Ex-Chief of C.I.A. Shapes Response to Detention Report - NYTimes.com - 0 views

  • Just after the Senate Intelligence Committee voted in April to declassify hundreds of pages of a withering report on the Central Intelligence Agency’s detention and interrogation program, C.I.A. Director John O. Brennan convened a meeting of the men who had played a role overseeing the program in its seven-year history.The spies, past and present, faced each other around the long wooden conference table on the seventh floor of the C.I.A.’s headquarters in Northern Virginia: J. Cofer Black, head of the agency’s counterterrorism center at the time of the Sept. 11 attacks; the undercover officer who now holds that job; and a number of other former officials from the C.I.A.’s clandestine service. Over the speakerphone came the distinctive, Queens-accented voice of George J. Tenet.

Pakistani Disapproval of US Highest Ever, Contra Brennan Fantasy That Drones Are 'Welco... - 0 views

  • During John Brennan’s Senate confirmation hearings last week, Senator Susan Collins asked him about whether the drone strikes in Pakistan are “creating a backlash” and “creating new terrorists when a neighbor or family member is killed in the course of the operations.” She cited statements to that effect from General Stanley McChrystal and former CIA Director Michael Hayden. In response, Brennan demurred, insisting that “we, in fact, have found in many areas is that the people are being held hostage to al-Qa’ida in these areas and have welcomed the work that the U.S. Government has done with their governments to rid them of the al-Qa’ida cancer that exists.” According to a new Gallup poll, more than nine out of ten Pakistanis (92%) disapprove of US leadership. Only 4% approve, “the lowest approval rating Pakistanis have ever given.”

According to The Washington Post, drone strikes are not “welcomed” by the population, as Brennan claims, but serve to radicalize the population against America. “The evidence of radicalization emerged in more than 20 interviews with tribal leaders, victims’ relatives, human rights activists and officials from four provinces in southern Yemen where U.S. strikes have targeted suspected militants,” the Post reported. “They described a strong shift in sentiment toward militants affiliated with the transnational network’s most active wing, al-Qaeda in the ­Arabian Peninsula, or AQAP.” “We have gone a long way down the road of creating a situation where we are creating more enemies than we are removing from the battlefield. We are already there with regards to Pakistan and Afghanistan,” said Robert Grenier, who headed the CIA’s counter-terrorism center and was previously a CIA station chief in Pakistan. Brennan is living in a fantasy land.

John Brennan Dodges a Question About CIA Spying on Americans - Conor Friedersdorf - The... - 0 views

  • Senator Mark Udall, a Colorado Democrat, has often used his perch on the Senate Intelligence Committee to ask national-security officials if they're misbehaving. He typically focuses on abuses that are actually happening, so his latest exchange with CIA Director John Brennan demands wider attention. Udall asked if the CIA is engaged in domestic spying or searches on American citizens. An idle question? One wouldn't think so. And the CIA director appeared to evade the question. For that reason, I suspect, but certainly cannot prove, that the intelligence agency is, in fact, engaged in this behavior. But don't take my word for it. Look at the transcript and judge for yourself:  UDALL: This committee was created to address a severe breach of trust that developed when it was revealed that the CIA was conducting unlawful domestic searches. The Church Committee went to work, found that to be true.
  • I want to be able to reassure the American people ... that the CIA and the director understand the limits of their mission and authorities. We're all aware of executive order 12333. That order prohibits the CIA from engaging in domestic spying and searches of US citizens within our borders. Can you assure the committee that the CIA does not conduct such domestic spying and searches?  BRENNAN: I can assure the committee that the CIA follows the letter and the spirit of the law in terms of what the CIA's authorities are, in terms of its responsibilities to collect intelligence that will keep this country safe. Yes, Senator, I do.  Hmm. Reframing the question. Answering indirectly. Concluding with syntax that doesn't fit. It all seems suspicious. When Udall asked, "Can you assure the committee that the CIA does not conduct such domestic spying and searches?" Brennan could've replied, "Yes." But that isn't what he said at all. Why, do you think? There could be an explanation I'm missing, but Udall doesn't typically mislead with questions. This is a subject to watch.

