Report: Verizon Claimed Public Utility Status To Get Government Perks - Slashdot - 0 views

  • Research for the Public Utility Law Project (PULP) has been released which details 'how Verizon deliberately moves back and forth between regulatory regimes, classifying its infrastructure either like a heavily regulated telephone network or a deregulated information service depending on its needs. The chicanery has allowed Verizon to raise telephone rates, all the while missing commitments for high-speed internet deployment' (PDF). In short, Verizon pushed for the government to give it common carrier privileges under Title II in order to build out its fiber network with tax-payer money. Result: increased service rates on telephone users to subsidize Verizon's 'infrastructure investment.' When it comes to regulations on Verizon's fiber network, however, Verizon has been pushing the government to classify its services as that of information only — i.e., beyond Title II. Verizon has made about $4.4 billion in additional revenue in New York City alone, 'money that's funneled directly from a Title II service to an array of services that currently lie beyond Title II's reach.' And it's all legal. An attorney at advocacy group Public Knowledge said it best: 'To expect that you can come in and use public infrastructure and funds to build a network and then be free of any regulation is absurd....When Verizon itself is describing these activities as a Title II common carrier, how can the FCC look at broadband internet and continue acting as though it's not a telecommunication network?'"

    Let's also not forget that what is now named "Verizon" used to be named Bell Atlantic, one of the seven Baby Bells that were spun off by AT&T by government order during antitrust proceedings.  In other words, this is one of the companies rate-payers financed through a heavily-regulated analog telephony absolute monopoly. But Verizon wants to spread its wings and escape the chains of regulation as a telecommunications carrier. While having its cake and eating it to, according to this article. The FCC has poised itself through a proposed rule with the flexibility to postpone a decision on net neutrality.  AT&T famously was allowed to keep its R&D arm while being freed of the expense of upgrading the U.S. telephony network from analog to digital and from copper wire to fibre optic.  And pay for those Baby Bells to make that transition we did. I remember monthly bills for a two person office running as high as $1,100 a month for calls all carried from Baby Bell to AT&T and back to another Baby Bell. All at state-regulated rates with FCC looking the other way. But now Verizon, Comcast (the originally munipally regulated cable television monopolies) and the few other "competing" survivors of that broadband rollout, having had their infrastructure paid for by the ratepayers, want to fly off and begin charging us at the other end of the pipe,via charges to content providers that will be passed on to us. Leading to the squeezing out of Mom and Pop internet businesses by the big content providers that can afford the charges and pass them on to us. This is looking more and more like another massive rip-off of the customers who already paid for that infrasture. Is that banksters I smell, privatizing a enormous public utility in the name of free markets?

Exclusive: Google mulling Wi-Fi for cities with Google Fiber - Network World - 0 views

  • Google is considering deploying Wi-Fi networks in towns and cities covered by its Google Fiber high-speed Internet service. The disclosure is made in a document Google is circulating to 34 cities that are the next candidates to receive Google Fiber in 2015.
  • Specific details of the Wi-Fi plan are not included in the document, which was seen by IDG News Service, but Google says it will be "discussing our Wi-Fi plans and related requirements with your city as we move forward with your city during this planning process."
  • Google Fiber is already available in Provo, Utah, and Kansas City, and is promised soon in Austin, Texas. It delivers a "basic speed" service for no charge, a gigabit-per-second service for US$70 per month and a $120 package that includes a bundle of more than 200 TV channels. Installation costs between nothing and $300. Google has sent the 34 cities that are next in line for Google Fiber a detailed request for information and they have until May 1 to reply.

  • Google is also asking cities to identify locations it would be able to install utility huts. Each 12-foot-by-30-foot (3.6-meter-by-9.1-meter) windowless hut needs to allow 24-hour access and be on land Google could lease for about 20 years. The huts, of which there will be between one and a handful in each city, would house the main networking equipment. From the hut, fiber cables would run along utility poles -- or in underground fiber ducts if they exist -- and terminate at neighborhood boxes, each serving up to 288 or 587 homes. The neighborhood boxes are around the same size or smaller than current utility cabinets often found on city streets.

