In response to the Harvard study documenting how newspapers labeled waterboarding as "torture" for almost 100 years until the Bush administration told them not to, The New York Times issued a statement justifying this behavior on the ground that it did not want to take sides in the debate. Andrew Sullivan, Greg Sargent and Adam Serwer all pointed out that "taking a side" is precisely what the NYT did: by dutifully complying with the Bush script and ceasing to use the term (replacing it with cleansing euphemisms), it endorsed the demonstrably false proposition that waterboarding was something other than torture. Yesterday, the NYT's own Brian Stelter examined this controversy and included a justifying quote from the paper's Executive Editor, Bill Keller, that is one of the more demented and reprehensible statements I've seen from a high-level media executive in some time (h/t Jay Rosen):

"We will fight it through all available means […] To quote what they say every day on Libya, all options are on the table." That's what the chief lobbyist for the U.S. Chamber of Commerce told the New York Times after hearing the White House may issue an executive order requiring corporations that do business with the government to disclose their political spending. The Chamber's pledge to fight tooth and nail to keep the American people in the dark about conflicts of interest in government is appalling, but not surprising. If corporations and their executives are spending on politicians in an effort to "win" government contracts, the American people should know.  Urge President Obama to stand up to the U.S. Chamber and fight for disclosure. Television is advertising. It is a medium whose purpose is to sell, to promote capitalism. In 1977, Jerry Mander, a former advertising executive in San Francisco, published Four Arguments For The Elimination Of Television. In the book, Mander reveals how the television networks and advertisers use this pervasive video medium for sales. Four Arguments talks about a lot more than just advertising. Mander attacks not only the contents of the television images, but the effects television has on the human mind and body. His discussion includes: The induction of alpha waves, a hypnotizing effect that a motionless mind enters. How viewers often regard what they see on television as real even though the programs are filled with quick camera switches, rapid image movement, computer generated objects, computer generated morphing and other technical events. The placement of artificial images into our mind's eye. And the effects that large amounts of television viewing have on children and the onset of attention deficit disorder. However, at the heart of Mander's arguments, lies advertising. In the words of writer Charles Bukowski: "[America is] not a free country -- everything is bought and sold and owned."

Love it or hate it, Fox News has shaken up the media establishment and achieved financial success by airing the views of strident conservative pundits. Yet while the network has never made any bones about the political slant of opinion shows hosted by the likes of Glenn Beck, Sean Hannity or Bill O'Reilly, executives often claim that its news coverage is "fair and balanced." A memo revealed this week by the liberal watchdog group Media Matters calls that into question.

Do you believe that it is in Americans' interest to allow a small group of U.S. leaders to unilaterally murder, maim, imprison and/or torture anyone they choose anywhere in the world, without the knowledge let alone oversight of their citizens or the international community? And, despite their proven record of failure to protect America -- from Indochina to Iran to Iraq -- do you believe they should be permitted to clandestinely expand their war-making without informed public debate? If so, you are betraying the principles upon which America was founded, endangering your nation, and displaying a distinctly "unamerican" subservience to unaccountable authority. But if you oppose autocratic power, you are called to support Wikileaks and others trying to limit U.S. Executive Branch mass murder abroad and failure to protect Americans at home.

For thirty years, now, Republicans have been yammering about small government, deficits, the glories of the free market, and the incompetence and wastefulness of government. It's all been a big lie, part of a well funded and cleverly executed coup d'etat, designed to enable the ultra rich and corporations to literally take power out of the hands of government and money out of the pockets of individual citizens.

Businesses have had at least 25 to 30 years near complete certainty -- certainty that they will pay lower and lower taxes, that they' will face less and less regulation, that they can outsource to their hearts' content (which when it does produce savings, comes at a loss of control, increased business system rigidity, and loss of critical know how). They have also been certain that unions will be weak to powerless, that states and municipalities will give them huge subsidies to relocate, that boards of directors will put top executives on the up escalator for more and more compensation because director pay benefits from this cozy collusion, that the financial markets will always look to short term earnings no matter how dodgy the accounting, that the accounting firms will provide plenty of cover, that the SEC will never investigate anything more serious than insider trading (Enron being the exception that proved the rule). So this haranguing about certainty simply reveals how warped big commerce has become in the US. Top management of supposedly capitalist enterprises want a high degree of certainty in their own profits and pay. Rather than earn their returns the old fashioned way, by serving customers well, by innovating, by expanding into new markets, their 'certainty' amounts to being paid handsomely for doing things that carry no risk. But since risk and uncertainty are inherent to the human condition, what they instead have engaged in is a massive scheme of risk transfer, of increasing rewards to themselves to the long term detriment of their enterprises and ultimately society as a whole.

Reynolds, State Farm Insurance, and other corporations were joined by their "task force" co-chairs -- all Republican state legislators -- to approve "model" legislation. They jointly head task forces of what is called the "American Legislative Exchange Council" (ALEC).
