea was also a "special case".  The Russian were legally present there and, in the Russian rationale, all the "Polite Armed Men in Green" did was to protect the local population to make it possible for the latter to freely express its will.  Only after that will was expressed did Russia agree to formally re-incorporate Crimea into Russia.  So from the legal Russian point of view, none of the Russian actions in Crimea included any form of  violation of Ukrainian sovereignty.  I know, most western analyst will not agree, but that is the official Russian stance.  And official stances are important because they form the basis for a legal argument.
  • Second, the aid which Russia has been sending to Novorussia has been exclusively covert.  Covert operations, no matter their magnitude, do not form the basis for a legal position.  The official position of Moscow has been that not only was there absolutely no military aid to Novorussia, but even when Ukie artillery shells landed inside Russia did the Kremlin authorize any retaliation, again in (official) deference to the Ukrainian national sovereignty. This time, however, there is no doubt at all that the Russians did deliberately and officially chose to ignore Kiev and move in.  Now, in fact, in reality, this is clearly the logically, politically and morally right thing to do.  But in legal terms, this clearly a violation of Ukrainian sovereignty.  From a legal point of view, the Ukies had the right to keep the Russian convoy at the border for another 10'000 years if they wanted and Russia had no legal right to simply move in.  What apparently happened this morning is that the Ukie officials did not even bother showing up, so the Kremlin just said "forget it!" and ordered the trucks in.
  • The US and their main agent in Kiev, Nalivaichenko, immediately and correctly understood the threat: not only did this convoy bring much needed humanitarian aid to Lugansk, it also provided a fantastic political and legal "cover" for future Russian actions inside Novorussia.  And by "actions" I don't necessarily mean military actions, although that is now clearly and officially possible.  I also mean legal actions such as recognizing Novorussia.  From their point of view, Obama, Poroshenko, Nalivaichenko are absolutely correct to be enraged, because I bet you that the timing, context and manner in which Russia moved into Novorussia will not result in further sanctions or political consequences.   Russia has now officially declared the Ukie national sovereignty as "over" and the EU will probably not do anything meaningful about it. That, by itself, is a nightmare for Uncle Sam. Furthermore, I expect the Russian to act with a great deal of restraint.  It would be stupid for them to say "okay, now that we violated the territorial integrity of the Ukraine and ignored its sovereignty we might as well bomb the junta forces and move our troops in".  I am quite confident that they will not do that.  Yet.  For the Russian side, the best thing to do now is to wait.  First, the convoy will really help.  Second, it will become a headache for the Ukies (bombing this convey would not look very good).  Third, this convoy will buy enough time for the situation to become far clearer.  What am I referring to here?

  • Not only did the Russians move in, but they did that without the ICRC whose personnel refused to go because of the lack of security guarantees from Kiev. The Russian response to that lack of security guarantees was a) to order this unarmed convoy in and b) to clearly state in the official statement: We are warning against any attempts to thwart this purely humanitarian mission which took a long time to prepare in conditions of complete transparency and cooperation with the Ukrainian side and the ICRC. Those who are ready to continue sacrificing human lives to their own ambitions and geopolitical designs and who are rudely trampling on the norms and principles of international humanitarian law will assume complete responsibility for the possible consequences of provocations against the humanitarian relief convoy. Again, from a logical, political or moral point of view, this is rather self-obvious, but from a legal point of view this is a threat to use force ("complete responsibility for the possible consequences") inside the putatively sovereign territory of the Ukraine.
  • The Ukie plan has been to present some major "victory" for the Sunday the 24, when they plan a victory parade in Kiev to celebrate independence day (yup, the US-controlled and Nazi-administered "Banderastan" will celebrate its "independence"... this is both sad and hilarious).  Instead, what they have a long streak of *very* nasty defeats during the past 5-6 days or so.  By all accounts, the Ukies are getting butchered and, for the first time, even pushed back (if only on a tactical level).  That convoy in Luganks will add a stinging symbolical "f**k you!" to the junta in Kiev.  It will also exacerbate the tensions between the ruling clique in power, the Right Sector and Dmitri Iarosh and the growing protest movement in western Ukraine. Bottom line: this is a risky move no doubt, probably brought about by the realization that with water running out in Luganks Putin had to act.  Still it is also an absolutely brilliant move which will create a massive headache for the US and its Nazi puppets in Kiev.