"A group of software developers have created a program to make Microsoft Office work with files in the OpenDocument format, a move that would bridge currently incompatible desktop applications. Gary Edwards, an engineer involved in the open-source OpenOffice.org project and founder of the OpenDocument Foundation, on Thursday discussed the software plug-in on the Web site Groklaw. The new program, which has been under development for about year and finished initial testing last week, is designed to let Microsoft Office manipulate OpenDocument format (ODF) files, Edwards said. "The ODF Plugin installs on the file menu as a natural and transparent part of the 'open,' 'save,' and 'save as' sequences. As far as end users and other application add-ons are concerned, ODF Plugin renders ODF documents as if (they) were native to MS Office," according to Edwards. If the software, which is not yet available, works as described, it will be a significant twist to an ongoing contest between Microsoft and the backers of OpenDocument, a document format gaining more interest lately, particularly among governments. Microsoft will not natively support OpenDocument in Office 2007, which will come out later this year. Company executives have said that there is not sufficient demand and OpenDocument is less functional that its own Office formats. Having a third-party product to save OpenDocument files from Office could give OpenDocument-based products a bump in the marketplace, said Stephen O'Grady, a RedMonk analyst. EU Committee Votes to Make All Smartphone Vendors Utilize a Standard Charger - HotHardware - 0 views

  • The EU has been known to make a lot of odd decisions when it comes to tech, such as forcing Microsoft's hand at including a "browser wheel" with its Windows OS, but this latest decision is one I think most people will agree with. One thing that's frustrating about different smartphones is the occasional requirement to use a different charger. More frustrating is actually losing one of these chargers, and being unable to charge your phone even though you might have 8 of another charger readily available.
  • While this decision would cut down on this happening, the focus is to cut down on waste. On Thursday, the EU's internal market and consumer protection committee voted on forcing smartphone vendors to adopt a standard charger, which common sense would imply means micro USB, given it's already featured on the majority of smartphones out there. The major exception is Apple, which deploys a Lightning connector with its latest iPhones. Apple already offers Lightning to micro USB cables, but again, those are only useful if you happen to own one, making a sudden loss of a charger all-the-more frustrating. While Lightning might offer some slight benefits, Apple implementing a micro USB connector instead would make situations like those a lot easier to deal with (I am sure a lot of us have multiple micro USB cables lying around). Even though this law was a success in the initial voting, the government group must still bring the proposal to the Council which will then lead to another vote being made in the Parliament. If it does end up passing, I have a gut feeling that Apple will modify only its European models to adhere to the law, while its worldwide models will remain with the Lightning connector. Or, Apple might be able to circumvent the law if it offers to include the micro USB cable in the box, essentially shipping the phone with that connector.

  • On Thursday, the Federal Communications Commission voted 3-2 to open for public debate new rules meant to guarantee an open Internet. Before the plan becomes final, though, the chairman of the commission, Tom Wheeler, will need to convince his colleagues and an array of powerful lobbying groups that the plan follows the principle of net neutrality, the idea that all content running through the Internet’s pipes is treated equally.While the rules are meant to prevent Internet providers from knowingly slowing data, they would allow content providers to pay for a guaranteed fast lane of service. Some opponents of the plan, those considered net neutrality purists, argue that allowing some content to be sent along a fast lane would essentially discriminate against other content.
  • “We are dedicated to protecting and preserving an open Internet,” Mr. Wheeler said immediately before the commission vote. “What we’re dealing with today is a proposal, not a final rule. We are asking for specific comment on different approaches to accomplish the same goal, an open Internet.”

