    Luminant Generation Company LLC; Comanche Peak Nuclear Power Plant Units 3 and 4 Combined License Application; Notice of Intent To Prepare an Environmental Impact Statement and Conduct Scoping Process Luminant Generation Company LLC (Luminant) has submitted an application for two combined licenses (COLs) to build Units 3 and 4 at its Comanche Peak Nuclear Power Plant (CPNPP) site, located on approximately 7,950 acres in Somervell and Hood Counties, Texas. CPNPP is located on Squaw Creek Reservoir, approximately 5.2 miles (mi) north of Glen Rose, Texas. Luminant submitted the application for the COL to the U.S. Nuclear Regulatory Commission (NRC) by letter dated September 19, 2008, pursuant to Title 10 of the Code of Federal Regulations (10 CFR) Part 52. A notice of receipt and availability of the application for the COLs, including the Environmental Report (ER), was published in the Federal Register on November 7, 2008 (73 FR 66276).

    On October 9, 2008, the Nuclear Regulatory Commission (NRC) published for public comment a proposal to amend its generic determination of no significant environmental impact for the temporary storage of spent fuel after cessation of reactor operation codified at 10 CFR 51.23(a) (73 FR 59547) and a related update and proposed revision of its 1990 Waste Confidence Decision (73 FR 59551). The comment period for this proposed rule and for the proposed revisions of its Waste Confidence Decision was to have expired on December 8, 2008. A number of requests for extension of the comment period have been received. The NRC has decided to extend the comment period for an additional 60 days.

    SUPPLEMENTARY INFORMATION: On November 17, 2005, the U.S. Nuclear Regulatory Commission (NRC or the Commission) issued NRC Materials License No. SNM-2514 to the Pacific Gas and Electric Company (PG&E) for the Humboldt Bay Independent Spent Fuel Storage Installation (ISFSI), located in Humboldt County, California. The license authorizes PG&E to receive, possess, store, and transfer spent nuclear fuel and associated radioactive materials resulting from the operation of the Humboldt Bay Power Plant in an ISFSI at the power plant site for a term of 20 years. The NRC staff also issued an Environmental Assessment and Finding of No Significant Impact related to the issuance of the initial ISFSI license on November 16, 2005, in accordance with the National Environmental Policy Act, and in conformance with the applicable requirements of 10 CFR part 51.