What Ukraine and the U.S. have been doing to delay humanitarian relief to Lugansk is beyond despicable. And though not dwelled on here, Kerry's State Dept. lodged an outraged demand that the Russian humanitarian aid convoy return to Russia post haste without unloading any of the supplies in Ukraine. Or else. Or else what? The U.S. also exercised its veto power on the U.N. Security Council to block a draft resolution instructing a temporary cease fire for delivery of the relief supplies.  Dumbout. Now Russia has officially violated Ukraine sovereignty under circumstances that are beyond reproach. The U.S. has no moral high ground to cry foul; the Russians have all of it.  I truly enjoy watching Mr. Lavrov play chess brilliantly while John Kerry steadfastly clings to his belief that the game is checkers. Kerry just can't accept that he's hopelessly outclassed by Lavrov.  And that blunt Russian promise to retaliate militarily if Kiev attacks the convoy? That's an announcement that future Russian humanitarian aid convoys into Ukraine will not be delayed or Russia will simply ignore the Kiev government and ride on through the border. Giving credit where it's due, Lavrov undoubtedly coordinated this action with Vladimir Putin.

Running for Cover: A Sham Air Force Summit Can't Fix the Close Air Support Gap Created ... - 0 views

  • “I can’t wait to be relieved of the burdens of close air support,” Major General James Post, the vice commander of Air Combat Command (ACC), allegedly told a collection of officers at a training session in August 2014. As with his now notorious warning that service members would be committing treason if they communicated with Congress about the successes of the A-10, Major General Post seems to speak for the id of Air Force headquarters’ true hostility towards the close air support (CAS) mission. Air Force four-stars are working hard to deny this hostility to the public and Congress, but their abhorrence of the mission has been demonstrated through 70 years of Air Force headquarters’ budget decisions and combat actions that have consistently short-changed close air support. For the third year in a row (many have already forgotten the attempt to retire 102 jets in the Air Force’s FY 2013 proposal), the Air Force has proposed retiring some or all of the A-10s, ostensibly to save money in order to pay for “modernization.” After failing to convince Congress to implement their plan last year (except for a last minute partial capitulation by retiring Senate and House Armed Services Committee chairmen Senator Carl Levin (D-MI) and Representative Buck McKeon (R-CA)) and encountering uncompromising pushback this year, Air Force headquarters has renewed its campaign with more dirty tricks.
  • First, Air Force headquarters tried to fight back against congressional skepticism by releasing cherry-picked data purporting to show that the A-10 kills more friendlies and civilians than any other U.S. Air Force plane, even though it actually has one of the lowest fratricide and civilian casualty rates. With those cooked statistics debunked and rejected by Senate Armed Services Chairman Senator John McCain (R-AZ), Air Force headquarters hastily assembled a joint CAS “Summit” to try to justify dumping the A-10. Notes and documents from the Summit meetings, now widely available throughout the Air Force and shared with the Project On Government Oversight’s Center for Defense Information (CDI), reveal that the recommendations of the Summit working groups were altered by senior Air Force leaders to quash any joint service or congressional concerns about the coming gaps in CAS capabilities. Air Force headquarters needed this whitewash to pursue, yet again, its anti-A-10 crusade without congressional or internal-Pentagon opposition.
  • The current A-10 divestment campaign, led by Air Force Chief of Staff Mark Welsh, is only one in a long chain of Air Force headquarters’ attempts by bomber-minded Air Force generals to get rid of the A-10 and the CAS mission. The efforts goes as far back as when the A-10 concept was being designed in the Pentagon, following the unfortunate, bloody lessons learned from the Vietnam War. For example, there was a failed attempt in late-1980s to kill off the A-10 by proposing to replace it with a supposedly CAS-capable version of the F-16 (the A-16). Air Force headquarters tried to keep the A-10s out of the first Gulf War in 1990, except for contingencies. A token number was eventually brought in at the insistence of the theater commander, and the A-10 so vastly outperformed the A-16s that the entire A-16 effort was dismantled. As a reward for these A-10 combat successes, Air Force headquarters tried to starve the program by refusing to give the A-10 any funds for major modifications or programmed depot maintenance during the 1990s. After additional combat successes in the Iraq War, the Air Force then attempted to unload the A-10 fleet in 2004.