    I'll need to read the proposed rule, but this doesn't sound good. the FCC majority tries to spin this as options still being open, but I don't recall ever seeing formal regulations changed substantially from their proposed form. If their were to be substantial change, another proposal and comment period would be likely. The public cannot comment on what has not been proposed, so substantial departure from the proposal, absent a new proposal and comment period, would offend basic principles of public notice and comment rulemaking under the Administrative Procedures Act. The proverbial elephant in the room that the press hasn't picked up on yet is the fight that is going on behind the scenes in the Dept. of Justice. If the Anti-trust Division gets its way, DoJ's public comments on the proposed rule could blow this show out of the water. The ISPs are regulated utility monopolies in vast areas of the U.S. with market consolidation at or near the limits of what the anti-trust folk will tolerate.     Of course Comcast, et ilk don't want Title II regulation. "Hey, just because we've divvied up the turf so that we've got geographical monopolies doesn't mean we shouldn't be able to leverage our monopolies into new monopolies." But the big cable companies got where they are by buying up community-granted and regulated monopoly utility companies. As part of consolidating those markets, the soon-to-be-gnormous cable companies, lobbied to get community regulation weakened and here we are with the FCC, with the cable companies now acting as ISPs too, which is straightforward telecommunications provider service, and these guys want to be able to charge a premium to the big internet content companies for fast-service after their ISP customers have already paid for fast service? So they can slow down the competition for their own content services.  Heck, yes, FCC. No one forced Comcast and crew to become telecommunications providers. Make 'em live with telecommunications regulation like all the other telcos. They are government-created monopolies and they should be regulated as such.

    MindTouch was by far and away the hottest property at the 2009 Web 2.0 Conference. And for good reason. They have figured out how to tap into the productivity value of enterprise collaborative networks. Most their underlying stuff is based on REST based data objects and services, but they also allow for proprietary data bindings. The key to MindTouch seemd to be the easy to fall into and use collaborative interface: imagine a workgroup project centered around a Web page filled with data objects, graphics and content, with each object also having a collabortaive conversation attached to it. Sounds complicated, but that's where the magic of MindTouch kicks in. It's simple. One the things that most impressed me was an interactive graph placed on one of the wiki project pages. The graph was being fed data from a local excel spreadsheet, and could be interacted with in real time. It was simple to change from a pie chart to a bar graph and so on. It was also possible to interact with the data itself and create what-if scenario's. Great stuff. With considerable persistence though, i was able to discover from Aaron that this interactivity and graphical richness was due to a Silverlight plug-in! From the article: "..... So the Indian Supreme Court’s August ruling that privacy is a fundamental, constitutional right for all of the country’s 1.32 billion citizens was momentous. But now, close to three months later, it’s still unclear exactly how the decision will be implemented. Will it change everything for internet users? Or will the status quo remain? The most immediate consequence of the ruling is that tech companies such as Facebook, Twitter, Google, and Alibaba will be required to rein in their collection, utilization, and sharing of Indian user data. But the changes could go well beyond technology. If implemented properly, the decision could affect national politics, business, free speech, and society. It could encourage the country to continue to make large strides toward increased corporate and governmental transparency, stronger consumer confidence, and the establishment and growth of the Indian “individual” as opposed to the Indian collective identity. But that’s a pretty big if. Advertisement The privacy debate in India was in many ways sparked by a controversy that has shaken up the landscape of national politics for several months. It began in 2016 as a debate around a social security program that requires participating citizens to obtain biometric, or Aadhaar, cards. Each card has a unique 12-digit number and records an individual’s fingerprints and irises in order to confirm his or her identity. The program was devised to increase the ease with which citizens could receive social benefits and avoid instances of fraud.     The International Telecommunication Union (ITU) will hold the World Conference on International Telecommunications (WCIT-12) in December in Dubai, an all-important treaty-writing event where ITU Member States will discuss the proposed revisions to the International Telecommunication Regulations (ITR). The ITU is a United Nations agency responsible for international telecom regulation, a bureaucratic, slow-moving, closed regulatory organization that issues treaty-level provisions for international telecommunication networks and services. The ITR, a legally binding international treaty signed by 178 countries, defines the boundaries of ITU's regulatory authority and provides "general principles" on international telecommunications. However, media reports indicate that some proposed amendments to the ITR-a negotiation that is already well underway-could potentially expand the ITU's mandate to encompass the Internet.