We believe this happened in 2010 but we have no way of knowing the specifics. Nor do we know why the documents were removed. The staff was focused on reviewing the tens of thousands of new documents that continued to arrive on a regular basis. […] Shortly [after Udall’s comments], on January 15, 2014, CIA Director Brennan requested an emergency meeting to inform me and Vice Chairman Chambliss that without prior notification or approval, CIA personnel had conducted a “search”—that was John Brennan’s word—of the committee computers at the offsite facility. This search involved not only a search of documents provided to the committee by the CIA, but also a search of the ”stand alone” and “walled-off” committee network drive containing the committee’s own internal work product and communications. According to Brennan, the computer search was conducted in response to indications that some members of the committee staff might already have had access to the Internal Panetta Review. The CIA did not ask the committee or its staff if the committee had access to the Internal Review, or how we obtained it. Instead, the CIA just went and searched the committee’s computers.
  • If what Feinstein alleges is true, it essentially amounts to a constitutional crisis. And she said as much during her speech, describing “a defining moment for the oversight of our intelligence community.” “I have grave concerns that the CIA’s search may well have violated the separation of powers principles embodied in the United States Constitution, including the Speech and Debate clause. It may have undermined the constitutional framework essential to effective congressional oversight of intelligence activities or any other government function,” Feinstein said. “Besides the constitutional implications, the CIA’s search may also have violated the Fourth Amendment, the Computer Fraud and Abuse Act, as well as Executive Order 12333, which prohibits the CIA from conducting domestic searches or surveillance.”
  • There’s also the issue of intimidation. The media reports that have been bubbling up recently around this issue have suggested that Senate investigators illegally obtained the Panetta review—some even raised the specter of hacking by the Senate investigators. The CIA went so far as to file a crime report with the Department of Justice, accusing Senate staffers of illegally obtaining the Panetta review. Tuesday morning, Feinstein strenuously denied the review was illegally obtained, and asserted it was included in the 6.2 million files turned over by the CIA and describing at length why Senate lawyers felt it was a lawful document for the committee to possess. And, in a remarkable statement, Feinstein accused the CIA of intimidation by filing the crime report. “[T]here is no legitimate reason to allege to the Justice Department that Senate staff may have committed a crime. I view the acting general counsel’s referral [to DoJ] as a potential effort to intimidate this staff—and I am not taking it lightly.” Feinstein went on to note one fairly amazing fact. The (acting) general counsel she referred to, who filed the complaint with DoJ, was a lawyer in the CIA’s counterterrorism center beginning in 2004. That means he was directly involved in legal justifications for the torture program. “And now this individual is sending a crimes report to the Department of Justice on the actions of congressional staff,” she noted gravely. “The same congressional staff who researched and drafted a report that details how CIA officers—including the acting general counsel himself—provided inaccurate information to the Department of Justice about the program.”

  • Feinstein included an interesting aside in her speech. “Let me note: because the CIA has refused to answer the questions in my January 23 letter, and the CIA inspector general review is ongoing, I have limited information about exactly what the CIA did in conducting its search.”
  • Also: remember that earlier this year, in response to a question from Senator Bernie Sanders, the National Security Agency did not expressly deny spying on Congress. The NSA may just have been being careful with its language, reasoning that since bulk data collection exists, perhaps members of Congress were caught up in it. But the question remains: if the CIA felt justified spying on Senate computers, may it have listened in on phone calls as well?
  • Feinstein’s grave concerns were echoed Tuesday morning by Senator Patrick Leahy, chair of the Senate Judiciary Committee. “This is not just about getting to the truth of the CIA’s shameful use of torture. This is also about the core founding principle of the separation of powers, and the future of this institution and its oversight role,” Leahy said in a statement. “The Senate is bigger than any one Senator. Senators come and go, but the Senate endures. The members of the Senate must stand up in defense of this institution, the Constitution, and the values upon which this nation was founded.”
  • Underlying this constitutional crisis is a desire by many at the CIA to sweep the Bush-era torture abuses under the rug. That logically would be the clear motivating factor in seizing the Panetta review from Senate investigators. And Brennan wasn’t afraid to keep pushing that approach—even during the same Tuesday interview with NBC’s Mitchell in which he denied “spying” on the Senate. Brennan also said that the CIA’s history of detention and interrogation should be “put behind us.” (It should be noted, of course, that there is strong circumstantial evidence that Brennan himself was complicit in the illegal torture program when he served in the Bush administration.) In the wake of her revelations on Tuesday, Feinstein renewed her desire to declassify the Senate report. “We’re not going to stop. I intend to move to have the findings, conclusions and the executive summary of the report sent to the president for declassification and release to the American people,” she said, and suggested the findings will shock the public. “If the Senate can declassify this report, we will be able to ensure that an un-American, brutal program of detention and interrogation will never again be considered or permitted.”
  • Obama has long said he supports declassification, and it seems it will happen soon. Tuesday, Feinstein was already moving to hold a committee vote on declassification. Committee Republicans will likely oppose it, but independent Senator Angus King, the swing vote, told reporters he is inclined to vote for declassification.