For these reasons, Army Chief of Staff General Ray Odierno has called the A-10 “the best close air support aircraft.” Other Air Force platforms can perform parts of the mission, though not as well; and none can do all of it. Senator Kelly Ayotte (R-NH) echoed the troops’ combat experience in a recent Senate Armed Services committee hearing: “It's ugly, it's loud, but when it comes in…it just makes a difference.”
  • In 2014, Congress was well on the way to roundly rejecting the Air Force headquarters’ efforts to retire the entire fleet of 350 A-10s. It was a strong, bipartisan demonstration of support for the CAS platform in all four of Congress’s annual defense bills. But in the final days of the 113th Congress, a “compromise” heavily pushed by the Air Force was tucked into the National Defense Authorization Act for FY 2015. The “compromise” allowed the Air Force to move A-10s into virtually retired “backup status” as long as the Cost Assessment and Program Evaluation (CAPE) office in DoD certified that the measure was the only option available to protect readiness. CAPE, now led by former Assistant Secretary of the Air Force for Financial Management and Comptroller Jamie Morin, duly issued that assessment—though in classified form, thus making it unavailable to the public. In one of his final acts as Secretary of Defense, Chuck Hagel then approved moving 18 A-10s to backup status.
  • The Air Force intends to replace the A-10 with the F-35. But despite spending nearly $100 billion and 14 years in development, the plane is still a minimum of six years away from being certified ready for any real—but still extremely limited—form of CAS combat. The A-10, on the other hand, is continuing to perform daily with striking effectiveness in Afghanistan, Iraq, and Syria—at the insistence of the CENTCOM commander and despite previous false claims from the Air Force that A-10s can’t be sent to Syria. A-10s have also recently been sent to Europe to be available for contingencies in Ukraine—at the insistence of the EUCOM Commander. These demands from active theaters are embarrassing and compelling counterarguments to the Air Force’s plea that the Warthog is no longer relevant or capable and needs to be unloaded to help pay for the new, expensive, more high-tech planes that Air Force headquarters vastly prefers even though the planes are underperforming.
  • So far, Congress has not been any more sympathetic to this year’s continuation of General Welsh’s campaign to retire the A-10. Chairman McCain rejected the Air Force’s contention that the F-35 was ready enough to be a real replacement for the A-10 and vowed to reverse the A-10 retirement process already underway. Senator Ayotte led a letter to Defense Secretary Ashton Carter with Senators Tom Cotton (R-AR), Lindsey Graham (R-SC), Thom Tillis (R-NC), Roger Wicker (R-MS), Mike Crapo (R-ID), Johnny Isakson (R-GA), and Richard Burr (R-NC) rebuking Hagel’s decision to place 18 A-10s in backup inventory. Specifically, the Senators called the decision a “back-door” divestment approved by a “disappointing rubber stamp” that guts “the readiness of our nation’s best close air support aircraft.” In the House, Representative Martha McSally (R-AZ) wrote to Secretary Carter stating that she knew from her own experience as a former A-10 pilot and 354th Fighter Squadron commander that the A-10 is uniquely capable for combat search and rescue missions, in addition to CAS, and that the retirement of the A-10 through a classified assessment violated the intent of Congress’s compromise with the Air Force:
  • Some in the press have been similarly skeptical of the Air Force’s intentions, saying that the plan “doesn’t add up,” and more colorfully, calling it “total bullshit and both the American taxpayer and those who bravely fight our wars on the ground should be furious.” Those reports similarly cite the Air Force’s longstanding antagonism to the CAS mission as the chief motive for the A-10’s retirement.
  • By announcing that pilots who spoke to Congress about the A-10 were “committing treason,” ACC Vice Commander Major General James Post sparked an Inspector General investigation and calls for his resignation from POGO and other whistleblower and taxpayer groups. That public relations debacle made it clear that the Air Force needed a new campaign strategy to support its faltering A-10 divestment campaign. On the orders of Air Force Chief of Staff General Mark Welsh, General Herbert “Hawk” Carlisle—the head of Air Combat Command—promptly announced a joint CAS Summit, allegedly to determine the future of CAS. It was not the first CAS Summit to be held (the most recent previous Summit was held in 2009), but it was the first to receive so much fanfare. As advertised, the purpose of the Summit was to determine and then mitigate any upcoming risks and gaps in CAS mission capabilities. But notes, documents, and annotated briefing slides reviewed by CDI reveal that what the Air Force publicly released from the Summit is nothing more than a white-washed assessment of the true and substantial operational risks of retiring the A-10.
  • Just prior to the Summit, a working group of approximately 40 people, including CAS-experienced Air Force service members, met for three days at Davis-Monthan Air Force Base to identify potential risks and shortfalls in CAS capabilities. But Air Force headquarters gave them two highly restrictive ground rules: first, assume the A-10s are completely divested, with no partial divestments to be considered; and second, assume the F-35 is fully CAS capable by 2021 (an ambitious assumption at best). The working groups included A-10 pilots, F-16 pilots, and Joint Terminal Attack Controllers (JTACs), all with combat-based knowledge of the CAS platforms and their shortfalls and risks. They summarized their findings with slides stating that the divestment would “cause significant CAS capability and capacity gaps for 10 to 12 years,” create training shortfalls, increase costs per flying hour, and sideline over 200 CAS-experienced pilots due to lack of cockpits for them. Additionally, they found that after the retirement of the A-10 there would be “very limited” CAS capability at low altitudes and in poor weather, “very limited” armor killing capability, and “very limited” ability to operate in the GPS-denied environment that most experts expect when fighting technically competent enemies with jamming technology, an environment that deprives the non-A-10 platforms of their most important CAS-guided munition. They also concluded that even the best mitigation plans they were recommending would not be sufficient to overcome these problems and that significant life-threatening shortfalls would remain.
  • General Carlisle was briefed at Davis-Monthan on these incurable risks and gaps that A-10 divestment would cause. Workshop attendees noted that he understood gaps in capability created by retiring the A-10 could not be solved with the options currently in place. General Carlisle was also briefed on the results of the second task to develop a list of requirements and capabilities for a new A-X CAS aircraft that could succeed the A-10. “These requirements look a lot like the A-10, what are we doing here?” he asked. The slides describing the new A-X requirements disappeared from subsequent Pentagon Summit presentations and were never mentioned in any of the press releases describing the summit.
  • At the four-day Pentagon Summit the next week, the Commander of the 355th Fighter Wing, Davis-Monthan Air Force Base, Col. James P. Meger, briefed lower level joint representatives from the Army and the Marine Corps about the risks identified by the group at Davis-Monthan. Included in the briefing was the prediction that divestment of the A-10 would result in “significant capability and capacity gaps for the next ten to twelve years” that would require maintaining legacy aircraft until the F-35A was fully operational. After the presentation, an Army civilian representative became concerned. The slides, he told Col. Meger, suggested that the operational dangers of divestment of the A-10 were much greater than had been previously portrayed by the Air Force. Col. Meger attempted to reassure the civilian that the mitigation plan would eliminate the risks. Following the briefing, Col. Meger met with Lt. Gen. Tod D. Wolters, the Deputy Chief of Staff for Operations for Air Force Headquarters. Notably, the Summit Slide presentation for general officers the next day stripped away any mention of A-10 divestment creating significant capability gaps. Any mention of the need to maintain legacy aircraft, including the A-10, until the F-35A reached full operating capability (FOC) was also removed from the presentation.
  • The next day, Col. Meger delivered the new, sanitized presentation to the Air Force Chief of Staff. There was only muted mention of the risks presented by divestment. There was no mention of the 10- to 12-year estimated capability gap, nor was there any mention whatsoever of the need to maintain legacy aircraft—such as the A-10 or less capable alternatives like the F-16 or F-15E—until the F-35A reached FOC. Other important areas of concern to working group members, but impossible to adequately address within the three days at Davis-Monthan, were the additional costs to convert squadrons from the A-10 to another platform, inevitable training shortfalls that would be created, and how the deployment tempos of ongoing operations would further exacerbate near-term gaps in CAS capability. To our knowledge, none of these concerns surfaced during any part of the Pentagon summit.
  • Inevitably, the Air Force generals leading the ongoing CAS Summit media blitz will point congressional Armed Services and Appropriations committees to the whitewashed results of their sham summit. When they do, Senators and Representatives who care about the lives of American troops in combat need to ask the generals the following questions: Why wasn’t this summit held before the Air Force decided to get rid of A-10s? Why doesn’t the Air Force’s joint CAS summit include any statement of needs from soldiers or Marines who have actually required close air support in combat? What is the Air Force’s contingency plan for minimizing casualties among our troops in combat in the years after 2019, if the F-35 is several years late in achieving its full CAS capabilities? When and how does the Air Force propose to test whether the F-35 can deliver close support at least as combat-effective as the A-10’s present capability? How can that test take place without A-10s? Congress cannot and should not endorse Air Force leadership’s Summit by divesting the A-10s. Instead, the Senate and House Armed Services Committees need to hold hearings that consider the real and looming problems of inadequate close support, the very problems that Air Force headquarters prevented their Summit from addressing. These hearings need to include a close analysis of CAPE’s assessment and whether the decision to classify its report was necessary and appropriate. Most importantly, those hearings must include combat-experienced receivers and providers of close support who have seen the best and worst of that support, not witnesses cherry-picked by Air Force leadership—and the witnesses invited must be free to tell it the way they saw it.
  • If Congress is persuaded by the significant CAS capability risks and gaps originally identified by the Summit’s working groups, they should write and enforce legislation to constrain the Air Force from further eroding the nation’s close air support forces. Finally, if Congress believes that officers have purposely misled them about the true nature of these risks, or attempted to constrain service members’ communications with Congress about those risks, they should hold the officers accountable and remove them from positions of leadership. Congress owes nothing less to the troops they send to fight our wars.