    The ITU Member States should urgently lift restrictions on sharing the preparatory materials and ITR amendments, and release the documents. The current preparatory process lacks the transparency, openness of process, and inclusiveness of all relevant stakeholders that is the hallmark of Internet policy-making. A truly multi-stakeholder participation model requires equal footing for each relevant stakeholders including civil society, the private sector, the technical community, and participating governments. These principles are the minimum that one could expect following commitments made at the World Summit on Information Society (WSIS). The ITU Secretary-General Dr. Hamadoun I. Touré reiterated these commitments last year at the Internet Governance Forum in Kenya: In its own words, the "ITU remains firmly committed to the WSIS process," and it considers itself to have "made considerable progress in many areas in advancing the implementation of the WSIS outcomes." And in practice? Not likely. This is why EFF, European Digital Rights, CIPPIC and CDT and a coalition of civil society organizations from around the world are demanding that the ITU Secretary General, the WCIT-12 Council Working Group, and ITU Member States open up the WCIT-12 and the Council working group negotiations, by immediately releasing all the preparatory materials and Treaty proposals. If it affects the digital rights of citizens across the globe, the public needs to know what is going on and deserves to have a say. The Council Working Group is responsible for the preparatory work towards WCIT-12, setting the agenda for and consolidating input from participating governments and Sector Members.

    We demand full and meaningful participation for civil society in its own right, and without cost, at the Council Working Group meetings and the WCIT on equal footing with all other stakeholders, including participating governments. A transparent, open process that is inclusive of civil society at every stage is crucial to creating sound policy. Respect the multi-stakeholder process Civil society has good reason to be concerned regarding an expanded ITU policy-making role. To begin with, the institution does not appear to have high regard for the distributed multi-stakeholder decision making model that has been integral to the development of an innovative, successful and open Internet. In spite of commitments at WSIS to ensure Internet policy is based on input from all relevant stakeholders, the ITU has consistently put the interests of one stakeholder-Governments-above all others. This is discouraging, as some government interests are inconsistent with an open, innovative network. Indeed, the conditions which have made the Internet the powerful tool it is today emerged in an environment where the interests of all stakeholders are given equal footing, and existing Internet policy-making institutions at least aspire, with varying success, to emulate this equal footing. This formula is enshrined in the Tunis Agenda, which was committed to at WSIS in 2005:

    83. Building an inclusive development-oriented Information Society will require unremitting multi-stakeholder effort. We thus commit ourselves to remain fully engaged-nationally, regionally and internationally-to ensure sustainable implementation and follow-up of the outcomes and commitments reached during the WSIS process and its Geneva and Tunis phases of the Summit. Taking into account the multifaceted nature of building the Information Society, effective cooperation among governments, private sector, civil society and the United Nations and other international organizations, according to their different roles and responsibilities and leveraging on their expertise, is essential. 84. Governments and other stakeholders should identify those areas where further effort and resources are required, and jointly identify, and where appropriate develop, implementation strategies, mechanisms and processes for WSIS outcomes at international, regional, national and local levels, paying particular attention to people and groups that are still marginalized in their access to, and utilization of, ICTs.

    Indeed, the ITU's current vision of Internet policy-making is less one of distributed decision-making, and more one of 'taking control.' For example, in an interview conducted last June with ITU Secretary General Hamadoun Touré, Russian Prime Minister Vladimir Putin raised the suggestion that the union might take control of the Internet: "We are thankful to you for the ideas that you have proposed for discussion," Putin told Touré in that conversation. "One of them is establishing international control over the Internet using the monitoring and supervisory capabilities of the International Telecommunication Union (ITU)." Rights to online expression are unlikely to fare much better than privacy under an ITU model. During last year's IGF in Kenya, a voluntary code of conduct was issued to further restrict free expression online. A group of nations (including China, the Russian Federation, Tajikistan and Uzbekistan) released a Resolution for the UN General Assembly titled, "International Code of Conduct for Information Security." The Code seems to be designed to preserve and protect national powers in information and communication. In it, governments pledge to curb "the dissemination of information that incites terrorism, secessionism or extremism or that undermines other countries' political, economic and social stability, as well as their spiritual and cultural environment." This overly broad provision accords any state the right to censor or block international communications, for almost any reason.