The Real Blame for Deaths in Libya    :   Information Clearing House: ICH - 0 views

  • However, in this political season, the Republicans want to gain some political advantage by stirring up doubts about President Barack Obama’s toughness on terrorism — and the Obama administration is looking for ways to blunt those rhetorical attacks by launching retaliatory strikes in Libya or elsewhere. Thus, it was small comfort to learn that Teflon-coated John Brennan, Obama’s counterterrorism adviser, had flown to Tripoli, hoping to unearth some interim Libyan government officials to consult with on the Benghazi attack. With the embassy’s help, he no doubt identified Libyan officials with some claim to purview over “terrorism.”
  • But Brennan is not about investigation. Retribution is his bag. It is likely that some Libyan interlocutor was brought forth who would give him carte blanche to retaliate against any and all those “suspected” of having had some role in the Benghazi murders. So, look for “surgical” drone strike or Abbottabad-style special forces attack — possibly before the Nov. 6 election — on whomever is labeled a “suspect.” Sound wild? It is. However, considering Brennan’s penchant for acting-first-thinking-later, plus the entrée and extraordinary influence he enjoys with President Obama, drone and/or special forces attacks are, in my opinion, more likely than not. (This is the same Brennan, after all, who compiles for Obama lists of nominees for assassination by drone.) If in Tuesday’s debate with ex-Massachusetts Gov. Mitt Romney, Obama is pressed, as expected on his supposed weakness in handling Benghazi, attacks on “terrorists,” real or “suspect,” become still more likely. Brennan and other White House functionaries might succeed in persuading the president that such attacks would be just what the doctor ordered for his wheezing poll numbers.
  • It was no surprise, then, that almost completely absent from the discussion at last Tuesday’s hearing was any attempt to figure out why a well-armed, well-organized group of terrorists wanted to inflict maximum damage on the U.S. consulate in Benghazi and kill the diplomats there. Were it not for Rep. Dennis Kucinich, D-Ohio, impressionable listeners would have been left with the idea that the attack had nothing to do with Washington’s hare-brained, bomb-heavy policies, from which al-Qaeda and similar terrorist groups are more beneficiary than victim, as in Libya. Not for the first time, Kucinich rose to the occasion at Tuesday’s hearing:

Security threats in Libya, including the unchecked extremist groups who are armed to the teeth, exist because our nation spurred on a civil war destroying the security and stability of Libya. … We bombed Libya. We destroyed their army. We obliterated their police stations … Al Qaeda expanded its presence. “Weapons are everywhere. Thousands of shoulder-to-air missiles are on the loose. It’s not surprising and it’s also not acceptable. … “We want to stop attacks on our embassies? Let’s stop trying to overthrow governments. This should not be a partisan issue. Let’s avoid the hype. Let’s look at the real situation here. Interventions do not make us safer. They do not protect our nation. They are themselves a threat to America.”
  • Congressman Kucinich went on to ask the witnesses if they knew how many shoulder-to-air missiles were on the loose in Libya. Nordstrom: “Ten to twenty thousand.”
  • In my view, counterterrorism guru Brennan shares the blame for this and other failures. But he has a strong allergy to acknowledging such responsibility. And he enjoys more Teflon protection from his perch closer to the president in the White House. The back-and-forth bickering over the tragedy in Benghazi has focused on so many trees that the forest never came into view. Not only did the hearing fall far short in establishing genuine accountability, it was bereft of vision. Without vision, the old proverb says, the people perish — and that includes American diplomats. The killings in Benghazi on Sept. 11, 2012, validate that wisdom. If the U.S. does not change the way it relates to the rest of the world, and especially to the Muslim world, more and more people will perish. If we persist on the aggressive path we are on, Americans will in no way be safer. As for our diplomats, in my view it is just a matter of time before our next embassy, consulate or residence is attacked.
  • We are told we should not speak ill of the dead. Dead consciences, though, should be fair game. In my view, the U.S. Secretary of State did herself no credit the morning after the killing of four of her employees, when she said: “I asked myself — how could this happen? How could this happen in a country we helped liberate, in a city we helped save from destruction? This question reflects just how complicated and, at times, how confounding the world can be. But we have to be clear-eyed, even in our grief.” But some things are confounding only to those suppressing their own responsibility for untold death and misery abroad. Secretary Clinton continues to preen about the U.S. role in the attack on Libya. And, of Gadhafi’s gory death, she exclaimed on camera with a joyous cackle, “We came; we saw; he died.” Can it come as a surprise to Clinton that this kind of attitude and behavior can set a tone, spawning still more violence?
  • At Tuesday’s hearing, Kucinich noted that in Libya “we intervened, absent constitutional authority.” Most of his colleagues reacted with the equivalent of a deep yawn, as though Kucinich had said something “quaint” and “obsolete.” Like most of their colleagues in the House, most Oversight Committee members continue to duck this key issue, which directly involves one of the most important powers/duties given the Congress in Article I of the Constitution. Such was their behavior last Tuesday, with most members preferring to indulge in hypocritical posturing aimed at scoring cheap political points. Palpable in that hearing room was one of the dangers our country’s Founders feared the most — that, for reasons of power, position and money, legislators might eventually be seduced into the kind of cowardice and expediency that would lead them to forfeit their power and their duty to prevent a president from making war at will. Many of those now doing their best to make political hay out of the Benghazi “scandal” are the same legislators who appealed strongly for the U.S. to bomb Libya and remove Gadhafi. This, despite it having been clear from the start that eastern Libya had become a new beachhead for al-Qaeda and other terrorists. From the start, it was highly uncertain who would fill the power vacuums in the east and in Tripoli.
  • As Congress failed to exercise its constitutional duties — to debate and vote on wars — Obama, along with his Defense Secretary Leon Panetta and Hillary Clinton, took a page out of the Bush/Cheney book and jumped into a new war. Just don’t call it war, said the White House. It’s merely a “kinetic humanitarian action.” You see, our friends in Europe covet that pure Libyan oil and Gadhafi had been a problem to the West for a long time. So, it was assumed that there would be enough anti-Gadhafi Libyans that a new “democratic” government could be created and talented diplomats, like Ambassador Christopher Stevens, could explain to “the locals” how missiles and bombs were in the long-term interest of Libyans.
  • On Libya, the Obama administration dissed Congress even more blatantly than Cheney and Bush did on Iraq, where there was at least the charade of a public debate, albeit perverted by false claims about Iraq’s WMDs and Saddam Hussein’s ties to al-Qaeda. And so Defense Secretary Panetta and Secretary of State Clinton stepped off cheerily to strike Libya with the same kind of post-war plan that Cheney, Bush, and then-Defense Secretary Donald Rumsfeld had for Iraq — none. Small wonder chaos reigns in Benghazi and other parts of the country. Can it be that privileged politicians like Clinton and Panetta and the many “one-percenters” in Congress and elsewhere really do not understand that, when the U.S. does what it did to Libya, there will be folks who don’t like it; that they will be armed; that there will be blowback; that U.S. diplomats, given an impossible task, will die?
  • Constitutionally, the craven Congress is a huge part of the problem. Only a few members of the House and Senate seem to care very much when presidents act like kings and send off troops drawn largely by a poverty draft to wars not authorized (or simply rubber-stamped) by Congress. Last Tuesday, Kucinich’s voice was alone crying in the wilderness, so to speak. (And, because of redistricting and his loss in a primary that pitted two incumbent Democrats against each other, he will not be a member of the new Congress in January.) This matters — and matters very much. At a hearing of the Senate Armed Services Committee on March 7, Sen. Jeff Sessions, R-Alabama, pursued this key issue with Panetta and Joint Chiefs Chairman Gen. Martin Dempsey. Chafing ex post facto at the unauthorized nature of the war in Libya, Sessions asked repeatedly what “legal basis” would the Obama administration rely on to do in Syria what it did in Libya. Watching that part of the testimony it seemed to me that Sessions, a conservative Southern lawyer, was not at all faking when he pronounced himself “almost breathless,” as Panetta stonewalled time after time. Panetta made it explicitly clear that the administration does not believe it needs to seek congressional approval for wars like Libya. At times he seemed to be quoting verses from the Book of Cheney.
  • Sessions: “I am really baffled … The only legal authority that’s required to deploy the U.S. military [in combat] is the Congress and the president and the law and the Constitution.” Panetta: “Let me just for the record be clear again, Senator, so there is no misunderstanding. US Intel Agencies Try to Strong-Arm Trump into War With Russia - 0 views