     Though not touched on in the article, the real problem is that the A10 has no proponents at the higher ranks of the Air Force because it is already bought and paid for; there's nothing in the A10 for the big Air Force aircraft manufacturing defense contractors. The F35, on the other hand is, is a defense contractor wet dream. It's all pie in the sky and big contracts just to get the first one in the air, let alone outfit it with the gear and programming needed to use it to inflict harm. It's been one cost-overrun after another and delay after delay. It's a national disgrace that has grown to become the most expensive military purchase in history. And it will never match the A10 for the close air support role. It's minimum airspeed is too high and its close-in maneuverability will be horrible. The generals, of course, don't want to poison the well for their post-military careers working for the defense contractors by putting a halt to the boondobble. Their answer: eliminate the close air support mission for at least 10-12 years and then attempt it with the F35.   As a former ground troop, that's grounds for the Air Force generals' court-martial and dishonorable discharge. I would not be alive today were it not for close air support. And there are tens of thousands of veterans who can say that in all truth. The A10 wasn't available back in my day, but by all reports its the best close air support weapons platform ever developed. It's a tank killer and is heavily armored, with redundant systems for pilot and aircraft survivability. The A10 is literally built around a 30 mm rotary cannon that fires at 3,900 rounds per minute. It also carries air to ground rockets and is the only close air support aircraft still in the U.S. arsenal. Fortunately, John McCain "get it" on the close air support mission and has managed to mostly protect the A10 from the generals. Pentagon 'big winner' in $1T omnibus bill | TheHill - 0 views