  • Powerful elites are using the credibility of the US Intelligence agencies to demonize Russia and prepare the country for war. This is the real meaning of the “Russia hacking” story which, as yet, has not produced any hard evidence of Russian complicity. Last week’s 25-page report, that was released by the Director of National Intelligence James Clapper, illustrates to what extent intelligence is being “fixed around the policy”.  Just as the CIA generated false information related to Weapons of Mass Destruction to soften public resistance to war with Iraq, so too, the spurious allegations in the DNI’s politically-motivated report are designed to depict Russia as a growing threat to US national security. The timing of the report has less to do with the election of Donald Trump as President than it does with critical developments in Syria where the Russian military has defeated US-proxies in Syria’s industrial hub, Aleppo, rolling back Washington’s 15-year War of Terror and derailing the imperialist plan to control vital resources and pipeline corridors across the Middle East and Central Asia. Russia has become the main obstacle to Washington achieving its strategic vision of pivoting to Asia and maintaining its dominant role into the next century. The Intelligence Community has been coerced into compromising its credibility to incite fear of Russia and to advance the geopolitical ambitions of deep state powerbrokers.
  • The “Russia hacking” flap shows how far the Intel agencies have veered from their original mandate, which is to impartially gather and analyze information that may be vital to US national security. As we have seen in the last two weeks, the leaders of these organizations feel free to offer opinions on  issues that clearly conflict with those of the new President-elect. Trump has stated repeatedly that he wants to reduce tensions and reset relations with Russia, but that policy is being sabotaged by members of the intelligence community, particularly CIA Director John Brennan who appeared just last week on PBS Newshour with Judy Woodruff. Here’s an excerpt from the interview: “We see that there are still a lot of actions that Russia is undertaking that undermine the principles of democracy in so many countries. What has happened in our recent election is not new. The Russians have engaged in trying to manipulate elections in Europe for a number of years… the Russians tried to interfere in our electoral process recently, and were actively involved in that.   • Brennan, of course, provided no evidence for his claims nor did he mention the hundreds of CIA interventions around the world. But Brennan’s accusations are less important than the fact that his appearance on a nationwide broadcast identifies him as a political advocate for policies that conflict with those of the new president. Do we really want unelected intelligence officials — whose job it is to provide the president with sensitive information related to national security– to assume a partisan role in shaping policy? And why would Brennan –whose is supposed to “serve at the pleasure of the president”– accept an invitation to offer his views on Russia when he knew they would be damaging to the new administration? Powerful people behind the scenes are obviously pushing the heads of these intelligence agencies to stick to their ‘anti-Moscow’ narrative to force Trump to abandon his plan for peaceful relations with Moscow.  Brennan isn’t calling the shots and neither are Clapper or Comey. They’re all merely agents serving the interests of establishment plutocrats whose geopolitical agenda doesn’t jibe with that of the incoming administration. If that wasn’t the case, then why would the Intelligence Community stake its reputation on such thin gruel as this Russian hacking gibberish? It doesn’t make any sense. The people who launched this campaign are either supremely arrogant or extremely desperate. Which is it?

  • What’s really going on here?  Why have the Intelligence agencies savaged their credibility just to convince people that Russia is up to no good? The Russia hacking story has more to do with recent developments in Syria than it does with delegitimizing Donald Trump. Aleppo was a real wake up call for the US foreign policy establishment which is beginning to realize that their plans for the next century have been gravely undermined by Russia’s military involvement in Syria. Aleppo represents the first time that an armed coalition of allied states (Russia, Iran, Syria, Hezbollah) have actively engaged US jihadist-proxies and soundly beat them to a pulp. The stunning triumph in Aleppo has spurred hope among the vassal states that Washington’s bloody military juggernaut can be repelled, rolled back and defeated. And if Washington’s CIA-armed, trained and funded jihadists can be repelled, then the elitist plan to project US power into Central Asia to dominate the world’s most populous and prosperous region, will probably fail. In other words, the outcome in Aleppo has cast doubts on Uncle Sam’s ability to successfully execute its pivot to Asia. That’s why the Intel agencies have been employed to shape public perceptions on Russia.  Their job is to prepare the American people for an escalation of hostilities between the two nuclear-armed superpowers. US powerbrokers are determined to intensify the conflict and reverse facts on the ground. (Recent articles by elites at the Council on Foreign Relations and the Brookings Institute reveal that they are as committed to partitioning Syria as ever.)  Washington wants to  reassert its exceptional role as the uncontested steward of global security and the lone ‘unipolar’ world power.

  • Fifty years ago, exactly one month after John Kennedy was killed, the Washington Post published an op-ed titled “Limit CIA Role to Intelligence.” The first sentence of that op-ed on Dec. 22, 1963, read, “I think it has become necessary to take another look at the purpose and operations of our Central Intelligence Agency.” It sounded like the intro to a bleat from some liberal professor or journalist. Not so. The writer was former President Harry S. Truman, who spearheaded the establishment of the CIA 66 years ago, right after World War II, to better coordinate U.S. intelligence gathering. But the spy agency had lurched off in what Truman thought were troubling directions.
  • Is this why the President feels he cannot fire his clumsily devious Director of National Intelligence James Clapper, who had to apologize to Congress for giving “clearly erroneous” testimony in March? Is this why he allows National Security Agency Director Keith Alexander and counterparts in the FBI to continue to mislead the American people, even though the intermittent snow showers from Snowden show our senior national security officials to have lied — and to have been out of control? This may be small solace to President Obama, but there is no sign that the NSA documents that Snowden’s has released include the Senate Intelligence Committee’s 6,300-page report on CIA torture. Rather, that report, at least, seems sure to be under Obama’s and Senate Intelligence Committee chair Dianne Feinstein’s tight control.