  • The Pentagon and the defense industry came out of the $1 trillion omnibus spending bill as a big winner, experts and lawmakers said Tuesday, a day after the bill was released. “The big winner is the Defense Department. They should be breaking out champagne in the Pentagon,” said Gordon Adams, a defense budget expert and former Clinton official.The omnibus spending bill provides about $497 billion for the Defense Department in 2014 — about the same as in 2013. But the Pentagon also received $85.2 billion in overseas contingency operations (OCO) for the war in Afghanistan, roughly $5 billion more than it requested for 2014.Before last month’s budget deal that relieved $22.4 billion in sequestration cuts, the 2014 defense budget would have been around $475 billion. The OCO funding, which Adams said is the “cherry on top of the dessert,” can be used to pay for operations and maintenance in the base budget and help restore military readiness lost in previous years. Fiscal watchdog and anti-war groups criticized the $5 billion increase from the Pentagon's request in OCO funding as a “slush fund to pad the department’s budget and avoid spending reductions,” especially with the winding down of the Afghan War. 
  • The defense industry was also a winner in the omnibus spending bill, Adams said. All major weapons systems procurement requests were fully-funded, including the F-35 Joint Strike Fighter — the Pentagon’s most expensive weapons system in history. Also fully funded were the Army’s M1 Abrams tank program, and the Navy’s shipbuilding plans for eight new ships. Israel is also a winner in the omnibus spending bill, with money fully provided for the Arrow, David’s Sling, and the Iron Dome rocket defense systems. 
  • While lawmakers touted the completed spending bill as a win for nearly everyone, there were a few losers. One of the most notable losers included the Pentagon’s research and development projects, which received $7 billion less than last year.In addition, the defense space program and the procurement for the E-2D Advanced Hawkeye program were delayed. Also, funds for the Afghan National Security Forces is about half as much as the White House requested, Adams said.