  • Truman concluded the op-ed with an admonition that was as clear as the syntax was clumsy: “I would like to see the CIA restored to its original assignment as the intelligence arm of the President, and that whatever else it can properly perform in that special field – and that its operational duties be terminated or properly used elsewhere.” The importance and prescient nature of that admonition are even clearer today, a half-century later.
  • After Kennedy was murdered in Dallas, the patrician, well-connected Dulles got himself appointed to the Warren Commission and took the lead in shaping the investigation of JFK’s assassination. Documents in the Truman Library show that Dulles also mounted a small domestic covert action of his own to neutralize any future airing of Truman’s and Souers’s warnings about covert action.
  • As the de facto head of the Warren Commission, Dulles was perfectly positioned to protect himself and his associates, were any commissioners or investigators — or journalists — tempted to question whether Dulles and the CIA played a role in killing Kennedy. And so, the question: Did Allen Dulles and other “cloak-and-dagger” CIA operatives have a hand in John Kennedy’s assassination and in then covering it up? In my view, the best dissection of the evidence pertaining to the murder appeared in James Douglass’s 2008 book, JFK and the Unspeakable. After updating and arraying the abundant evidence, and conducting still more interviews, Douglass concludes that the answer is Yes.
  • The mainstream media had an allergic reaction to Douglass’s book and gave it almost no reviews. It is, nevertheless, still selling well. And, more important, it seems a safe bet that President Barack Obama knows what it says and maybe has even read it. This may go some way toward explaining why Obama has been so deferential to the CIA, NSA, FBI and the Pentagon. Could this be at least part of the reason he felt he had to leave the Cheney/Bush-anointed torturers, kidnappers and black-prison wardens in place, instructing his first CIA chief Leon Panetta to become, in effect, the agency’s lawyer rather than leader.
  • Sadly, those concerns that Truman expressed in that op-ed — that he had inadvertently helped create a Frankenstein monster — are as valid today as they were 50 years ago, if not more so.
  • But the timorous President has a big problem. He is acutely aware that, if released, the Senate committee report would create a firestorm – almost certainly implicating Obama’s CIA Director John Brennan and many other heavy-hitters of whom he appears to be afraid. And so Obama has allowed Brennan to play bureaucratic games, delaying release of the report for more than a year, even though its conclusions are said to closely resemble earlier findings of the CIA’s own Inspector General and the Constitution Project (see below).
  • Hat tip to the New Yorker’s Jane Mayer, who took the trouble to read the play-by-play of testimony to the Senate Intelligence Committee by former CIA General Counsel (2009-2013) Stephen W. Preston, nominated (and now confirmed) to be general counsel at the Department of Defense. Under questioning by Sen. Mark Udall, D-Colorado, Preston admitted outright that, contrary to the CIA’s insistence that it did not actively impede congressional oversight of its detention and interrogation program, “briefings to the committee included inaccurate information related to aspects of the program of express interest to Members.”
  • That “inaccurate information” apparently is thoroughly documented in the Senate Intelligence Committee report which, largely because of the CIA’s imaginative foot-dragging, cost taxpayers $40 million. Udall has revealed that the report (which includes 35,000 footnotes) contains a very long section titled “C.I.A. Representations on the C.I.A. Interrogation Program and the Effectiveness of the C.I.A.’s Enhanced Interrogation Techniques to Congress.” Preston also acknowledged that the CIA inadequately informed the Justice Department on interrogation and detention.   • As Katherine Hawkins, the senior investigator for last April’s bipartisan, independent report by the Constitution Project’s Task Force on Detainee Treatment, noted in an Oct. 18, 2013 posting, the memos from acting OLC chief, Steven Bradbury, relied very heavily on now-discredited CIA claims that “enhanced interrogation” saved lives, and that the sessions were carefully monitored by medical and psychological personnel to ensure that detainees’ suffering would not rise to the level of torture. According to Hawkins, Udall complained – and Preston admitted – that, in providing the materials requested by the committee, “the CIA removed several thousand CIA documents that the agency thought could be subjected to executive privilege claims by the President, without any decision by Obama to invoke the privilege.”

The assessment amounts to an acknowledgment by U.S. spy agencies that Russian airstrikes have derailed the Obama administration’s aims of pushing Assad aside as part of a political settlement to the nearly five-year old conflict. “The Russian reinforcement has changed the calculus completely,” Lt.   • A confidential Justice Department memo concludes that the U.S. government can order the killing of American citizens if they are believed to be “senior operational leaders” of al-Qaida or “an associated force” -- even if there is no intelligence indicating they are engaged in an active plot to attack the U.S.The 16-page memo, a copy of which was obtained by NBC News, provides new details about the legal reasoning behind one of the Obama administration’s most secretive and controversial polices: its dramatically increased use of drone strikes against al-Qaida suspects, including those aimed at American citizens, such as the  September 2011 strike in Yemen that killed alleged al-Qaida operatives Anwar al-Awlaki and Samir Khan. Both were U.S. citizens who had never been indicted by the U.S. government nor charged with any crimes.

  • Although not an official legal memo, the white paper was represented by administration  officials as a policy document that closely mirrors the arguments of classified memos on targeted killings by the Justice Department’s  Office of Legal Counsel, which provides authoritative legal advice to the president and all executive branch agencies. The administration has refused to turn over to Congress or release those memos publicly -- or even publicly confirm their existence. A source with access to the white paper, which is not classified, provided a copy to NBC News.