    The War Party wins again. Spending cuts will come out of non-defense branches of government. Meanwhile, the Judicial Branch is nearly flat on its back because of sequestration. Judicial spending before sequestration was only 0.19 per cent of federal spending (19 cents of each $100) but  $350 million got chopped by sequestration.  The result: things like massive delays in court proceedings and a 35 per cent cut in personnel in the Federal Defenders office, a loss of institutional knowledge that will never be recovered.

US, Afghan security deal at risk as Karzai calls for delay in signing | Fox News - 0 views

  • The tentative security deal reached between Secretary of State John Kerry and Afghan President Hamid Karzai could be at risk after Karzai told a gathering of elders that the signing should be put off until after next year's Afghan presidential election -- and signed only if it is approved by the council and the parliament. 
  • A delay in the signing would be problematic for the U.S. government, which wants an agreement as soon as possible to allow American planners to prepare for a military presence after 2014, when the majority of foreign combat forces will have left Afghanistan.  Despite the decision to defer signing the agreement until after the scheduled April 5 election, Karzai spoke in support of the deal on the first day of the meeting of the 2,500-member national consultative council of Afghan elders known as the Loya Jirga Thursday in Kabul.  At one point, Karzai acknowledged there was little trust between his government and Washington. He was quoted by Reuters as saying "My trust with America is not good. I don't trust them and they don't trust me. During the past 10 years I have fought with them and they have made propaganda against me.'' 
  • Karzai did not address one of the biggest points of contention in the proposed deal, the U.S. request for jurisdiction over its own troops. Lack of agreement over that issue helped scuttle a similar agreement with Iraq and prompted Washington to order most troops out of that country in 2011.  The Loya Jirga retains the right to revise or reject any clause of the deal. If the deal is approved by the council, whatever version of the pact that is extant must also be approved by the Afghan parliament.

    Here's hoping that the Jirga or Afghan Parliament will nix the deal as Iraq did, by refusing to grant U.S. troops and contractors immunity from Afghan criminal law. I read the leaked U.S. markup version of the deal two days ago. It would extend the U.S. Afghan War until 2024 or beyond. Kerry and Obama might be upset; both announced that Kerry had signed the deal this morning. According to Kerry, U.S. involvement will gradually wind down to about 15K troops plus who-knows-how-many contractors and subcontractors. Number of U.S. troops in Afghanistan when Obama took office: 26,607. Number of U.S. troops there as of October, 2013: roughly 51,000. Our Nobel Peace Prize Prez who jokes to his staff about how many people he kills. Ha, ha. Funny. Not.  Let's remember that as recently as June, Obama said that the U.S. could have all troops out before the present deal expires in 2014 if there's no new agreement. I can hope.