The Senate has oversight of the CIA; the CIA has no lawful oversight of the Senate and furthermore is forbidden by law from conducting surveillance within the U.S. But the CIA spied on the Senate, then used evidence it found to file a criminal complaint with the DoJ against Senate staffers.   • The sharing of crucial intelligence about counter-terrorism between the FBI, the Department of Homeland Security and local police departments takes place through a patchwork process that amounts to “organized chaos”, according to a new report. The report, released Tuesday by the Brennan Center for Justice, a public-policy institute at New York University law school that has a track record of being skeptical of government surveillance, found inconsistent rules, inadequate oversight, apparent wastefulness and insufficient regard for civil liberties nationwide. “This poorly organized system not only wastes time and resources; it also risks masking reliable intelligence that could be crucial to an investigation,” the report says, warning that a “din of data” is overwhelming law enforcement.
  • The Brennan Center report examined 16 major police departments across the US, along with 19 affiliated “fusion centers” – controversial data-sharing pools between federal, state and local agencies – and 14 of the FBI’s joint terrorism task force partnerships with police.

  • Fusion centers have been the subject of criticism from both civil libertarians and powerful elected officials. A 2012 investigation by the bipartisan Senate permanent subcommittee on investigations of more than 80,000 fusion center documents could not find any contribution the centers had made to “disrupt[ing] an active terrorist plot”. DHS disputes the results of that investigation, as do several legislators on committees overseeing the department. Senator Tom Coburn, an Oklahoman who serves as the top Republican on the Senate government reform and homeland security committee, has emerged as a leading legislative critic of fusion centers and joint terrorism task forces, for many of the same reasons detailed in the Brennan Center report. After a government inquiry indicated many federal data-sharing efforts were duplicative, Coburn issued a statement in April calling them “a vital component of national security”, but adding, “that is not an excuse to waste taxpayer funds”.

  • But it is not the “turf wars,” nor the “abuse and waste,” which occupies the central part of Murphy’s long report, that truly matters; nor even the contradictory and self-defeating nature of U.S. objectives pursued. Rather, the report tells us quite plainly why the attempted ceasefires have failed (although this is not explicitly treated in the analysis), and it helps explain why parts of the U.S. Administration (Defense Secretary Ashton Carter and CIA Director Brenner) have declined to comply with President Obama’s will – as expressed in the diplomatic accord (the recent ceasefire) reached with the Russian Federation. The story is much worse than that hinted in Murphy’s title: it underlies the present mess which constitutes relations between the U.S. and Russia, and the collapse of the ceasefire.

    Ron Wyden comes out swinging at a Senate hearing, giving 3 examples of lies about digital surveillance told to Congress by intelligence officials and DoJ. Then he presses DNI Clapper, CIA head Brennan, and FBI head Comey to provide by dates certain written public answers to a series of questions that he had previously asked in writing but never received answers on. All three said they would provide the answers, Clapper within 30 days and the other two within 7 days.  The questions themselves are extremely important, about the government's interpretation of legal authorities to conduct warrantless searches and in the case of the CIA, whether it is subject to the Computer Fraud and Abuse Act. That Act provides for criminal penalties and civil damages for accessing a "protected computer" (essentially any computer connected to the internet, whether in the U.S. or abroad) or activating any command or installing any malware on a protected computer. Brennan was warned that the Associated Press and The Washington Post were about to publish the results of a long investigation revealing that Robert Levinson, a retired FBI agent who had gone missing while "on private business" in Iran six years ago, had actually been working for the CIA. A handful of national security reporters in D.C. had known of Levinson's CIA connection for years but agreed to sit on it, accepting the CIA's rationale that publishing the information could endanger the life of Levinson, who was ostensibly pursuing an investigation of cigarette smuggling for a private client when he went missing on Iran's Kish Island in March 2007. Levinson was thought to be in Iranian hands. On Thursday morning, the entreaties of lower ranking CIA officials to the AP and Washington Post not to publish the story were rebuffed. Other high-ranking Obama administration officials, including White House chief of staff Denis McDonough and deputy national security advisor Ben Rhodes, as well as FBI Deputy Director Mark Giuliano, made the same argument to the reporters and their editors. By the time Brennan got his warning from headquarters, however, it was too late to for him to make an appeal.
